HB1206--INDIVIDUALIZED INVESTIGATIONAL TREATMENT SPONSOR: Stinnett Thisbillestablishesthe"HopeforMissouriPatientsAct",which permitseligiblemanufacturerswithineligiblefacilitiestomake availableindividualized investigational drugs,biological products,ordevicesforeligiblepatients,butdoesnotmandate theprovisionofthesedrugs,products,ordevicestopatients. Thebillallowsfacilitiesormanufacturerstoeitherprovidethese itemstopatientswithoutreceivingcompensationortorequirea patienttopaythecostsofthemanufactureofthesedrugs, products,ordevices. Thebilladditionallypermits,butdoesnot require,healthplans,third-partyadministrators, orgovernmental agenciestoprovidecoverageforthecostsoforassociatedwith thesedrugs,products,ordevices,andprovidesthathospitalsor facilitieslicensedbytheDepartmentandHealthandSenior Servicestoprovideneworadditionalservicesunlessapprovedby thehospitalorfacility. Ifapatient'sdeathisproximatelycausedbytreatmentwiththese drugs,products,ordevices,thepatient'sestate,heirs,or deviseesarenotliableforanyremainingdebt,butthisisnot construedtobeanexemptiontoliabilityforanychargesfornon- experimentaltreatmentsprovidedtothepatient. Nolicensingboardordisciplinarysubcommitteeistorevoke,fail torenew,suspend,ortakeanyactionagainstahealthcare provider'slicensebasedsolelyontheprovider'srecommendations toaneligiblepatientregardingaccessto,ortreatmentwith, thesedrugs,products,ordevices,norwillanentityresponsible forMedicarecertificationdothesameforaprovider'sMedicare certification. Thebilladditionallyprohibitsanystateofficial,employee,or agentfromblockingorattemptingtoblockapatient'saccessto thesedrugs,products,ordevices;providesthatcounselingfroma licensedhealthcareproviderconsistentwithmedicalstandardsof careisnotaviolationofthisbill;andthataprivatecauseof actionagainstamanufacturerofthesedrugs,products,ordevices isnotestablishedthroughtheprovisionsofthisbill.
