117.
Currently,apersonwhohashadhisorherdriver'slicense
suspendedorrevokedbecauseofanassessmentofpointsforan
intoxication-relatedtrafficoffenseconvictionandwhohasaprior
alcohol-relatedenforcementcontactmustshowprooftotheDirector
ofRevenuethatanymotorvehicledrivenbythepersonhasa
certifiedignitioninterlockdeviceinstalled,andtheignition
interlockdevicemustbeinstalledforatleastsixmonths.Under
thisbill,therequirementappliesonlytoapersonwhohasan
intoxication-relatedtrafficoffenseconvictioninwhichthe
person'sbloodalcoholcontentwasatleast.08butlessthan.15
andwhohasaprioralcohol-relatedenforcementcontactortoa
personwhohasanassessmentofpointsforanintoxication-related
trafficoffenseconvictioninwhichtheperson'sbloodalcohol
contentwasfoundtobe.15ormore.
Thebillalsoprohibitsrestricteddrivingprivilegestobeissued
toanypersonwhosedrivingrecordshowsanintoxication-related
trafficoffenseinwhichtheperson'sbloodalcoholcontentwas
foundtobe.15ormoreuntilthepersonfilesproofwiththe
DepartmentofRevenuethatanymotorvehicleoperatedbytheperson
isequippedwithafunctioning,certifiedignitioninterlock
device.
Thebillalsoaddstotheoffenseofburglaryintheseconddegree
whenapersonunlawfullyentersamotorvehicleoranypartofa
motorvehiclewiththeintenttocommitatheftoranyfelony.The
billdefines"enters"asapersonintrudingwithanypartofthe
bodyoranyphysicalobjectconnectedwiththebody.Ifaperson
whocommitsaviolationunderthisprovisionwasinpossessionofa
firearmatthetimeorstoleafirearmfromthemotorvehicle
duringtheviolation,heorsheisguiltyofaclassCfelony.
Thebillalsocreatestheoffenseofunlawfullygainingentryinto
amotorvehicle,whichapersoncommitsifheorsheliftsthedoor
handlesorotherwisetriesthedoorsandlocksofsuccessive
vehiclesinanattempttogainentry.Aviolationofthissection
isaclassEfelony.Apersondoesnotcommittheoffenseof
unlawfullygainingentryintoamotorvehicleifthepersonisthe ownerofthevehicleorhastheowner'spermissiontoenterthe
vehicle.
