6.Anyonewhofailstocomplywiththerequirementsofthissectionshallbeguiltyof 70aclassBmisdemeanor. 71 7.Anapplicantforregistrationmaymakeadonationofonedollartopromotea 72blindnesseducation,screeningandtreatmentprogram.Thedirectorofrevenueshallcollect 73thedonationsanddepositallsuchdonationsinthestatetreasurytothecreditoftheblindness 74education,screeningandtreatmentprogramfundestablishedinsection209.015.Moneysin 75theblindnesseducation,screeningandtreatmentprogramfundshallbeusedsolelyforthe 76purposesestablishedinsection209.015;exceptthatthedepartmentofrevenueshallretainno 77morethanonepercentforitsadministrativecosts.Thedonationprescribedinthissubsection 78isvoluntaryandmayberefusedbytheapplicantforregistrationatthetimeofissuanceor 79renewal.Thedirectorshallinquireofeachapplicantatthetimetheapplicantpresentsthe 80completedapplicationtothedirectorwhethertheapplicantisinterestedinmakingtheone 81dollardonationprescribedinthissubsection. 82 8.Anapplicantforregistrationmaymakeadonationofanamountnotlessthanone 83dollartopromoteanorgandonorprogram.Thedirectorofrevenueshallcollectthedonations 84anddepositallsuchdonationsinthestatetreasurytothecreditoftheorgandonorprogram HB1069 3 85fundasestablishedinsections194.297to194.304.Moneysintheorgandonorfundshallbe 86usedsolelyforthepurposesestablishedinsections194.297to194.304,exceptthatthe 87departmentofrevenueshallretainnomorethanonepercentforitsadministrativecosts.The 88donationprescribedinthissubsectionisvoluntaryandmayberefusedbytheapplicantfor 89registrationatthetimeofissuanceorrenewal.Thedirectorshallinquireofeachapplicantat 90thetimetheapplicantpresentsthecompletedapplicationtothedirectorwhethertheapplicant 91isinterestedinmakingacontributionnotlessthanonedollarasprescribedinthissubsection. 92 9.AnapplicantforregistrationmaymakeadonationofonedollartotheMissouri 93medalofhonorrecipientsfund.Thedirectorofrevenueshallcollectthedonationsand 94depositallsuchdonationsinthestatetreasurytothecreditoftheMissourimedalofhonor 95recipientsfundasestablishedinsection226.925.Moneysinthemedalofhonorrecipients 96fundshallbeusedsolelyforthepurposesestablishedinsection226.925,exceptthatthe 97departmentofrevenueshallretainnomorethanonepercentforitsadministrativecosts.The 98donationprescribedinthissubsectionisvoluntaryandmayberefusedbytheapplicantfor 99registrationatthetimeofissuanceorrenewal.Thedirectorshallinquireofeachapplicantat 100thetimetheapplicantpresentsthecompletedapplicationtothedirectorwhethertheapplicant 101isinterestedinmakingtheonedollardonationprescribedinthissubsection. 301.032.1.Notwithstandingtheprovisionsofsections301.030and301.035tothe 2contrary,thedirectorofrevenueshallestablishasystemofregistrationofallfleetvehicles 3ownedorpurchasedbyafleetownerregisteredpursuanttothissection.Thedirectorof 4revenueshallprescribetheformsforsuchfleetregistrationandtheformsandproceduresfor 5theregistrationupdatesprescribedinthissection.Anyowneroftenormoremotorvehicles 6whichmustberegisteredinaccordancewiththischaptermayregisterasafleetowner.All 7registeredfleetownersmay,attheiroption,registerallmotorvehiclesincludedinthefleeton 8acalendaryearorbiennialbasispursuanttothissectioninlieuoftheregistrationperiods 9providedinsections301.030,301.035,and301.147.Thedirectorshallissueanidentification 10numbertoeachregisteredowneroffleetvehicles. 11 2.Allfleetvehiclesincludedinthefleetofaregisteredfleetownershallberegistered 12duringAprilofthecorrespondingyearoronaproratedbasisasprovidedinsubsection3of 13thissection.Feesofallvehiclesinthefleettoberegisteredonacalendaryearbasisorona 14biennialbasisshallbepayablenotlaterthanthelastdayofAprilofthecorrespondingyear, 15withtwoyears'feesdueforbiennially-registeredvehicles.[Notwithstandingtheprovisions 16ofsection307.355,anapplicationforregistrationofafleetvehiclemustbeaccompaniedbya 17certificateofinspectionandapprovalissuednomorethanonehundredtwentydayspriorto 18thedateofapplication.] Thefeesforvehiclesaddedtothefleetwhichmustbelicensedatthe 19timeofregistrationshallbepayableatthetimeofregistration,exceptthatwhensuchvehicle 20islicensedbetweenJulyfirstandSeptemberthirtieththefeeshallbethree-fourthstheannual HB1069 4 21fee,whenlicensedbetweenOctoberfirstandDecemberthirty-firstthefeeshallbeone-half 22theannualfeeandwhenlicensedonorafterJanuaryfirstthefeeshallbeone-fourththe 23annualfee.Whenbiennialregistrationissoughtforvehiclesaddedtoafleet,anadditional 24year'sannualfeewillbeaddedtothepartialyear'sproratedfee. 25 3.Atanytimeduringthecalendaryearinwhichanownerofafleetpurchasesor 26otherwiseacquiresavehiclewhichistobeaddedtothefleetortransfersplatestoafleet 27vehicle,theownershallpresenttothedirectorofrevenuetheidentificationnumberasafleet 28numberandmayregisterthevehicleforthepartialyearasprovidedinsubsection2ofthis 29section.Thefleetownershallalsobechargedatransferfeeoftwodollarsforeachvehicleso 30transferredpursuanttothissubsection. 31 4.Exceptasspecificallyprovidedinthissubsection,allfleetvehiclesregistered 32pursuanttothissectionshallbeissuedaspeciallicenseplatewhichshallhavethewords 33"FleetVehicle"inplaceofthewords"Show-MeState"inthemannerprescribedbythe 34advisorycommitteeestablishedinsection301.129.Alternatively,foraone-timeadditional 35fivedollarper-vehiclefeebeyondtheregularregistrationfee,afleetownerofatleastfifty 36fleetvehiclesmayapplyforfleetlicenseplatesbearingacompanynameorlogo,thesizeand 37designthereofsubjecttoapprovalbythedirector.Allfleetlicenseplatesshallbemadewith 38fullyreflectivematerialwithacommoncolorschemeanddesign,shallbeclearlyvisibleat 39night,andshallbeaestheticallyattractive,asprescribedbysection301.130.Fleetvehicles 40shallbeissuedmultiyearlicenseplatesasprovidedinthissectionwhichshallnotrequire 41issuanceofarenewaltab.Uponpaymentofappropriateregistrationfees,thedirectorof 42revenueshallissuearegistrationcertificateorothersuitableevidenceofpaymentofthe 43annualorbiennialfee,andsuchevidenceofpaymentshallbecarriedatalltimesinthe 44vehicleforwhichitisissued. 45 5.[Notwithstandingtheprovisionsofsections307.350to307.390tothecontrary,a 46fleetvehicleregisteredinMissouriisexemptfromtherequirementsofsections307.350to 47307.390ifatthetimeoftheannualfleetregistration,suchfleetvehicleissituatedoutsidethe 48stateofMissouri. 49 6.](1)Notwithstandinganyotherprovisionsoflawtothecontrary,anyperson, 50company,orcorporationengagedinthebusinessofrentingorleasingthreethousandfive 51hundredormoremotorvehicleswhicharetobeusedexclusivelyforrentalorleasing 52purposesandnotforresalethathasappliedtothedirectorofrevenueforauthoritytooperate 53asaleaseorrentalcompanyasprescribedinsection144.070mayoperateasaregisteredfleet 54ownerasprescribedintheprovisionsofthissubsectiontosubsection[10]9ofthissection. 55 (2)Thedirectorofrevenuemayissuelicenseplatesafterpresentmentofan 56application,asdesignedbythedirector,andpaymentofanannualfeeofthreehundredsixty 57dollarsforthefirsttenplatesandthirty-sixdollarsforeachadditionalplate.Thepaymentand HB1069 5 58issuanceofsuchplatesshallbeinlieuofregisteringeachmotorvehiclewiththedirectoras 59otherwiseprovidedbylaw. 60 (3)Theregistrationfeesforvehiclesintheregisteredfleetowner'sfleetshallbefully 61payableatthetimesuchplatesareordered,exceptthatwhensuchplateisorderedafterthe 62firstmonthofregistration,thefeespayableshallbeproratedbythemonththeplateswere 63ordered.Whenbiennialregistrationissought,anadditionalyear'sannualfeeshallbeadded 64tothepartialyear'sproratedfee. 65 (4)Suchmotorvehicleswithinthefleetshallnotbeexemptedfromthe[safety 66inspectionand]emissionsinspectionprovisionsasprescribedin[chapters307and]chapter 67643,but[notwithstandingtheprovisionsofsection307.355,] suchinspectionsshallnotbe 68requiredtobepresentedtothedirectorofrevenue. 69 [7.]6.Arecipientofaleaseorrentalcompanylicenseissuedbythedirectorof 70revenueasprescribedinsection144.070operatingasaregisteredfleetownerunderthis 71sectionshallregistersuchfleetwiththedirectorofrevenueonanannualorbiennialbasisin 72lieuoftheindividualmotorvehicleregistrationperiodsasprescribedinsections301.030, 73301.035,and301.147.Ifanapplicantelectsabiennialfleetregistration,theannualfleet 86subsections[6to10]5to9ofthissectionshallmakeavailable,uponrequest,tothedirector 87ofrevenueandallMissourilawenforcementagenciesanycorrespondingvehicleand 88registrationinformationthatmayberequestedasprescribedbyrule. 89 [11.]10.Thedirectorshallmakeallnecessaryrulesandregulationsforthe 90administrationofthissectionandshalldesignallnecessaryformsrequiredbythissection. 91Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatiscreatedunder 92theauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplieswithandis 93subjecttoalltheprovisionsofchapter536and,ifapplicable,section536.028.Thissection 94andchapter536arenonseverableandifanyofthepowersvestedwiththegeneralassembly HB1069 6 95underchapter536toreview,todelaytheeffectivedate,ortodisapproveandannularuleare 3provisionsshallannuallyfurnish[proofofvehicleinspectionand]proofofdisabilitytothe 4director,exceptthatanapplicantwhoseserviceconnecteddisabilityqualifyinghimfor 5speciallicenseplatesconsistsinwholeorinpartoflossofaneyeoralimboranapplicant 6withaonehundredpercentpermanentdisability,asestablishedbyaphysician'ssigned 7statementtothateffect,needonlyfurnishproofofdisabilitytothedirectorwheninitially 8applyingforthespeciallicenseplatesandnotthereafter,butinsuchcaseproofthatthe 3beenalteredfromthemanufacturer'soriginaldesignorhasabodyconstructedfrom 4nonoriginalmaterials. 5 2.Themodelyearandtheyearofmanufacturethatarelistedonthecertificateoftitle 6ofastreetrodvehicleshallbethemodelyearandyearofmanufacturethatthebodyofsuch 7vehicleresembles.Thecurrentandallsubsequentcertificatesofownershipshallbe 8designatedwiththeword"REPLICA". 9 3.Foreachstreetrod,thereshallbeanannualfeeequaltothefeechargedfor 10personalizedlicenseplatesinsection301.144inadditiontotheregularannualregistration 11fees. 12 4.Inapplyingforregistrationofastreetrodpursuanttothissection,theownerofthe 13streetrodshallsubmitwiththeapplicationacertificationthatthevehicleforwhichthe 14applicationismade: 15 (1)Willbemaintainedforoccasionaltransportation,exhibitions,clubactivities, 16parades,tours,andsimilaruses; 17 (2)Willnotbeusedforgeneraldailytransportation. 18 5.[Inadditiontothecertificationrequiredpursuanttosubsection4ofthissection, 19whenapplyingforregistrationofastreetrod,thenewownerofthestreetrodshallprovide 301.147.1.Notwithstandingtheprovisionsofsection301.020tothecontrary, 2beginningJuly1,2000,thedirectorofrevenuemayprovideownersofmotorvehicles,other 3thancommercialmotorvehicleslicensedinexcessoffifty-fourthousandpoundsgross 4weight,theoptionofbienniallyregisteringmotorvehicles.Anyvehiclemanufacturedasan 5even-numberedmodelyearvehicleshallberenewedeacheven-numberedcalendaryearand 6anysuchvehiclemanufacturedasanodd-numberedmodelyearvehicleshallberenewedeach 7odd-numberedcalendaryear,subjecttothefollowingrequirements: HB1069 9 8 (1)Thefeecollectedatthetimeofbiennialregistrationshallincludetheannual 9registrationfeeplusaprorataamountfortheadditionaltwelvemonthsofthebiennial 10registration; 11 (2)Presentationofalldocumentationotherwiserequiredbylawforvehicle 29poundsgrossweight.Oncetheownerofamotorvehiclechoosestheoptionofbiennial 30registration,suchregistrationmustbemaintainedforthefulltwenty-fourmonthperiod. 301.190.1.Nocertificateofregistrationofanymotorvehicleortrailer,ornumber 2platetherefor,shallbeissuedbythedirectorofrevenueunlesstheapplicantthereforshall 3makeapplicationforandbegrantedacertificateofownershipofsuchmotorvehicleortrailer, 4orshallpresentsatisfactoryevidencethatsuchcertificatehasbeenpreviouslyissuedtothe 5applicantforsuchmotorvehicleortrailer.Applicationshallbemadewithinthirtydaysafter 6theapplicantacquiresthemotorvehicleortrailer,unlessthemotorvehiclewasacquired 7undersection301.213orsubsection5ofsection301.210inwhichcasetheapplicantshall 8makeapplicationwithinthirtydaysafterreceivingtitlefromthedealer,uponablankform 9furnishedbythedirectorofrevenueandshallcontaintheapplicant'sidentificationnumber,a 10fulldescriptionofthemotorvehicleortrailer,thevehicleidentificationnumber,andthe 11mileageregisteredontheodometeratthetimeoftransferofownership,asrequiredbysection 12407.536,togetherwithastatementoftheapplicant'ssourceoftitleandofanyliensor 13encumbrancesonthemotorvehicleortrailer,providedthatforgoodcauseshownthedirector 14ofrevenuemayextendtheperiodoftimeformakingsuchapplication.Whenanownerwants HB1069 10 15toaddordeleteanameornamesonanapplicationforcertificateofownershipofamotor 16vehicleortrailerthatwouldcauseittobeinconsistentwiththenameornameslistedonthe 17noticeoflien,theownershallprovidethedirectorwithdocumentationevidencingthe 18lienholder'sauthorizationtoaddordeleteanameornamesonanapplicationforcertificateof 19ownership. 20 2.Thedirectorofrevenueshallusereasonablediligenceinascertainingwhetherthe 21factsstatedinsuchapplicationaretrueandshall,totheextentpossiblewithoutsubstantially 22delayingprocessingoftheapplication,reviewanyodometerinformationpertainingtosuch 23motorvehiclethatisaccessibletothedirectorofrevenue.Ifsatisfiedthattheapplicantisthe 30certificatepursuanttosection407.536,astatementofanyliensorencumbranceswhichthe 31applicationmayshowtobethereon,and,ifownershipofthevehiclehasbeentransferred,the 32nameofthestateissuingthetransferor'stitleandwhetherthetransferor'sodometermileage 33statementexecutedpursuanttosection407.536indicatedthatthetruemileageismaterially 34differentfromthenumberofmilesshownontheodometer,orisunknown. 35 3.Thedirectorofrevenueshallappropriatelydesignateonthecurrentandall 36subsequentissuesofthecertificatethewords"ReconstructedMotorVehicle","MotorChange 37Vehicle","SpeciallyConstructedMotorVehicle",or"Non-USA-StdMotorVehicle",as 44andthedateofpurchaseorissuanceoftheimmediatelypriorcertificate;or 45 (2)Anyothermileageinformationprovidedtothedirectorofrevenue,andthedate 46thedirectorobtainedorrecordedthatinformation. 47 4.Thecertificateofownershipissuedbythedirectorofrevenueshallbe 48manufacturedinamannertoprohibitasnearlyaspossibletheabilitytoalter,counterfeit, 49duplicate,orforgesuchcertificatewithoutreadydetection.Inordertocarryoutthe 50requirementsofthissubsection,thedirectorofrevenuemaycontractwithanonprofit 51scientificoreducationalinstitutionspecializingintheanalysisofsecuredocumentsto HB1069 11 52determinethemosteffectivemethodsofrenderingMissouricertificatesofownership 53nonalterableornoncounterfeitable. 54 5.Thefeeforeachoriginalcertificatesoissuedshallbeeightdollarsandfiftycents, 55inadditiontothefeeforregistrationofsuchmotorvehicleortrailer.Ifapplicationforthe 56certificateisnotmadewithinthirtydaysafterthevehicleisacquiredbytheapplicant,or 57wherethemotorvehiclewasacquiredundersection301.213orsubsection5ofsection 58301.210andtheapplicantfailstomakeapplicationwithinthirtydaysafterreceivingtitle 59fromthedealer,adelinquencypenaltyfeeoftwenty-fivedollarsforthefirstthirtydaysof 60delinquencyandtwenty-fivedollarsforeachthirtydaysofdelinquencythereafter,notto 61exceedatotaloftwohundreddollars,butsuchpenaltymaybewaivedbythedirectorfora 62goodcauseshown.Ifthedirectorofrevenuelearnsthatanypersonhasfailedtoobtaina 63certificatewithinthirtydaysafteracquiringamotorvehicleortrailer,orwherethemotor 64vehiclewasacquiredundersection301.213orsubsection5ofsection301.210andthe 65applicantfailstomakeapplicationwithinthirtydaysafterreceivingtitlefromthedealer,or 66hassoldavehiclewithoutobtainingacertificate,heshallcanceltheregistrationofall 67vehiclesregisteredinthenameoftheperson,eitherassoleownerorasaco-owner,andshall 68notifythepersonthatthecancellationwillremaininforceuntilthepersonpaysthe 69delinquencypenaltyfeeprovidedinthissection,togetherwithallfees,chargesandpayments 70whichthepersonshouldhavepaidinconnectionwiththecertificateofownershipand 71registrationofthevehicle.Thecertificateshallbegoodforthelifeofthemotorvehicleor 72trailersolongasthesameisownedorheldbytheoriginalholderofthecertificateandshall 73nothavetoberenewedannually. 74 6.Anyapplicantforacertificateofownershiprequestingthedepartmentofrevenue 75toprocessanapplicationforacertificateofownershipinanexpeditiousmannerrequiring 76specialhandlingshallpayafeeoffivedollarsinadditiontotheregularcertificateof 77ownershipfee. 78 7.Itisunlawfulforanypersontooperateinthisstateamotorvehicleortrailer 79requiredtoberegisteredundertheprovisionsofthelawunlessacertificateofownershiphas 80beenappliedforasprovidedinthissection. 81 8.BeforeanoriginalMissouricertificateofownershipisissued,aninspectionofthe 82vehicleandaverificationofvehicleidentificationnumbersshallbemadebytheMissouri 83statehighwaypatrolonvehiclesforwhichthereisacurrenttitleissuedbyanotherstateifa 84Missourisalvagecertificateoftitlehasbeenissuedforthesamevehiclebutnoprior 85inspectionandverificationhasbeenmadeinthisstate,exceptthatifsuchvehiclehasbeen 86inspectedinanotherstatebyalawenforcementofficerinamannercomparabletothe 87inspectionprocessinthisstateandthevehicleidentificationnumbershavebeensoverified, 88theapplicantshallnotbeliableforthetwenty-fivedollarinspectionfeeifsuchapplicant HB1069 12 89submitsproofofinspectionandvehicleidentificationnumberverificationtothedirectorof 90revenueatthetimeoftheapplication.Theapplicant,whohassuchatitleforavehicleon 91whichnopriorinspectionandverificationhavebeenmade,shallpayafeeoftwenty-five 92dollarsforsuchverificationandinspection,payabletothedirectorofrevenueatthetimeof 93therequestfortheapplication,whichshallbedepositedinthestatetreasurytothecreditof 94thestatehighwaysandtransportationdepartmentfund. 95 9.EachapplicationforanoriginalMissouricertificateofownershipforavehicle 96whichisclassifiedasareconstructedmotorvehicle,speciallyconstructedmotorvehicle,kit 97vehicle,motorchangevehicle,non-USA-stdmotorvehicle,orothervehicleasrequiredby 98thedirectorofrevenueshallbeaccompaniedbyavehicleexaminationcertificateissuedby 99theMissouristatehighwaypatrol,orotherlawenforcementagencyasauthorizedbythe 100directorofrevenue.Thevehicleexaminationshallincludeaverificationofvehicle 101identificationnumbersandadeterminationoftheclassificationofthevehicle.Theownerof 102avehiclewhichrequiresavehicleexaminationcertificateshallpresentthevehiclefor 103examinationandobtainacompletedvehicleexaminationcertificatepriortosubmittingan 104applicationforacertificateofownershiptothedirectorofrevenue.Notwithstandingany 105provisionofthelawtothecontrary,anownerpresentingamotorvehiclewhichhasbeen 106issuedasalvagetitleandwhichistenyearsofageoroldertoavehicleexaminationdescribed 107inthissubsectioninordertoobtainacertificateofownershipwiththedesignationprior 108salvagemotorvehicleshallnotberequiredtorepairorrestorethevehicletoitsoriginal 109appearanceinordertopassorcompletethevehicleexamination.Thefeeforthevehicle 110examinationapplicationshallbetwenty-fivedollarsandshallbecollectedbythedirectorof 111revenueatthetimeoftherequestfortheapplicationandshallbedepositedinthestate 112treasurytothecreditofthestatehighwaysandtransportationdepartmentfund.Ifthevehicle 113isalsotoberegisteredinMissouri,[thesafetyinspectionrequiredinchapter307and]the 114emissionsinspectionrequiredunderchapter643shallbecompletedandthefeesrequiredby 115section307.365andsection643.315shallbechargedtotheowner. 116 10.WhenanapplicationismadeforanoriginalMissouricertificateofownershipfor 117amotorvehiclepreviouslyregisteredortitledinastateotherthanMissouriorasrequiredby 118section301.020,itshallbeaccompaniedbyacurrentinspectionformcertifiedbyaduly 119authorizedofficialinspectionstationasdescribedinchapter307.Thecompletedformshall 120certifythatthemanufacturer'sidentificationnumberforthevehiclehasbeeninspected,thatit 121iscorrectlydisplayedonthevehicleandshallcertifythereadingshownontheodometerat 122thetimeofinspection.Theinspectionstationshallcollectthesamefeeasauthorizedin 123section307.365formakingtheinspection,andthefeeshallbedepositedinthesamemanner 124asprovidedinsection307.365.IfthevehicleisalsotoberegisteredinMissouri,[thesafety 125inspectionrequiredinchapter307and]theemissionsinspectionrequiredunderchapter643 HB1069 13 126shallbecompletedandonlythefeesrequiredbysection307.365andsection643.315shallbe 127chargedtotheowner.Thissectionshallnotapplytovehiclesbeingtransferredona 128manufacturer'sstatementoforigin. 129 11.Motorvehiclesbroughtintothisstateinawreckedordamagedconditionorafter 130beingtowedasanabandonedvehiclepursuanttoanotherstate'sabandonedmotorvehicle 131proceduresshall,inlieuoftheinspectionrequiredbysubsection10ofthissection,be 132inspectedbytheMissouristatehighwaypatrolinaccordancewithsubsection9ofthis 133section.Iftheinspectionrevealsthevehicletobeinasalvageorjunkcondition,thedirector 134shallsoindicateonanyMissouricertificateofownershipissuedforsuchvehicle.Any 135salvagedesignationshallbecarriedforwardonallsubsequentlyissuedcertificatesoftitlefor 136themotorvehicle. 137 12.WhenanapplicationismadeforanoriginalMissouricertificateofownershipfor 138amotorvehiclepreviouslyregisteredortitledinastateotherthanMissouri,andthe 139certificateofownershiphasbeenappropriatelydesignatedbytheissuingstateasa 140reconstructedmotorvehicle,motorchangevehicle,speciallyconstructedmotorvehicle,or 141priorsalvagevehicle,thedirectorofrevenueshallappropriatelydesignateonthecurrent 142Missouriandallsubsequentissuesofthecertificateofownershipthenameoftheissuingstate 143andsuchpriordesignation.Theabsenceofanypriordesignationshallnotrelieveatransferor 144ofthedutytoexerciseduediligencewithregardtosuchcertificateofownershippriortothe 145transferofacertificate.Ifatransferorexercisesanyduediligencewithregardtoacertificate 146ofownership,thelegaltransferofacertificateofownershipwithoutanydesignationthatis 156patrolshallmakeandenforcerulesfortheadministrationoftheinspectionsrequiredbythis 157section. 158 15.EachapplicationforanoriginalMissouricertificateofownershipforavehicle 174agencyshallincludeacheckforstolenvehicles. 175 176Thedepartmentofrevenueshallissuetheowneracertificateofownershipdesignatedwith 177thewords"ReconstructedMotorVehicle"anddeliversuchcertificateofownershipin 178accordancewiththeprovisionsofthischapter.Notwithstandingsubsection9ofthissection, 179noownerofareconstructedmotorvehicledescribedinthissubsectionshallberequiredto 180obtainavehicleexaminationcertificateissuedbytheMissouristatehighwaypatrol. 301.380.1.Whenevertheoriginal,manufacturer's,orotherdistinguishingnumberon 2anymotorvehicle,trailerormotorvehicletirehasbeendestroyed,removed,covered,altered, 3defacedorisotherwisenonexistent,thedirectorofrevenue,uponapplication,paymentofa 4feeofsevendollarsandfiftycents,andsatisfactoryproofofownershipbytheowner,shall 5issueacertificateauthorizingtheownertoplaceaspecialnumberdesignatedbythedirector 6ofrevenueuponthevehicle,trailerortire. 7 2.Inordertoproperlycalculatethesalestaxdue,inthecaseofatrailerwhichis 8allegedtohavebeenmadebysomeonewhoisnotamanufacturerusingreadily 9distinguishablemanufacturers'identifyingnumbersoracertificateoforigin,theperson 10seekingthespecialnumberauthorizedbytheprovisionsofthissectionshallsecurea[written 11statementfromamotorvehicleinspectionstation] vehicleexaminationcertificateissuedby 12theMissouristatehighwaypatrol,orotherlawenforcementagencyasauthorizedbythe 13directorofrevenue,thatthetrailerhasbeenexaminedandthatitisnotonemadebya 14regularmanufacturer.Thesuperintendentofthestatehighwaypatrolshallprovidesuch 15formsfor[inspectionstations,andtheperson,firm,orcorporationseekingtheexamination 16shallpayaregularinspectionfeefortheexamination.Theproceedsofthefeeshallbe 17distributedinthesamemannerasregularinspectionfeesaredistributed] lawenforcement HB1069 15 18agenciesperformingsuchinspections. Thissubsectionshallnotapplytotrailersinspected 19undersection301.191. 20 3.Thedirectorofrevenueshalldesignatethespecialnumbersconsecutively 21beginningwiththenumberoneprecededbytheletters"DR"andfollowedbytheletters"Mo" 22foreachmakeofmotorvehicle,trailerormotorvehicletire,orifthemakebeunknown,the 23numbershallalsobeprecededbytheletter"X". 24 4.Whensuchnumberhasbeenplaceduponthemotorvehicleormotororengine 25thereof,ortrailerormotorvehicletire,itshallbethelawfulnumberofthesameforthe 26purposeofidentification,registration,andallotherpurposesofthischapter,andtheowner 27maysellandtransfersuchpropertyunderthespecialnumber.Nopersonshalldestroy, 28remove,cover,alterordefaceanysuchspecialnumber. 301.443.1.AnylegalresidentofthestateofMissouriwhoisaveteranofservicein 2theArmedForcesoftheUnitedStatesandhasbeenhonorablydischargedfromsuchservice 3andwhoisaformerprisonerofwarandanylegalresidentofthestateofMissouriwhoisa 4formerprisonerofwarandwhowasaUnitedStatescitizennotintheArmedForcesofthe 5UnitedStatesduringsuchtimeis,uponfilinganapplicationforregistrationtogetherwith 6suchinformationandproofintheformofastatementfromtheUnitedStatesVeterans 7AdministrationortheDepartmentofDefenseoranyotherformofproofasthedirectormay 8require,entitledtoreceiveannuallyonecertificateofregistrationandonesetoflicenseplates 9orotherevidenceofregistrationasprovidedinsection301.130foramotorvehicleotherthan 10acommercialmotorvehiclelicensedinexcessoftwenty-fourthousandpoundsgrossweight. 11Thereshallbenofeechargedforlicenseplatesissuedundertheprovisionsofthissection. 12 2.Notmorethanonecertificateofregistrationandonecorrespondingsetofmotor 13vehiclelicenseplatesorotherevidenceofregistrationasprovidedinsection301.130shallbe 14issuedeachyeartoaqualifiedformerprisonerofwarunderthissection. 15 3.Proofofownership[andvehicleinspection] oftheparticularmotorvehiclefor 16whicharegistrationcertificateandsetoflicenseplatesisrequestedmustbeshownatthetime 17ofapplication.Proofofstatusasaformerprisonerofwarasrequiredinsubsection1ofthis 18sectionshallonlyberequiredontheinitialapplication. 19 4.Asusedinthissection,"formerprisonerofwar"meansanypersonwhowastaken 20asanenemyprisonerduringWorldWarI,WorldWarII,theKoreanConflict,ortheVietnam 21Conflict. 22 5.Thedirectorshallfurnisheachformerprisonerofwarobtainingasetoflicense 23platesundertheprovisionsofsubsections1to4ofthissectionspecialplateswhichshallhave 24thewords"FORMERP.O.W."onthelicenseplatesinpreferencetothewords"SHOW-ME 35thesurvivingspouseofaformerprisonerofwarwhohasnotremarriedandwhohasbeen 36issuedlicenseplatesdescribedinsubsection5ofthissectionshallbeentitledtotransfersuch 37licenseplatestothemotorvehicleofthesurvivingspouseandreceiveannuallyonecertificate 38ofregistrationandonesetoflicenseplatesorotherevidenceofregistrationasprovidedin 39section301.130asifaformerprisonerofwaruntilremarriage.Thereshallbenofeecharged 40forthetransferofsuchlicenseplates. 41 (2)Thedepartmentofrevenueshallpromulgaterulesfortheobtainingofasetof 42licenseplatesdescribedinsubsection5ofthissectionbythesurvivingspouseoftheformer 43prisonerofwarwhensuchlicenseplatesarenotissuedpriortothedeathoftheformer 44prisonerofwar.Thesurvivingspouseshallbeentitledtoreceiveannuallyonecertificateof 45registrationandonesetoflicenseplatesorotherevidenceofregistrationasprovidedin 46section301.130asifaformerprisonerofwaruntilremarriage.Thereshallbenofeecharged 47forthelicenseplatesissuedpursuanttothissubdivision. 301.800.1.Anymotorvehicleassembledbyatwo-orfour-yearinstitutionofhigher 2educationexclusivelyutilizingsolarpowerandbuilttocompeteinanationalcompetition 3organizedtofosterinterestinsolarenergyshallberegisteredandtitledbythedirectorof 4revenue,otherlawsregulatinglicensingofmotorvehiclestothecontrarynotwithstanding. 5 2.Suchinstitutionshallfileanapplicationinaformprescribedbythedirector, 6verifiedbyaffidavit,thatsuchvehiclemeetstherequirementsofsubsection1ofthissection. 7 3.Theplateissuedbythedirectorshallbethecollegiateplateoftheinstitutionand 8shalldisplaytheterm"solar"inamannerprescribedbythedirector. 9 4.Theinstitutionshallpaytheapplicablefeesasdeterminedbythedirector. 10 5.Suchmotorvehicleshallbeexemptfromthe[inspectionsrequiredbysection 11307.350and]inspectionrequiredundersection643.315andshallonlybeoperatedonthe 12streetsandhighwayswiththeapprovaloftheinstitutionofhighereducation. 307.360.1.ThesuperintendentoftheMissouristatehighwaypatrolshallissue 2permitsandwritteninstructionstoofficialinspectionstationsandshallfurnishformsand 3certificatesforthe[inspectionofbrakes,lightingequipment,signalingdevices,steering 4mechanisms,horns,mirrors,windshieldwipers,tires,wheels,exhaustsystem,glazing,air HB1069 17 5pollutioncontroldevices,fuelsystem,andanyothersafetyequipmentrequiredbythestate. 6Innoinstancewillroadtestingofavehiclebeconsideredapartoftheinspectionprocedure] 7certificationofmanufacturer'sidentificationnumbersandodometerreadingsfor 8vehiclespresentedforinspection. 9 2.ThesuperintendentoftheMissouristatehighwaypatrolshallprescribethe 10standardsandequipmentnecessaryforanofficialinspectionstationandthequalificationsfor 11personswhoconducttheinspections,andnoapplicantmaybeapprovedtooperateanofficial 12inspectionstationuntiltheapplicantmeetsthestandardsandhastherequiredequipmentand 13qualifiedinspectorsasprescribed.ThesuperintendentoftheMissouristatehighwaypatrol 14shallestablishstandardsandprocedurestobefollowedinthemakingofinspectionsrequired 15bysections[307.350] 307.360to307.390andshallprescriberulesandregulationsforthe 16operationofthestations. 17 3.(1)Theapplicationforpermitasanofficialinspectionstationshallbemadetothe 18superintendentoftheMissouristatehighwaypatrolonaformfurnishedbythe 19superintendent.Thefeeforapermittooperateanofficialinspectionstationshallbeten 20dollarsperyearandeachpermitshallberenewedannuallyonthedateofissue.Allfeesshall 21bepayabletothedirectorofrevenueandshallbedepositedbyhiminthestatetreasurytothe 22creditofthestatehighwayfund. 23 (2)Theapplicationshallsetforththenameunderwhichapplicanttransactsorintends 24totransactbusiness,thelocationoftheapplicant'splaceofbusinessandsuchother 25informationasthesuperintendentoftheMissouristatehighwaypatrolmayrequire.Ifthe 26applicanthasorintendstohavemorethanoneplaceofbusinesswithinthestate,aseparate 27applicationshallbemadeforeachplaceofbusiness.Iftheapplicantisapartnership,the 28applicationshallsetforththenamesofthepartners;ifacorporation,thenamesoftheofficers 29shallbeshown.Theapplicationshallbesignedandverifiedbyoathoraffirmationofthe 30owneroranauthorizedofficerorpartner. 31 (3)EachlocationwhichfulfillsthesuperintendentoftheMissouristatehighway 32patrol'srequirementsandwhoseowners,proprietorsandemployeescomplywiththe 33superintendent'sregulationsandqualificationsshallbedesignatedasanofficialinspection 34stationandtheapplicantissuedacertificate.ThesuperintendentoftheMissouristate 35highwaypatrolshallinvestigateallapplicantsforinspectionstationpermitstodetermine 36whetherornotthepremises,equipmentandpersonnelmeettherequirementsprescribedby 37him. 38 (4)Anyautomobilemechanicwhohashadatleastoneyearofpracticalexperienceas 39anautomotivemechanicoranypersonwhohassuccessfullycompletedacourseofvocational 40instructioninautomotivemechanicsfromagenerallyrecognizededucationalinstitution, 41eitherpublicorprivate,andwhohasdemonstratedtheknowledgeandabilitytoconductan HB1069 18 42inspectionincompliancewiththeregulationsestablishedbythesuperintendentofthe 43Missouristatehighwaypatrolmaybeissuedapermittoconductinspectionsatanyofficial 44inspectionstation.Nopersonwithoutavalidpermitshallconductanypartofaninspection[, 45exceptapersonwithoutavalidpermitmayassistintheinspectionofavehiclebyoperating 46thevehicle'slightingequipmentandsignalingdevices.ThesuperintendentoftheMissouri 47statehighwaypatrolmayrequireamechanictobereexaminedatanytimetodeterminethe 48mechanic'sknowledgeandabilitytoconductaninspection.Ifthemechanicfailsthe 49reexaminationorrefusestobereexamined,thepermitissuedtothemechanicshallbe 50suspendeduntilthemechanicpassestheexaminationbutundernocircumstancescanthe 51mechanicagainbetesteduntilaperiodofthirtydayshaselapsed]. Nofeeshallbecharged 52forthepermitandthepermitshallremainvalidforaperiodofthreeyearsfromthedateof 53issueoruntilsuspendedorrevokedbythesuperintendentoftheMissouristatehighway 54patrol. 55 [(5)ThesuperintendentoftheMissouristatehighwaypatrolmayissueaprivate 56officialinspectionstationpermittoanyassociation,person,partnership,corporationand/or 57subsidiarycorporation,andgovernmentalentityhavingregisteredortitledinhis,herorits 58nameinthisstateoneormorevehiclesofthetyperequiredtobeinspectedbysection 59307.350,orwhomaintainssuchvehiclesunderawrittenmaintenanceagreementofatleast 60oneyear'sdurationandwhomaintainsapprovedinspectionfacilitiesandhasqualified 61personnel;butseparatepermitsmustbeobtainedforseparatefacilitiesofthesame 62association,person,partnership,corporationand/orsubsidiarycorporation,orgovernmental 63entity.Suchprivatestationsshallinspectonlyvehiclesregisteredortoberegistered,titledor 64tobetitledormaintainedinthenameofthepersonororganizationdescribedonthe 65applicationforpermit.Nofeeshallbechargedforapermitissuedtoagovernmentalentity.] 66 4.(1)ThesuperintendentoftheMissouristatehighwaypatrolshallsuperviseand 67causeinspectionstobemadeoftheofficialinspectionstationsandinspectingpersonnelandif 68thesuperintendentfindsthattheprovisionsofsections[307.350] 307.360to307.390orthe 69regulationsissuedpursuanttosections[307.350] 307.360to307.390arenotbeingcomplied 70with,orthatthebusinessofanofficialinspectionstation[, inconnectionwithcorrections, 71adjustments,repairsorinspectionofvehicles] isbeingimproperlyconducted,the 72superintendentshallsuspendorrevokethepermitofthestationforaperiodofnotless 73thanthirtydaysormorethanoneyearandrequiretheimmediatesurrenderandreturnofthe 74permit,togetherwithallofficialformsandcertificatesofinspectionandapproval.Ifthe 75superintendentfindsthataninspectorhasviolatedanyoftheprovisionsofsections[307.350] 76307.360to307.390ortheregulationsissuedpursuanttosections[307.350] 307.360to 77307.390,thesuperintendentshallsuspendorrevoketheinspector'spermitforaperiodofnot 78lessthanthirtydaysnormorethanoneyear.Ifastationoperatororifaninspectorviolates HB1069 19 79anyoftheprovisionsofsections[307.350] 307.360to307.390,heorsheissubjectto 80prosecutionasprovidedinsection307.390. 81 (2)Thesuspensionorrevocationofastationpermitorofaninspector'spermitshall 82beinwritingtotheoperator,inspector,orthepersoninchargeofthestation.Before 83suspendingorrevokingeitherofthepermits,thesuperintendentshallservenoticeinwriting 84bycertifiedmailorbypersonalservicetothepermitteeatthepermittee'saddressofrecord 85givingthepermitteetheopportunitytoappearintheofficeofthesuperintendentonastated 86date,notlessthantennormorethanthirtydaysafterthemailingorserviceofthenotice,fora 87hearingtoshowcausewhythepermittee'spermitshouldnotbesuspendedorrevoked.An 88inspectionstationowneroraninspectormayappearinpersonorbycounselintheofficeof 89thesuperintendenttoshowcausewhytheproposedsuspensionorrevocationisinerror,orto 90presentanyotherfactsortestimonythatwouldbearonthefinaldecisionofthe 91superintendent.Ifthepermitteeorthepermittee'sagentdoesnotappearonthestatedday 92afterreceiptofnotice,itshallbepresumedthatthepermitteeadmitstheallegationsoffact 93containedinthehearingnotificationletter.Thedecisionofthesuperintendentmayinsuch 94casebebaseduponthewrittenreportssubmittedbythesuperintendent'sofficers.Theorder 95ofthesuperintendent,specifyinghisfindingsoffactandconclusionsoflaw,shallbe 96consideredfinalimmediatelyafterreceiptofnoticethereofbythepermittee. 97 (3)Anypersonwhosepermitissuspendedorrevokedorwhoseapplicationfora 98permitisdeniedmaywithintendaysappealtheactionasprovidedinchapter536. 307.365.1.Nopermitforanofficialinspectionstationshallbeassignedor 2transferredorusedatanylocationotherthanthereindesignatedandeverypermitshallbe 3postedinaconspicuousplaceatthelocationdesignated.ThesuperintendentoftheMissouri 4statehighwaypatrolshalldesignandfurnisheachofficialinspectionstation,atnocost,one 5officialsignmadeofmetalorotherdurablematerialtobedisplayedinaconspicuouslocation 6todesignatethestationasanofficialinspectionstation.Additionalsignsmaybeobtainedby 7anofficialinspectionstationforafeeequaltothecosttothestate.Eachinspectionstation 8shallalsobesuppliedwithoneormoreposterswhichmustbedisplayedinaconspicuous 9locationattheplaceofinspectionandwhichinformsthepublicthatrequiredrepairsor 10correctionsneednotbemadeattheinspectionstation. 11 2.Nopersonoperatinganofficialinspectionstationpursuanttotheprovisionsof 12sections[307.350] 307.360to307.390mayissueacertificateofinspectionandapprovalfor 13anyvehicleexceptuponanofficialformfurnishedbythesuperintendentoftheMissouristate 14highwaypatrolforthatpurpose[andonlyafterinspectingthevehicleanddeterminingthatits 15brakes,lightingequipment,signalingdevices,steeringmechanisms,horns,mirrors, 16windshieldwipers,tires,wheels,exhaustsystem,glazing,airpollutioncontroldevices, 17fuelsystemandanyothersafetyequipmentasrequiredbythestateareinpropercondition HB1069 20 18andadjustmenttobeoperateduponthepublichighwaysofthisstatewithsafetytothedriver 19oroperator,otheroccupantstherein,aswellasotherpersonsandpropertyuponthehighways, 20asprovidedbysections307.350to307.390andtheregulationsprescribedbythe 21superintendentoftheMissouristatehighwaypatrol.Brakesmaybeinspectedforsafety 22bymeansofvisualinspectionorcomputerizedbraketesting]. Nopersonoperatinganofficial 23inspectionstationshallfurnish,loan,giveorsellacertificateofinspectionandapprovalto 24anyotherpersonexceptthoseentitledtoreceiveitunderprovisionsofsections[307.350] 25307.360to307.390.[Nopersonshallhaveinsuchperson'spossessionanycertificateof 26inspectionandapprovaland/orinspectionstickerwithknowledgethatthecertificateand/or 27inspectionstickerhasbeenillegallypurchased,stolenorcounterfeited.] 28 3.ThesuperintendentoftheMissouristatehighwaypatrolmayrequireofficially 29designatedstationstofurnishreportsuponformsfurnishedbythesuperintendentforthat 30purposeasthesuperintendentconsidersreasonablynecessaryfortheproperandefficient 31administrationofsections[307.350] 307.360to307.390. 32 4.[If,uponinspection,defectsorunsafeconditionsarefound,theownermaycorrect 33themorshallhavethemcorrectedatanyplacetheownerchooseswithintwentydaysafterthe 34defectorunsafeconditionisfound,andshallhavetherighttoremovethevehicletosuch 35placeforcorrection,butbeforethevehicleisoperatedthereafteruponthepublichighwaysof 36thisstate,acertificateofinspectionandapprovalmustbeobtained.Theinspectingpersonnel 37oftheofficialinspectionstationmustinformtheownerthatthecorrectionsneednotbemade 38attheinspectionstation. 39 5.]Afee,nottoexceedtwelvedollars,asdeterminedbyeachofficialinspection 40station,maybechargedbyanofficialinspectionstationforeachofficialinspectionincluding 41theissuanceofthecertificateofinspection[andapproval,sticker,sealorotherdeviceanda 42totalfee,nottoexceedtendollars,asdeterminedbyeachofficialinspectionstation,maybe 43chargedforanofficialinspectionofatrailerormotorcycle,whichshallincludetheissuance 44ofthecertificateofinspectionandapproval,sticker,sealorotherdevice]. Suchfeeshallbe 45conspicuouslypostedonthepremisesofeachsuchofficialinspectionstation.[Noowner 46shallbechargedanadditionalinspectionfeeuponhavingcorrecteddefectsorunsafe 47conditionsfoundinaninspectioncompletedwithintheprevioustwentyconsecutivedays, 48excludingSaturdays,Sundaysandholidays,ifsuchfollow-upinspectionismadebythe 49stationmakingtheinitialinspection.Everyinspectionforwhichafeeischargedshallbea 50completeinspection,anduponcompletionoftheinspection,ifanydefectsarefoundthe 51ownerofthevehicleshallbefurnishedalistofthedefectsandareceiptforthefeepaidfor 52theinspection.Iftheownerofavehicledecidestohaveanynecessaryrepairsorcorrections 53madeattheofficialinspectionstation,theownershallbefurnishedawrittenestimateofthe 54costofsuchrepairsbeforesuchrepairsorcorrectionsaremadebytheofficialinspection HB1069 21 55station.Thewrittenestimateshallhaveplainlywrittenuponitthattheownerunderstands 56thatthecorrectionsneednotbemadebytheofficialinspectionstationandshallhavea 57signaturelinefortheowner.Theownermustsignbelowthestatementonthesignatureline 58beforeanyrepairsaremade. 59 6.Certificatesofinspectionandapproval,sticker,sealorotherdeviceshallbe 60purchasedbytheofficialinspectionstationsfromthesuperintendentoftheMissouristate 61highwaypatrol.ThesuperintendentoftheMissouristatehighwaypatrolshallcollectafeeof 62onedollarandfiftycentsforeachcertificateofinspection,sticker,sealorotherdeviceissued 63totheofficialinspectionstations,exceptthatnochargeshallbemadeforcertificatesof 64inspection,sticker,sealorotherdeviceissuedtoofficialinspectionstationsoperatedby 65governmentalentities.Allfeescollectedshallbedepositedinthestatetreasurywithone 66dollarofeachfeecollectedcreditedtothestatehighwayfundand,forthepurposeof 67administeringandenforcingthestatemotorvehiclelawsandtrafficregulations,fiftycents 68creditedtothe"HighwayPatrolInspectionFund"whichisherebycreated.Themoneys 69collectedanddepositedinthehighwaypatrolinspectionfundshallbeexpendedsubjectto 70appropriationsbythegeneralassemblyfortheadministrationandenforcementofsections 71307.350to307.390bytheMissouristatehighwaypatrol.Theunexpendedbalanceinthe 72fundattheendofeachbienniumexceedingtheamountoftheappropriationsfromthefund 73forthefirsttwofiscalyearsshallbetransferredtothestateroadfund,andtheprovisionsof 74section33.080,relatingtothetransferoffundstothegeneralrevenuefundattheendofthe 75biennium,shallnotapplytothefund. 76 7.]5.Theowneroroperatorofanyinspectionstationwhodiscontinuesoperation 77duringtheperiodthatastationpermitisvalidorwhosestationpermitissuspendedor 78revokedshallreturnallofficialsignsandposters[andanycurrentunusedinspectionstickers, 79sealsorotherdevices] tothesuperintendentoftheMissouristatehighwaypatrolandshall 80receiveafullrefundonrequestexceptforofficialsignsandposters,providedtherequestis 81madeduringthecalendaryearorwithinsixtydaysthereafterinthemannerprescribedbythe 82superintendentoftheMissouristatehighwaypatrol.[Stationswhichhaveavalidpermitshall 83exchangeunusedpreviousyearissueinspectionstickersand/ordecalsforanidenticalnumber 84ofcurrentyearissue,providedtheunusedstickersand/ordecalsaresubmittedforexchange 85notlaterthanAprilthirtiethofthecurrentcalendaryear,inthemannerprescribedbythe 86superintendentoftheMissouristatehighwaypatrol. 87 8.]6.Notwithstandingtheprovisionsofsection307.390tothecontrary,aviolationof 88thissectionshallbeaclassCmisdemeanor. 89 [9.]7.Theowneroroperatorofanyinspectionstationshallmaintainliability 90insuranceatalltimestocoverpossibledamagetovehiclesduringtheinspectionprocess. HB1069 22 307.370.1.Nopersonshallrepresentinanymanneranyplaceasanofficial 2inspectionstationunlessthestationisoperatedunderavalidpermitissuedbythe 3superintendentoftheMissouristatehighwaypatrol. 4 2.Nopersonunlessthenholdingavalidpermitshallissueacertificateofinspection 5[andapproval,sticker,sealorotherdevice]. 6 3.Nopersonshallmake,issueorknowinglyuseanyimitationorcounterfeitofan 7officialcertificateofinspection[, sticker,sealorotherdevice]. 8 4.Nopersonshalldisplayorcauseorpermittobedisplayeduponanyvehicleany 9certificateofinspectionandapproval[, sticker,sealorotherdevice] knowingthesametobe 10fictitiousorissuedforanothervehicleorissuedwithoutaninspectionhavingbeenmade. 307.375.1.Theownerofeverybususedtotransportchildrentoorfromschoolin 2additiontoanyotherinspectionrequiredbylawshallsubmitthevehicletoanofficialschool 3businspectionstation,andobtainacertificateofinspection,sticker,sealorotherdevice 4annually,buttheinspectionofthevehicleshallnotbemademorethansixtydayspriorto 5operatingthevehicleduringtheschoolyear.Theinspectionshall[, inadditiontothe 6inspectionofthemechanismandequipmentrequiredforallmotorvehiclesunderthe 7provisionsofsections307.350to307.390,] includeadeterminationthatthebrakes, 8lightingequipment,signalingdevices,steeringmechanisms,horns,mirrors,windshield 9wipers,tires,wheels,exhaustsystem,glazing,airpollutioncontroldevices,andfuel 10systemofthebusareinproperconditionand,inaddition,includeaninspectionto 11ascertainthatthefollowingitemsarecorrectlyfitted,adjusted,andingoodworking 12condition: 13 2.Inadditiontotheinspectionrequiredbysubsection1ofthissection,theMissouri 35statehighwaypatrolshallconductaninspectionafterFebruaryfirstofeachschoolyearofall 36vehiclesrequiredtobemarkedasschoolbusesundersection304.050.Thisinspectionshall 37beconductedbytheMissourihighwaypatrolincooperationwiththedepartmentof 38elementaryandsecondaryeducationandshallinclude,asaminimum,itemsinsubsection1 39ofthissectionandthefollowing: 40 (1)Thedriverseatbelts; 41 (2)Theheatinganddefrostingsystems; 42 (3)Thereflectors; 43 (4)Thebussteps; 44 (5)Theaisles; 45 (6)Theframe. 46 3.If,uponinspection,conditionswhichviolatethestandardsinsubsection2ofthis 47sectionarefound,theowneroroperatorshallhavethemcorrectedintendaysandnotifythe 48superintendentoftheMissouristatehighwaypatrolorthosepersonsauthorizedbythe 49superintendent.Ifthedefectsorunsafeconditionsfoundconstituteanimmediatedanger,the 50busshallnotbeuseduntilcorrectionsaremadeandthesuperintendentoftheMissouristate 51highwaypatrolorthosepersonsauthorizedbythesuperintendentarenotified. 52 4.TheMissourihighwaypatrolmayinspectanyschoolbusatanytimeandifsuch 53inspectionrevealsadeficiencyaffectingthesafeoperationofthebus,theprovisionsof 54subsection3ofthissectionshallbeapplicable. 55 5.[Notwithstandingtheprovisionsofsection307.390tothecontrary,]Aviolationof 56thissectionshallbeaclassCmisdemeanor. 57 6.ThesuperintendentoftheMissouristatehighwaypatrolshallprescribethe 58standardsandequipmentnecessaryforanofficialschoolbusinspectionstationandthe 59qualificationsforpersonswhoconducttheinspections.TheMissouristatehighway 60patrolshallestablishstandardsandprocedurestobefollowedwhenconductingthe 61inspectionsrequiredunderthissectionandshallprescriberulesandregulationsforthe 62operationoftheschoolbusinspectionstations. 307.385.ThesuperintendentoftheMissouristatehighwaypatrolmaynotifythe 2directorofrevenueandthedirectorofrevenueshallsuspendtheregistrationofanyvehicle HB1069 24 3whichthesuperintendentoftheMissouristatehighwaypatroldetermines,afterawritten 4notice,isnotequippedasrequiredbylaworforwhichacertificaterequiredbysections 5[307.350] 307.360to307.390hasnotbeenobtained. 307.390.1.Anypersonwhoviolatesanyprovisionofsections[307.350] 307.360to 2307.390isguiltyofamisdemeanoranduponconvictionshallbepunishedasprovidedby 3law. 4 2.ThesuperintendentoftheMissouristatehighwaypatrolmayassignqualified 5personswhoarenothighwaypatrolofficerstoinvestigateandenforcemotorvehiclesafety 6inspectionlawsandregulationspursuanttosections[307.350] 307.360to307.390and 7sections643.300to643.355.Apersonassignedbythesuperintendentpursuanttothe 8authoritygrantedbythissubsectionshallbedesignatedamotorvehicleinspectorandshall 9havelimitedpowerstoissueauniformcomplaintandsummonsforaviolationofthemotor 10vehicleinspectionlawsandregulations.Amotorvehicleinspectorshallnothaveauthorityto 11exercisethepowergrantedinthissubsectionuntilsuchinspectorsuccessfullycompletes 12trainingprovidedby,andtothesatisfactionof,thesuperintendent. 643.303.1.BeginningSeptember1,2007,emissionsinspectionsrequiredbysections 2643.300to643.355shallbeconductedthroughadecentralizedemissionsprogramthatmeets 3therequirementsofthissection.PriortoSeptember1,2007,theairconservationcommission 4shalldevelopadecentralizedemissionsinspectionprogramthatallowsofficialinspection 5stationstoconducton-boarddiagnosticemissioninspectionsof1996modelyearandnewer 6motorvehiclesequippedwithon-boarddiagnosticsystemsmeetingthefederalEnvironmental 7ProtectionAgencyOn-BoardDiagnosticsII(OBDII)standards.Thedecentralizedemissions 8inspectionprogramshall,ataminimum,provideforthefollowing: 9 (1)Theperiodicinspectionofcertainmotorvehiclesasrequiredundersection 10643.315; 11 (2)Thecertificationandoperationofofficialemissionsinspectionstationsandthe 12licensingofemissioninspectors; 13 (3)Thetestingofmotorvehiclesthroughon-boarddiagnostictestingtechnologies; 14 (4)Thetraining,certification,andsupervisionofemissioninspectorsandother 15personnel;and 16 (5)Proceduresforcertifyingtestresultsandforreportingandmaintainingrelevant 17datarecords. 18 2.Inadditiontoanyothercriteriaestablishedbythecommissionundersection 19643.320orbyrule,thedecentralizedemissionsinspectionprogramshallallowanyofficial 20inspectionstationlocatedinanareadescribedinsubsection1ofsection643.305otherwise 21qualifiedbytheMissouristatehighwaypatroltoconductmotorvehicle[safety] inspections 22undersection307.360toconducton-boarddiagnosticemissioninspections.Anymotor HB1069 25 23vehicle[safety] inspectionstationthatdesirestoconductemissionsinspectionsshallsubmit 24anapplicationforacertificateofauthorizationtothecommissionasprovidedforunder 25section643.320.Otherindividuals,corporations,orentities[thatdonotconductmotor 26vehiclesafetyinspections] mayconductemissioninspectionsprovidedtheymeetthe 27qualificationssetforthinsections643.300to643.355and[the]rulespromulgatedbythe 28commission.Applicationsshallbemadeuponaformdesignatedbythecommissionand 29shallcontainsuchinformationasmayberequiredbythecommission.Acertificateof 30authorizationissuedundersection643.320toconductemissioninspectionsshallbeissued 31onlyafterthecommissionhasmadeadeterminationthattheapplicant'sproposedinspection 32stationwillbeproperlyequipped,hasthenecessarylicensedemissioninspectorstoconduct 33inspections,andmeetsallotherrequirementsofsections643.300to643.355orrules 34promulgatedtocarryouttheprovisionsofthosesections. 35 3.Thedecentralizedemissionsinspectionprogramshallallowanyofficialemissions 36inspectionstationthatiscertifiedtoconductanon-boarddiagnosticemissioninspection 37undersections643.300to643.355torepairmotorvehiclesinordertobringsuchvehiclesinto 38compliancewithsections643.300to643.355,ifsuchstationandpersonnelmeetthe 39qualificationstoconductemissionrepairsassetforthinsections643.300to643.355.An 40officialemissioninspectionstationmayelecttobeanemissionstest-onlystationormayelect 41toconductbothemissioninspectionsandrepairs. 42 4.Thecommissionisauthorizedtobegincertificationofofficialemissions 43inspectionstationspriortoSeptember1,2007,inordertoimplementthedecentralized 44emissionsinspectionprogram.PriortoJanuary1,2007,thedepartmentofnaturalresources 45shallissueareporttothegeneralassemblyandthegovernorregardingtheprogressof 46implementingthedecentralizedemissionsinspectionprogram.Thereportshallinclude,but 47notbelimitedto,asummarydescribinghowmanyinspectionstationsorindividualsthe 48departmentexpectstoparticipateintheprogramandhowmanyinspectionstationsor 49individualswillbequalifiedbySeptember1,2007,toconductsuchemissionsinspections. 50 5.Thecommissionmay,asapartofimplementingthedecentralizedemissions 51inspectionprogram,useremotesensingdevicestocollectinformationregardingthevehicle 52fleetemissionscharacteristicsandregistrationcompliancewithintheareadescribedin 53subsection1ofsection643.305.Thedecentralizedemissionsinspectionprogramestablished 54bythecommissionmayalsoincludeacleanscreenprogramthatutilizesremotesensing 55devices.Ownersofeligiblevehicleswhocomplywithcleanscreen/remotesensing 56proceduresshallbedeemedtohavecompliedwiththemandatoryinspectionrequirementsfor 57thenextinspectioncycle.Asusedinthissubsection,theterm"cleanscreenprogram"shall 58meanaprocedureorsystemthatutilizesremotesensingtechnologiestodeterminewhethera HB1069 26 59motorvehiclehasacceptableemissionlevelsandthenallowsthemotorvehicleownerto 60bypasstheemissionsinspectiontestrequiredundersection643.315. 61 6.Thedecentralizedemissionsinspectionprogrammayincludeagascappressure 62testandavisualinspectioncomponent[, andsuchtestsmaybeincludedaspartofthemotor 63vehiclesafetyinspectiontestundersection307.350]. 64 7.Asusedinsections643.300to643.355,"decentralizedemissionsinspection 65program"meansanemissionsinspectionprogramunderwhichacertifiedemissionsinspector 66conductsemissionsinspectiontestingatanofficialinspectionstation. 67 8.Thedecentralizedemissioninspectionprogramshallsatisfytherequirements 68establishedbyregulationoftheUnitedStatesEnvironmentalProtectionAgency. 69 9.Thedecentralizedemissionsinspectionprogramestablishedbythecommission 70andsections643.300to643.355shallnotbeconstruedtobeanewprogramasdescribedin 71section23.253,andthedecentralizedemissionsinspectionprogramshallnotbesubjecttothe 72sunsetmandateprescribedbysections23.250to23.298. 73 10.NolaterthanJuly1,2007,thedepartmentofnaturalresourcesandtheMissouri 74highwaypatrolshallenterintoaninteragencyagreementcoveringallaspectsofthe 75administrationandenforcementofsections643.300to643.355. 76 11.NolaterthanJuly1,2007,theairconservationcommissionshallpromulgaterules 77fortheimplementationofthissection.Anyruleorportionofarule,asthattermisdefinedin 78section536.010,thatiscreatedundertheauthoritydelegatedinthissectionshallbecome 79effectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter536and,if 80applicable,section536.028.Thissectionandchapter536arenonseverableandifanyofthe 81powersvestedwiththegeneralassemblyunderchapter536toreview,todelaytheeffective 82date,ortodisapproveandannularulearesubsequentlyheldunconstitutional,thenthegrant 83ofrulemakingauthorityandanyruleproposedoradoptedafterAugust28,2006,shallbe 84invalidandvoid. 85 12.PriortoSeptember1,2007,thedepartmentofnaturalresourcesshallactively 86promoteparticipationinthedecentralizedemissionsinspectionprogramamongqualified 87motorvehicledealers,servicestations,andotherindividuals.Aftertheimplementationofthe 88decentralizedemissioninspectionprogram,thedepartmentshallmonitorparticipationinsuch 89program.Indeterminingwhetherthereareasufficientnumberofindividualsconducting 90motorvehicleemissioninspectionsunderthedecentralizedprogram,thedepartmentshall 91attempttoensure,throughpromotionalefforts,thatnomorethantwentypercentofall 92personsresidingintheaffectednonattainmentarearesidefartherthanfivemilesfromthe 93nearestinspectionstation. 643.315.1.Exceptasprovidedinsections643.300to643.355,allmotorvehicles 2whicharedomiciled,registeredorprimarilyoperatedinanareaforwhichthecommission HB1069 27 3hasestablishedamotorvehicleemissionsinspectionprogrampursuanttosections643.300to 4643.355shallbeinspectedandapprovedpriortosaleortransfer;providedthat,ifsuch 5vehicleisinspectedandapprovedpriortosaleortransfer,suchvehicleshallnotbesubjectto 6anotheremissionsinspectionforninetydaysafterthedateofsaleortransferofsuchvehicle. 7Inaddition,anysuchvehiclemanufacturedasaneven-numberedmodelyearvehicleshallbe 8inspectedandapprovedundertheemissionsinspectionprogramestablishedpursuantto 9sections643.300to643.355ineacheven-numberedcalendaryearandanysuchvehicle 10manufacturedasanodd-numberedmodelyearvehicleshallbeinspectedandapprovedunder 11theemissionsinspectionprogramestablishedpursuanttosections643.300to643.355ineach 12odd-numberedcalendaryear.Allmotorvehiclessubjecttotheinspectionrequirementsof 13sections643.300to643.355shalldisplayavalidemissionsinspectionsticker,andwhen 14applicable,avalidemissionsinspectioncertificateshallbepresentedatthetimeof 15registrationorregistrationrenewalofsuchmotorvehicle.Thedepartmentofrevenueshall 16requireevidenceof[thesafetyand]emissioninspectionandapprovalrequiredbythissection 17inissuingthemotorvehicleannualregistrationinconformitywiththeprocedurerequiredby 18[sections307.350to307.390and]sections643.300to643.355.Thedirectorofrevenuemay 19verifythatasuccessful[safetyand]emissionsinspectionwascompletedviaelectronicmeans. 20 2.Theinspectionrequirementofsubsection1ofthissectionshallapplytoallmotor 21vehiclesexcept: 22 (1)Motorvehicleswithamanufacturer'sgrossvehicleweightratinginexcessof 23eightthousandfivehundredpounds; 24 (2)Motorcyclesandmotortricyclesifsuchvehiclesareexemptedfromthemotor 25vehicleemissionsinspectionunderfederalregulationandapprovedbythecommissionby 26rule; 27 (3)Modelyearvehiclesmanufacturedpriorto1996; 28 (4)Vehicleswhicharepoweredexclusivelybyelectricorhydrogenpowerorbyfuels 29otherthangasolinewhichareexemptedfromthemotorvehicleemissionsinspectionunder 30federalregulationandapprovedbythecommissionbyrule; 31 (5)Motorvehiclesregisteredinanareasubjecttotheinspectionrequirementsof 32sections643.300to643.355whicharedomiciledandoperatedexclusivelyinanareaofthe 33statenotsubjecttotheinspectionrequirementsofsections643.300to643.355,butonlyifthe 34ownerofsuchvehiclepresentstothedepartmentanaffidavitthatthevehiclewillbeoperated 35exclusivelyinanareaofthestatenotsubjecttotheinspectionrequirementsofsections 36643.300to643.355forthenexttwenty-fourmonths,andtheownerappliesforandreceivesa 37waiverwhichshallbepresentedatthetimeofregistrationorregistrationrenewal; 38 (6)Newandunusedmotorvehicles,ofmodelyearsofthecurrentcalendaryearand 39ofanycalendaryearwithintwoyearsofsuchcalendaryear,whichhaveanodometerreading HB1069 28 40oflessthansixthousandmilesatthetimeoforiginalsalebyamotorvehiclemanufactureror 41licensedmotorvehicledealertothefirstuser; 42 (7)Historicmotorvehiclesregisteredpursuanttosection301.131; 43 (8)Schoolbuses; 44 (9)Heavy-dutydiesel-poweredvehicleswithagrossvehicleweightratinginexcess 45ofeightthousandfivehundredpounds; 46 (10)Newmotorvehiclesthathavenotbeenpreviouslytitledandregistered,forthe 47four-yearperiodfollowingtheirmodelyearofmanufacture[, providedtheodometerreading 48forsuchmotorvehiclesareunderfortythousandmilesattheirfirstrequiredbiennialsafety 49inspectionconductedundersections307.350to307.390;otherwisesuchmotorvehiclesshall 50besubjecttotheemissionsinspectionrequirementsofsubsection1ofthissectionduringthe 51sameperiodthatthebiennialsafetyinspectionisconducted]; 52 (11)Motorvehiclesthataredrivenfewerthantwelvethousandmilesbetween 53biennial[safetyinspections] registrationperiods; and 54 (12)Qualifiedplug-inelectricdrivevehicles.Forthepurposesofthissection, 55"qualifiedplug-inelectricdrivevehicle"shallmeanaplug-inelectricdrivevehiclethatis 56madebyamanufacturer,hasnotbeenmodifiedfromoriginalmanufacturerspecifications, 57andcanoperatesolelyonelectricpowerandiscapableofrechargingitsbatteryfromanon- 58boardgenerationsourceandanoff-boardelectricitysource. 59 3.Thecommissionmay,byrule,allowinspectionreciprocitywithotherstateshaving 60equivalentormorestringenttestingandwaiverrequirementsthanthoseestablishedpursuant 61tosections643.300to643.355. 62 4.(1)Atthetimeofsale,alicensedmotorvehicledealer,asdefinedinsection 63301.550,maychoosetosellamotorvehiclesubjecttotheinspectionrequirementsofsections 64643.300to643.355either: 65 (a)Withpriorinspectionandapprovalasprovidedinsubdivision(2)ofthis 66subsection;or 67 (b)Withoutpriorinspectionandapprovalasprovidedinsubdivision(3)ofthis 68subsection. 69 (2)Ifthedealerchoosestosellthevehiclewithpriorinspectionandapproval,the 70dealershalldisclose,inwriting,priortosale,whetherthevehicleobtainedapprovalby 71meetingtheemissionsstandardsestablishedpursuanttosections643.300to643.355orby 72obtainingawaiverpursuanttosection643.335.Avehiclesoldpursuanttothissubdivisionby 73alicensedmotorvehicledealershallbeinspectedandapprovedwithintheonehundred 74twentydaysimmediatelyprecedingthedateofsale,and,forthepurposeofregistrationof 75suchvehicle,suchinspectionshallbeconsideredtimely. HB1069 29 76 (3)Ifthedealerchoosestosellthevehiclewithoutpriorinspectionandapproval,the 77purchasermayreturnthevehiclewithintendaysofthedateofpurchase,providedthatthe 78vehiclehasnomorethanonethousandadditionalmilessincethetimeofsale,ifthevehicle 79fails,uponinspection,tomeettheemissionsstandardsspecifiedbythecommissionandthe 80dealershallhavethevehicleinspectedandapprovedwithouttheoptionforawaiverofthe 81emissionsstandardandreturnthevehicletothepurchaserwithavalidemissionscertificate 82andstickerwithinfiveworkingdaysorthepurchaseranddealermayenterintoanyother 83mutuallyacceptableagreement.Ifthedealerchoosestosellthevehiclewithoutprior 84inspectionandapproval,thedealershalldiscloseconspicuouslyonthesalescontractandbill 85ofsalethatthepurchaserhastheoptiontoreturnthevehiclewithintendays,providedthatthe 86vehiclehasnomorethanonethousandadditionalmilessincethetimeofsale,tohavethe 87dealerrepairthevehicleandprovideanemissionscertificateandstickerwithinfiveworking 88daysifthevehiclefails,uponinspection,tomeettheemissionsstandardsestablishedbythe 89commission,orenterintoanymutuallyacceptableagreementwiththedealer.Aviolationof 90thissubdivisionshallbeanunlawfulpracticeasdefinedinsection407.020.[Noemissions 91inspectionshallberequiredpursuanttosections643.300to643.360forthesaleofanymotor 92vehiclewhichmaybesoldwithoutacertificateofinspectionandapproval,asprovided 93pursuanttosubsection2ofsection307.380.] [307.350.1.Theownerofeverymotorvehicleasdefinedinsection 2 301.010whichisrequiredtoberegisteredinthisstate,except: 3 (1)Motorvehicleshavinglessthanonehundredfiftythousandmiles, 4 fortheten-yearperiodfollowingtheirmodelyearofmanufacture,excluding 5 priorsalvagevehiclesimmediatelyfollowingarebuildingprocessandvehicles 6 subjecttotheprovisionsofsection307.380; 7 (2)Thosemotorvehicleswhichareengagedininterstatecommerce 8 andareproportionatelyregisteredinthisstatewiththeMissourihighway 9 reciprocitycommission,althoughtheownermayrequestthatsuchvehiclebe 10 inspectedbyanofficialinspectionstation,andapeaceofficermaystopand 11 inspectsuchvehiclestodeterminewhetherthemechanicalconditionisin 12 compliancewiththesafetyregulationsestablishedbytheUnitedStates 13 DepartmentofTransportation;and 14 (3)Historicmotorvehiclesregisteredpursuanttosection301.131; 15 (4)Vehiclesregisteredinexcessoftwenty-fourthousandpoundsfora 16 periodoflessthantwelvemonths; 17 18 shallsubmitsuchvehiclestoabiennialinspectionoftheirmechanismand 19 equipmentinaccordancewiththeprovisionsofsections307.350to307.390 20 andobtainacertificateofinspectionandapprovalandasticker,seal,orother 21 devicefromadulyauthorizedofficialinspectionstation.Theinspection, 22 excepttheinspectionofschoolbuseswhichshallbemadeatthetimeprovided 23 insection307.375,shallbemadeatthetimeprescribedintherulesand 24 regulationsissuedbythesuperintendentoftheMissouristatehighwaypatrol; HB1069 30 25 buttheinspectionofavehicleshallnotbemademorethansixtydayspriorto 26 thedateofapplicationforregistrationorwithinsixtydaysofwhenavehicle's 27 registrationistransferred;however,ifavehiclewaspurchasedfromamotor 28 vehicledealerandavalidinspectionhadbeenmadewithinsixtydaysofthe 29 purchasedate,thenewownershallbeabletoutilizeaninspectionperformed 30 withinninetydayspriortotheapplicationforregistrationortransfer.Any 31 vehiclemanufacturedasaneven-numberedmodelyearvehicleshallbe 32 inspectedandapprovedpursuanttothesafetyinspectionprogramestablished 33 pursuanttosections307.350to307.390ineacheven-numberedcalendaryear 34 andanysuchvehiclemanufacturedasanodd-numberedmodelyearvehicle 35 shallbeinspectedandapprovedpursuanttosections307.350to307.390in 36 eachodd-numberedyear.Thecertificateofinspectionandapprovalshallbea 37 sticker,seal,orotherdeviceorcombinationthereof,asthesuperintendentof 38 theMissouristatehighwaypatrolprescribesbyregulationandshallbe 39 displayeduponthemotorvehicleortrailerasprescribedbytheregulations 40 establishedbyhim.Thereplacementofcertificatesofinspectionandapproval 41 whicharelostordestroyedshallbemadebythesuperintendentofthe 42 Missouristatehighwaypatrolunderregulationsprescribedbyhim. 43 2.Forthepurposeofobtaininganinspectiononly,itshallbelawfulto 44 operateavehicleoverthemostdirectroutebetweentheowner'susualplaceof 45 residenceandaninspectionstationofsuchowner'schoice,notwithstanding 46 thefactthatthevehicledoesnothaveacurrentstateregistrationlicense.It 47 shallalsobelawfultooperatesuchavehiclefromaninspectionstationto 48 anotherplacewhererepairsmaybemadeandtoreturnthevehicletothe 49 inspectionstationnotwithstandingtheabsenceofacurrentstateregistration 50 license. 51 3.Nopersonwhosemotorvehiclewasdulyinspectedandapprovedas 52 providedinthissectionshallberequiredtohavethesamemotorvehicleagain 53 inspectedandapprovedforthesolereasonthatsuchpersonwishestoobtaina 54 setofanyspecialpersonalizedlicenseplatesavailablepursuanttosection 55 301.144orasetofanylicenseplatesavailablepursuanttosection301.142, 56 priortotheexpirationdateofsuchmotorvehicle'scurrentregistration. 57 4.Notwithstandingtheprovisionsofsection307.390,violationofthis 58 sectionshallbedeemedaninfraction.] [307.353.Otherprovisionsoflawnotwithstanding,nopersonshallbe 2 requiredtohaveabiennialvehicleinspectionduringaregistrationperiod 3 whichexceedstwoyears.Theinspectionrequiredatthebeginningofthe 4 registrationperiodshallbevalidfortheentireregistrationperiod.] [307.355.1.Nostateregistrationlicensetooperatethetypeofvehicle 2 requiredtobeinspectedbysection307.350maybetransferredorissued 3 duringabiennialregistrationyearinwhichthevehicleisrequiredtobe 4 inspectedunlesstheapplicationisaccompaniedbyacertificateofinspection 5 andapprovalissuednomorethansixtydayspriortothedateofapplication,or 6 inthecaseofschoolbuses,whichwillberequiredtobeinspectedannuallyas 7 providedinsection307.375,except: HB1069 31 8 (1)Thedirectorofrevenuemaytransferorissueastateregistration 9 licensetothetypeofvehiclerequiredtobeinspectedbysection307.350 10 withoutacertificateofinspectionandapprovalaccompanyingtheapplication 11 ifthedirectorhassatisfactoryevidencethatthevehiclewasnotinthestateof 12 Missouriatanytimeduringthesixtydayspriortothedateofapplication; 13 however,theownerofeverysuchvehiclemustsubmitthevehiclefor 14 inspectionandobtainacertificateofinspectionandapprovalwithintendays 15 afterthevehicleisfirstreturnedtothestateofMissouri; 16 (2)Thedirectorofrevenueshallrenewavehicle'sregistrationlicense 17 withoutacertificateofinspectionandapprovalaccompanyingtheapplication 18 ifsatisfactorydocumentaryevidenceispresentedatthetimeofapplication 19 thatthelicensebeingrenewedwasproperlytransferredwithinasix-month 20 periodpriortotheexpirationofthelicensebeingrenewedorthatthevehicle 21 forwhichtheregistrationisbeingissuedwasissuedaregistrationforaperiod 22 oflessthanoneyearfortheregistrationperiodjustexpiring. 23 2.Ifduetointerstateoperationacommercialmotorvehicleasdefined 24 insection301.010oratrailerofthetyperequiredtobeinspectedisrequiredto 25 obtainfullfeeregistrationinthisandanyotherstateduringthesamecalendar 26 year,noMissouricertificateofinspectionandapprovalisrequiredifthe 27 vehiclebearsevidencethatacurrentvalidinspectionstickerordecalwas 28 issuedbysuchotherstateinwhichthevehicleisregistered;providedthatthe 29 stickerordecalissuedbysuchotherstateisvalidfortheregistrationperiodin 30 thisstate. 31 3.Afteracommercialmotorvehicleasdefinedinsection301.010has 32 beenregisteredforthecurrentyear,nocertificateofinspectionandapprovalis 33 requiredwhenalocalcommercialmotorvehiclelicenseischangedtoa 34 beyond-localcommercialmotorvehiclelicenseorwhenthelicensedgross 35 weightischangedduringthelicensedperiod.] [307.380.1.Everyvehicleofthetyperequiredtobeinspectedupon 2 havingbeeninvolvedinanaccidentandwhensodirectedbyapoliceofficer 3 mustbeinspectedandanofficialcertificateofinspectionandapproval, 4 sticker,sealorotherdevicebeobtainedforsuchvehiclebeforeitisagain 5 operatedonthehighwaysofthisstate.Attheseller'sexpenseeveryused 6 motorvehicleofthetyperequiredtobeinspectedbysection307.350shall 7 immediatelypriortosalebefullyinspectedregardlessofanycurrent 8 certificateofinspectionandapproval,andanappropriatenewcertificateof 9 inspectionandapproval,sticker,sealorotherdeviceshallbeobtained. 10 2.Nothingcontainedintheprovisionsofthissectionshallbe 11 construedtoprohibitadealeroranyotherpersonfromsellingavehicle 12 withoutacertificateofinspectionandapprovalifthevehicleissoldforjunk, 13 salvage,orforrebuilding,orforvehiclessoldatpublicauctionorfromdealer 14 todealer.Thepurchaserofanyvehiclewhichispurchasedforjunk,salvage, 15 orforrebuildingshallgivetotheselleranaffidavit,onaformprescribedby 16 thesuperintendentoftheMissouristatehighwaypatrol,statingthatthevehicle 17 isbeingpurchasedforoneofthereasonsstatedherein.Novehicleofthetype 18 requiredtobeinspectedbysection307.350whichispurchasedasjunk, 19 salvage,orforrebuildingshallagainberegisteredinthisstateuntiltheowner HB1069 32 20 hassubmittedthevehicleforinspectionandobtainedanofficialcertificateof 21 inspectionandapproval,sticker,sealorotherdeviceforsuchvehicle. 22 3.Notwithstandingtheprovisionsofsection307.390,violationofthis 23 sectionshallbedeemedaninfraction.] [307.402.Allstateagenciesowningmotorvehiclesshallbe 2 responsibleforobtaininganinspectionofeachoftheirvehicle'smechanism 3 andequipmentinaccordancewiththeprovisionsofsections307.350to 4 307.402andobtainingacertificateofinspectionandapprovalandasticker, 5 sealorotherdevicefromadulyauthorizedofficialinspectionstation.] SectionB.SectionAofthisactshallbecomeeffectiveJanuary1,2026. ✔ HB1069 33
