Thisbillrequiresanycharterschoolestablishedonorafter
August28,2025,toapplyforacertificateofneedwiththeState
BoardofEducation(SBE).Acertificateofneedisonlyrequired
forproposedcharterschoolsthatarenotestablishedpriorto
August28,2025,andarenotrequiredforcharterrenewalsor
transfersofsponsorship. Thebillmustnotbeconstruedtoexempt
charterschoolsfromstatelawsgoverningchartercontractsorany
otherapplicablestateorfederallaworregulation.
Thecertificateofneedapplicationmustbeawritten
certification, includingsupportingdocumentation, submittedbythe
governingboardoftheschooldistrictorthegoverningbodyofthe
cityorcountyinwhichtheproposedcharterschoolwouldbe
operated,affirmingthatcertainconditionsapplytotheschool
districtinwhichthecharterschoolwouldbeoperatedasspecified
inthebill.
TheStateBoardofEducationmustrevieweachcharterschool
certificateofneedapplicationandeitherapproveordisapprove
eachapplicationwithin120calendardaysofreceiptandprovideto
theapplicantwrittendocumentationofthereasonswhythe
applicationwasnotapprovedifthatisthedetermination.
