Torepealsection650.550,RSMo,andtoenactinlieuthereofonenewsectionrelatingtothe
economicdistresszonefund.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section650.550,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection650.550,toreadasfollows:
650.550.1.Thereisherebycreatedinthestatetreasurythe"EconomicDistressZone
2Fund",whichshallconsistofmoneyappropriatedunderthissection.Thestatetreasurershall
3becustodianofthefund.Inaccordancewithsections30.170and30.180,thestatetreasurer
4mayapprovedisbursements.Thefundshallbeadedicatedfundandmoneyinthefundshall
5beusedsolelybythedepartmentofpublicsafetytoprovidefundingtoorganizations
6registeredwiththeUnitedStatesInternalRevenueServiceasa501(c)(3)corporationthat
7provideservicestoresidentsofthestateinareasofhighincidentsofcrimeanddeteriorating
8infrastructureinforthepurposeofdeterringcriminalbehaviorinsuchareas.Anymoneys
9appropriatedandanyothermoneysmadeavailablebygift,grant,bequest,contribution,or
10otherwisetocarryoutthepurposeofthissection,andallinterestearnedon,andincome
11generatedfrom,moneysinthefundshallbepaidto,anddepositedin,theeconomicdistress
12zonefund.
13 2.Notwithstandingtheprovisionsofsection33.080tothecontrary,anymoneys
14appropriatedtothefundoverthreemilliondollars,excludinganymoneysmadeavailableby
15gift,grant,bequest,contribution,orotherwise,thatremaininthefundattheendofthe
16bienniumshallreverttothecreditofthegeneralrevenuefund.
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17 3.Thedepartmentofpublicsafetyshallpromulgaterulestocarryouttheprovisions
18ofthissection.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis
19createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies
20withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.
21Thissectionandchapter536arenonseverableandifanyofthepowersvestedwiththe
22generalassemblypursuanttochapter536toreview,todelaytheeffectivedate,orto
23disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof
24rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2021,shallbeinvalid
25andvoid.
26 4.Asusedinthissection,"areasofhighincidentsofcrimeanddeteriorating
27infrastructure"shallmeanacitywithahomiciderateofatleastseventimesthenational
28averageaccordingtotheFederalBureauofInvestigation'sUniformCrimeReportingSystem;
29apovertyratethatexceedstwentypercentaccordingtotheUnitedStatesCensusBureau;and
30hasaschooldistrictwithatleasteightypercentofstudentswhoqualifyforfreeorreduced
31lunch.
32 5.TheprovisionsofthissectionshallterminateonAugust28,[2024] 2028.
