SectionA.Chapter393,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection393.2600,toreadasfollows:
393.2600.1.Asusedinthissection,thefollowingtermsmean:
2 (1)"Light-mitigatingtechnologysystem",aircraftdetectionlightingorany
3othercomparablesystemcapableofreducingtheimpactoffacilityobstructionlighting
4whilemaintainingconspicuitysufficienttoassistaircraftinidentifyingandavoiding
5collisionwithawindenergyconversionsystem;
6 (2)"Powerofftakeagreement",along-termcontractthatprovidesfor:
7 (a)Thewholeoranypartoftheavailablecapacityorthesaleorotherdisposal
8ofthewholeoranypartoftheoutputofawindenergyconversionsystem;or
9 (b)Acontractfordifferencesorfinancialhedgetiestotheoutputfromthewind
10energyconversionsystem;
11 (3)"Windenergyconversionsystem",anelectricgenerationfacilityconsisting
12offiveormorewindturbinesthatarefiftyfeettallortallerinheightandanyaccessory
13structuresandbuildings,includingsubstations,meteorologicaltowers,electrical
14infrastructure,transmissionlines,andotherappurtenantstructures.
15 2.AfterAugust28,2025,nonewwindenergyconversionsystemshallbegin
16commercialoperationsinthisstateunlessthedeveloper,owner,oroperatorofthewind
17energyconversionsystemsappliestotheFederalAviationAdministrationfor

19seq.IftheinstallationisapprovedbytheFederalAviationAdministration,the
20developer,owner,oroperatorofsuchwindenergyconversionsystemshallinstallthe
21light-mitigatingtechnologysystemonapprovedturbineswithintwenty-fourmonthsof
22receiptofapproval.
23 3.AfterJanuary1,2027,anydeveloper,owner,oroperatorofawindenergy
24conversionsystemthathascommencedcommercialoperationsinthestatewithouta
25light-mitigatingtechnologysystemshallapplytotheFederalAviationAdministration
26forinstallationandoperationofalight-mitigatingtechnologysystemthatcomplieswith
2714CFR1.1,etseq.withinsixmonthsaftertheexecutionofanewpowerofftake
28agreementrelatedtosuchwindenergyconversionsystem.Iftheinstallationis
29approvedbytheFederalAviationAdministration,thedeveloper,owner,oroperatorof
30suchwindenergyconversionsystemshallinstallthelight-mitigatingtechnologysystem
31onapprovedturbineswithintwenty-fourmonthsofreceiptofapproval.
32 4.Anyvendorthatisselectedforinstallationoflight-mitigatingtechnology
33systemonawindenergyconversionsystemundertheprovisionsofthissectionandis
34approvedbytheFederalAviationAdministrationforsuchinstallationshallprovideto
35theMissouridepartmentofnaturalresources,intheformandmannerprescribedby
36thedepartment,noticeoftheprogressoftheinstallationofsuchlight-mitigating
37technologysystem.
38 5.Iftheinstallationofthelight-mitigatingtechnologysystemisdelayedbeyond
39thetwenty-four-monthinstallationrequirementestablishedunderthissection,the
40vendorshallprovidenoticetotheMissouridepartmentofnaturalresourcesnolessthan
41onceeverythreemonthswithanupdateonthereasonsforthedelayandthecurrent
42statusofinstallation.Thedepartmentshallestablishpoliciesandproceduresto
43establishauniformscheduleforsubmittingnoticeasrequiredunderthissubsection.
44 6.Anycostsassociatedwiththeinstallation,implementation,operation,and
45maintenanceofalight-mitigatingtechnologysystemshallbetheresponsibilityofthe
46developer,owner,oroperatorofthewindenergyconversionsystem.
47 7.Thedirectormaypromulgateallnecessaryrulesandregulationsforthe
48administrationofthissection.Anyruleorportionofarule,asthattermisdefinedin
49section536.010,thatiscreatedundertheauthoritydelegatedinthissectionshall
50becomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter
51536and,ifapplicable,section536.028.Thissectionandchapter536arenonseverable
52andifanyofthepowersvestedwiththegeneralassemblypursuanttochapter536to
53review,todelaytheeffectivedate,ortodisapproveandannularulearesubsequently
HB1124	2 54heldunconstitutional,thenthegrantofrulemakingauthorityandanyruleproposedor
55adoptedafterAugust28,2025,shallbeinvalidandvoid.
