Thisbillrequiresthatanoriginalequipmentmanufacturerof
motorcyclesandpartsformotorcyclesmakeavailable,onfairand
reasonableterms,toanyindependentrepairproviderorownerofa
motorcycleanydocumentation, parts,andtoolsrequiredto
diagnose,maintain,orrepairthemotorcycle.
Forequipmentthatcontainsamotorcyclesecuritylockorother
security-relatedfunction,theoriginalequipmentmanufacturermust
makeavailableanyspecialdocumentation, tools,andpartsneeded
toaccessandresetthelockorfunctionwhendisabled. With
respecttoequipmentthatcontainsanelectronicsecuritylockor
othersecurity-relatedfunction,amanufacturermustmakeavailable
anydocumentation, parts,embeddedsoftware,firmware,ortools,or
data neededtoresetthelockorfunctionwhendisabledinthe
courseofprovidingservices.
Aviolationisconsideredanunlawfulpracticeunderthe
MerchandisingPracticesAct.
Thebilldoesnotrequirethedivulgenceofatradesecretoralter
thetermsofanyarrangementbetweenanauthorizedrepairprovider
andanoriginalequipmentmanufacturer. Themanufacturerisnot
requiredtomakeavailablespecialdocumentation, tools,andparts
thatwoulddisableoroverrideantitheftsecuritymeasuressetby
theowneroftheproductwithouttheowner'sauthorization. No
originalequipmentmanufacturerorauthorizedrepairprovideris
liableforanydamageorinjurycausedtoanymotorcyclebyan
independentrepairproviderorownerwhichoccursduringthecourse
ofrepair,diagnosis,ormaintenance.
Theprovisionsofthebillapplytomotorcyclessoldorinuseon
orafterJanuary1,2026.
