HB1087--CIVILLIABILITYFOREMPLOYERSHIRINGEX-OFFENDERS SPONSOR: Gallick Thisbillestablishesthe"CivilLiabilityforEmployersHiringEx- OffendersAct",whichprovidesthatacauseofactioncannotbe broughtagainstanemployer,generalcontractor,premisesowner,or otherthirdpartyforhiringanemployeeorindependentcontractor whohasbeenconvictedofanoffense,excludingcertainviolentand sexualoffensesspecifiedinthebill. Inanactionfornegligenthiringagainstanemployer,general contractor,premisesowner,orotherthirdpartyforactsofan employeeorindependentcontractorthatisbasedonatheoryof liabilitynotcoveredbythisbill,thefactthattheemployeeor independentcontractorwasconvictedofanonviolent,nonsexual offensebeforetheemployeeorindependentcontractor'semployment orcontractualobligationwiththeemployer,generalcontractor, premisesowner,orotherthirdparty,willbeinadmissibleas evidence. Thebillwillnotprecludeanyexistingcauseofactionforfailure ofanemployertoprovideadequatesupervisionofanemployeeor independentcontractor,exceptthattheconvictionofanonviolent, nonsexualoffensecanonlybeadmissibleasevidenceinsuchaction baseduponconditionsdescribedinthebill. Thebillsetsforthcertaingroundswhereprotectionsdonotapply toanemployer,generalcontractor,premisesowner,orthirdparty inanactionthatisbrought. Theprovisionsofthisbillwillnotbeinterpretedasimplyinga causeofactionexistsfornegligenthiringofanindividual convictedofanoffenseinsituationsnotcoveredinthebill.
