postconvictionrelief.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section547.370,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection547.370,toreadasfollows:
547.370.1.Whenamotionisfiledasprovidedinsection547.360tosetasidea
2sentenceofdeath,thecourtshallfindontherecordwhetherthemovantisindigent.Ifthe
3movantisindigent,thecourtshallcausetobeappointedtwocounseltorepresentthemovant.
4Ifmovantseekstorejecttheappointmentofcounsel,thecourtshallfindontherecord,aftera
5hearing,ifnecessary,whetherthemovantisabletocompetentlydecidewhethertoacceptor
6rejecttheappointmentandwhetherthemovantrejectedtheofferwiththeunderstandingofits
7legalconsequences.Unlessthemovantissocompetentandunderstandsthelegal
8consequences,movantshallnotbepermittedtorejecttheappointmentofcounsel.
9 2.AllcounselappointedasprovidedinthissectionshallbemembersofTheMissouri
10BarorshallbeadmittedtopracticeintheparticularcaseasprovidedinMissourisupreme
11courtrule9.Atleastoneofthecounselshallmeetthefollowingqualifications:
12 (1)Haveattendedandsuccessfullycompletedwithintwoyearsimmediately
13precedingtheappointmentatleasttwelvehoursoftrainingoreducationalprogramsonthe
14postconvictionphaseofacriminalcaseandfederalandstateaspectsofcasesinwhichthe
15deathpenaltyissought;and
16 (2)Haveatleastthreeyearslitigationexperienceinthefieldofcriminallaw;and

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17 (3)Haveparticipatedascounselorco-counseltofinaljudgmentinatleastfive
18postconvictionmotionsinvolvingclassAfeloniesineitherstateorfederaltrialcourts;and
19 (4)Haveparticipatedineitherstateorfederalcourtascounselorco-counseltofinal
20judgmentinatleast:
21 (a)Threefelonyjurytrials;or
22 (b)Fivedirectcriminalappealsinfelonycases.

24Counselshallcertifytothestatepublicdefenderinsuchformasthedefendermayrequirethat
25counselmeetsthequalificationsofthissectionpriortofilingcounsel'sentryofappearancein
26thecase.
27 3.Counselappointedtorepresentthemovantshallnothaverepresentedthemovant
28attrialoronthedirectappealtherefrom.
29 4.Astoanycounselappointedasprovidedinthissection,thestatepublicdefender
30shallprovidecounselwithreasonablecompensationandshallprovidereasonableand
31necessarylitigationexpenses.
32 5.ThissectionshallapplytoanymotionsunderMissourisupremecourtrules
