301.020.1.Everyownerofamotorvehicleortrailer,whichshallbeoperatedor
2drivenuponthehighwaysofthisstate,exceptashereinotherwiseexpresslyprovided,shall
3annuallyfile,bymailorotherwise,intheofficeofthedirectorofrevenue,anapplicationfor
4registrationonablanktobefurnishedbythedirectorofrevenueforthatpurposecontaining:
5 (1)Abriefdescriptionofthemotorvehicleortrailertoberegistered,includingthe
6nameofthemanufacturer,thevehicleidentificationnumber,theamountofmotivepowerof
7themotorvehicle,statedinfiguresofhorsepowerandwhetherthemotorvehicleistobe
8registeredasamotorvehicleprimarilyforbusinessuseasdefinedinsection301.010;
9 (2)Thename,theapplicant'sidentificationnumberandaddressoftheownerofsuch
10motorvehicleortrailer;

13 2.Ifthevehicleisamotorvehicleprimarilyforbusinessuseasdefinedinsection
14301.010andifsuchvehicleistenyearsofageorlessandhaslessthanonehundredfifty
15thousandmilesontheodometer,thedirectorofrevenueshallretaintheodometerinformation
16provided[inthevehicleinspectionreport] bytheownerofthevehicle, andprovidefor
17promptaccesstosuchinformation,togetherwiththevehicleidentificationnumberforthe
18motorvehicletowhichsuchinformationpertains,foraperiodoftenyearsafterthereceiptof
19suchinformation.Thissectionshallnotapplyunless:
20 (1)Theapplicationforthevehicle'scertificateofownershipwassubmittedafterJuly
211,1989;and
22 (2)Thecertificatewasissuedpursuanttoamanufacturer'sstatementoforigin.
23 3.Ifthevehicleisanymotorvehicleotherthanamotorvehicleprimarilyforbusiness
24use,arecreationalmotorvehicle,motorcycle,motortricycle,autocycle,bus,orany
25commercialmotorvehiclelicensedforovertwelvethousandpoundsandifsuchmotor
26vehicleistenyearsofageorlessandhaslessthanonehundredfiftythousandmilesonthe
27odometer,thedirectorofrevenueshallretaintheodometerinformationprovided[inthe
28vehicleinspectionreport] bytheownerofthevehicle, andprovideforpromptaccesstosuch
29information,togetherwiththevehicleidentificationnumberforthemotorvehicletowhich
30suchinformationpertains,foraperiodoftenyearsafterthereceiptofsuchinformation.This
31subsectionshallnotapplyunless:
32 (1)Theapplicationforthevehicle'scertificateofownershipwassubmittedafterJuly
331,1990;and
34 (2)Thecertificatewasissuedpursuanttoamanufacturer'sstatementoforigin.
35 4.Ifthevehiclequalifiesasareconstructedmotorvehicle,motorchangevehicle,
36speciallyconstructedmotorvehicle,non-USA-stdmotorvehicle,asdefinedinsection
37301.010,orpriorsalvageasreferencedinsection301.573,theownerorlienholdershall
38surrenderthecertificateofownership.Theownershallmakeanapplicationforanew
39certificateofownership,paytherequiredtitlefee,andobtainthevehicleexamination
40certificaterequiredpursuanttosubsection9ofsection301.190.Ifaninsurancecompany
41paysaclaimonasalvagevehicleasdefinedinsection301.010andtheownerretainsthe
42vehicle,aspriorsalvage,thevehicleshallonlyberequiredtomeettheexamination
43requirementsundersubsection10ofsection301.190.Notarizedbillsofsalealongwitha
44copyofthefrontandbackofthecertificateofownershipforallmajorcomponentparts
45installedonthevehicleandinvoicesforallessentialpartswhicharenotdefinedasmajor
46componentpartsshallaccompanytheapplicationforanewcertificateofownership.Ifthe
47vehicleisaspeciallyconstructedmotorvehicle,asdefinedinsection301.010,twopicturesof
HB1069	2 48thevehicleshallbesubmittedwiththeapplication.Ifthevehicleisakitvehicle,the
49applicantshallsubmittheinvoiceandthemanufacturer'sstatementoforiginonthekit.Ifthe
50vehiclerequirestheissuanceofaspecialnumberbythedirectorofrevenueorareplacement
51vehicleidentificationnumber,theapplicantshallsubmittherequiredapplicationand
52applicationfee.Allapplicationsrequiredunderthissubsectionshallbesubmittedwithany
53applicabletaxeswhichmaybedueonthepurchaseofthevehicleorparts.Thedirectorof
54revenueshallappropriatelydesignate"ReconstructedMotorVehicle","MotorChange
55Vehicle","Non-USA-StdMotorVehicle",or"SpeciallyConstructedMotorVehicle"onthe
56currentandallsubsequentissuesofthecertificateofownershipofsuchvehicle.
57 5.Everyinsurancecompanythatpaysaclaimforrepairofamotorvehiclewhichas
58theresultofsuchrepairsbecomesareconstructedmotorvehicleasdefinedinsection301.010
59orthatpaysaclaimonasalvagevehicleasdefinedinsection301.010andtheowneris
60retainingthevehicleshallinwritingnotifytheownerofthevehicle,andinafirstpartyclaim,
61thelienholderifalienisineffect,thatheisrequiredtosurrenderthecertificateofownership,
62andthedocumentsandfeesrequiredpursuanttosubsection4ofthissectiontoobtainaprior
63salvagemotorvehiclecertificateofownershipordocumentsandfeesasotherwiserequired
64bylawtoobtainasalvagecertificateofownership,fromthedirectorofrevenue.The
65insurancecompanyshallwithinthirtydaysofthepaymentofsuchclaimsreporttothe
66directorofrevenuethenameandaddressofsuchowner,theyear,make,model,vehicle
67identificationnumber,andlicenseplatenumberofthevehicle,andthedateoflossand
68payment.
69 6.Anyonewhofailstocomplywiththerequirementsofthissectionshallbeguiltyof
70aclassBmisdemeanor.
71 7.Anapplicantforregistrationmaymakeadonationofonedollartopromotea
72blindnesseducation,screeningandtreatmentprogram.Thedirectorofrevenueshallcollect
73thedonationsanddepositallsuchdonationsinthestatetreasurytothecreditoftheblindness
74education,screeningandtreatmentprogramfundestablishedinsection209.015.Moneysin
75theblindnesseducation,screeningandtreatmentprogramfundshallbeusedsolelyforthe
76purposesestablishedinsection209.015;exceptthatthedepartmentofrevenueshallretainno
77morethanonepercentforitsadministrativecosts.Thedonationprescribedinthissubsection
78isvoluntaryandmayberefusedbytheapplicantforregistrationatthetimeofissuanceor
79renewal.Thedirectorshallinquireofeachapplicantatthetimetheapplicantpresentsthe
80completedapplicationtothedirectorwhethertheapplicantisinterestedinmakingtheone
81dollardonationprescribedinthissubsection.
82 8.Anapplicantforregistrationmaymakeadonationofanamountnotlessthanone
83dollartopromoteanorgandonorprogram.Thedirectorofrevenueshallcollectthedonations
84anddepositallsuchdonationsinthestatetreasurytothecreditoftheorgandonorprogram
HB1069	3 85fundasestablishedinsections194.297to194.304.Moneysintheorgandonorfundshallbe
86usedsolelyforthepurposesestablishedinsections194.297to194.304,exceptthatthe
87departmentofrevenueshallretainnomorethanonepercentforitsadministrativecosts.The
88donationprescribedinthissubsectionisvoluntaryandmayberefusedbytheapplicantfor
89registrationatthetimeofissuanceorrenewal.Thedirectorshallinquireofeachapplicantat
90thetimetheapplicantpresentsthecompletedapplicationtothedirectorwhethertheapplicant
91isinterestedinmakingacontributionnotlessthanonedollarasprescribedinthissubsection.
92 9.AnapplicantforregistrationmaymakeadonationofonedollartotheMissouri
93medalofhonorrecipientsfund.Thedirectorofrevenueshallcollectthedonationsand
94depositallsuchdonationsinthestatetreasurytothecreditoftheMissourimedalofhonor
95recipientsfundasestablishedinsection226.925.Moneysinthemedalofhonorrecipients
96fundshallbeusedsolelyforthepurposesestablishedinsection226.925,exceptthatthe
97departmentofrevenueshallretainnomorethanonepercentforitsadministrativecosts.The
98donationprescribedinthissubsectionisvoluntaryandmayberefusedbytheapplicantfor
99registrationatthetimeofissuanceorrenewal.Thedirectorshallinquireofeachapplicantat
100thetimetheapplicantpresentsthecompletedapplicationtothedirectorwhethertheapplicant
101isinterestedinmakingtheonedollardonationprescribedinthissubsection.
301.032.1.Notwithstandingtheprovisionsofsections301.030and301.035tothe
2contrary,thedirectorofrevenueshallestablishasystemofregistrationofallfleetvehicles
3ownedorpurchasedbyafleetownerregisteredpursuanttothissection.Thedirectorof
4revenueshallprescribetheformsforsuchfleetregistrationandtheformsandproceduresfor
5theregistrationupdatesprescribedinthissection.Anyowneroftenormoremotorvehicles
6whichmustberegisteredinaccordancewiththischaptermayregisterasafleetowner.All
7registeredfleetownersmay,attheiroption,registerallmotorvehiclesincludedinthefleeton
8acalendaryearorbiennialbasispursuanttothissectioninlieuoftheregistrationperiods
9providedinsections301.030,301.035,and301.147.Thedirectorshallissueanidentification
10numbertoeachregisteredowneroffleetvehicles.
11 2.Allfleetvehiclesincludedinthefleetofaregisteredfleetownershallberegistered
12duringAprilofthecorrespondingyearoronaproratedbasisasprovidedinsubsection3of
13thissection.Feesofallvehiclesinthefleettoberegisteredonacalendaryearbasisorona
14biennialbasisshallbepayablenotlaterthanthelastdayofAprilofthecorrespondingyear,
15withtwoyears'feesdueforbiennially-registeredvehicles.[Notwithstandingtheprovisions
16ofsection307.355,anapplicationforregistrationofafleetvehiclemustbeaccompaniedbya
17certificateofinspectionandapprovalissuednomorethanonehundredtwentydayspriorto
18thedateofapplication.] Thefeesforvehiclesaddedtothefleetwhichmustbelicensedatthe
19timeofregistrationshallbepayableatthetimeofregistration,exceptthatwhensuchvehicle
20islicensedbetweenJulyfirstandSeptemberthirtieththefeeshallbethree-fourthstheannual
HB1069	4 21fee,whenlicensedbetweenOctoberfirstandDecemberthirty-firstthefeeshallbeone-half
22theannualfeeandwhenlicensedonorafterJanuaryfirstthefeeshallbeone-fourththe
23annualfee.Whenbiennialregistrationissoughtforvehiclesaddedtoafleet,anadditional
24year'sannualfeewillbeaddedtothepartialyear'sproratedfee.
25 3.Atanytimeduringthecalendaryearinwhichanownerofafleetpurchasesor
26otherwiseacquiresavehiclewhichistobeaddedtothefleetortransfersplatestoafleet
27vehicle,theownershallpresenttothedirectorofrevenuetheidentificationnumberasafleet
28numberandmayregisterthevehicleforthepartialyearasprovidedinsubsection2ofthis
29section.Thefleetownershallalsobechargedatransferfeeoftwodollarsforeachvehicleso
30transferredpursuanttothissubsection.
31 4.Exceptasspecificallyprovidedinthissubsection,allfleetvehiclesregistered
32pursuanttothissectionshallbeissuedaspeciallicenseplatewhichshallhavethewords
33"FleetVehicle"inplaceofthewords"Show-MeState"inthemannerprescribedbythe
34advisorycommitteeestablishedinsection301.129.Alternatively,foraone-timeadditional
35fivedollarper-vehiclefeebeyondtheregularregistrationfee,afleetownerofatleastfifty
36fleetvehiclesmayapplyforfleetlicenseplatesbearingacompanynameorlogo,thesizeand
37designthereofsubjecttoapprovalbythedirector.Allfleetlicenseplatesshallbemadewith
38fullyreflectivematerialwithacommoncolorschemeanddesign,shallbeclearlyvisibleat
39night,andshallbeaestheticallyattractive,asprescribedbysection301.130.Fleetvehicles
40shallbeissuedmultiyearlicenseplatesasprovidedinthissectionwhichshallnotrequire
41issuanceofarenewaltab.Uponpaymentofappropriateregistrationfees,thedirectorof
42revenueshallissuearegistrationcertificateorothersuitableevidenceofpaymentofthe
43annualorbiennialfee,andsuchevidenceofpaymentshallbecarriedatalltimesinthe
44vehicleforwhichitisissued.
45 5.[Notwithstandingtheprovisionsofsections307.350to307.390tothecontrary,a
46fleetvehicleregisteredinMissouriisexemptfromtherequirementsofsections307.350to
47307.390ifatthetimeoftheannualfleetregistration,suchfleetvehicleissituatedoutsidethe
48stateofMissouri.
49 6.](1)Notwithstandinganyotherprovisionsoflawtothecontrary,anyperson,
50company,orcorporationengagedinthebusinessofrentingorleasingthreethousandfive
51hundredormoremotorvehicleswhicharetobeusedexclusivelyforrentalorleasing
52purposesandnotforresalethathasappliedtothedirectorofrevenueforauthoritytooperate
53asaleaseorrentalcompanyasprescribedinsection144.070mayoperateasaregisteredfleet
54ownerasprescribedintheprovisionsofthissubsectiontosubsection[10]9ofthissection.
55 (2)Thedirectorofrevenuemayissuelicenseplatesafterpresentmentofan
56application,asdesignedbythedirector,andpaymentofanannualfeeofthreehundredsixty
57dollarsforthefirsttenplatesandthirty-sixdollarsforeachadditionalplate.Thepaymentand
HB1069	5 58issuanceofsuchplatesshallbeinlieuofregisteringeachmotorvehiclewiththedirectoras
59otherwiseprovidedbylaw.
60 (3)Theregistrationfeesforvehiclesintheregisteredfleetowner'sfleetshallbefully
61payableatthetimesuchplatesareordered,exceptthatwhensuchplateisorderedafterthe
62firstmonthofregistration,thefeespayableshallbeproratedbythemonththeplateswere
63ordered.Whenbiennialregistrationissought,anadditionalyear'sannualfeeshallbeadded
64tothepartialyear'sproratedfee.
65 (4)Suchmotorvehicleswithinthefleetshallnotbeexemptedfromthe[safety
66inspectionand]emissionsinspectionprovisionsasprescribedin[chapters307and]chapter
67643,but[notwithstandingtheprovisionsofsection307.355,] suchinspectionsshallnotbe
68requiredtobepresentedtothedirectorofrevenue.
69 [7.]6.Arecipientofaleaseorrentalcompanylicenseissuedbythedirectorof
70revenueasprescribedinsection144.070operatingasaregisteredfleetownerunderthis
71sectionshallregistersuchfleetwiththedirectorofrevenueonanannualorbiennialbasisin
72lieuoftheindividualmotorvehicleregistrationperiodsasprescribedinsections301.030,
73301.035,and301.147.Ifanapplicantelectsabiennialfleetregistration,theannualfleet
74licenseplatefeesprescribedinsubdivision(1)ofsubsection[6]5ofthissectionshallbe

91Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatiscreatedunder
92theauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplieswithandis
93subjecttoalltheprovisionsofchapter536and,ifapplicable,section536.028.Thissection
94andchapter536arenonseverableandifanyofthepowersvestedwiththegeneralassembly

301.074.Licenseplatesissuedundersections301.071to301.075shallbevalidfor
2thedurationoftheveteran'sdisability.Eachsuchapplicantissuedlicenseplatesunderthese
3provisionsshallannuallyfurnish[proofofvehicleinspectionand]proofofdisabilitytothe
4director,exceptthatanapplicantwhoseserviceconnecteddisabilityqualifyinghimfor
5speciallicenseplatesconsistsinwholeorinpartoflossofaneyeoralimboranapplicant
6withaonehundredpercentpermanentdisability,asestablishedbyaphysician'ssigned
7statementtothateffect,needonlyfurnishproofofdisabilitytothedirectorwheninitially
8applyingforthespeciallicenseplatesandnotthereafter,butinsuchcaseproofthatthe
9veteranisaliveshallberequiredannually.Nocommercialmotorvehicleinexcessoftwenty-
10fourthousandpoundsgrossweightmaybelicensedundertheprovisionsofsections301.071
11to301.075.
301.132.1.Forpurposesofthissection,"streetrod"isavehicleolderthan1949ora
2vehiclemanufacturedafter1948toresembleavehiclemanufacturedbefore1949;andhas
3beenalteredfromthemanufacturer'soriginaldesignorhasabodyconstructedfrom
4nonoriginalmaterials.
5 2.Themodelyearandtheyearofmanufacturethatarelistedonthecertificateoftitle
6ofastreetrodvehicleshallbethemodelyearandyearofmanufacturethatthebodyofsuch
7vehicleresembles.Thecurrentandallsubsequentcertificatesofownershipshallbe
8designatedwiththeword"REPLICA".
9 3.Foreachstreetrod,thereshallbeanannualfeeequaltothefeechargedfor
10personalizedlicenseplatesinsection301.144inadditiontotheregularannualregistration
11fees.
12 4.Inapplyingforregistrationofastreetrodpursuanttothissection,theownerofthe
13streetrodshallsubmitwiththeapplicationacertificationthatthevehicleforwhichthe
14applicationismade:
15 (1)Willbemaintainedforoccasionaltransportation,exhibitions,clubactivities,
16parades,tours,andsimilaruses;
17 (2)Willnotbeusedforgeneraldailytransportation.
18 5.[Inadditiontothecertificationrequiredpursuanttosubsection4ofthissection,
19whenapplyingforregistrationofastreetrod,thenewownerofthestreetrodshallprovide
20proofthatthestreetrodpassedasafetyinspectioninaccordancewithsection307.350that
21shallbeapprovedbythedepartmentofpublicsafetyinconsultationwiththestreetrod
22communityinthisstate.

24ofrevenueshallissuetotheownertwolicenseplatescontainingthenumberassignedtothe
25registrationcertificateissuedbythedirectorofrevenue,andthefollowingwords:"STREET
26ROD","STATEOFMISSOURI".Suchlicenseplatesshallbekeptsecurelyattachedtothe
27motorvehicleregisteredpursuanttothissection.Thedirectorofrevenueshalldeterminethe
28characteristicfeaturesofsuchlicenseplatesforvehiclesregisteredpursuanttotheprovisions
29ofthissectionsothattheymayberecognizedassuch,exceptthatsuchlicenseplatesshallbe
30madewithfullyreflectivematerialwithacommoncolorschemeanddesign,shallbeclearly
31visibleatnight,andshallbeaestheticallyattractive,asprescribedbysection301.130.
32 [7.]6.Unlessthepresenceoftheequipmentwasspecificallyrequiredbyastatuteof
33thisstateasaconditionofsaleintheyearlistedastheyearofmanufactureonthecertificate
34oftitle,thepresenceofanyspecificequipmentisnotrequiredfortheoperationofavehicle

44 (2)Hasbeenalteredfromthemanufacturer'soriginaldesign,orhasanentirebody
45constructedfromnonoriginalmaterials.
46 [10.]9.Themodelyearandtheyearofmanufacturethatarelistedonthecertificate
47oftitleofacustomvehicleshallbethemodelyearandyearofmanufacturethatthebodyof
48suchvehicleresembles.Thecurrentandallsubsequentcertificatesofownershipshallbe
49designatedwiththeword"REPLICA".
50 [11.]10.Foreachcustomvehicle,thereshallbeanannualfeeequaltothefee
51chargedforpersonalizedlicenseplatesinsection301.144inadditiontotheregularannual
52registrationfees.
53 [12.]11.Inapplyingforregistrationofacustomvehiclepursuanttothissection,the
54ownerofthecustomvehicleshallsubmitwiththeapplicationacertificationthatthevehicle
55forwhichtheapplicationismade:
56 (1)Willbemaintainedforoccasionaltransportation,exhibits,clubactivities,parades,
57tours,andsimilaruses;and
58 (2)Willnotbeusedforgeneraldailytransportation.

84Missourisalvagecertificateoftitlehasbeenissuedforthesamevehiclebutnoprior
85inspectionandverificationhasbeenmadeinthisstate,exceptthatifsuchvehiclehasbeen
86inspectedinanotherstatebyalawenforcementofficerinamannercomparabletothe
87inspectionprocessinthisstateandthevehicleidentificationnumbershavebeensoverified,
88theapplicantshallnotbeliableforthetwenty-fivedollarinspectionfeeifsuchapplicant

4revenue,otherlawsregulatinglicensingofmotorvehiclestothecontrarynotwithstanding.
5 2.Suchinstitutionshallfileanapplicationinaformprescribedbythedirector,
6verifiedbyaffidavit,thatsuchvehiclemeetstherequirementsofsubsection1ofthissection.
7 3.Theplateissuedbythedirectorshallbethecollegiateplateoftheinstitutionand
8shalldisplaytheterm"solar"inamannerprescribedbythedirector.
9 4.Theinstitutionshallpaytheapplicablefeesasdeterminedbythedirector.
10 5.Suchmotorvehicleshallbeexemptfromthe[inspectionsrequiredbysection
11307.350and]inspectionrequiredundersection643.315andshallonlybeoperatedonthe
12streetsandhighwayswiththeapprovaloftheinstitutionofhighereducation.
307.360.1.ThesuperintendentoftheMissouristatehighwaypatrolshallissue
2permitsandwritteninstructionstoofficialinspectionstationsandshallfurnishformsand
3certificatesforthe[inspectionofbrakes,lightingequipment,signalingdevices,steering
4mechanisms,horns,mirrors,windshieldwipers,tires,wheels,exhaustsystem,glazing,air

6Innoinstancewillroadtestingofavehiclebeconsideredapartoftheinspectionprocedure]

8vehiclespresentedforinspection.
9 2.ThesuperintendentoftheMissouristatehighwaypatrolshallprescribethe
10standardsandequipmentnecessaryforanofficialinspectionstationandthequalificationsfor
11personswhoconducttheinspections,andnoapplicantmaybeapprovedtooperateanofficial
12inspectionstationuntiltheapplicantmeetsthestandardsandhastherequiredequipmentand
13qualifiedinspectorsasprescribed.ThesuperintendentoftheMissouristatehighwaypatrol
14shallestablishstandardsandprocedurestobefollowedinthemakingofinspectionsrequired
15bysections[307.350] 307.360to307.390andshallprescriberulesandregulationsforthe
16operationofthestations.
17 3.(1)Theapplicationforpermitasanofficialinspectionstationshallbemadetothe
18superintendentoftheMissouristatehighwaypatrolonaformfurnishedbythe
19superintendent.Thefeeforapermittooperateanofficialinspectionstationshallbeten
20dollarsperyearandeachpermitshallberenewedannuallyonthedateofissue.Allfeesshall
21bepayabletothedirectorofrevenueandshallbedepositedbyhiminthestatetreasurytothe
22creditofthestatehighwayfund.
23 (2)Theapplicationshallsetforththenameunderwhichapplicanttransactsorintends
24totransactbusiness,thelocationoftheapplicant'splaceofbusinessandsuchother
25informationasthesuperintendentoftheMissouristatehighwaypatrolmayrequire.Ifthe
26applicanthasorintendstohavemorethanoneplaceofbusinesswithinthestate,aseparate
27applicationshallbemadeforeachplaceofbusiness.Iftheapplicantisapartnership,the
28applicationshallsetforththenamesofthepartners;ifacorporation,thenamesoftheofficers
29shallbeshown.Theapplicationshallbesignedandverifiedbyoathoraffirmationofthe
30owneroranauthorizedofficerorpartner.
31 (3)EachlocationwhichfulfillsthesuperintendentoftheMissouristatehighway
32patrol'srequirementsandwhoseowners,proprietorsandemployeescomplywiththe
33superintendent'sregulationsandqualificationsshallbedesignatedasanofficialinspection
34stationandtheapplicantissuedacertificate.ThesuperintendentoftheMissouristate
35highwaypatrolshallinvestigateallapplicantsforinspectionstationpermitstodetermine
36whetherornotthepremises,equipmentandpersonnelmeettherequirementsprescribedby
37him.
38 (4)Anyautomobilemechanicwhohashadatleastoneyearofpracticalexperienceas
39anautomotivemechanicoranypersonwhohassuccessfullycompletedacourseofvocational
40instructioninautomotivemechanicsfromagenerallyrecognizededucationalinstitution,
41eitherpublicorprivate,andwhohasdemonstratedtheknowledgeandabilitytoconductan

43Missouristatehighwaypatrolmaybeissuedapermittoconductinspectionsatanyofficial
44inspectionstation.Nopersonwithoutavalidpermitshallconductanypartofaninspection[,
45exceptapersonwithoutavalidpermitmayassistintheinspectionofavehiclebyoperating
46thevehicle'slightingequipmentandsignalingdevices.ThesuperintendentoftheMissouri
47statehighwaypatrolmayrequireamechanictobereexaminedatanytimetodeterminethe
48mechanic'sknowledgeandabilitytoconductaninspection.Ifthemechanicfailsthe
49reexaminationorrefusestobereexamined,thepermitissuedtothemechanicshallbe
50suspendeduntilthemechanicpassestheexaminationbutundernocircumstancescanthe
51mechanicagainbetesteduntilaperiodofthirtydayshaselapsed]. Nofeeshallbecharged
52forthepermitandthepermitshallremainvalidforaperiodofthreeyearsfromthedateof
53issueoruntilsuspendedorrevokedbythesuperintendentoftheMissouristatehighway
54patrol.
55 [(5)ThesuperintendentoftheMissouristatehighwaypatrolmayissueaprivate

5officialsignmadeofmetalorotherdurablematerialtobedisplayedinaconspicuouslocation
6todesignatethestationasanofficialinspectionstation.Additionalsignsmaybeobtainedby
7anofficialinspectionstationforafeeequaltothecosttothestate.Eachinspectionstation
8shallalsobesuppliedwithoneormoreposterswhichmustbedisplayedinaconspicuous
9locationattheplaceofinspectionandwhichinformsthepublicthatrequiredrepairsor
10correctionsneednotbemadeattheinspectionstation.
11 2.Nopersonoperatinganofficialinspectionstationpursuanttotheprovisionsof

10vehicleinspectionlawsandregulations.Amotorvehicleinspectorshallnothaveauthorityto
11exercisethepowergrantedinthissubsectionuntilsuchinspectorsuccessfullycompletes
12trainingprovidedby,andtothesatisfactionof,thesuperintendent.
643.303.1.BeginningSeptember1,2007,emissionsinspectionsrequiredbysections
2643.300to643.355shallbeconductedthroughadecentralizedemissionsprogramthatmeets
3therequirementsofthissection.PriortoSeptember1,2007,theairconservationcommission
4shalldevelopadecentralizedemissionsinspectionprogramthatallowsofficialinspection
5stationstoconducton-boarddiagnosticemissioninspectionsof1996modelyearandnewer
6motorvehiclesequippedwithon-boarddiagnosticsystemsmeetingthefederalEnvironmental
7ProtectionAgencyOn-BoardDiagnosticsII(OBDII)standards.Thedecentralizedemissions
8inspectionprogramshall,ataminimum,provideforthefollowing:
9 (1)Theperiodicinspectionofcertainmotorvehiclesasrequiredundersection
10643.315;
11 (2)Thecertificationandoperationofofficialemissionsinspectionstationsandthe
12licensingofemissioninspectors;
13 (3)Thetestingofmotorvehiclesthroughon-boarddiagnostictestingtechnologies;
14 (4)Thetraining,certification,andsupervisionofemissioninspectorsandother
15personnel;and
16 (5)Proceduresforcertifyingtestresultsandforreportingandmaintainingrelevant
17datarecords.
18 2.Inadditiontoanyothercriteriaestablishedbythecommissionundersection
19643.320orbyrule,thedecentralizedemissionsinspectionprogramshallallowanyofficial
20inspectionstationlocatedinanareadescribedinsubsection1ofsection643.305otherwise
21qualifiedbytheMissouristatehighwaypatroltoconductmotorvehicle[safety] inspections
22undersection307.360toconducton-boarddiagnosticemissioninspections.Anymotor

24anapplicationforacertificateofauthorizationtothecommissionasprovidedforunder

26vehiclesafetyinspections] mayconductemissioninspectionsprovidedtheymeetthe
27qualificationssetforthinsections643.300to643.355and[the]rulespromulgatedbythe
28commission.Applicationsshallbemadeuponaformdesignatedbythecommissionand
29shallcontainsuchinformationasmayberequiredbythecommission.Acertificateof
30authorizationissuedundersection643.320toconductemissioninspectionsshallbeissued
31onlyafterthecommissionhasmadeadeterminationthattheapplicant'sproposedinspection
32stationwillbeproperlyequipped,hasthenecessarylicensedemissioninspectorstoconduct
33inspections,andmeetsallotherrequirementsofsections643.300to643.355orrules
34promulgatedtocarryouttheprovisionsofthosesections.
35 3.Thedecentralizedemissionsinspectionprogramshallallowanyofficialemissions
36inspectionstationthatiscertifiedtoconductanon-boarddiagnosticemissioninspection
37undersections643.300to643.355torepairmotorvehiclesinordertobringsuchvehiclesinto
38compliancewithsections643.300to643.355,ifsuchstationandpersonnelmeetthe
39qualificationstoconductemissionrepairsassetforthinsections643.300to643.355.An
40officialemissioninspectionstationmayelecttobeanemissionstest-onlystationormayelect
41toconductbothemissioninspectionsandrepairs.
42 4.Thecommissionisauthorizedtobegincertificationofofficialemissions
43inspectionstationspriortoSeptember1,2007,inordertoimplementthedecentralized
44emissionsinspectionprogram.PriortoJanuary1,2007,thedepartmentofnaturalresources
45shallissueareporttothegeneralassemblyandthegovernorregardingtheprogressof
46implementingthedecentralizedemissionsinspectionprogram.Thereportshallinclude,but
47notbelimitedto,asummarydescribinghowmanyinspectionstationsorindividualsthe
48departmentexpectstoparticipateintheprogramandhowmanyinspectionstationsor
49individualswillbequalifiedbySeptember1,2007,toconductsuchemissionsinspections.
50 5.Thecommissionmay,asapartofimplementingthedecentralizedemissions
51inspectionprogram,useremotesensingdevicestocollectinformationregardingthevehicle
52fleetemissionscharacteristicsandregistrationcompliancewithintheareadescribedin
53subsection1ofsection643.305.Thedecentralizedemissionsinspectionprogramestablished
54bythecommissionmayalsoincludeacleanscreenprogramthatutilizesremotesensing
55devices.Ownersofeligiblevehicleswhocomplywithcleanscreen/remotesensing
56proceduresshallbedeemedtohavecompliedwiththemandatoryinspectionrequirementsfor
57thenextinspectioncycle.Asusedinthissubsection,theterm"cleanscreenprogram"shall
58meanaprocedureorsystemthatutilizesremotesensingtechnologiestodeterminewhethera

74highwaypatrolshallenterintoaninteragencyagreementcoveringallaspectsofthe
75administrationandenforcementofsections643.300to643.355.
76 11.NolaterthanJuly1,2007,theairconservationcommissionshallpromulgaterules
77fortheimplementationofthissection.Anyruleorportionofarule,asthattermisdefinedin
78section536.010,thatiscreatedundertheauthoritydelegatedinthissectionshallbecome
79effectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter536and,if
80applicable,section536.028.Thissectionandchapter536arenonseverableandifanyofthe
81powersvestedwiththegeneralassemblyunderchapter536toreview,todelaytheeffective

85 12.PriortoSeptember1,2007,thedepartmentofnaturalresourcesshallactively
86promoteparticipationinthedecentralizedemissionsinspectionprogramamongqualified
87motorvehicledealers,servicestations,andotherindividuals.Aftertheimplementationofthe
88decentralizedemissioninspectionprogram,thedepartmentshallmonitorparticipationinsuch
89program.Indeterminingwhetherthereareasufficientnumberofindividualsconducting
90motorvehicleemissioninspectionsunderthedecentralizedprogram,thedepartmentshall
91attempttoensure,throughpromotionalefforts,thatnomorethantwentypercentofall
92personsresidingintheaffectednonattainmentarearesidefartherthanfivemilesfromthe
93nearestinspectionstation.
643.315.1.Exceptasprovidedinsections643.300to643.355,allmotorvehicles
2whicharedomiciled,registeredorprimarilyoperatedinanareaforwhichthecommission

12odd-numberedcalendaryear.Allmotorvehiclessubjecttotheinspectionrequirementsof
13sections643.300to643.355shalldisplayavalidemissionsinspectionsticker,andwhen
14applicable,avalidemissionsinspectioncertificateshallbepresentedatthetimeof
15registrationorregistrationrenewalofsuchmotorvehicle.Thedepartmentofrevenueshall
16requireevidenceof[thesafetyand]emissioninspectionandapprovalrequiredbythissection
17inissuingthemotorvehicleannualregistrationinconformitywiththeprocedurerequiredby
18[sections307.350to307.390and]sections643.300to643.355.Thedirectorofrevenuemay
19verifythatasuccessful[safetyand]emissionsinspectionwascompletedviaelectronicmeans.
20 2.Theinspectionrequirementofsubsection1ofthissectionshallapplytoallmotor

42 Missouristatehighwaypatrolunderregulationsprescribedbyhim.
43 2.Forthepurposeofobtaininganinspectiononly,itshallbelawfulto
44 operateavehicleoverthemostdirectroutebetweentheowner'susualplaceof
45 residenceandaninspectionstationofsuchowner'schoice,notwithstanding
46 thefactthatthevehicledoesnothaveacurrentstateregistrationlicense.It
47 shallalsobelawfultooperatesuchavehiclefromaninspectionstationto
48 anotherplacewhererepairsmaybemadeandtoreturnthevehicletothe
49 inspectionstationnotwithstandingtheabsenceofacurrentstateregistration
50 license.
51 3.Nopersonwhosemotorvehiclewasdulyinspectedandapprovedas
52 providedinthissectionshallberequiredtohavethesamemotorvehicleagain
53 inspectedandapprovedforthesolereasonthatsuchpersonwishestoobtaina
54 setofanyspecialpersonalizedlicenseplatesavailablepursuanttosection
55 301.144orasetofanylicenseplatesavailablepursuanttosection301.142,
56 priortotheexpirationdateofsuchmotorvehicle'scurrentregistration.
57 4.Notwithstandingtheprovisionsofsection307.390,violationofthis

27 vehiclebearsevidencethatacurrentvalidinspectionstickerordecalwas
28 issuedbysuchotherstateinwhichthevehicleisregistered;providedthatthe
29 stickerordecalissuedbysuchotherstateisvalidfortheregistrationperiodin
30 thisstate.
31 3.Afteracommercialmotorvehicleasdefinedinsection301.010has
32 beenregisteredforthecurrentyear,nocertificateofinspectionandapprovalis
33 requiredwhenalocalcommercialmotorvehiclelicenseischangedtoa
34 beyond-localcommercialmotorvehiclelicenseorwhenthelicensedgross
35 weightischangedduringthelicensedperiod.]
[307.380.1.Everyvehicleofthetyperequiredtobeinspectedupon
2 havingbeeninvolvedinanaccidentandwhensodirectedbyapoliceofficer
3 mustbeinspectedandanofficialcertificateofinspectionandapproval,
4 sticker,sealorotherdevicebeobtainedforsuchvehiclebeforeitisagain
5 operatedonthehighwaysofthisstate.Attheseller'sexpenseeveryused
6 motorvehicleofthetyperequiredtobeinspectedbysection307.350shall
7 immediatelypriortosalebefullyinspectedregardlessofanycurrent
8 certificateofinspectionandapproval,andanappropriatenewcertificateof
9 inspectionandapproval,sticker,sealorotherdeviceshallbeobtained.
10 2.Nothingcontainedintheprovisionsofthissectionshallbe
11 construedtoprohibitadealeroranyotherpersonfromsellingavehicle
12 withoutacertificateofinspectionandapprovalifthevehicleissoldforjunk,
13 salvage,orforrebuilding,orforvehiclessoldatpublicauctionorfromdealer
14 todealer.Thepurchaserofanyvehiclewhichispurchasedforjunk,salvage,
15 orforrebuildingshallgivetotheselleranaffidavit,onaformprescribedby
16 thesuperintendentoftheMissouristatehighwaypatrol,statingthatthevehicle
17 isbeingpurchasedforoneofthereasonsstatedherein.Novehicleofthetype
