Thisbillprohibitsanew"WindEnergyConversionSystem",as
definedinthebill,tobegincommercialoperationsafterAugust
28,2025,unlessthatdeveloper,owner,oroperatorappliestothe
FederalAviationAdministration (FAA)forinstallationofalight-
mitigatingtechnologysystem.Iftheinstallationisapprovedby
theFAA,thedeveloper,owner,oroperatorofsuchwindenergy
conversionsystemmustinstallthelight-mitigatingtechnology
systemonapprovedturbineswithin24monthsofapproval.
BeforeAugust28,2030,anydeveloper,owner,oroperatorofa
commercialwindenergyconversionsystemwithoutalight-mitigating
technologysystemmustapplytotheFAAforinstallationand
operationofasystem.IftheinstallationisapprovedbytheFAA,
thedeveloper,owner,oroperatormustinstallthesystemon
approvedturbineswithin24monthsofapproval.
Anyvendorselectedforinstallationofalight-mitigating
technologysystemmustprovidetotheDepartmentofNatural
Resourcesnoticeoftheprogressoftheinstallationofthesystem.
Iftheinstallationisdelayedbeyondthe24-monthrequirement,the
vendormustprovidenoticetotheDepartmentatleasteverythree
months,withanupdateonthereasonsforthedelayandcurrent
statusofinstallation. Anycostsassociatedwiththe
installation,implementation, operation,andmaintenanceofthe
systemmustbetheresponsibility ofthedeveloper,owner,or
operatorofthewindenergyconversionsystem.
Anydeveloper,owner,oroperatorthatisapprovedfortoinstalla
light-mitigatingsystembutdoesnot,isliableforafineof
$5,000perday,perturbine,untilthesystemisinstalled.
