SectionA.Section590.653,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection590.653,toreadasfollows:
590.653.1.Eachcity,countyandcitynotwithinacountymayestablishacivilian
2reviewboard,divisionofcivilianoversight,oranyotherentitywhichprovidescivilian
3revieworoversightofpoliceagencies,ormayuseanexistingcivilianreviewboardor
4divisionofcivilianoversightorothernamedentitywhichhasbeenappointedbythelocal
5governingbody,withtheauthoritytoinvestigateallegationsofmisconductbylocallaw
6enforcementofficerstowardsmembersofthepublic.Themembersshallnotreceive
7compensationbutshallreceivereimbursementfromthelocalgoverningbodyforall
8reasonableandnecessaryexpenses.
9 2.Theboard,division,oranyothersuchentity,shallhavethepowersolelylimitedto
10receiving,investigating,makingfindings, andrecommendingdisciplinaryactionupon
11complaintsbymembersofthepublicagainstmembersofthepolicedepartmentthatallege
12misconductinvolvingexcessiveuseofforce,abuseofauthority,discourtesy,oruseof
13offensivelanguage,including,butnotlimitedto,slursrelatingtorace,ethnicity,religion,
14gender,sexualorientation, anddisability.Thefindingsandrecommendationsoftheboard,
15division,orotherentityandthebasistherefor,shallbesubmittedtothechieflawenforcement
16official.Nofindingorrecommendationshallbebasedsolelyuponanunsworncomplaintor
17statement,norshallpriorunsubstantiated,unfoundedorwithdrawncomplaintsbethebasis
