3 2.Thegeneralassemblyfindsanddeclaresthat:
4 (1)ThegeneralassemblyofthestateofMissouriisfirmlyresolvedtosupportand
5defendtheConstitutionoftheUnitedStatesagainsteveryaggression,whetherforeignor
6domestic,andisduty-boundtoopposeeveryinfractionofthoseprinciplesthatconstitutethe
7basisoftheunionofthestatesbecauseonlyafaithfulobservanceofthoseprinciplescan
8securetheunion'sexistenceandthepublichappiness;
9 (2)ActingthroughtheConstitutionoftheUnitedStates,thepeopleoftheseveral
10statescreatedthefederalgovernmenttobetheiragentintheexerciseofafewdefined
11powers,whilereservingforthestategovernmentsthepowertolegislateonmatters
12concerningthelives,liberties,andpropertiesofcitizensintheordinarycourseofaffairs;
13 (3)Thelimitationofthefederalgovernment'spowerisaffirmedunderAmendmentX
14oftheConstitutionoftheUnitedStates,whichdefinesthetotalscopeoffederalpowersas
15beingthosethathavebeendelegatedbythepeopleoftheseveralstatestothefederal
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 16governmentandallpowersnotdelegatedtothefederalgovernmentintheConstitutionofthe
17UnitedStatesarereservedtothestatesrespectivelyorthepeoplethemselves;
18 (4)Ifthefederalgovernmentassumespowersthatthepeopledidnotgrantitinthe
19ConstitutionoftheUnitedStates,itsactsareunauthoritative,void,andofnoforce;
20 (5)TheseveralstatesoftheUnitedStatesrespecttheproperroleofthefederal
21governmentbutrejectthepropositionthatsuchrespectrequiresunlimitedsubmission.Ifthe
22federalgovernment,createdbyacompactamongthestates,weretheexclusiveorfinaljudge
23oftheextentofthepowersgrantedtoitbythestatesthroughtheConstitutionoftheUnited
24States,thefederalgovernment'sdiscretion,andnottheConstitutionoftheUnitedStates,
25wouldnecessarilybecomethemeasureofthosepowers.Tothecontrary,asinallothercases
26ofcompactsamongpowershavingnocommonjudge,eachpartyhasanequalrighttojudge
27foritselfastowhetherinfractionsofthecompacthaveoccurred,aswellastodeterminethe
28modeandmeasureofredress.Althoughtheseveralstateshavegrantedsupremacytolaws
29andtreatiesmadeunderthepowersgrantedintheConstitutionoftheUnitedStates,such
30supremacydoesnotextendtovariousfederalstatutes,executiveorders,administrativeorders,
31courtorders,rules,regulations,orotheractionsthatcollectdataorrestrictorprohibitthe
32manufacture,ownership,oruseoffirearms,firearmaccessories,orammunitionexclusively
33withinthebordersofMissouri;suchstatutes,executiveorders,administrativeorders,court
34orders,rules,regulations,andotheractionsexceedthepowersgrantedtothefederal
35governmentexcepttotheextenttheyarenecessaryandproperforgoverningandregulating
36theUnitedStatesArmedForcesorfororganizing,arming,anddiscipliningmilitiaforces
37activelyemployedintheserviceoftheUnitedStatesArmedForces;
38 (6)ThepeopleoftheseveralstateshavegivenCongressthepower"toregulate
39commercewithforeignnations,andamongtheseveralstates",but"regulatingcommerce"
40doesnotincludethepowertolimitcitizens'righttokeepandbeararmsindefenseoftheir
41families,neighbors,persons,orpropertynortodictatewhatsortsofarmsandaccessories
42law-abidingMissouriansmaybuy,sell,exchange,orotherwisepossesswithinthebordersof
43thisstate;
44 (7)ThepeopleoftheseveralstateshavealsograntedCongressthepowers"tolayand
45collecttaxes,duties,imports,andexcises,topaythedebts,andprovideforthecommon
46defenseandgeneralwelfareoftheUnitedStates"and"tomakealllawswhichshallbe
47necessaryandproperforcarryingintoexecutionthepowersvestedbytheConstitutionofthe
48UnitedStatesinthegovernmentoftheUnitedStates,orinanydepartmentorofficethereof".
49Theseconstitutionalprovisionsmerelyidentifythemeansbywhichthefederalgovernment
50mayexecuteitslimitedpowersandshallnotbeconstruedtograntunlimitedpowerbecauseto
51dosowouldbetodestroythecarefullyconstructedequilibriumbetweenthefederalandstate
52governments.Consequently,thegeneralassemblyrejectsanyclaimthatthetaxingand

54keepandbeararms;
55 (8)Thegeneralassemblyfindsthatthefederalexcisetaxrateonarmsand
56ammunitionineffectpriortoJanuary1,2021,whichfundsprogramsundertheWildlife
57RestorationAct,doesnothaveachillingeffectonthepurchaseorownershipofsucharms
58andammunition;
59 (9)ThepeopleofMissourihavevestedthegeneralassemblywiththeauthorityto
60regulatethemanufacture,possession,exchange,anduseoffirearmswithinthebordersofthis
61state,subjectonlytothelimitsimposedbyAmendmentIIoftheConstitutionoftheUnited
62StatesandtheConstitutionofMissouri;and
63 (10)ThegeneralassemblyofthestateofMissouristronglypromotesresponsiblegun
64ownership,includingparentalsupervisionofminorsintheproperuse,storage,andownership
65ofallfirearms;thepromptreportingofstolenfirearms;andtheproperenforcementofallstate
66gunlaws.ThegeneralassemblyofthestateofMissouriherebycondemnsanyunlawful
67transferoffirearmsandtheuseofanyfirearminanycriminalorunlawfulactivity.]Sections
681.410to1.485shallbeknownandmaybecitedasthe"SecondAmendment

8whethertheywereenactedbeforeoraftertheprovisionsofsections1.410to1.485,that
9infringeonthepeople'srighttokeepandbeararmsasguaranteedbytheSecond
10AmendmenttotheConstitutionoftheUnitedStatesandArticleI,Section23ofthe
11ConstitutionofMissourishallbeinvalidtothisstate,shallnotberecognizedbythis
12state,shallbespecificallyrejectedbythisstate,andshallnotbeenforcedbythisstate.
1.440.[Itshallbethedutyofthecourtsandlawenforcementagenciesofthisstateto
2protecttherightsoflaw-abidingcitizenstokeepandbeararmswithinthebordersofthisstate
3andtoprotecttheserightsfromtheinfringementsdefinedundersection1.420.] Itshallbe
4thedutyofthecourtsandlawenforcementagenciesofthisstatetoprotecttherightsof
5law-abidingcitizenstokeepandbeararmswithinthebordersofthisstateandto

1.450.[Noentityorperson,includinganypublicofficeroremployeeofthisstateor
2anypoliticalsubdivisionofthisstate,shallhavetheauthoritytoenforceorattempttoenforce
3anyfederalacts,laws,executiveorders,administrativeorders,rules,regulations,statutes,or
4ordinancesinfringingontherighttokeepandbeararmsasdescribedundersection1.420.
5Nothinginsections1.410to1.480shallbeconstruedtoprohibitMissouriofficialsfrom
6acceptingaidfromfederalofficialsinanefforttoenforceMissourilaws.] Noentityor
7person,includinganypublicofficeroremployeeofthisstateoranypoliticalsubdivision
8ofthisstate,shallhavetheauthoritytoenforceorattempttoenforceanyfederalacts,

1.460.[1.Anypoliticalsubdivisionorlawenforcementagencythatemploysalaw
2enforcementofficerwhoactsknowingly,asdefinedundersection562.016,toviolatethe
3provisionsofsection1.450orotherwiseknowinglydeprivesacitizenofMissouriofthe
4rightsorprivilegesensuredbyAmendmentIIoftheConstitutionoftheUnitedStatesor
5ArticleI,Section23oftheConstitutionofMissouriwhileactingunderthecolorofanystate
6orfederallawshallbeliabletotheinjuredpartyinanactionatlaw,suitinequity,orother
7properproceedingforredress,andsubjecttoacivilpenaltyoffiftythousanddollarsper
8occurrence.Anypersoninjuredunderthissectionshallhavestandingtopursueanactionfor
9injunctivereliefinthecircuitcourtofthecountyinwhichtheactionallegedlyoccurredorin
10thecircuitcourtofColeCountywithrespecttotheactionsofsuchindividual.Thecourtshall
11holdahearingonthemotionfortemporaryrestrainingorderandpreliminaryinjunction
12withinthirtydaysofserviceofthepetition.

8transportation;clothing;orotherphysicalassets.Materialaidandsupportshallnotinclude
9givingorallowingtheuseofmedicineorothermaterialsnecessarytotreatphysicalinjuries,
10norshallthetermincludeanyassistanceprovidedtohelppersonsescapeaserious,present
11riskoflife-threateninginjury.
12 3.Itshallnotbeconsideredaviolationofsections1.410to1.480toprovidematerial
13aidtofederalofficialswhoareinpursuitofasuspectwhenthereisademonstrablecriminal
14nexuswithanotherstateorcountryandsuchsuspectiseithernotacitizenofthisstateoris
15notpresentinthisstate.
16 4.Itshallnotbeconsideredaviolationofsections1.410to1.480toprovidematerial
17aidtofederalprosecutionfor:
18 (1)Felonycrimesagainstapersonwhensuchprosecutionincludesweapons
19violationssubstantiallysimilartothosefoundinchapter570or571solongassuchweapons
20violationsaremerelyancillarytosuchprosecution;or
21 (2)ClassAorclassBfelonyviolationssubstantiallysimilartothosefoundinchapter
22579whensuchprosecutionincludesweaponsviolationssubstantiallysimilartothosefound
23inchapter570or571solongassuchweaponsviolationsaremerelyancillarytosuch
24prosecution.
25 5.Theprovisionsofsections1.410to1.485shallbeapplicabletooffensesoccurring
26onorafterAugust28,2021.] 1.Forsections1.410to1.485,theterm"law-abiding

28possessingafirearmandshallnotbeconstruedtoincludeanyonewhoisnotlegally
29presentintheUnitedStatesorthestateofMissouri.
30 2.Forthepurposesofsections1.410to1.480,"materialaidandsupport"shall
31includevoluntarilygivingorallowingotherstomakeuseoflodging;communications
32equipmentorservices,includingsocialmediaaccounts;facilities;weapons;personnel;

50 5.Theprovisionsofsections1.410to1.485shallbeapplicabletooffenses

1.485.[Ifanyprovisionofsections1.410to1.485ortheapplicationthereoftoany
2personorcircumstanceisheldinvalid,suchdeterminationshallnotaffecttheprovisionsor
