182.910.1.Forpurposesofthissection,thefollowingtermsmean:
2 (1)"Digitallibrarymaterial"or"digitallibrarymaterials",materialsthatare
3directlyaccessiblethroughthepubliclibrarydatabaseincluding,butnotlimitedto,the
4following:digitalaudiobooks,electronicbooks,electronictextbooks,electronic
5journals,electronicmagazinesandperiodicals,databases,digitalvocationaland
6careerresources,digitalreferenceresources,streamingvideo,andacademicsoftware
7programs.Theterm"digitallibrarymaterial"or"digitallibrarymaterials"excludes
8anyonlineordigitalcontentavailabletopatronsoutsideofthepubliclibraryor
9platform;
10 (2)"Material"or"materials",anyofthefollowingthatisavailablefor
11circulationtothepublicthatisprintedorwritten:anypicture,drawing,photograph,
12motionpicturefilm,videotapeorvideotapeproduction,orpictorialrepresentation;any
13recordingortranscription;anymechanical,chemical,orelectricalreproduction;any
14storedcomputerdata;oranythingthatisormaybeusedasameansofcommunication.
15"Material"includes,butisnotlimitedto,undevelopedphotographs,molds,printing
16plates,storedcomputerdata,andotherlatentrepresentationalobjects;
17 (3)"Minor",anindividualwhoisundereighteenyearsofage;

30 3.Apubliclibraryshallremovematerialsfromitspermanentcollection,
31relocatematerialswithinitscollection,orremoveaccesstodigitallibrarymaterials
32withinitscollectiononlyifthematerialshavebeenreviewedinaccordancewithan
33establishedpolicyforthereconsiderationofmaterialsanddigitallibrarymaterialsthat
34complieswiththerequirementsofthissection.
35 4.Tomakearequestforreconsiderationofmaterialsordigitallibrary
36materials,theindividualmakingtherequestshallsignaformaffirmingthat:
37 (1)Suchindividualhasreadorconsumedtheentiretyofthechallenged
38material;and
39 (2)Suchindividualpermanentlyresidesinthetaxingdistrictofthepublic
40libraryinwhichtherequestismade;and
41 (3)Suchindividualholdsalibrarycardforthepubliclibraryinwhichthe
42individualisfilingtherequestforreconsideration.
43 5.Eachpubliclibraryshalldevelopanappealsprocessforthereconsideration
44policythatoutlinesaprocessforappealingadecisionmaderegardingtheremovalof
45materials.Arecordofallappealsrequestedandtheiroutcomesshallbemadeavailable
46byapubliclibraryuponrequest.
47 6.Digitallibrarymaterialsthatundergoreconsiderationshallbesubjectto
48removalatthetitle,issue,orarticlelevel.Anythirdpartycontractedtoprovide
49databasesthatcontainorprovideaccesstodigitallibrarymaterialsshallhavethe
50abilitytocuratethosematerialsusingamechanismortoolthatallowsfortheremovalof
51accesstochallengedcontentwithoutdisruptingaccesstotheremainderofdigitallibrary
52materialsaccessibleinthepubliclibrary.Curationofdigitallibrarymaterialsshallnot
53beappliedatanindividualuserlevel,butshallbeappliedatthelocallibrarysystem
54level.

56digitallibraryresourcesshallnottrackorprovidethird-partynotificationregarding
57digitallibrarymaterialsaccessedbyindividualusersviapubliclibrarydatabases.
58 8.Anindividualwhoisalibrarian,mediaspecialist,otheremployee,contractor,
59orvolunteerofapubliclibraryshallnotbesubjecttotermination,demotion,discipline,
60retaliation,oranyotherpenaltyforrefusingtoremovematerialsordigitallibrary
61materialsbeforesuchmaterialshavebeenreviewedinaccordancewithapubliclibrary
62policythatcomplieswiththeprovisionsofthissection.
