offenseoflittering,withpenaltyprovisions.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section577.070,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection577.070,toreadasfollows:
577.070.1.Apersoncommitstheoffenseoflitteringifheorsheplaces,deposits,or
2causestobeplacedordeposited,anyglass,glassbottles,wastematerialsresultingfromthe
3intentionaloutdoorreleaseorabandonmentofoneormoreballoons,wire,nails,tacks,
4hedge,cans,garbage,trash,refuse,orrubbishofanykind,natureordescriptionontheright-
5of-wayofanypublicroadorstatehighwayoronorinanyofthewatersinthisstateoronthe
6banksofanystream,oronanylandorwaterowned,operatedorleasedbythestate,any
7board,department,agencyorcommissionthereoforonanylandorwaterowned,operatedor
8leasedbythefederalgovernmentoronanyprivaterealpropertyownedbyanotherwithout
9theowner'sconsent.
10 2.Exceptasprovidedinsubsection3ofthissection,theoffenseoflitteringisa
11classCmisdemeanorunless:
12 (1)Suchlitteringcreatesasubstantialriskofphysicalinjuryorpropertydamageto
13another;or
14 (2)Thepersonhasbeenfoundguiltyofaviolationofthissectionoranoffense
15committedinanotherjurisdictionwhich,ifcommittedinthisstate,wouldbeaviolationunder
16thissection,inwhichcaseitisaclassAmisdemeanor.
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17 3.Iftheoffenseoflitteringinvolvestheintentionaloutdoorreleaseor
18abandonmentofoneormoreballoons,thefollowingpenaltiesshallapply:
19 (1)Forafirstoffenseifapersonintentionallyreleasesorabandonstenballoons
20orfewer,thepersonshallbesubjecttoafinethatisnolessthanonehundreddollarsbut
21nomorethanfivehundreddollars.Anysecondorsubsequentoffenseshallresultina
22finenolessthanfivehundredonedollarsbutnomorethanonethousanddollars;
23 (2)Forafirstoffenseifapersonintentionallyreleasesorabandonselevenor
24moreballoons,thepersonshallbesubjecttoafinethatisnolessthanfivehundred
25dollars.Anysecondorsubsequentoffenseshallresultinafinenolessthantwo
26thousanddollars.
27 4.Itisaviolationofthissectionforapersontointentionallyreleaseorabandon
28outdoorsaballoonthatisinflatedorfilledwithagasthatislighterthanair,exceptthat
29itisnotaviolationofthissectionforapersonto:
30 (1)Unintentionallyreleaseballoonsinanyamount;or
31 (2)Intentionallyreleaseorabandonoutdoorsaballooncarryingscientific
32instrumentation,aballoonusedformeteorologicalobservationbyagovernmentor
33scientificorganization,orahotairballoonthatisrecoveredafterlaunching.
34 5.Asusedinthissection,"balloon"meansaflexible,nonporousbagmadefrom
35materialssuchasrubber,latex,polychloroprene,ornylonfabricthatcanbeinflatedor
36filledwithgasorfluid,suchashelium,hydrogen,nitrousoxide,oxygen,air,orwater,
37andthensealedattheneckofthebag.
