49notamemberofarepresentativeorganizationshallmeetthedutiesunderthissection

51 3.(1)Arepresentativeorganizationoraproducerofarchitecturalpaintsoldat
52retailinthisstatethatisnotamemberofsuchrepresentativeorganizationshalldevelop
53andsubmittothedirectorforthedirector'sapprovalaplanfortheestablishmentofa
54post-consumerpaintcollectionprogram.Theprogramshallbestructuredto:
55 (a)Reducethegenerationofpost-consumerpaint;
HB1216	2 56 (b)Promotethereuseandrecyclingofpost-consumerpaint;
57 (c)Managethepost-consumerpaintwastestreamusingenvironmentallysound
58managementpractices;and
59 (d)Limitthedepartment'sroletooversightactivitiesthatincludeapprovingthe
60programplanandreviewingtheannualreport.
61 (2)Theplansubmittedunderthissectionshall:
62 (a)Providealistofparticipatingproducersandbrandscoveredbytheprogram;
63 (b)Provideinformationonthearchitecturalpaintproductscoveredunderthe
64program,suchasinteriororexteriorwater-andoil-basedcoatings,primers,sealers,or
65woodcoatings;
66 (c)Describehowtheprogramwillprovideforconvenientandcost-effective
67statewidecollectionofpost-consumerpaintinthisstate.Theproducersor
68representativeorganizationmaycoordinatetheprogramwithexistinghousehold
69hazardouswastecollectioninfrastructureasismutuallyagreeable.Apaintretailer
70shallbeauthorizedbytheproducersorrepresentativeorganizationasapaintcollection
71siteonlyifthepaintretailervoluntarilyagreestoactassuchandcomplieswithall
72applicablelawsandregulationsandtheretaillocationisconsistentwiththe
73maintenanceofacost-effectivenetworkofpaintcollectionlocations;
74 (d)Establishagoalforthenumberandgeographicdistributionofsitesfor
75collectionofpost-consumerpaintbasedonthefollowingcriteria:
76 a.AtleastninetypercentofMissouriresidentsshallhaveacollectionsitewithin
77afifteen-mileradiusandonesiteshallbeestablishedforeveryfiftythousandresidents
78ofthestateunlessotherwiseapprovedbythedirector;or
79 b.Iftheprogramisunabletomeettherequirementsofthissubsection,a
80collectioneventorotherdepartment-approvedcollectionserviceshallbescheduledona
81periodicbasistoservesuchresidents;
82 (e)Describehowpost-consumerpaintwillbemanagedinthemost
83environmentallyandeconomicallysoundmannerusingthefollowingstrategiesinthe
84followingorder:reuse,recycling,energyrecovery,anddisposal;
85 (f)Describeeducationandoutreacheffortstoinformconsumersaboutthe
86program.Sucheffortsshallinclude,butnotbelimitedto:
87 a.Informationaboutcollectionopportunitiesforpost-consumerpaint;
88 b.Informationaboutthechargefortheoperationoftheprogramthatshallbe
89includedinthepurchasepriceofallarchitecturalpaintsoldinthisstate;and
90 c.Effortstopromotethesourcereduction,reuse,andrecyclingofarchitectural
91paint;
HB1216	3 92 (g)Establishaper-containercosttobeaddedtoarchitecturalpaintsoldinthis
93stateasaresultoftheprogram.Thisper-containercost,knownasthepaintassessment
94fee,shallbereviewedbyanindependentfinancialauditortoensurethatanyaddedcost
95topaintsoldinthisstateasaresultoftheprogramdoesnotexceedthecoststooperate
96andsustaintheprograminaccordancewithsoundmanagementpractices;and
97 (h)Describehowtheprogramwillcompensateserviceprovidersforactivities
98conductedundertheprogramthatmayinclude:
99 a.Thecollectionofpost-consumerarchitecturalpaintandarchitecturalpaint
100containersthroughpermanentcollectionsites,collectionevents,orcurbsideservices;
101 b.Thereuseorprocessingofpost-consumerarchitecturalpaintatapermanent
102collectionsite;and
103 c.Thetransportation,recycling,andproperdisposalofpost-consumer
104architecturalpaint.
105 (3)Theindependentfinancialauditorrequiredunderparagraph(g)of
106subdivision(2)ofthissubsectionshallbeselectedbytherepresentativeorganization
107afterconsultationwiththedepartment.Theindependentfinancialauditorshallverify
108thatthecostaddedtoeachunitofpaintwillcoverthecostsoftheprogram.The
109departmentshallreviewtheworkproductoftheindependentfinancialauditor.The
110costofanyworkperformedbysuchindependentfinancialauditorshallbefundedby
111thepaintassessmentfeesauthorizedbytheprogram.
112 (4)Eachmanufacturerundertheplanshallincludeinthepriceofany
113architecturalpaintsoldtoretailersordistributorsinthestatetheper-containeramount
114ofthefeesetforthintheplanorfeeadjustment.Ifarepresentativeorganization
115implementstheplanforamanufacturer,themanufacturershallberesponsiblefor
116filing,reporting,andremittinganyfeeassessedunderthissectionforeachcontainerof
117architecturalpainttotherepresentativeorganization.Aretailerordistributorshallnot
118deducttheamountofthefeefromthepurchasepriceofanyarchitecturalpaintthe
119retailerordistributorsells.
120 (5)Nolaterthansixtydaysafterthesubmissionofaplanunderthissection,the
121directorshallmakeawrittendeterminationofwhethertoapprovetheplanas
122submittedordisapprovetheplan.Ifthedirectorfindstheplandoesnotmeetthe
123requirementsofthissection,thedirectorshallprovideawrittenexplanationofthe
124nonconformingitems.Withinsixtydaysfollowingreceiptofthedirector'swritten
125explanationofitemsthatdonotmeettherequirementsofthissection,therepresentative
126organizationortheproducerofarchitecturalpaintshallsubmitarevisedplantothe
127directorforapproval.
HB1216	4 128 (6)Thedepartmentshallenforcetheproducer'sortherepresentative
129organization'scompliancewiththeplanandmay,byregulationorbyusingexisting
130regulationspromulgatedundersections260.230,260.240,and260.249,establish
131enforcementproceduresandpenalties.
132 (7)Nolaterthantheimplementationdateoftheprogram,information
133regardingtheapprovedplan,thenamesofparticipatingproducers,andthebrandsof
134architecturalpaintcoveredbytheprogramshallbepostedonthedepartment'swebsite
135andonthewebsiteoftherepresentativeorganization.
136 (8)Theplanrequiredunderthissubsectionshallbesubmittedtothedepartment
137notlaterthantwelvemonthsaftertheeffectivedateofthissection.Thedepartment
138may,forgoodcauseshown,grantanextensionofthedeadlineforsubmission.
139 (9)Nothinginthissectionshallbeconstruedtorequirethedepartmentto
140developtheplanorestablishtheprogramauthorizedunderthissection.Such
141requirementshallbethesoleresponsibilityoftheproducersorrepresentative
142organization.
143 (10)Nothinginthissectionshallrequirearetailertotrack,file,report,submit,
144orremitafeeassessedunderthissection,salesdata,oranyotherinformationonbehalf
145ofamanufacturer,distributor,orrepresentativeorganization.Nothinginthissection
146shallprohibitamanufacturerandaretailerfromenteringintoremitteragreements.
147 4.(1)Thedepartmentshallestablishanadministrativefeetobepaidbyeach
148producerorrepresentativeorganizationsubmittingaplanunderthissection.The
149departmentshallsetthefeeatanamountthat,whenpaidbyeveryproduceror
150representativeorganizationthatsubmitsaplan,isadequatetoreimbursethe
151department'sfullcostsofadministeringthissection.Thetotalamountofannualfees
152collectedunderthissubdivisionshallnotexceedtheamountnecessarytoreimburse
153costsincurredbythedepartmenttoadministerthissection.Thedepartmentmay
154considerrelevantfactorswhenestablishingthefeeincluding,butnotlimitedto,the
155portionofarchitecturalpaintsoldinthestatebytheproducerorthemembersofthe
156representativeorganizationcomparedtothetotalamountofarchitecturalpaintsoldin
157thestatebyallproducersorrepresentativeorganizationssubmittingaplan.
158 (2)Eachproducerorrepresentativeorganizationimplementingaplanunder
159thissectionshallpaytheadministrativefeerequiredinsubdivision(1)ofthissubsection
160onorbeforeJuly1,2026,andannuallythereafter.Eachyearaftertheinitialpayment,
161theannualadministrativefeeshallnotexceedfivepercentoftheaggregateprogramfee
162addedtothecostofallarchitecturalpaintsoldbyproducersinthestateforthe
163precedingcalendaryear.Thedepartmentmayextendthetimeforpaymentupongood
164causeshown.
HB1216	5 165 5.Uponimplementationoftheprogram,eachproducershallincludeintheprice
166ofanyarchitecturalpaintsoldtoretailersanddistributorsinthisstatetheper-container
167amount,knownasthepaintassessmentfee,intheapprovedplan.Noretaileror
168distributorshalldeductsuchamountfromthepurchaseprice.
169 6.Retailersmayincorporatethefeeaspartofthepriceamountdisplayedto
170consumersofarchitecturalproducts.Retailersshallnotberequiredtoincorporatethe
171feeaspartofthepriceamountdisplayedtoconsumersforarchitecturalproducts,
172providedthattheretailersmakeinformationaboutthefeeavailabletoconsumersof
173architecturalpaintproductspriortopurchase.
174 7.(1)Aftertheprogramisimplemented,noproducerorretailershallsellor
175offerforsalearchitecturalpainttoanypersoninthisstateunlesstheproducerofa
176paintbrandorarepresentativeorganizationisimplementingorparticipatinginthe
177programasrequiredbythissection.
178 (2)Aretailershallbedeemedtobeincompliancewiththissectionif,onthedate
179thearchitecturalpaintwasofferedforsale,theproducerislistedonthedepartment's
180websiteasimplementingorparticipatingintheprogramorifthepaintbrandislisted
181onthedepartment'swebsiteasbeingincludedintheprogram.
182 (3)Apaintcollectionsiteauthorizedunderthissectionshallnotchargeany
183additionalamountforthedisposalofpaintwhenthepaintisofferedfordisposal.
184 (4)Aproducerortherepresentativeorganizationthatorganizesthecollection,
185transport,andprocessingofpost-consumerpaintinaccordancewiththeprogramshall
186notbeliableforanyclaimofaviolationofantitrust,restraintoftrade,unfairtrade
187practice,orotheranticompetitiveactivityarisingfromconductundertakenin
188accordancewiththeprogramunderthissection.
189 (5)BeforeMarchthirty-firstofeachyear,theproducersorrepresentative
190organizationshallsubmitanannualreportforthepreviousyeartothedirectorthat
191detailstheprogram.Thefirstreportshallbesubmittedafterthefirstfullyearof
192implementation.Thedirectormay,forgoodcauseshown,extendthedeadlineforfiling
193thereport.Thereportorinformationrelatingtothereportshallbepostedonthe
194department'swebsiteandonthewebsiteoftherepresentativeorganization.Thereport
195shallcontainatleastthefollowing:
196 (a)Adescriptionofthemethodsusedtocollect,transport,andprocesspost-
197consumerpaintinthisstate;
198 (b)Thevolumeandtypeofpost-consumerpaintcollectedbymethodof
199disposition,containinginformationaboutreuse,recycling,othermethodsofprocessing,
200andanyotherrelatedandappropriateinformation;

202paint;
203 (d)Thetotalcostoftheprogram;and
204 (e)Anindependentfinancialauditcompletedbyanindividualfinancialauditor
205chosenbytheproducersortherepresentativeorganization.
206 (6)Financial,production,orsalesdatareportedtothedepartmentbya
207producerorbytherepresentativeorganizationshallnotbesubjecttodisclosure,butthe
208directormayreleaseasummaryformofsuchdatathatdoesnotdisclosefinancial,
209production,orsalesdataoftheproducer,retailer,orrepresentativeorganization.
210 (7)Theproducersortherepresentativeorganizationshallimplementthe
211programrequiredunderthissectiononJanuary1,2027,orsixmonthsafterthe
212approvaloftheplanunderthissection,whicheveroccurslater.
213 8.(1)Generatorsofhouseholdwastesandconditionallyexemptsmallquantity
214generatorsmaytransportorsendarchitecturalpaintstoapaintcollectionsitetothe
215extentpermittedbyaprogramapprovedbythedirector.
216 (2)Paintcollectionsitesmaycollectandtemporarilystorearchitecturalpaints
217generatedbyentitiesspecifiedinsubdivision(1)ofthissubsectioninaccordancewith
218therequirementsoftheprograminlieuofanyotherwiseapplicablerequirementsof
219statelawsorregulations.
220 (3)Nothinginthissectionshallbeconstruedtorestrictthecollectionof
221architecturalpaintbyaprogramwheresuchcollectionisauthorizedbyanyotherstate
222lawsorregulations.
223 (4)Nothinginthissectionshallbeconstruedtoaffectanyrequirements
224applicabletofacilitiesthattreat,dispose,orrecyclearchitecturalpaintunderanyother
225statelawsorregulations.
226 9.Thedirectormaypromulgateallnecessaryrulesandregulationsforthe
227administrationofthissection.Anyruleorportionofarule,asthattermisdefinedin
228section536.010,thatiscreatedundertheauthoritydelegatedinthissectionshall
229becomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter
230536and,ifapplicable,section536.028.Thissectionandchapter536arenonseverable
231andifanyofthepowersvestedwiththegeneralassemblypursuanttochapter536to
232review,todelaytheeffectivedate,ortodisapproveandannularulearesubsequently
233heldunconstitutional,thenthegrantofrulemakingauthorityandanyruleproposedor
