Torepealsection72.418,RSMo,andtoenactinlieuthereofonenewsectionrelatingtofire
protectionservices.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section72.418,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection72.418,toreadasfollows:
72.418.1.Notwithstandinganyotherprovisionoflawtothecontrary,nonewcity
2createdpursuanttosections72.400to72.423shallestablishamunicipalfiredepartmentto
3providefireprotectionservices,includingemergencymedicalservices,ifsuchcityformerly
4consistedofunincorporatedareasinthecountyormunicipalitiesinthecounty,orboth,which
5areprovidedfireprotectionservicesandemergencymedicalservicesbyoneormorefire
6protectiondistricts.Suchfireprotectiondistrictsshallcontinuetoprovideservicestothearea
7comprisingthenewcityandmaylevyandcollecttaxesthesameassuchdistrictshadpriorto
8thecreationofsuchnewcity.
9 2.Fireprotectiondistrictsservingtheareaincludedwithinanyannexationbyacity
10havingafiredepartment,includingsimplifiedboundarychanges,shallcontinuetoprovide
11fireprotectionservices,includingemergencymedicalservicestosucharea.Theannexing
12cityshallpayannuallytothefireprotectiondistrictanamountequaltothatwhichthefire
13protectiondistrictwouldhaveleviedonalltaxablepropertywithintheannexedarea.Such
14annexedareashallnotbesubjecttotaxationforanypurposethereafterbythefireprotection
15districtexceptforbondedindebtednessbythefireprotectiondistrictwhichexistedpriorto
16theannexation.Theamounttobepaidannuallybythemunicipalitytothefireprotection
17districtpursuantheretoshallbeasumequaltotheannualassessedvaluemultipliedbythe
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18annualtaxrateascertifiedbythefireprotectiondistricttothemunicipality,includingany
19portionofthetaxcreatedforemergencymedicalserviceprovidedbythedistrict,perone
20hundreddollarsofassessedvalueinsucharea.Thetaxratesocomputedshallincludeanytax
21onbondedindebtednessincurredsubsequenttosuchannexation,butshallnotincludeany
22portionofthetaxrateforbondedindebtednessincurredpriortosuchannexation.
23Notwithstandinganyotherprovisionoflawtothecontrary,theresidentsofanarea
24annexedonorafterMay26,1994,mayvoteinallfireprotectiondistrictelectionsandmaybe
25electedtothefireprotectiondistrictboardofdirectors.
26 3.Thefireprotectiondistrictmayapproveorrejectanyproposalfortheprovisionof
27fireprotectionandemergencymedicalservicesbyacity.
28 4.Notwithstandinganyotherprovisionoflawtothecontrary,inanycitywith
29morethaneleventhousandbutfewerthantwelvethousandfivehundredinhabitants
30andlocatedinacountywithmorethanonemillioninhabitantsthatbecamea
31constitutionalchartercityafter1990andthatpaysafireprotectiondistrictunderthis
32section,allresidentsofthecityshallreceivefireprotectionservicesfromthecityfire
33departmentbeginningJanuary1,2026,solongasthecityfiredepartmentisin
34existence,andnotafireprotectiondistrict,andthecityshallnotmakeanypaymentsto
35afireprotectiondistrictunderthissectiononorafterJanuary1,2026.Nothinginthis
36subsectionshallpreventsuchcityfromcontractingwithanyfireprotectiondistrictfor
37servicesifthecityandfireprotectiondistrictmutuallyagree.Uponthecityproviding
38fireprotectionservicesasdescribedinthissubsection,theresidentsofanareaannexed
39onorafterMay26,1994,shallnolongerbeabletovoteinanyfireprotectiondistrict
40electionandshallnotbeelectedtoanyfireprotectiondistrict'sboardofdirectors.
