Thisbillrepealssectionsoflawknowasthe"SecondAmendment
PreservationAct"whichweredeclaredunconstitutional inUnited
Statesv.Missouri.
Thebillreestablishesthe"SecondAmendmentPreservationAct"as
follows.
Thisbilldeclaresasinvalidallfederallawsthatinfringeonthe
righttobeararmsundertheSecondAmendmenttotheU.S.
ConstitutionandArticleI,Section23oftheMissouri
Constitution. Somelawsdeclaredinvalidunderthisbillinclude
certaintaxes,certainregistrationandtrackinglaws,certain
prohibitionsonthepossession,ownership,use,ortransferofa
specifictypeoffirearm,andconfiscationordersasprovidedin
thebill.
Thebilldeclaresthatitisthedutyofthecourtsandlaw
enforcementagenciestoprotecttherightsoflaw-abidingcitizens
tokeepandbeararms.
Underthisbill,nopublicofficerorstateorlocalemployeehas
theauthoritytoenforcefirearmslawsdeclaredinvalidbytheact.
However,stateemployeesmayacceptaidfromfederalofficialsin
anefforttoenforceMissourilaws.Sovereignimmunityshallnot
beanaffirmativedefenseunderthebill.
Anypublicofficerorstateorlocalemployeewhotriestoenforce
thefirearmslawdeclaredinvalidbythebilloranypersonwho
actsunderthecoloroflawtodepriveaMissouricitizenofrights
orprivilegesensuredbythefederalandstateconstitutionswill
besubjecttoacivilpenaltyof$50,000peremployeehiredbythe
lawenforcementagency.Insuchanactionattorney'sfeesand
costsmaybeawarded.
Additionally,apersonhasstandingtopursueanactionfor
injunctivereliefinthecircuitcourtofthecountyinwhichthe
actionallegedlyoccurredorinthecircuitcourtofColeCounty.
Thecourtmustholdahearingonthemotionforatemporary
restrainingorderandpreliminaryinjunctionwithin30daysof
serviceofthepetition.
Itisnotaviolationofthisbilltoprovideaidtofederal
officialswhoareinpursuitofasuspectwhenthereisa
demonstrablecriminalnexuswithanotherstateorcountyandthe
suspectisnotacitizenofthisstateorisnotpresentinthis state.Itisnotaviolationofthebilltoaidafederal
prosecutionforfelonycrimesinvolvingaweaponsviolationagainst
apersonorforfelonycrimesinvolvingaweaponsviolationanda
controlledsubstanceviolationiftheviolationisaclassAorB
felony.
Theprovisionsofthisbilliseapplicabletooffensesoccurringon
orafterAugust28,2025.
Thisactcontainsaseverabilityclause.
