376.1260.1.Asusedinthissection,thefollowingtermsmean:
2 (1)"Cost-sharingrequirement",anydeductible,coinsurance,co-payment,or
3maximumlimitationontheapplicationofsuchdeductible,coinsurance,co-payment,or
4similarout-of-pocketexpense;
5 (2)"Geneticcounseling",theprovisionofservicestoindividuals,couples,
6families,andorganizationsbyoneormoreappropriatelytrainedindividualstoaddress
7thephysicalandpsychologicalissuesassociatedwiththeoccurrenceorriskof
8occurrenceofageneticdisorder,birthdefect,orgeneticallyinfluencedconditionor
9diseaseinanindividualorafamily;

14 2.Eachhealthbenefitplandelivered,issuedfordelivery,continued,orrenewed
15onorafterJanuary1,2026,shallprovidecoverageforgeneticcounselingandgenetic
16testingprovidedbyanindividualcertifiedbyanaccreditingbody,recognizedbythe
17departmentofcommerceandinsurance,toprovidegeneticcounselingandgenetic

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18testing.Thecoveragerequiredunderthissectionshallincludeallcostsassociatedwith
19geneticcounselingand,ifindicatedaftergeneticcounseling,ageneticlaboratorytestof
20genesforindividualsassessedtobeatanincreasedrisk,basedonaclinicalrisk
21assessmenttool,ofpotentiallyharmfulmutationsingenesduetoapersonalorfamily
22historyofcancer.
23 3.Nohealthbenefitplanorhealthcarriershallconsider,orrequestapprovalto
24consider,theresultsofanygenetictestingortheprovisionofgeneticcounseling
25providedinaccordancewiththissectionindeterminingeligibilityforcoverage,
26establishingpremiums,limitingcoverage,renewingcoverage,oranyotherunderwriting
27decision.Aviolationofthissubsectionshallconstituteaviolationofsection375.1303.
28 4.Nohealthbenefitplanshallimposeanycost-sharingrequirementwithrespect
29tocoveragerequiredunderthissection.Ifapplicationofthissectionwouldresultin
30healthsavingsaccountineligibilityunderSection223oftheInternalRevenueCodeof
311986,asamended,thissectionshallapplytohealthsavingsaccount-qualifiedhigh
32deductiblehealthplanswithrespecttoanycost-sharingundertheplansonlyafteran
33enrolleehassatisfiedtheminimumdeductibleunderSection223,exceptwithrespectto
34itemsorservicesthatarepreventivecareunderSection223(c)(2)(C)oftheInternal
35RevenueCodeof1986,asamended,inwhichcasetherequirementsofthissectionshall
36applyregardlessofwhethertheminimumdeductibleunderSection223hasbeen
37satisfied.
