2knownassection566.088,toreadasfollows:
566.088.1.Apersoncommitstheoffenseofsexualexploitationbya
2clergypersonifsuchpersonisorholdsoneselfouttobeaclergypersonasdefinedin
3subsection3ofthissection,engagesinsexualconductasdefinedinsection566.010with
4anotherpersonwhoisnottheclergyperson'sspouse,andthesexualconductoccurred:
5 (1)Duringthecourseofameetinginwhichthevictimsoughtorreceived
6religious,spiritual,marital,orrelationshipadvice,counseling,therapy,aid,orcomfort
7fromtheclergypersonorwithinonehundredtwentydaysaftersuchmeeting;
8 (2)Duringaperiodoftimeinwhichthevictimwasmeetingonanongoingbasis
9withtheclergypersontoseekorreceivereligious,spiritual,marital,orrelationship
10advice,counseling,therapy,aid,orcomfortfromtheclergyperson;or
11 (3)Whiletheclergypersonwasinapositionoftrustorauthorityoverthevictim
12andusedthatpositionoftrustorauthoritytoengageinthesexualconduct.
13 2.Consentbythevictimshallbeadefenseunderthissectionunlessthevictimis
14achildunderseventeenyearsofage.

16ministerofthegospel,clergy,pastor,priest,bishop,cardinal,rabbi,ChristianScience
