48weekperiodshallbeincludedinthedeterminationofunemploymentbenefitsuponthe 49filingofaclaim,providedallothereligibilityrequirementsaremet; 50 (5)Theclaimanthasmadeaclaimforbenefitswithinfourteendaysfromthelastday 51oftheweekbeingclaimed.Thefourteen-dayperiodmay,forgoodcause,beextendedto 52twenty-eightdays; HB1381 2 53 80section288.034,shallbepayableinthesameamount,onthesametermsandsubjecttothe 81sameconditionsascompensationpayableonthebasisofotherservicesubjecttothislaw; 82exceptthat: 83 (a)Withrespecttoserviceperformedinaninstructional,research,orprincipal 84administrativecapacityforaneducationalinstitution,benefitsshallnotbepaidbasedonsuch 85servicesforanyweekofunemploymentcommencingduringtheperiodbetweentwo 86successiveacademicyearsorterms,orduringasimilarperiodbetweentworegularbutnot 87successiveterms,orduringaperiodofpaidsabbaticalleaveprovidedforintheindividual's 88contract,toanyindividualifsuchindividualperformssuchservicesinthefirstofsuch 89academicyears(orterms)andifthereisacontractorareasonableassurancethatsuch HB1381 3 90individualwillperformservicesinanysuchcapacityforanyeducationalinstitutioninthe 91secondofsuchacademicyearsorterms; 92 (b)Withrespecttoservicesperformedinanycapacity(otherthaninstructional, 93research,orprincipaladministrativecapacity)foraneducationalinstitution,benefitsshallnot 94bepaidonthebasisofsuchservicestoanyindividualforanyweekwhichcommencesduring 95aperiodbetweentwosuccessiveacademicyearsortermsifsuchindividualperformssuch 96servicesinthefirstofsuchacademicyearsortermsandthereisacontractorareasonable 97assurancethatsuchindividualwillperformsuchservicesinthesecondofsuchacademic 98yearsorterms; 99 (c)Withrespecttoservicesdescribedinparagraphs(a)and(b)ofthissubdivision, 100benefitsshallnotbepaidonthebasisofsuchservicestoanyindividualforanyweekwhich 101commencesduringanestablishedandcustomaryvacationperiodorholidayrecessifsuch 102individualperformedsuchservicesintheperiodimmediatelybeforesuchvacationperiodor 103holidayrecess,andthereisreasonableassurancethatsuchindividualwillperformsuch 104servicesimmediatelyfollowingsuchvacationperiodorholidayrecess; 105 (d)Withrespecttoservicesdescribedinparagraphs(a)and(b)ofthissubdivision, 106benefitspayableonthebasisofservicesinanysuchcapacityshallbedeniedasspecifiedin 107paragraphs(a),(b),and(c)ofthissubdivisiontoanyindividualwhoperformedsuchservices 108ataneducationalinstitutionwhileintheemployofaneducationalserviceagency,andforthis 109purposetheterm"educationalserviceagency"meansagovernmentalagencyor 110governmentalentitywhichisestablishedandoperatedexclusivelyforthepurposeof 111providingsuchservicestooneormoreeducationalinstitutions. 112 (2)Ifcompensationisdeniedforanyweekpursuanttoparagraph(b)or(d)of 113subdivision(1)ofthissubsectiontoanyindividualperformingservicesataneducational 114institutioninanycapacity(otherthaninstructional,researchorprincipaladministrative 115capacity),andsuchindividualwasnotofferedanopportunitytoperformsuchservicesforthe 116secondofsuchacademicyearsorterms,suchindividualshallbeentitledtoaretroactive 117paymentofthecompensationforeachweekforwhichtheindividualfiledatimelyclaimfor 118compensationandforwhichcompensationwasdeniedsolelybyreasonofparagraph(b)or 119(d)ofsubdivision(1)ofthissubsection. 120 4.(1)Aclaimantshallbeineligibleforwaitingweekcredit,benefitsorsharedwork 121benefitsforanyweekforwhichheorsheisreceivingorhasreceivedremunerationexceeding 122hisorherweeklybenefitamountorsharedworkbenefitamountintheformof: 123 (a)Compensationfortemporarypartialdisabilitypursuanttotheworkers' 124compensationlawofanystateorpursuanttoasimilarlawoftheUnitedStates; 125 (b)Agovernmentalorotherpension,retirementorretiredpay,annuity,orother 126similarperiodicpaymentwhichisbasedonthepreviousworkofsuchclaimanttotheextent HB1381 4 127thatsuchpaymentisprovidedfromfundsprovidedbyabaseperiodorchargeableemployer 128pursuanttoaplanmaintainedorcontributedtobysuchemployer;but,exceptforsuch 129paymentsmadepursuanttotheSocialSecurityActortheRailroadRetirementActof1974 130(orthecorrespondingprovisionsofpriorlaw),theprovisionsofthisparagraphshallnotapply 131iftheservicesperformedforsuchemployerbytheclaimantafterthebeginningofthebase 132period(orremunerationforsuchservices)donotaffecteligibilityfororincreasetheamount 133ofsuchpension,retirementorretiredpay,annuityorsimilarpayment. 134 (2)Iftheremunerationreferredtointhissubsectionislessthanthebenefitswhich 135wouldotherwisebedue,theclaimantshallbeentitledtoreceiveforsuchweek,ifotherwise 136eligible,benefitsreducedbytheamountofsuchremuneration,and,ifsuchbenefitisnota 137multipleofonedollar,suchamountshallbeloweredtothenextmultipleofonedollar. 138 (3)Notwithstandingtheprovisionsofsubdivisions(1)and(2)ofthissubsection,ifa 139claimanthascontributedinanywaytotheSocialSecurityActortheRailroadRetirementAct 140of1974,orthecorrespondingprovisionsofpriorlaw,nopartofthepaymentsreceived 141pursuanttosuchfederallawshallbedeductiblefromtheamountofbenefitsreceived 142pursuanttothischapter. 143 5.Aclaimantshallbeineligibleforwaitingweekcreditorbenefitsforanyweekfor 144whichorapartofwhichheorshehasreceivedorisseekingunemploymentbenefitspursuant 145toanunemploymentinsurancelawofanotherstateortheUnitedStates;provided,thatifitbe 146finallydeterminedthattheclaimantisnotentitledtosuchunemploymentbenefits,such 147ineligibilityshallnotapply. 148 6.(1)Aclaimantshallbeineligibleforwaitingweekcreditorbenefitsforanyweek 149forwhichthedeputyfindsthatsuchclaimant'stotalorpartialunemploymentisduetoa 150stoppageofworkwhichexistsbecauseofalabordisputeinthefactory,establishmentorother 151premisesinwhichsuchclaimantisorwaslastemployed.Intheeventtheclaimantsecures 152otheremploymentfromwhichheorsheisseparatedduringtheexistenceofthelabordispute, 153theclaimantmusthaveobtainedbonafideemploymentasapermanentemployeeforatleast 154themajorpartofeachoftwoweeksinsuchsubsequentemploymenttoterminatehisorher 155ineligibility.If,inanycase,separatebranchesofworkwhicharecommonlyconductedas 156separatebusinessesatseparatepremisesareconductedinseparatedepartmentsofthesame 157premises,eachsuchdepartmentshallforthepurposesofthissubsectionbedeemedtobea 158separatefactory,establishmentorotherpremises.Thissubsectionshallnotapplyifitis 159showntothesatisfactionofthedeputythat: 160 (a)Theclaimantisnotparticipatinginorfinancingordirectlyinterestedinthelabor 161disputewhichcausedthestoppageofwork;and 162 (b)Theclaimantdoesnotbelongtoagradeorclassofworkersofwhich, 163immediatelyprecedingthecommencementofthestoppage,thereweremembersemployedat HB1381 5 164thepremisesatwhichthestoppageoccurs,anyofwhomareparticipatinginorfinancingor 165directlyinterestedinthedispute. 166 (2)"Stoppageofwork"asusedinthissubsectionmeansasubstantialdiminutionof 167theactivities,productionorservicesattheestablishment,plant,factoryorpremisesofthe 168employingunit.Thisdefinitionshallnotapplytoastrikewheretheemployeesinthe 169bargainingunitwhoinitiatedthestrikeareparticipatinginthestrike.Suchemployeesshall 170notbeeligibleforwaitingweekcreditorbenefitsduringtheperiodwhenthestrikeisin 171effect,regardlessofdiminution,unlesstheemployerhasbeenfoundguiltyofanunfairlabor 172practicebytheNationalLaborRelationsBoardorafederalcourtoflawforanactoractions 173precedingorduringthestrike. 174 7.OnorafterJanuary1,1978,benefitsshallnotbepaidtoanyindividualonthebasis 175ofanyservices,substantiallyallofwhichconsistofparticipatinginsportsorathleticevents 176ortrainingorpreparingtosoparticipate,foranyweekwhichcommencesduringtheperiod 177betweentwosuccessivesportseasons(orsimilarperiods)ifsuchindividualperformedsuch 178servicesinthefirstofsuchseasons(orsimilarperiods)andthereisareasonableassurance 179thatsuchindividualwillperformsuchservicesinthelaterofsuchseasons(orsimilar 180periods). 181 8.Benefitsshallnotbepayableonthebasisofservicesperformedbyanalien,unless 182suchalienisanindividualwhowaslawfullyadmittedforpermanentresidenceatthetime 183suchserviceswereperformed,waslawfullypresentforpurposesofperformingsuchservices, 184orwaspermanentlyresidingintheUnitedStatesundercoloroflawatthetimesuchservices 185wereperformed(includinganalienwhowaslawfullypresentintheUnitedStatesasaresult 186oftheapplicationoftheprovisionsofSection212(d)(5)oftheImmigrationandNationality 187Act,8U.S.C.Section1182,asamended). 188 (1)Anydataorinformationrequiredofindividualsapplyingforbenefitstodetermine 189whetherbenefitsarenotpayabletothembecauseoftheiralienstatusshallbeuniformly 190requiredfromallapplicantsforbenefits. 191 (2)Inthecaseofanindividualwhoseapplicationforbenefitswouldotherwisebe 192approved,nodeterminationthatbenefitstosuchindividualarenotpayablebecauseofsuch 193individual'salienstatusshallbemadeexceptuponapreponderanceoftheevidence. 194 9.Aclaimantshallbeineligibleforwaitingweekcreditorbenefitsforanyweeksuch 195claimanthasanoutstandingpenaltywhichwasassessedbaseduponanoverpaymentof 196benefits,asprovidedforinsubsection9ofsection288.380. 197 10.Thedirectorsofthedivisionofemploymentsecurityandthedivisionof 198workforcedevelopmentshallsubmittothegovernor,thespeakerofthehouseof 199representatives,andthepresidentprotemofthesenatenolaterthanOctober15,2006,a 200reportoutliningtheirrecommendationsforhowtoimproveworksearchverificationand HB1381 6 201claimantreemploymentactivities.Therecommendationsshallinclude,butnotlimitedto 202howtobestutilize"greathires.org",andhowtoreducetheaveragedurationofunemployment 203insuranceclaims.Eachcalendaryearthereafter,thedirectorsshallsubmitareportcontaining 204theirrecommendationsontheseissuesbyDecemberthirty-firstofeachyear. 205 11.Forpurposesofthissection,aclaimantmaysatisfyreportingrequirements 206providedunderthissectionbyreportingbyinternetcommunicationoranyothermeans 207deemedacceptablebythedivisionofemploymentsecurity. 288.500.1.Thereiscreatedunderthissectionavoluntary"SharedWork 2UnemploymentCompensationProgram".Inconnectiontherewith,thedivisionmayadopt 3rulesandestablishprocedures,notinconsistentwiththissection,whicharenecessaryto 4administerthisprogram. 5 2.Asusedinthissection,thefollowingtermsmean: 6 (1)"Affectedunit",aspecifieddepartment,shift,orotherunitofthreeormore 7employeeswhichisdesignatedbyanemployertoparticipateinasharedworkplan; 8 (2)"Division",thedivisionofemploymentsecurity; 9 (3)"Fringebenefit",healthinsurance,aretirementbenefitreceivedunderadefined 10benefitpensionplan,asdefinedinSection414(j)oftheInternalRevenueCode,or 11contributionsunderadefinedcontributionplan,asdefinedinSection414(i)oftheInternal 12RevenueCode,apaidvacationday,apaidholiday,sickleave,andanyotheranalogous 27reduceunemploymentandstabilizetheworkforcebyallowingcertainemployeestocollect 28unemploymentcompensationbenefitsiftheemployeessharetheworkremainingaftera HB1381 7 30 3.Anemployerwhowishestoparticipateinthesharedworkunemployment 31compensationprogramestablishedunderthissectionshallsubmitawrittensharedworkplan 32inaformacceptabletothedivisionforapproval.Asaconditionforapprovalbythedivision, 33aparticipatingemployershallagreetofurnishthedivisionwithreportsrelatingtothe 34operationofthesharedworkplanasrequestedbythedivision.Theemployershallmonitor 35andevaluatetheoperationoftheestablishedsharedworkplanasrequestedbythedivision 36andshallreportthefindingstothedivision. 37 4.Thedivisionmayapproveasharedworkplanif: 38 (1)Theemployerhasfiledallreportsrequiredtobefiledunderthischapterforall 39pastandcurrentperiodsandhaspaidallcontributionsdueforallpastandcurrentperiods; 40 (2)Thesharedworkplanappliestoandidentifiesaspecifiedaffectedunit; 41 (3)TheemployeesintheaffectedunitareidentifiedbynameandSocialSecurity 42number; 43 (4)Thesharedworkplanreducesthenormalweeklyhoursofworkforanemployee 44intheaffectedunitbynotlessthantwentypercentandnotmorethanfortypercent; 53 (7)Theemployercertifiesthattheimplementationofasharedworkplanandthe 54resultingreductioninworkhoursisinlieuoflayoffsthatwouldaffectatleasttenpercentof 55theemployeesintheaffectedunitandthatwouldresultinanequivalentreductioninwork 56hours; HB1381 8 65 (10)Theemployercertifiesthatparticipationinthesharedworkplanandits 66implementationisconsistentwiththeemployer'sobligationunderapplicablefederalandstate 67laws;and 68 (11)ThesharedworkplanincludesanyotherprovisionthattheUnitedStates 69SecretaryofLabordeterminestobeappropriateforthepurposeofasharedwork 70unemploymentcompensationprogram. 71 5.Ifanyoftheemployeeswhoparticipateinasharedworkplanunderthissectionare 72coveredbyacollectivebargainingagreement,thesharedworkplanshallbeapprovedin 73writingbythecollectivebargainingagent. 74 6.Nosharedworkplanwhichwillsubsidizeseasonalemployersduringtheoff- 75seasonshallbeapprovedbythedivision.Nosharedworkplanbenefitswillbeinitiatedwhen 76thereducedhourscoincidewithholidayearningsalreadycommittedtobepaidbythe 77employer.Sharedworkplanbenefitsmaynotbedeniedinanyweekcontainingaholidayfor 78whichholidayearningsarecommittedtobepaidbytheemployerunlessthesharedwork 79benefitstobepaidareforthesamehoursinthesamedayastheholidayearnings. 80 7.Thedivisionshallapproveordenyasharedworkplannotlaterthanthethirtieth 81dayafterthedayonwhichthesharedworkplanisreceivedbythedivision.Thedivision 82shallapproveordenyaplaninwriting.Ifthedivisiondeniesaplan,thedivisionshallnotify 83theemployerofthereasonsforthedenial.Approvalordenialofaplanbythedivisionshall 84befinalandsuchdeterminationshallbesubjecttoreviewinthemannerotherwiseprovided 85bylaw.Ifapprovalofaplanisdeniedbythedivision,theemployermaysubmitanewplan 86tothedivisionforconsiderationnosoonerthanforty-fivecalendardaysfollowingthedateon 87whichthedivisiondisapprovedtheemployer'spreviouslysubmittedplan. 88 8.Thedivisionmayrevokeapprovalofasharedworkplanandterminatetheplanifit 89determinesthatthesharedworkplanisnotbeingexecutedaccordingtothetermsandintent 90ofthesharedworkunemploymentcompensationprogram,orifitisdeterminedbythe 91divisionthattheapprovalofthesharedworkplanwasbased,inwholeorinpart,upon 92informationcontainedintheplanwhichwaseitherfalseorsubstantiallymisleading. 93 9.Eachsharedworkplanapprovedbythedivisionshallbecomeeffectiveonthefirst 94dayoftheweekinwhichitisapprovedbythedivisionoronalaterdateasspecifiedinthe 95sharedworkplan.Eachsharedworkplanapprovedbythedivisionshallexpireonthelast 96dayofthetwelfthfullcalendarmonthaftertheeffectivedateofsuchsharedworkplan. 97 10.Anemployermaymodifyasharedworkplancreatedunderthissectiontomeet 98changedconditionsifthemodificationconformstothebasicprovisionsofthesharedwork 99planasoriginallyapprovedbythedivision.Theemployershallreportthechangesmadeto 100theplaninwritingtothedivisionatleastsevendaysbeforeimplementingsuchchanges.The 101divisionshallreevaluatethesharedworkplanandmayapprovethemodifiedsharedwork HB1381 9 102planifitmeetstherequirementsforapprovalundersubsection4ofthissection.Theapproval 103ofamodifiedsharedworkplanshallnot,underanycircumstances,affecttheexpirationdate 104originallysetforthesharedworkplan.Ifmodificationscausethesharedworkplantofailto 105meettherequirementsforapproval,thedivisionshalldenyapprovalofthemodificationsas 106providedinsubsection7ofthissection. 107 11.Notwithstandinganyotherprovisionsofthischapter,anindividualisunemployed 108forthepurposesofthissectioninanyweekinwhichtheindividual,asanemployeeinan 109affectedunit,workslessthanhisnormalweeklyhoursofworkinaccordancewithan 110approvedsharedworkplanineffectforthatweek. 111 12.Anindividualwhoisotherwiseentitledtoreceiveregularunemployment 112insurancebenefitsunderthischaptershallbeeligibletoreceivesharedworkbenefitswith 113respecttoanyweekinwhichthedivisionfindsthat: 114 (1)Theindividualisemployedasamemberofanaffectedunitsubjecttoashared 115workplanthatwasapprovedbeforetheweekinquestionandisineffectforthatweek; 116 (2)Notwithstandingtheprovisionsofsubdivision(2)ofsubsection1ofsection 117288.040,theindividualisabletoworkandavailableforhisorhernormalhoursofworkwith 118theparticipatingemployer; 119 (3)Theindividual'snormalweeklyhoursofworkhavebeenreducedbyatleast 120twentypercentbutnotmorethanfortypercent,withacorrespondingreductioninwages;and 121 (4)Theindividualhasservedawaitingweekasdefinedinsection288.030, exceptas 122providedundersubsection13ofthissection. 123 13.Awaitingweekservedundertheprovisionsofsubdivision(3)ofsubsection1of 124section288.040shallservetomeettherequirementsofsubdivision(4)ofsubsection12of 125thissectionandawaitingweekservedundertheprovisionsofsubdivision(4)ofsubsection 12612ofthissectionshallservetomeettherequirementsofsection288.040.Notwithstanding 127anyotherprovisionsofthischapter,anindividualwhofilesanewinitialclaimduringthe 128pendencyofthetwelve-monthperiodinwhichasharedworkplanisineffectshallservea 129waitingweekwhetherornottheindividualhasservedawaitingweekunderthissubsection. 130Effectiveforcalendaryear2026andeachyearthereafter,thewaitingperiodofone 131weekshallnotapplytoanynewsharedworkbenefitsfiledonorafterJanuary1,2026, 132andsuchone-weekperiodshallbeincludedinthedeterminationofthesharedwork 133benefits,providedallothereligibilityrequirementsaremet. 134 14.Thedivisionshallnotdenysharedworkbenefitsforanyweektoanotherwise 135eligibleindividualbyreasonoftheapplicationofanyprovisionofthischapterthatrelatesto 136availabilityforwork,activesearchforwork,refusaltoapplyfororacceptworkwithan 137employerotherthantheparticipatingemployerundertheplan,ortrainingthatisapprovedby HB1381 10 138thedirector,asprovidedinsection288.055,suchasemployer-sponsoredtrainingortraining 139fundedundertheWorkforceInvestmentActof1998. 140 15.Thedivisionshallpayanindividualwhoiseligibleforsharedworkbenefits 141underthissectionaweeklysharedworkbenefitamountequaltotheindividual'sregular 142weeklybenefitamountforaperiodoftotalunemploymentlessanydeductibleamountsunder 143thischapterexceptwagesreceivedfromanyemployer,multipliedbythefullpercentageof 144reductionintheindividual'shoursassetforthintheemployer'ssharedworkplan.Ifthe 145sharedworkbenefitamountcalculatedunderthissubsectionisnotamultipleofonedollar, 146thedivisionshallroundtheamountsocalculatedtothenextlowestmultipleofonedollar. 147 16.Anindividualshallnotbeentitledtoreceivesharedworkbenefitsandregular 148unemploymentcompensationbenefitsinanaggregateamountwhichexceedsthemaximum 149totalamountofbenefitspayabletothatindividualinabenefityearasprovidedundersection 150288.060.Notwithstandinganyotherprovisionsofthischapter,anindividualshallnotbe 151eligibletoreceivesharedworkbenefitsformorethanfifty-twocalendarweeksduringthe 152twelve-monthperiodofthesharedworkplan.Noweekshallbecountedasaweekof 153unemploymentforthepurposesofthissubsectionunlessitoccurswithinthetwelve-month 154periodofthesharedworkplan. 155 17.Notwithstandinganyotherprovisionofthischapter,allbenefitspaidundera 156sharedworkplanwhicharechargeabletotheparticipatingemployeroranyotherbaseperiod 157employershallbechargedtoemployersinthesamemannerasregularunemployment 158benefitsarechargeableunderthischapter. 159 18.Anindividualwhohasreceivedallofthesharedworkbenefitsandregular 160unemploymentcompensationbenefitsavailableinabenefityearisanexhausteeunder 161section288.062andisentitledtoreceiveextendedbenefitsundersection288.062ifthe 162individualisotherwiseeligibleunderthatsection. 163 19.IftheUnitedStatesSecretaryofLabordeterminesanyprovisionofthissectionto 164benonconformingwithfederallaw,thenonconformingprovisionshallnotaffectthevalidity 165oftheremainingprovisionsofthissection. ✔ HB1381 11
