geographicalinformationsystems.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section67.1850,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection67.1850,toreadasfollows:
67.1850.1.Asusedinthissection,thefollowingtermsmean:
2 (1)"Community",anymunicipalityorcountyasdefinedinthissection;
3 (2)"County",anycountyformofgovernment;
4 (3)"Geographicalinformationsystem",acomputerized,spatialcoordinatemapping
5andrelationaldatabasetechnologywhich:
6 (a)Captures,assembles,stores,converts,manages,analyzes,amalgamatesand
7records,inthedigitalmode,allkindsandtypesofinformationanddata;
8 (b)Transformssuchinformationanddataintointelligenceandsubsequently
9retrieves,presentsanddistributesthatintelligencetoauserforuseinmakingtheintelligent
10decisionsnecessaryforsoundmanagement;
11 (4)"Municipality",anycitylocatedinanycounty.
12 2.Thedevelopmentofgeographicalinformationsystemshasnotbeenundertakenin
13anylarge-scaleandusefulwaybyprivateenterprise.Theuseofmoderntechnologycan
14enhancetheplanninganddecision-makingprocessesofcommunities.Thedevelopmentof
15geographicalinformationsystemsisatime-consumingandexpensiveactivity.Intheinterest
16ofmaintainingcommunitygovernmentsopenandaccessibletothepublic,information
17gatheredbycommunitiesforuseinageographicalinformationsystem,unlessproperlymade
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18aclosedrecord,shouldbeavailabletothepublic.However,accesstotheinformationina
19waybywhichapersoncouldrendertheinvestmentofthepublicinageographical
20informationsystemaspecialbenefittothatperson,andnottothepublic,shouldnotbe
21permitted.
22 3.Anycommunityasdefinedinthissectionmaycreateageographicalinformation
23systemforthecommunity.Thescopeofthegeographicalinformationsystemshallbe
24determinedbythegoverningbodyofthecommunity.Themethodofcreation,maintenance,
25useanddistributionofthegeographicalinformationsystemshallbedeterminedbythe
26governingbodyofthecommunity.Acommunityshallnotmandatetheuseofthissystem[or
27allocatethecostsofthesystemtononusers].
28 4.Theinformationcollectedorassimilatedbyacommunityforuseinageographical
29informationsystemshallnotbewithheldfromthepublic,unlessotherwiseproperlymadea
30closedrecordofthecommunityasprovidedbysection610.021.Theinformationcollectedor
31assimilatedbyacommunityforuseinageographicalinformationsystemneednotbe
32disclosedinaformwhichmaybereadormanipulatedbycomputer,absentalicense
33agreementbetweenthecommunityandthepersonrequestingtheinformation.
34 5.(1)Informationcollectedorassimilatedbyacommunityforuseinageographical
35informationsystemanddisclosedinanyform,otherthaninaformwhichmaybereador
36manipulatedbycomputer,shallbeprovided[forareasonablefee,asestablishedbysection
37610.026] tothepublic.
38 (2)Acommunitymaintainingageographicalinformationsystem[shall] maymake
39mapsandotherhard-copyproductsofthesystemavailabletothepublic.Thecostofthe
40maporotherproductshallnotexceedareasonablefeerepresentingthecosttothecommunity
41oftime,equipment, consumables,andpersonnelintheproductionofthemaporother
42product.
43 (3)Acommunitymaylicensetheuseofageographicalinformationsystem.[The
44totalcostoflicensingageographicalinformationsystemmaynotexceedthecost,as
45establishedbysection610.026,ofthe:
46 (1)Costtothecommunityoftime,equipmentandpersonnelintheproductionofthe
47informationinageographicalinformationsystemortheproductionofthegeographical
48informationsystem;and
49 (2)Costtothecommunityofthecreation,purchase,orotheracquisitionofthe
50informationinageographicalinformationsystemorofthegeographicalinformationsystem.]
51 (4)Nofeeshallbeassessedforaccesstoageographicalinformationsystemor
52anyplatformsordatabasespreparedbyacommunity.
53 6.Theprovisionsofthissectionshallnothinderthedailyorroutinecollectionofdata
54fromthegeographicalinformationsystembyrealestatebrokersandagents,titlecollectors,
HB1182	2 55developers,surveyors,utilitycompanies,banks,newsmediaormortgagecompanies,nor
56shalltheprovisionsallowforthechargingoffeesforthecollectionofsuchdata[exceeding
57thatallowedpursuanttosection610.026]. Theprovisionsofthissection,however,shallallow
58acommunitymaintainingageographicalinformationsystemtolicense[andestablishcosts
59for]theuseofthesystem'scomputerprogramandcomputersoftware[, andmayalsoestablish
60costsfortheuseofcomputerprogramsandcomputersoftwarethatprovideaccessto
61informationaggregatedwithgeographicinformationsysteminformation].
62 7.Acommunitydistributinginformationusedinageographicalinformationsystem
63ordistributingageographicalinformationsystemshallnotbeliableforanydamageswhich
64mayarisefromanyerrorwhichmayexistintheinformationorthegeographicalinformation
65system.
