HB1122 8 25 4.Thefuneraldirectororpersoninchargeoffinaldispositionofthedeadbodyshall 26filethecertificateofdeath.Thefuneraldirectororpersoninchargeofthefinaldispositionof 27thedeadbodyshallobtainorverifyandenterintotheelectronicdeathregistrationsystem: 28 (1)Thepersonaldatafromthenextofkinorthebestqualifiedpersonorsource 29available; 30 (2)Themedicalcertificationfromthepersonresponsibleforsuchcertificationif 31designatedtodosoundersubsection5ofthissection;and 32 (3)Anyotherinformationordatathatmayberequiredtobeplacedonadeath 33certificateorenteredintotheelectronicdeathcertificatesystemincluding,butnotlimitedto, 34thenameandlicensenumberoftheembalmer. 35 5.Themedicalcertificationshallbecompleted,attestedtoitsaccuracyeitherby 36signatureoranelectronicprocessapprovedbythedepartment,andreturnedtothefuneral 37directororpersoninchargeoffinaldispositionwithinseventy-twohoursafterdeathbythe 38physician,physicianassistant,assistantphysician,oradvancedpracticeregisterednursein 39chargeofthepatient'scarefortheillnessorconditionwhichresultedindeath.Intheabsence 40ofthephysician,physicianassistant,assistantphysician,oradvancedpracticeregistered 41nurseorwiththephysician's,physicianassistant's,assistantphysician's,oradvancedpractice 42registerednurse'sapprovalthecertificatemaybecompletedandattestedtoitsaccuracyeither 43bysignatureoranapprovedelectronicprocessbythephysician'sassociatephysician,the 44chiefmedicalofficeroftheinstitutioninwhichdeathoccurred,orthephysicianwho 45performedanautopsyuponthedecedent,providedsuchindividualhasaccesstothemedical 46historyofthecase,viewsthedeceasedatorafterdeathanddeathisduetonaturalcauses. 47Thepersonauthorizedtocompletethemedicalcertificationmay,inwriting,designateany 48otherpersontoenterthemedicalcertificationinformationintotheelectronicdeath 49registrationsystemifthepersonauthorizedtocompletethemedicalcertificatehasphysically 50orbyelectronicprocesssignedastatementstatingthecauseofdeath.Anypersons 51completingthemedicalcertificationorenteringdataintotheelectronicdeathregistration 52systemshallbeimmunefromcivilliabilityforsuchcertificationcompletion,dataentry,or 53determinationofthecauseofdeath,absentgrossnegligenceorwillfulmisconduct.Thestate 54registrarmayapprovealternatemethodsofobtainingandprocessingthemedicalcertification 55andfilingthedeathcertificate.TheSocialSecuritynumberofanyindividualwhohasdied 56shallbeplacedintherecordsrelatingtothedeathandrecordedonthedeathcertificate. 57 6.Whendeathoccursfromnaturalcausesmorethanthirty-sixhoursafterthe 58decedentwaslasttreatedbyaphysician,physicianassistant,assistantphysician,oradvanced 59practiceregisterednurse,thecaseshallbereferredtothecountymedicalexaminerorcoroner 60orphysicianorlocalregistrarforinvestigationtodetermineandcertifythecauseofdeath.If 61thedeathisdeterminedtobeofanaturalcause,themedicalexaminerorcoronerorlocal HB1122 9 62registrarshallreferthecertificateofdeathtotheattendingphysician,physicianassistant, 63assistantphysician,oradvancedpracticeregisterednurseforsuchcertification.Ifthe 64attendingphysician,physicianassistant,assistantphysician,oradvancedpracticeregistered 65nurserefusesorisotherwiseunavailable,themedicalexaminerorcoronerorlocalregistrar 66shallattesttotheaccuracyofthecertificateofdeatheitherbysignatureoranapproved 67electronicprocesswithinthirty-sixhours. 68 7.Ifthecircumstancessuggestthatthedeathwascausedbyotherthannaturalcauses, 69themedicalexaminerorcoronershalldeterminethecauseofdeathandshall,eitherby 70signatureoranapprovedelectronicprocess,completeandattesttotheaccuracyofthe 71medicalcertificationwithinseventy-twohoursaftertakingchargeofthecase. 72 8.Ifthecauseofdeathcannotbedeterminedwithinseventy-twohoursafterdeath, 73theattendingmedicalexaminer,coroner,attendingphysician,physicianassistant,assistant 74physician,advancedpracticeregisterednurse,orlocalregistrarshallgivethefuneraldirector, 75orpersoninchargeoffinaldispositionofthedeadbody,noticeofthereasonforthedelay, 76andfinaldispositionofthebodyshallnotbemadeuntilauthorizedbythemedicalexaminer, 77coroner,attendingphysician,physicianassistant,assistantphysician,advancedpractice 78registerednurse,orlocalregistrar. 79 9.Whenadeathispresumedtohaveoccurredwithinthisstatebutthebodycannotbe 80located,adeathcertificatemaybepreparedbythestateregistraruponreceiptofanorderofa 81courtofcompetentjurisdictionwhichshallincludethefindingoffactsrequiredtocomplete 82thedeathcertificate.Suchadeathcertificateshallbemarked"Presumptive",showonitsface 83thedateofregistration,andidentifythecourtandthedateofdecree. 84 10.(1)Thedepartmentofhealthandseniorservicesshallnotifyallphysicians, 85physicianassistants,assistantphysicians,andadvancedpracticeregisterednurseslicensed 86underchapters334and335oftherequirementsregardingtheuseoftheelectronicvital 87recordssystemprovidedforinthissection. 88 (2)OnorbeforeAugust30,2015,thedepartmentofhealthandseniorservices, 89divisionofcommunityandpublichealthshallcreateaworkinggroupcomprisedof 90representationfromtheMissourielectronicvitalrecordssystemusersandrecipientsofdeath 91certificatesusedforprofessionalpurposestoevaluatetheMissourielectronicvitalrecords 92system,developrecommendationstoimprovetheefficiencyandusabilityofthesystem,and 93toreportsuchfindingsandrecommendationstothegeneralassemblynolaterthanJanuary1, 942016. 95 11.Notwithstandinganyprovisionoflawtothecontrary,ifacoronerordeputy 96coronerisnotcurrentwithoriswithouttheapprovedtrainingunderchapter58,the 97departmentofhealthandseniorservicesshallprohibitsuchcoronerfromattestingtothe 98accuracyofacertificateofdeath.Nopersonelectedorappointedtotheofficeofcoronercan HB1122 10 99assumesuchelectedofficeuntilthetraining[, asestablishedbythecoronerstandardsand 100trainingcommissionundertheprovisionsofsection58.035,] requiredundersection58.030 101hasbeencompletedandacertificateofcompletionhasbeenissued.Intheeventacoroner 102cannotfulfillhisorherdutiesorisnolongerqualifiedtoattesttotheaccuracyofadeath 103certificate,thesheriffofthecountyshallappointamedicalprofessionaltoattestdeath 104certificatesuntilsuchtimeasthecoronercanresumehisorherdutiesoranothercoroneris 105appointedorelectedtotheoffice. 193.265.1.Fortheissuanceofacertificationorcopyofadeathrecord,theapplicant 2shallpayafeeoffourteendollarsforthefirstcertificationorcopyandafeeofelevendollars 3foreachadditionalcopyorderedatthattime.Fortheissuanceofacertificationorcopyofa 4birth,marriage,divorce,orfetaldeathrecord,theapplicantshallpayafeeoffifteendollars. 5Nofeeshallberequiredorcollectedforacertificationofbirth,death,ormarriageifthe 6requestforcertificationismadebythechildren'sdivision,thedivisionofyouthservices,a 7guardianadlitem,orajuvenileofficeronbehalfofachildorpersonundertwenty-oneyears 8ofagewhohascomeunderthejurisdictionofthejuvenilecourtundersection211.031.All 9feescollectedunderthissubsectionshallbedepositedtothestatedepartmentofrevenue. 10BeginningAugust28,2004,foreachvitalrecordsfeecollected,thedirectorofrevenueshall 11creditfourdollarstothegeneralrevenuefund,fivedollarstothechildren'strustfund,one 12dollarshallbecreditedtotheendowedcarecemeteryauditfund,onedollarforeach 13certificationorcopyofdeathrecordstotheMissouri[state] coroners'[training] fund 14establishedinsection58.208,andthreedollarsforthefirstcopyofdeathrecordsandfive 15dollarsforbirth,marriage,divorce,andfetaldeathrecordsshallbecreditedtotheMissouri 16publichealthservicesfundestablishedinsection192.900.Moneyintheendowedcare 17cemeteryauditfundshallbeavailablebyappropriationtothedivisionofprofessional 18registrationtopayitsexpensesinadministeringsections214.270to214.410.Allinterest 19earnedonmoneydepositedintheendowedcarecemeteryauditfundshallbecreditedtothe 20endowedcarecemeteryauditfund.Notwithstandingtheprovisionsofsection33.080tothe 21contrary,moneyplacedintheendowedcarecemeteryauditfundshallnotbetransferredand 22placedtothecreditofgeneralrevenueuntiltheamountinthefundattheendofthebiennium 23exceedsthreetimestheamountoftheappropriationfromtheendowedcarecemeteryaudit 24fundfortheprecedingfiscalyear.Themoneydepositedinthepublichealthservicesfund 25underthissectionshallbedepositedinaseparateaccountinthefund,andmoneysinsuch 26account,uponappropriation,shallbeusedtoautomateandimprovethestatevitalrecords 27system,anddevelopandmaintainanelectronicbirthanddeathregistrationsystem.Forany 28searchofthefilesandrecords,whennorecordisfound,thestateshallbeentitledtoafee 29equaltotheamountforacertificationofavitalrecordforafive-yearsearchtobepaidbythe 30applicant.Fortheprocessingofeachlegitimation,adoption,courtorderorrecordingafterthe HB1122 11 31registrant'stwelfthbirthday,thestateshallbeentitledtoafeeequaltotheamountfora 32certificationofavitalrecord.Exceptwheneveracertifiedcopyorcopiesofavitalrecordis 33requiredtoperfectanyclaimofanypersononrelief,oranydependentofanypersonwhowas 34onreliefforanyclaimuponthegovernmentofthestateorUnitedStates,thestateregistrar 35shall,uponrequest,furnishacertifiedcopyorsomanycertifiedcopiesasarenecessary, 36withoutanyfeeorcompensationtherefor. 37 2.Fortheissuanceofacertificationofadeathrecordbythelocalregistrar,the 38applicantshallpayafeeoffourteendollarsforthefirstcertificationorcopyandafeeof 39elevendollarsforeachadditionalcopyorderedatthattime.Foreachfeecollectedunderthis 40subsection,onedollarshallbedepositedtothestatedepartmentofrevenueandtheremainder 41shallbedepositedtotheofficialcityorcountyhealthagency.Thedirectorofrevenueshall 42creditallfeesdepositedtothestatedepartmentofrevenueunderthissubsectiontothe 43Missouri[state] coroners'[training] fundestablishedinsection58.208. 44 3.Fortheissuanceofacertificationorcopyofabirth,marriage,divorce,orfetal 45deathrecord,theapplicantshallpayafeeoffifteendollars;exceptthat,inanycountywitha 46charterformofgovernmentandwithmorethansixhundredthousandbutfewerthanseven 47hundredthousandinhabitants,adonationofonedollarmaybecollectedbythelocalregistrar 48overandaboveanyfeesrequiredbylawwhenacertificationorcopyofanymarriagelicense 49orbirthcertificateisprovided,withsuchdonationscollectedtobeforwardedmonthlybythe 50localregistrartothecountytreasurerofsuchcountyandthedonationssoforwardedtobe 51depositedbythecountytreasurerintothehousingresourcecommissionfundtoassist 52homelessfamiliesandprovidefinancialassistancetoorganizationsaddressinghomelessness 53insuchcounty.Thelocalregistrarshallincludeacheck-offboxontheapplicationformfor 54suchcopies.Allfeescollectedunderthissubsection,otherthanthedonationscollectedin 55anycountywithacharterformofgovernmentandwithmorethansixhundredthousandbut 56fewerthansevenhundredthousandinhabitantsformarriagelicensesandbirthcertificates, 57shallbedepositedtotheofficialcityorcountyhealthagency. 58 4.Acertifiedcopyofadeathrecordbythelocalregistrarcanonlybeissuedafter 59acceptanceandregistrationwiththestateregistrar.Thefeespaidtotheofficialcountyhealth 60agencyshallberetainedbythelocalagencyforlocalpublichealthpurposes. 61 5.Nofeeunderthissectionshallberequiredorcollectedfromaparentorguardianof 62ahomelesschildorhomelessyouth,asdefinedinsubsection1ofsection167.020,oran 63unaccompaniedyouth,asdefinedin42U.S.C.Section11434a(6),fortheissuanceofa 64certification,orcopyofsuchcertification,ofbirthofsuchchildoryouth.Anunaccompanied 65youthshallbeeligibletoreceiveacertificationorcopyofhisorherownbirthrecordwithout 66theconsentorsignatureofhisorherparentorguardian;provided,thatonlyonecertificate HB1122 12 67underthisprovisionshallbeprovidedwithoutcosttotheunaccompaniedorhomelessyouth. 68Fortheissuanceofanyadditionalcertificates,thestatutoryfeeshallbepaid. 69 6.(1)Notwithstandinganyprovisionoflawtothecontrary,nofeeshallberequired 70orcollectedforacertificationofbirthiftherequestismadebyavictimofdomesticviolence 71orabuse,asthosetermsaredefinedinsection455.010,andthevictimprovides 72documentationsignedbyanemployee,agent,orvolunteerofavictimserviceprovider,an 73attorney,orahealthcareormentalhealthprofessional,fromwhomthevictimhassought 74assistancerelatingtothedomesticviolenceorabuse.Suchdocumentationshallstatethat, 75underpenaltyofperjury,theemployee,agent,orvolunteerofavictimserviceprovider,the 76attorney,orthehealthcareormentalhealthprofessionalbelievesthevictimhasbeen 77involvedinanincidentofdomesticviolenceorabuse. 78 (2)Avictimmaybeeligibleonlyonetimeforafeewaiverunderthissubsection. [58.035.1.Thereisherebyestablishedwithinthedepartmentof 2 healthandseniorservicesa"CoronerStandardsandTrainingCommission" 3 whichshallbecomposedofeightmembers,appointedbythegovernor,with 4 theadviceandconsentofthesenate.Thegovernorshalltakeintoaccountthe 5 diversityofthestatewhenmakingtheappointmentstothiscommission.The 6 commissionshallconsistof: 7 (1)Twocoronerselectedfromcountiesofthethirdclassification; 8 (2)Onecoronerelectedfromacountyofthefirst,second,orfourth 9 classification; 10 (3)Onecurrentlyappointedmedicalexaminer; 11 (4)Onechilddeathpathologist; 12 (5)Oneelectedprosecutingattorney; 13 (6)Oneelectedsheriff; 14 (7)Thedirectorofthedepartmentofhealthandseniorservices,orhis 15 orherdesignee,whoshallserveasanonvotingmemberofthecommission. 16 17 Eachmemberofthecoronerstandardsandtrainingcommissionshallhave 18 beenatthetimeofhisappointmentacitizenoftheUnitedStatesandaresident 19 ofthisstateforaperiodofatleastoneyear,andmemberswhoarecoroners 20 shallbequalifiedasestablishedbythischapter. 21 2.Themembersofthecommissionshallserveforthefollowingterms: 22 (1)Everymemberofthecommissionwhoholdselectedofficeshall 23 serveaninitialtermoftwoyears; 24 (2)Everymemberofthecommissionwhodoesnotholdelectedoffice 25 shallserveaninitialtermoffouryears; 26 (3)Everymemberofthecommissionshallserveforatermoffour 27 yearsaftertheinitialtermhasbeenserved. 28 3.Annuallythecommissionshallelectoneofthemembersas 29 chairperson.Thecoronerstandardsandtrainingcommissionshallmeetat 30 leasttwiceeachyearasdeterminedbythedirectorofthedepartmentofhealth 31 andseniorservices,thechairperson,oramajorityofthememberstoperform HB1122 13 32 itsduties.Amajorityofthemembersofthecoronerstandardsandtraining 33 commissionshallconstituteaquorum. 34 4.Nomemberofthecoronerstandardsandtrainingcommissionshall 35 receiveanycompensationfortheperformanceofhisorherofficialduties. 36 5.Thecoronerstandardsandtrainingcommissionshallestablish 37 trainingstandards,byrule,relatingtotheofficeofcountycoroner.These 38 standardsshallrelatetotheoperationoftheoffice,thelegalresponsibilitiesof 39 theoffice,andthetechnicalskillsandknowledgerequiredoftheoffice. 40 6.Anyruleorportionofarule,asthattermisdefinedinsection 41 536.010,thatiscreatedundertheauthoritydelegatedinthissectionshall 42 becomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisions 43 ofchapter536and,ifapplicable,section536.028.Thissectionandchapter 44 536arenonseverableandifanyofthepowersvestedwiththegeneral 45 assemblypursuanttochapter536toreview,todelaytheeffectivedate,orto 46 disapproveandannularulearesubsequentlyheldunconstitutional,thenthe 47 grantofrulemakingauthorityandanyruleproposedoradoptedafterAugust 48 28,2020,shallbeinvalidandvoid. 49 7.Oncethecommissionhasdevelopedstandards,thecommission 50 shallissueareportdetailingthestandards.Thisreportshallbesubmittedto 51 thespeakerofthehouseofrepresentativesandthepresidentprotemporeof 52 thesenate,andshallbepublishedonthewebsiteofthedepartmentofhealth 53 andseniorservices.] [58.096.Eachdeputycountycoroneruponcertificationbythe 2 MissouriCoronersandMedicalExaminersAssociationofattendanceata 3 trainingprogramrequiredbytheprovisionsofsubsection2ofsection58.095 4 shallreceiveannualcompensation,inadditiontoothercompensation,ofone 5 thousanddollarsperyearsolongassubsection2ofsection58.095remainsin 6 effect.Thisadditionalcompensationshallbepaidinthesamemannerandat 7 thesametimesasothercompensationispaidtothedeputycountycoroner. 8 Theprovisionsofthissectionshallnotpermitorrequireareductioninthe 9 amountofcompensationreceivedbyanypersonholdingtheofficeofdeputy 10 countycoroneronJanuary1,1989.] ✔ HB1122 14
