557.021.1.Anyoffensedefinedoutsidethiscode[which] thatisdeclaredtobea

565.004.1.Eachhomicideoffense[which] thatislawfullyjoinedinthesame

3homicideshallbechargedtogetherwithsuchoffenseinseparatecounts.Acountcharging
4anyoffenseofhomicidemayonlybechargedandtriedtogetherwithoneormorecountsof
5anyotherhomicideoroffenseotherthanahomicideasprovidedinsubsection2ofsection
6545.140.Exceptasprovidedinsubsections2[,]and3[,and4]ofthissection,nomurderin
7thefirstdegreeoffensemaybetriedtogetherwithanyoffenseotherthanmurderinthefirst
8degree.Intheeventofajoinderofhomicideoffenses,alloffenseschargedwhichare
9supportedbytheevidenceinthecase,togetherwithallproperlesseroffensesundersection
10565.029,shall,whenrequestedbyoneofthepartiesorthecourt,besubmittedtothejuryor,
11inajury-waivedtrial,consideredbythejudge.
12 2.Acountcharginganyoffenseofhomicideofaparticularindividualmaybejoined
13inanindictmentorinformationandtriedwithoneormorecountschargingalternativelyany
14otherhomicideoroffenseotherthanahomicidecommittedagainstthatindividual.Thestate
15shallnotberequiredtomakeanelectionastothealternativecountonwhichitwillproceed.
16Thissubsectioninnowaylimitstherighttotryintheconjunctive,wheretheyareproperly
17joinedundersubsection1ofthissection,eitherseparateoffensesotherthanmurderinthe
18firstdegreeorseparateoffensesofmurderinthefirstdegreecommittedagainstdifferent
19individuals.
20 3.Whenadefendanthasbeenchargedandprovenbeforetrialtobeaprioroffender
21pursuanttochapter558sothatthejudgeshallassesspunishmentandnotajuryforanoffense
HB118	2 22otherthanmurderinthefirstdegree,thatoffensemaybetriedandsubmittedtothetrier
23togetherwithanymurderinthefirstdegreechargewithwhichitislawfullyjoined.Insuch
24casethejudgewillassesspunishmentonanyoffensejoinedwithamurderinthefirstdegree
25chargeaccordingtolawand,whenthetrierisajury,itshallbeinstructeduponpunishmenton
26thechargeofmurderinthefirstdegree[inaccordancewithsection565.030.
27 4.Whenthestatewaivesthedeathpenaltyforamurderfirstdegreeoffense,that
28offensemaybetriedandsubmittedtothetriertogetherwithanyotherchargewithwhichitis
29lawfullyjoined].
565.006.1.Atanytimebeforethecommencementofthetrialofahomicideoffense,
2thedefendantmay,withtheassentofthecourt,waiveatrialbyjuryandagreetosubmitall
3issuesinthecasetothecourt,whosefindingshallhavetheforceandeffectofaverdictofa
4jury.Suchawaivermustincludeawaiverofatrialbyjuryofallissuesandoffensescharged
5inthecase,includingthepunishmenttobeassessedandimposedifthedefendantisfound
6guilty.
7 2.Nodefendantwhopleadsguiltytoahomicideoffenseorwhoisfoundguiltyofa
8homicideoffenseaftertrialtothecourtwithoutajuryshallbepermittedatrialbyjuryonthe
9issueofthepunishmenttobeimposed,exceptbyagreementofthestate.
10 3.[Ifadefendantisfoundguiltyofmurderinthefirstdegreeafterajurytrialin
11whichthestatehasnotwaivedthedeathpenalty,thedefendantmaynotwaiveajurytrialof
12theissueofthepunishmenttobeimposed,exceptbyagreementwiththestateandthecourt.
13 4.]Anywaiverofajurytrialandagreementpermittedbythissectionshallbeentered
14inthecourtrecord.
565.020.1.Apersoncommitstheoffenseofmurderinthefirstdegreeifheorshe
2knowinglycausesthedeathofanotherpersonafterdeliberationuponthematter.
3 2.TheoffenseofmurderinthefirstdegreeisaclassAfelony,and,ifapersonis
4eighteenyearsofageorolderatthetimeoftheoffense,thepunishmentshallbe[eitherdeath
5or]imprisonmentforlifewithouteligibilityforprobation[or],parole,orreleaseexceptbyact
6ofthegovernor.Ifapersonhasnotreachedhisorhereighteenthbirthdayatthetimeofthe
7commissionoftheoffense,thepunishmentshallbeasprovidedundersection565.033.
565.040.1.[Intheeventthatthedeathpenaltyprovidedinthischapterisheldtobe
2unconstitutional,] Anypersonconvictedofmurderinthefirstdegreeshallbesentencedby
3thecourttolifeimprisonmentwithouteligibilityforprobation,parole,orreleaseexceptby
4actofthegovernor[, withtheexceptionthatwhenaspecificaggravatingcircumstancefound
5inacaseisheldtobeunconstitutionalorinvalidforanotherreason,thesupremecourtof
6Missouriisfurtherauthorizedtoremandthecaseforresentencingorretrialofthepunishment
7pursuanttosubsection5ofsection565.035].
HB118	3 8 2.In[theeventthat]anycaseinwhichadeathsentencehaspreviouslybeen
9imposedpursuanttothischapter[isheldtobeunconstitutional,thetrialcourtwhich
10previouslysentencedthedefendanttodeathshallcausethedefendanttobebroughtbeforethe
11courtandshallsentencethedefendanttolifeimprisonmentwithouteligibilityforprobation,
12parole,orreleaseexceptbyactofthegovernor,withtheexceptionthatwhenaspecific
13aggravatingcircumstancefoundinacaseisheldtobeinapplicable,unconstitutionalor
14invalidforanotherreason,thesupremecourtofMissouriisfurtherauthorizedtoremandthe
15caseforretrialofthepunishmentpursuanttosubsection5ofsection565.035] buthasnot
16beenexecuted,suchsentenceshallnotbemodifiedunlessotherwiseprovidedbylaw.
[546.680.Whenjudgmentofdeathisrenderedbyanycourtof
2 competentjurisdiction,awarrantsignedbythejudgeandattestedbytheclerk
3 underthesealofthecourtmustbedrawnanddeliveredtothesheriff.Itmust
4 statetheconvictionandjudgmentandappointadayonwhichthejudgment
5 mustbeexecuted,whichmustnotbelessthanthirtynormorethansixtydays
6 fromthedateofjudgment,andmustdirectthesherifftodeliverthedefendant,
7 atatimespecifiedinsaidorder,notmorethantendaysfromthedateof
8 judgment,tothechiefadministrativeofficerofacorrectionalfacilityofthe
9 departmentofcorrections,forexecution.]
[546.690.Thejudgeofacourtatwhichaconvictionishadmust,
2 immediatelyaftertheconviction,transmittothegovernorofthestate,bymail
3 orotherwise,astatementoftheconvictionandjudgment.]
[546.700.Whenever,foranyreason,anyconvictsentencedtothe
2 punishmentofdeathshallnothavebeenexecutedpursuanttosuchsentence,
3 andthecauseshallstandinfullforce,thesupremecourt,orthecourtofthe
4 countyinwhichtheconvictionwashad,ontheapplicationoftheprosecuting
5 attorney,shallissueawritofhabeascorpustobringsuchconvictbeforethe
6 court;orifhebeatlarge,awarrantforhisapprehensionmaybeissuedby
7 suchcourt,oranyjudgethereof.]
[546.710.Uponsuchconvictedoffenderbeingbroughtbeforethe
2 court,theyshallproceedtoinquireintothefacts,andifnolegalreasonsexist
3 againsttheexecutionofsentence,suchcourtshallissueawarranttothe
4 directorofthedepartmentofcorrections,fortheexecutionoftheprisonerat
5 thetimethereinspecified,whichexecutionshallbeobeyedbythedirector
6 accordingly.]
[546.720.1.Themannerofinflictingthepunishmentofdeathshallbe
2 bytheadministrationoflethalgasorbymeansoftheadministrationoflethal
3 injection.Andforsuchpurposethedirectorofthedepartmentofcorrectionsis
4 herebyauthorizedanddirectedtoprovideasuitableandefficientroomor
5 place,enclosedfrompublicview,withinthewallsofacorrectionalfacilityof
6 thedepartmentofcorrections,andthenecessaryappliancesforcarryinginto
HB118	4 7 executionthedeathpenaltybymeansoftheadministrationoflethalgasorby
8 meansoftheadministrationoflethalinjection.
9 2.Thedirectorofthedepartmentofcorrectionsshallselectan
10 executionteamwhichshallconsistofthosepersonswhoadministerlethalgas
11 orlethalchemicalsandthosepersons,suchasmedicalpersonnel,whoprovide
12 directsupportfortheadministrationoflethalgasorlethalchemicals.The
13 identitiesofmembersoftheexecutionteam,asdefinedintheexecution
14 protocolofthedepartmentofcorrections,shallbekeptconfidential.
15 Notwithstandinganyprovisionoflawtothecontrary,anyportionofa
16 recordthatcouldidentifyapersonasbeingacurrentorformermemberofan
17 executionteamshallbeprivilegedandshallnotbesubjecttodiscovery,
18 subpoena,orothermeansoflegalcompulsionfordisclosuretoanypersonor
19 entity,theremainderofsuchrecordshallnotbeprivilegedorclosedunless
20 protectedfromdisclosurebylaw.Thesectionofanexecutionprotocolthat
21 directlyrelatestotheadministrationoflethalgasorlethalchemicalsisanopen
22 record,theremainderofanyexecutionprotocolofthedepartmentof
23 correctionsisaclosedrecord.
24 3.Apersonmaynot,withouttheapprovalofthedirectorofthe
25 departmentofcorrections,knowinglydisclosetheidentityofacurrentor
26 formermemberofanexecutionteamordisclosearecordknowingthatitcould
27 identifyapersonasbeingacurrentorformermemberofanexecutionteam.
28 Anypersonwhoseidentityisdisclosedinviolationofthissectionshall:
29 (1)Haveacivilcauseofactionagainstapersonwhoviolatesthis
30 section;
31 (2)Beentitledtorecoverfromanysuchperson:
32 (a)Actualdamages;and
33 (b)Punitivedamagesonashowingofawillfulviolationofthis
34 section.
35 4.Notwithstandinganyprovisionoflawtothecontrary,ifamember
36 oftheexecutionteamislicensedbyaboardordepartment,thelicensingboard
37 ordepartmentshallnotcensure,reprimand,suspend,revoke,ortakeanyother
38 disciplinaryactionagainsttheperson'slicensebecauseofhisorher
39 participationinalawfulexecution.Allmembersoftheexecutionteamare
40 entitledtocoverageunderthestatelegalexpensefundestablishedbysection
41 105.711forconductofsuchexecutionteammemberarisingoutofand
42 performedinconnectionwithhisorherofficialdutiesonbehalfofthestateor
43 anyagencyofthestate,providedthatmoneysinthisfundshallnotbe
44 availableforpaymentofclaimsunderchapter287.]
[546.730.Ajudgmentofdeathmustbeexecutedwithinacorrectional
2 centerofthedepartmentofcorrections;andsuchexecutionshallbeunderthe
3 supervisionanddirectionofthedirectorofthedepartmentofcorrections.]
[546.740.Thechiefadministrativeofficerofthecorrectionalcenter,or
2 hisdulyappointedrepresentativeshallbepresentattheexecutionandthe
3 directorofthedepartmentofcorrectionsshallinvitethepresenceofthe
4 attorneygeneralofthestate,andatleasteightreputablecitizens,tobeselected
5 byhim;andheshallattherequestofthedefendant,permitsuchclergyor
HB118	5 6 religiousleaders,notexceedingtwo,asthedefendantmayname,andany
7 person,otherthananotherincarceratedoffender,relativesorfriends,notto
8 exceedfive,tobepresentattheexecution,togetherwithsuchpeaceofficersas
9 hemaythinkexpedient,towitnesstheexecution;butnopersonundertwenty-
10 oneyearsofageshallbeallowedtowitnesstheexecution.]
[546.750.Aftertheexecutionthechiefadministrativeofficerofthe
2 correctionalfacilityshallmakeareturnuponthedeathwarranttothecourtby
3 whichthejudgmentwasrendered,showingthetime,modeandmannerin
4 whichitwasexecuted.]
[546.800.If,afteranyfemaleconvictshallbesentencedtothe
2 punishmentofdeath,theofficerhavingchargeofherpersonshallhavereason
3 tosuspectthatsheispregnant,heshallinlikemannersummonajuryofsix
4 persons,notlessthanthreeofwhomshallbephysicians,andshallgivenotice
5 thereoftotheprosecutingattorneyofthecountywheresuchcriminal
6 proceedingsoriginated,ortothecircuitattorneyofthecityofSt.Louis,if
7 suchcriminalproceedingsoriginatedinthatcity,whoshallattend,andthe
8 proceedingsshallbehadasprovided.]
[546.810.Theinquisitionshallbesignedbythejuryandtheofficerin
2 chargeofsuchconvict,andifitappearthatsuchfemaleconvictispregnant
3 withchild,herexecutionshallbesuspendedandtheinquisitionshallbe
4 transmittedtothegovernor.]
[546.820.Wheneverthegovernorshallbesatisfiedthatthecauseof
2 suchsuspensionnolongerexists,heshallissuehiswarrant,appointingaday
3 fortheexecutionofsuchconvict,pursuanttohersentence;orhemay,athis
4 discretion,commuteherpunishmenttoimprisonmentinthepenitentiaryfor
5 life.]
[565.005.1.Atareasonabletimebeforethecommencementofthe
2 firststageofanytrialofmurderinthefirstdegreeatwhichthedeathpenaltyis
3 notwaived,thestateanddefendant,uponrequestandwithoutorderofthe
4 court,shallservecounseloftheopposingpartywith:
5 (1)Alistofallaggravatingormitigatingcircumstancesasprovidedin
6 subsection1ofsection565.032,whichthepartyintendstoproveatthesecond
7 stageofthetrial;
8 (2)Thenamesofallpersonswhomthepartyintendstocallas
9 witnessesatthesecondstageofthetrial;
10 (3)Copiesorlocationsandcustodianofanybooks,papers,
11 documents,photographsorobjectswhichthepartyintendstoofferatthe
12 secondstageofthetrial.Ifcopiesofsuchmaterialsarenotsuppliedto
13 opposingcounsel,thepartyshallcausethemtobemadeavailablefor
14 inspectionandcopyingwithoutorderofthecourt.
15 2.Thedisclosuresrequiredinsubsection1ofthissectionare
16 supplementaltothoserequiredbyrulesofthesupremecourtrelatingtoa
17 continuingdutytodiscloseinformation,theuseofmattersdisclosed,matters

19 withanapplicablediscoveryruleororder,allofwhichshallalsoapplytoany
20 disclosurerequiredbythissection.]
[565.030.1.Wheremurderinthefirstdegreeischargedbutnot
2 submittedorwherethestatewaivesthedeathpenalty,thesubmissiontothe
3 trierandallsubsequentproceedingsinthecaseshallproceedasinallother
4 criminalcases.
5 2.Wheremurderinthefirstdegreeissubmittedtothetrierwithouta
6 waiverofthedeathpenalty,thetrialshallproceedintwostagesbeforethe
7 sametrier.Atthefirststagethetriershalldecideonlywhetherthedefendant
8 isguiltyornotguiltyofanysubmittedoffense.Theissueofpunishmentshall
9 notbesubmittedtothetrieratthefirststage.Ifanoffenseischargedother
10 thanmurderinthefirstdegreeinacounttogetherwithacountofmurderinthe
11 firstdegree,thetrialjudgeshallassesspunishmentonanysuchoffense
12 accordingtolaw,afterthedefendantisfoundguiltyofsuchoffenseandafter
13 hefindsthedefendanttobeaprioroffenderpursuanttochapter558.
14 3.Ifmurderinthefirstdegreeissubmittedandthedeathpenaltywas
15 notwaivedbutthetrierfindsthedefendantguiltyofalesserhomicide,a
16 secondstageofthetrialshallproceedasinallothercriminalcases.The
17 attorneysmaythenargueasinothercriminalcasestheissueofpunishment,
18 afterwhichthetriershallassessanddeclarethepunishmentasinallother
19 criminalcases.
20 4.Ifthetrieratthefirststageofatrialwherethedeathpenaltywasnot
21 waivedfindsthedefendantguiltyofmurderinthefirstdegree,asecondstage
22 ofthetrialshallproceedatwhichtheonlyissueshallbethepunishmenttobe
23 assessedanddeclared.Evidenceinaggravationandmitigationofpunishment,
24 includingbutnotlimitedtoevidencesupportinganyoftheaggravatingor
25 mitigatingcircumstanceslistedinsubsection2or3ofsection565.032,maybe
26 presentedsubjecttotherulesofevidenceatcriminaltrials.Suchevidence
27 mayinclude,withinthediscretionofthecourt,evidenceconcerningthe
28 murdervictimandtheimpactoftheoffenseuponthefamilyofthevictimand
29 others.Rebuttalandsurrebuttalevidencemaybepresented.Thestateshallbe
30 thefirsttoproceed.Ifthetrierisajuryitshallbeinstructedonthelaw.The
31 attorneysmaythenarguetheissueofpunishmenttothejury,andthestateshall
32 havetherighttoopenandclosetheargument.Thetriershallassessand
33 declarethepunishmentatlifeimprisonmentwithouteligibilityforprobation,
34 parole,orreleaseexceptbyactofthegovernor:
35 (1)Ifthetrierfindsbyapreponderanceoftheevidencethatthe
36 defendantisintellectuallydisabled;or
37 (2)Ifthetrierdoesnotfindbeyondareasonabledoubtatleastoneof
38 thestatutoryaggravatingcircumstancessetoutinsubsection2ofsection
39 565.032;or
40 (3)Ifthetrierconcludesthatthereisevidenceinmitigationof
41 punishment,includingbutnotlimitedtoevidencesupportingthestatutory
42 mitigatingcircumstanceslistedinsubsection3ofsection565.032,whichis
43 sufficienttooutweightheevidenceinaggravationofpunishmentfoundbythe
44 trier;or

51 doubt.Ifthetrierisajuryitshallbeinstructedbeforethecaseissubmitted

53 anddeclarethepunishmentatlifeimprisonmentwithouteligibilityfor
54 probation,parole,orreleaseexceptbyactofthegovernorordeath.Thecourt
55 shallfollowthesameprocedureassetoutinthissectionwheneveritis
56 requiredtodeterminepunishmentformurderinthefirstdegree.
57 5.Uponwrittenagreementofthepartiesandwithleaveofthecourt,
58 theissueofthedefendant'sintellectualdisabilitymaybetakenupbythecourt
59 anddecidedpriortotrialwithoutprejudicingthedefendant'srighttohavethe
60 issuesubmittedtothetrieroffactasprovidedinsubsection4ofthissection.
61 6.Asusedinthissection,theterms"intellectualdisability"or
62 "intellectuallydisabled"refertoaconditioninvolvingsubstantiallimitations
63 ingeneralfunctioningcharacterizedbysignificantlysubaverageintellectual
64 functioningwithcontinualextensiverelateddeficitsandlimitationsintwoor
65 moreadaptivebehaviorssuchascommunication,self-care,homeliving,social
66 skills,communityuse,self-direction,healthandsafety,functionalacademics,
67 leisureandwork,whichconditionsaremanifestedanddocumentedbefore
68 eighteenyearsofage.
69 7.Theprovisionsofthissectionshallonlygovernoffensescommitted
70 onorafterAugust28,2001.]
[565.032.1.Inallcasesofmurderinthefirstdegreeforwhichthe
2 deathpenaltyisauthorized,thejudgeinajury-waivedtrialshallconsider,or
3 shallincludeinhisorherinstructionstothejuryforittoconsider:
4 (1)Whetherastatutoryaggravatingcircumstanceorcircumstances
5 enumeratedinsubsection2ofthissectionisestablishedbytheevidence
6 beyondareasonabledoubt;and
7 (2)Ifastatutoryaggravatingcircumstanceorcircumstancesisproven
8 beyondareasonabledoubt,whethertheevidenceasawholejustifiesa
9 sentenceofdeathorasentenceoflifeimprisonmentwithouteligibilityfor
10 probation,parole,orreleaseexceptbyactofthegovernor.

12 Indeterminingtheissuesenumeratedinsubdivisions(1)and(2)ofthis
13 subsection,thetriershallconsiderallevidencewhichitfindstobein
14 aggravationormitigationofpunishment,includingevidencereceivedduring
15 thefirststageofthetrialandevidencesupportinganyofthestatutory
16 aggravatingormitigatingcircumstancessetoutinsubsections2and3ofthis
17 section.Ifthetrierisajury,itshallnotbeinstructeduponanyspecific
18 evidencewhichmaybeinaggravationormitigationofpunishment,butshall

[565.035.1.Wheneverthedeathpenaltyisimposedinanycase,and

4 thecourttryingthecase,withintendaysafterreceivingthetranscript,shall
5 transmittheentirerecordandtranscripttothesupremecourttogetherwitha
6 noticepreparedbythecircuitclerkandareportpreparedbythetrialjudge.
7 Thenoticeshallsetforththetitleanddocketnumberofthecase,thenameof

30 (1)Affirmthesentenceofdeath;or
31 (2)Setthesentenceasideandresentencethedefendanttolife
32 imprisonmentwithouteligibilityforprobation,parole,orreleaseexceptbyact
33 ofthegovernor;or
