SectionA.Sections488.040and494.455,RSMo,arerepealedandtwonewsections
2enactedinlieuthereof,tobeknownassections488.040and494.455,toreadasfollows:
488.040.[1.]Eachgrandandpetitjurorshall[, pursuanttotheprovisionsofsection
2494.455,receivesixdollarsperdayforeverydayheorshemayactuallyserveassuchand
3sevencentsforeverymileheorshemaynecessarilytravelgoingfromhisorherplaceof
4residencetothecourthouseandreturning,tobepaidfromfundsofthecountyoracitynot
5withinacounty.
6 2.Providedthatacountyoracitynotwithinacountyauthorizesdailycompensation
7payablefromcountyorcityfundsforjurorswhoserveinthatcountypursuanttosubsection3
8ofthissectionintheamountofatleastsixdollarsperdayinadditiontotheamountrequired
9bysubsection1ofthissection,apersonshallreceiveanadditionalsixdollarsperday,
10pursuanttotheprovisionsofsection494.455,tobereimbursedbythestateofMissouriso
11thatthetotalcompensationpayableshallbeatleasteighteendollars,plusmileageas
12indicatedinsubsection1ofthissection,foreachdaythatthepersonactuallyservesasapetit
13jurorinaparticularcase;orforeachdaythatapersonactuallyservesasagrandjurorduring
14atermofagrandjury.Thestateshallreimbursethecountyforsixdollarsoftheadditional
15jurorcompensationprovidedbythissubsection.
16 3.Thegoverningbodyofeachcountyoracitynotwithinacountymayauthorize
17additionaldailycompensationandmileageallowanceforjurors,whichadditional

19governingbodyofeachcountyoracitynotwithinacountymayauthorizeadditionaldaily
20compensationandmileageallowanceforjurorsattendingacoroner'sinquest.Jurorsmay
21receivetheadditionalcompensationandmileageallowanceauthorizedbythissubsection
22onlyifthegoverningbodyofthecountyorthecitynotwithinacountyauthorizesthe
23additionalcompensation.Theprovisionsofthissubsectionauthorizingadditional
24compensationshallterminateupontheissuanceofamandatebytheMissourisupreme
25courtwhichresultsinthestateofMissouribeingobligatedorrequiredtopayanysuch
26additionalcompensationevenifsuchadditionalcompensationisformallyapprovedor
27authorizedbythegoverningbodyofacountyoracitynotwithinacounty.
28 4.Wheneachpanelofjurorssummonedandattendingcourthascompletedits
29service,theboardofjurycommissionersshallcausetobesubmittedtothegoverningbodyof
30thecountyoracitynotwithinacountyastatementoffeesearnedbyeachjuror.Withinthirty
31daysofthesubmissionofthestatementoffees,thegoverningbodyshallcausepaymenttobe
32madetothosejurorssummonedthefeesearnedduringtheirserviceasjurors] receivedaily
33compensationandmileageallowanceintheamountprovidedbylawpursuanttosection

494.455.1.[Eachcountyorcitynotwithinacountymayelecttocompensateits
2jurorspursuanttosubsection2ofthissectionexceptasotherwiseprovidedinsubsection3of
3thissection.
4 2.]Eachgrandandpetitjurorshallreceiveaminimumofsixdollarsperday,for
5everyday[heorshe]thejurormayactuallyserveas[such] ajuror,and[sevencents] the
6mileagerateasprovidedbysection33.095forstateemployeesforeverymile[heorshe]
7thejurormaynecessarilytravelgoingfrom[hisorher]thejuror'splaceofresidencetothe
8courthouseandreturning,tobepaidfromfundsofthecountyoracitynotwithinacounty.
9Eachcountyorcitynotwithinacountymayelecttocompensateitsjurorspursuantto
10subsection2ofthissection,exceptasotherwiseprovidedinsubsection3ofthissection.
11 2.Thegoverningbodyofeachcountyoracitynotwithinacountymayauthorize
12additionaldailycompensationandmileageallowanceforjurors,whichadditional
13compensationshallbepaidfromthefundsofthecountyoracitynotwithinacounty.
14Thegoverningbodyofeachcountyoracitynotwithinacountymayauthorizeadditional
15dailycompensationandmileageallowanceforjurorsattendingacoroner'sinquest.Jurors
16mayreceivetheadditionalcompensationandmileageallowanceauthorizedbythissubsection
17onlyifthegoverningbodyofthecountyorthecitynotwithinacountyauthorizesthe
18additionalcompensation.Theprovisionsofthissubsectionauthorizingadditional
19compensationshallterminateupontheissuanceofamandatebytheMissourisupreme
20courtwhichresultsinthestateofMissouribeingobligatedorrequiredtopayanysuch

22authorizedbythegoverningbodyofacountyoracitynotwithinacounty.Providedthata
23countyoracitynotwithinacountyauthorizesdailycompensationpayablefromcountyor
24cityfundsforjurorswhoserveinthatcountypursuanttothissubsectionintheamountofat
25leastsixdollarsperdayinadditiontotheamountrequiredby[this] subsection1ofthis
26section, apersonshallreceiveanadditionalsixdollarsperdaytobereimbursedbythestate
27ofMissourisothatthetotalcompensationpayableshallbeatleasteighteendollars,plus
28mileageforeachdaythatthepersonactuallyservesasapetitjurorinaparticularcase;orfor
29eachdaythatapersonactuallyservesasagrandjurorduringatermofagrandjury.Thestate
30shallreimbursethecountyforsixdollarsoftheadditionaljurorcompensationprovidedby
31thissubsection.
32 3.[Inanycountyofthefirstclassificationwithoutacharterformofgovernmentand
33withapopulationofatleasttwohundredthousandinhabitants,nograndorpetitjurorshall
34receivecompensationforthefirsttwodaysofservice,butshallreceivefiftydollarsperday
35forthethirddayandeachsubsequentdayheorshemayactuallyserveassuch,andseven
36centsforeverymileheorshemaynecessarilytravelgoingfromhisorherplaceofresidence
37tothecourthouseandreturning,tobepaidfromfundsofthecounty.]Notwithstandingthe
38provisionsofsubsection1or2ofthissection,byamajorityvote,thegoverningbodyof
39acountyorcitynotwithinacountymayadoptasystemforjurorcompensationinthe
40countyorcitynotwithinacountyasfollows:eachgrandorpetitjurorshallreceivefifty
41dollarsperdayforthethirddaythejurormayactuallyserveasajurorandforeach
42subsequentdayofactualservice,andthemileagerateasprovidedbysection33.095for
43stateemployeesforeverymilethejurormaynecessarilytravelfromthejuror'splaceof
44residencetothecourthouseandreturning,tobepaidfromfundsofthecountyorcity
45notwithinacounty,providedthatnograndorpetitjurorshallreceivecompensationfor
46thefirsttwodaysthejurormayactuallyserveassuch.
47 4.Wheneachpanelofjurorssummonedandattendingcourthascompletedits
48service,theboardofjurycommissionersshallcausetobesubmittedtothegoverningbodyof
49thecountyoracitynotwithinacountyastatementoffeesearnedbyeachjuror.Withinthirty
50daysofthesubmissionofthestatementoffees,thegoverningbodyshallcausepaymenttobe
51madetothosejurorssummonedthefeesearnedduringtheirserviceasjurors.
