ThefollowingisasummaryoftheHouseCommitteeSubstituteforHB
1116.
Thisbillspecifiesthatiftheownerofapropertyoracontractor
hiredbytheownerconstructs,maintains,orrepairsadivision
fenceusedtoencloseafieldorenclosurewhereanimalsarekept,
theownerorcontractormayenterontotheadjoiningpropertyupto
10feettorepair,maintainorconstructthefence.Theowneror
contractorisnotliablefordamagesforclearinganytrees,brush,
orvegetationwithinthe10footboundaryordivisionfence.
Howevertheownerorcontractorwouldbeliablefordamagescaused
byentryontotheadjoiningproperty,includingdamagestocrops.
Theseprovisionsdonotincludeadjoiningpropertyownedbyany
utilitycompany,railroad,orcertainzoologicalparks,wildlife
conservationfacilities,oranimalsanctuaries. Theprovisionsdo
notallowanownerorcontractortoenterintoabuildingonthe
adjoiningproperty.

fence.However,repairingafencemayrequireenteringthe
neighbor'spropertytoaccessthefence.Thisbillwouldensure
thatfencerepairscanbeperformedwithoutthethreatof
trespassing.
