withpenaltyprovisions.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Chapter389,RSMo,isamendedbyaddingtheretofournewsections,to
2beknownassections389.611,389.1100,389.1200,and389.1220,toreadasfollows:
389.611.Itshallbeunlawfulforthedirectingofficerortheoperatorofany
2railroadtraintodirecttheoperationofortooperatethesameinsuchamannerasto
3preventtheuseofanystreetforpurposesoftravelforaperiodoftimelongerthan
4fifteenminutes,providedthatthissectionshallnotapplytoamovingtrainortoone
5stoppedbecauseofanemergencyorforrepairsnecessarybeforeitcanproceedsafely.
389.1100.Norailroadoperatingonanymaintrackorbranchlineshalloperate,
2orpermittobeoperated,anyrailroadtrainthatexceedseightthousandfivehundred
3feetinlengthonanypartofamaintrackorbranchline.
389.1200.1.Forpurposesofthissection,thefollowingtermsmean:
2 (1)"Crewmember",anemployeeofthecommoncarrierinvolvedinthe
3operationofarailroadtrainorlightengine;"crewmember"doesnotincludeahostler
4serviceorutilityemployeeorcontractorofthecarrier;
5 (2)"Helperservice",theuseofalocomotiveoragroupoflocomotivestoassist
6anothertrainthatisexperiencingmechanicalfailureorlacksthepowertotraverse
7difficultterrain;"helperservice"includesthetraveltoorfromalocationwherethe
8assistanceisprovided;

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 9 (3)"Hostlerservice",themovementoflocomotivesthatarenotattachedtorail

11 2.Arailroadtrainorlightengineoperatedinconnectionwithcarryingfreight
12shallhaveatleasttwoqualifiedcrewmembers.
13 3.Subsection2ofthissectiondoesnotapplyto:
14 (1)Helperservices;
15 (2)Hostlerservices;and
16 (3)Themovementofatrainforthepurposeofloadingorunloadingfreightso
17longasthetrainismovingnomorethantenmilesperhour.
18 4.Apersonwhowillfullyviolatestheprovisionsofsubsection2ofthissectionis
19guiltyofa:
20 (1)ClassDmisdemeanorforafirstoffenseandshallbepunishedbyafinenotto
21exceedfivehundreddollars;
22 (2)ClassCmisdemeanorforasecondoffenseandshallbepunishedbyafinenot
23toexceedsevenhundreddollars;and
24 (3)ClassBmisdemeanorforathirdorsubsequentoffenseandshallbepunished
25byafinenottoexceedonethousanddollars.
389.1220.1.Personallyidentifyinginformationoftraincrewmembersand
2engineerscontainedinreportsrelatingtorailroadincidentsinvolvingmotorvehicles
3andcontainedincommunicationsbetweenlawenforcementandtraincrewmembers
4andengineersinvolvedinthoseoccurrencesshallberedactedfromanypublicreports
5andshallbemaintainedbythelawenforcementdepartmentsandanypersonsin
6subsequentpossessioninamannerthatensurestheconfidentialityofthetraincrew's
7andengineer'spersonallyidentifyinginformation.Unredactedcopiesofsuchreports
8andcommunicationscontainingpersonallyidentifyinginformationshallbeaccessible:
9 (1)Tothehostoremployingrailroad;
10 (2)Bycourtorder,andtoothersspecificallyauthorizedbycourtordertoobtain
11theinformationiftheaccessisnecessaryintheperformanceoftheirduties;and
12 (3)Tolawenforcementofficers,theattorneygeneral'soffice,anddepartmentof
13transportationstaffiftheaccessisnecessaryintheperformanceoftheirduties.
14 2.Ifacrewmemberorengineerisfoundbyacourttobenotatfaultina
15railroadincidentinvolvingamotorvehicle,suchperson'spersonallyidentifying
16informationshallremainredactedfromanypublicreports.
