Torepealsection476.458,RSMo,andtoenactinlieuthereofonenewsectionrelatingto
retirementforcertainjudges.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section476.458,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection476.458,toreadasfollows:
476.458.1.Exceptasotherwiseprovidedinthissection,orbyanyotherlaw,
2associatecircuitjudges,magistratejudges,probatejudges,andprobateexofficiomagistrate
3judgesshallretireattheageofseventyyearsandmayparticipate,ifotherwiseeligible,inthe
4retirementplanestablishedbysections476.515to476.570,exceptthat,theprovisionsof
5sections476.458,[478.015,478.021,478.071,] 478.072,[482.040,482.090,482.230,] and
6482.300to482.365[and483.497] shallnotpreventanypersonholdingtheofficeofassociate
7circuitjudge,magistratejudge,probatejudgeorprobateexofficiomagistratejudge,orany
8personelectedorappointedtotheofficeofassociatecircuitjudge,magistratejudge,probate
9judgeorprobateexofficiomagistratejudgefromholdingofficeduringtheremainderofthe
10termtowhichheorshewaselectedorappointed.
11 2.Anymagistratejudge,probatejudgenotunderthenonpartisancourtplan,or
12probateexofficiomagistratejudgewhoonAugust13,1976,orwithinsixmonthsthereafter,
13isseventyyearsofageorolder,maypetitionthecommissiononretirement,removaland
14disciplinetocontinuetoserveuntilageseventy-sixifheorshehasnotcompletedatotalof
15twelveyearsofserviceasajudge.Exceptasotherwiseprovidedbyanyotherlaw,any
16magistratejudge,probatejudgenotunderthenonpartisancourtplan,orprobateexofficio
17magistratejudge,whoisinofficeonAugust13,1976,may,withinsixmonthsbefore
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18attainingtheageofseventyyears,petitionthecommissiononretirement,removal,and
19disciplinetobeallowedtoserveafterheorshehasattainedthatageuntilageseventy-sixor
20hascompletedatotaloftwelveyearsofserviceasajudge,whichevershalloccurfirst.Ifthe
21commissionfindsthepetitionertobeabletoperformhisorherdutiesandapprovessuch
22service,thepetitionermaycontinuetoserveassuchajudgeuntilageseventy-sixifheorshe
23hasnotcompletedatotaloftwelveyearsofserviceasajudgeatsuchage.Nopersonshallbe
24permittedtoserveassuchajudgebeyondtheageofseventy-sixyearsregardlessofwhether
25ornotheorshehascompletedatotaloftwelveyearsexceptforthepurposeofcompleting
26thetermtowhichheorshewaselectedorappointed,asprovidedinsubsection1ofthis
27section.
28 3.Anymagistrate,regardlessofageelectedin1976tofillanunexpiredtermshallbe
29permittedtocompletethatterm.
