SectionA.Sections311.310,311.325,311.480,311.710,and537.053,RSMo,are
2repealedandfivenewsectionsenactedinlieuthereof,tobeknownassections311.310,
3311.325,311.480,311.710,and537.053,toreadasfollows:
311.310.1.Anylicenseeunderthischapter,orhisemployee,whoshallsell,vend,
2giveawayorotherwisesupplyanyintoxicatingliquorinanyquantitywhatsoevertoany
3personundertheageoftwenty-oneyears,ortoanypersonintoxicatedorappearingtobeina
4stateofintoxication,ortoahabitualdrunkard,[and] shallbedeemedguiltyofa
5misdemeanor.
6 2.Anypersonwhomsoever[excepthisparentorguardian] whoshallprocurefor,sell,
7giveawayorotherwisesupplyintoxicatingliquortoanypersonundertheageoftwenty-one
8years,excepthisorherparentorguardian,ortoanyintoxicatedpersonoranyperson
9appearingtobeinastateofintoxication,ortoahabitualdrunkard,shallbedeemedguiltyofa
10misdemeanor[, exceptthat].
11 3.Thissectionshallnotapplyto:
12 (1)Thesupplyingofintoxicatingliquortoapersonundertheageoftwenty-oneyears
13formedicalpurposesonly[, orto];
14 (2)Theadministeringofsuchintoxicatingliquortoanypersonbyadulylicensed
15physician;

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 16 (3)Thepossessionandconsumptionofintoxicatingliquorbyapersonunderthe
17ageoftwenty-oneyearsinapubliclocationorestablishment,includingalicensed
18establishment,ifthepersonisundertwenty-oneyearsofageandiseighteenyearsofage
19orolderandsuchpersonisinthepresenceof,accompaniedby,andsupervisedbyhisor
20herparent,guardian,orspousewhoistwenty-oneyearsofageorolder;or
21 (4)Thesupplyingorservingofintoxicatingliquortoapersonundertwenty-one
22yearsofage,inapubliclocationorestablishment,includingalicensedestablishment,if
23thepersonisundertwenty-oneyearsofageandiseighteenyearsofageorolderand
24suchpersonisinthepresenceof,accompaniedby,andsupervisedbyhisorherparent,
25guardian,orspousewhoistwenty-oneyearsofageorolder.

27Nopersonshallbedeniedalicenseorrenewalofalicenseissuedunderthischaptersolely
28duetoaconvictionforunlawfulsaleorsupplytoaminorwhenservinginthecapacityasan
29employeeofalicensedestablishment.
30 [2.]4.Exceptasprovidedunderthissubsectionandundersubsection3ofthis
31section,anyowner,occupant,orotherpersonorlegalentitywithalawfulrighttothe
32exclusiveuseandenjoymentofanypropertywhoknowinglyallowsapersonundertheageof
33twenty-onetodrinkorpossessintoxicatingliquororknowinglyfailstostopapersonunder
34theageoftwenty-onefromdrinkingorpossessingintoxicatingliquoronsuchproperty,unless
35suchpersonallowingthepersonundertheageoftwenty-onetodrinkorpossessintoxicating
36liquorishisorherparentorguardian,isguiltyofaclassBmisdemeanor.Anysecondor
37subsequentviolationofthissubsectionisaclassAmisdemeanor.
38 [3.]5.Itshallbeadefensetoprosecutionunderthissectionif:
39 (1)Thedefendantisalicensedretailer,club,drinkingestablishment,orcatereror
40holdsatemporarypermit,oranemployeethereof;
41 (2)Thedefendantsoldtheintoxicatingliquortotheminorwithreasonablecauseto
42believethattheminorwastwenty-one[ormore] yearsofageorolder,orwithreasonable
43causetobelievethatthepersoninthepresenceof,accompanying,andsupervisingthe
44minor,asallowedundersubsection3ofthissection,wastwenty-oneyearsofageor
45olderandwastheminor'sparent,guardian,orspouse; and
46 (3)Topurchasetheintoxicatingliquor,thepersonexhibitedtothedefendanta
47driver'slicense,Missourinondriver'sidentificationcard,orotherofficialorapparently
48officialdocument,containingaphotographoftheminorandpurportingtoestablishthatsuch
49minorwastwenty-oneyearsofageandofthelegalageforconsumptionofintoxicating
50liquor.
311.325.1.Anypersonundertheageoftwenty-oneyears,whopurchasesor
2attemptstopurchase,orhasinhisorherpossession,anyintoxicatingliquorasdefinedin
HB1443	2 3section311.020orwhoisvisiblyinanintoxicatedconditionasdefinedinsection577.001,or
4hasadetectablebloodalcoholcontentofmorethantwo-hundredthsofonepercentormoreby
5weightofalcoholinsuchperson'sbloodisguiltyofamisdemeanor.Afirstviolationofthis
6sectionshallbepunishableasaclassDmisdemeanor.Asecondorsubsequentviolationof
7thissectionshallbepunishableasaclassAmisdemeanor.Priorfindingsofguiltshallbe
8[pleaded] pledandproveninthesamemannerasrequiredbysection558.021.Forpurposes
9ofprosecutionunderthissectionoranyotherprovisionofthischapterinvolvinganalleged
10illegalsaleortransferofintoxicatingliquortoapersonundertwenty-oneyearsofage,a
11manufacturer-sealedcontainerdescribingthatthereisintoxicatingliquorthereinneednotbe
12openedorthecontentsthereintestedtoverifythatthereisintoxicatingliquorinsuch
13container.Theallegedviolatormayallegethattherewasnotintoxicatingliquorinsuch
14container,buttheburdenofproofofsuchallegationisonsuchperson,asitshallbepresumed
15thatsuchasealedcontainerdescribingthatthereisintoxicatingliquorthereincontains
16intoxicatingliquor.
17 2.Forpurposesofdeterminingviolationsofanyprovisionofthischapter,orofany
18ruleorregulationofthesupervisorofalcoholandtobaccocontrol,amanufacturer-sealed
19containerdescribingthatthereisintoxicatingliquorthereinneednotbeopenedorthe
20contentsthereintestedtoverifythatthereisintoxicatingliquorinsuchcontainer.Thealleged
21violatormayallegethattherewasnotintoxicatingliquorinsuchcontainer,buttheburdenof
22proofofsuchallegationisonsuchperson,asitshallbepresumedthatsuchasealedcontainer
23describingthatthereisintoxicatingliquorthereincontainsintoxicatingliquor.
24 3.Anypersonundertheageoftwenty-oneyearswhopurchasesorattemptsto
25purchase,orhasinhisorherpossession,anyintoxicatingliquor,orwhoisvisiblyinan
26intoxicatedconditionasdefinedinsection577.001,shallbedeemedtohavegivenconsentto
27achemicaltestortestsoftheperson'sbreath,blood,saliva,orurineforthepurposeof
28determiningthealcoholordrugcontentoftheperson'sblood.Theimpliedconsenttosubmit
29tothechemicaltestslistedinthissubsectionshallbelimitedtonotmorethantwosuchtests
30arisingfromthesamearrest,incident,orcharge.Chemicalanalysisoftheperson'sbreath,
31blood,saliva,orurineshallbeperformedaccordingtomethodsapprovedbythestate
32departmentofhealthandseniorservicesbylicensedmedicalpersonnelorbyaperson
33possessingavalidpermitissuedbythestatedepartmentofhealthandseniorservicesforthis
34purpose.Thestatedepartmentofhealthandseniorservicesshallapprovesatisfactory
35techniques,devices,equipment,ormethodstobeconsideredvalidandshallestablish
36standardstoascertainthequalificationsandcompetenceofindividualstoconductanalyses
37andtoissuepermitswhichshallbesubjecttoterminationorrevocationbythestate
38departmentofhealthandseniorservices.Thepersontestedmayhaveaphysician,ora
39qualifiedtechnician,chemist,registerednurse,orotherqualifiedpersonatthechoosingand
HB1443	3 40expenseofthepersontobetested,administeratestinadditiontoanyadministeredatthe
41directionofalawenforcementofficer.Thefailureorinabilitytoobtainanadditionaltestbya
42personshallnotprecludetheadmissionofevidencerelatingtothetesttakenatthedirection
43ofalawenforcementofficer.Upontherequestofthepersonwhoistested,fullinformation
44concerningthetestshallbemadeavailabletosuchperson.Fullinformationislimitedtothe
45following:
46 (1)Thetypeoftestadministeredandtheproceduresfollowed;
47 (2)Thetimeofthecollectionofthebloodorbreathsampleorurineanalyzed;
48 (3)Thenumericalresultsofthetestindicatingthealcoholcontentofthebloodand
49breathandurine;
50 (4)Thetypeandstatusofanypermitwhichwasheldbythepersonwhoperformed
51thetest;
52 (5)Ifthetestwasadministeredbymeansofabreath-testinginstrument,thedateof
53performanceofthemostrecentrequiredmaintenanceofsuchinstrument.

55Fullinformationdoesnotincludemanuals,schematics,orsoftwareoftheinstrumentusedto
56testthepersonoranyothermaterialthatisnotintheactualpossessionofthestate.
57Additionally,fullinformationdoesnotincludeinformationinthepossessionofthe
58manufacturerofthetestinstrument.
59 4.Theprovisionsofthissectionshallnotapplytoastudentwho:
60 (1)Iseighteenyearsofageorolder;
61 (2)Isenrolledinanaccreditedcollegeoruniversityandisastudentinaculinary
62course;
63 (3)Isrequiredtotaste,butnotconsumeorimbibe,anybeer,ale,porter,wine,or
64othersimilarmaltorfermentedbeverageaspartoftherequiredcurriculum;and
65 (4)Tastesabeverageundersubdivision(3)ofthissubsectiononlyforinstructional
66purposesduringclassesthatarepartofthecurriculumoftheaccreditedcollegeoruniversity.
67Thebeveragemustatalltimesremaininthepossessionandcontrolofanauthorized
68instructorofthecollegeoruniversity,whomustbetwenty-oneyearsofageorolder.Nothing
69inthissubsectionmaybeconstruedtoallowastudentundertheageoftwenty-onetoreceive
70anybeer,ale,porter,wine,orothersimilarmaltorfermentedbeverageunlessthebeverageis
71deliveredaspartofthestudent'srequiredcurriculumandthebeverageisusedonlyfor
72instructionalpurposesduringclassesconductedaspartofthecurriculum.
73 5.Theprovisionsofthissectionshallnotapplytoapersoneighteenyearsofage
74orolderbutundertwenty-oneyearsofagedrinking,possessing,orconsuming
75intoxicatingliquorinapubliclocationorestablishment,includingalicensed
76establishment,providedthatsuchpersonisinthepresenceof,accompaniedby,and
HB1443	4 77supervisedbysuchperson'sparent,guardian,orspousewhoistwenty-oneyearsofage
78orolder.
311.480.1.Itshallbeunlawfulforanypersonoperatinganypremiseswherefood,
2beveragesorentertainmentaresoldorprovidedforcompensation,whodoesnotpossessa
3licenseforthesaleofintoxicatingliquor,topermitthedrinkingorconsumptionof
4intoxicatingliquorinthepremises,withouthavingalicenseasinthissectionprovided.
5 2.Applicationforsuchlicenseshallbemadetothesupervisorofalcoholandtobacco
6controlonformstobeprescribedbyhimorher,describingthepremisestobelicensedand
7givingallotherreasonableinformationrequiredbytheform.Thelicenseshallbeissued
8uponthepaymentofthefeerequiredinthissection.Alicenseshallberequiredforeach
9separatepremisesandshallexpireonthethirtiethdayofJunenextsucceedingthedateof
10suchlicense.Thelicensefeeshallbesixtydollarsperyearandtheapplicantshallpayfive
11dollarsforeachmonthorpartthereofremainingfromthedateofthelicensetothenext
12succeedingfirstofJuly.Applicationsforrenewalsoflicensesshallbefiledonorbeforethe
13firstofMayofeachyear.
14 3.Thedrinkingorconsumptionofintoxicatingliquorshallnotbepermittedinor
15uponthelicensedpremisesbyanypersonundertwenty-oneyearsofage,exceptasprovided
16undersubsection9ofthissection,orbyanyotherpersonbetweenthehoursof1:30a.m.
17and6:00a.m.onanydayoftheweek.Licensesissuedhereundershallbeconditionedupon
18theobservanceoftheprovisionsofthissectionandtheregulationspromulgatedthereunder
19governingtheconductofpremiseslicensedforthesaleofintoxicatingliquorbythedrink.
20Theprovisionofthissectionregulatingthedrinkingorconsumptionofintoxicatingliquor
21betweencertainhoursandonSundayshallapplyalsotopremiseslicensedunderthischapter
22tosellintoxicatingliquorbythedrink.Inanyincorporatedcityhavingapopulationofmore
23thantwentythousandinhabitants,theboardofaldermen,citycouncil,orotherproper
24authoritiesofincorporatedcitiesmay,inadditiontothelicensefeerequiredinthissection,
25requirealicensefeenotexceedingthreehundreddollarsperannum,payabletothe
26incorporatedcities,andprovideforthecollectionthereof;makeandenforceordinances
27regulatingthehoursofconsumptionofintoxicatingliquorsonpremiseslicensedhereunder,
28notinconsistentwiththeotherprovisionsofthislaw,andprovidepenaltiesfortheviolation
29thereof.Nopersonshallbegrantedalicensehereunderunlesssuchpersonisofgoodmoral
30characterandaqualifiedlegalvoterandataxpayingcitizenofthecounty,town,cityor
31village,norshallanycorporationbegrantedalicensehereunderunlessthemanagingofficer
32ofsuchcorporationisofgoodmoralcharacterandaqualifiedlegalvoterandtaxpaying
33citizenofthecounty,town,cityorvillage.
34 4.Anypremisesoperatedinviolationoftheprovisionsofthissection,orwhere
35intoxicatingliquorisconsumedinviolationofthissection,isherebydeclaredtobeapublic
HB1443	5 36andcommonnuisance,anditshallbethedutyofthesupervisorofalcoholandtobacco
37controlandoftheprosecutingorcircuitattorneyoftheCityofSt.Louis,andtheprosecuting
38attorneyofthecountyinwhichthepremisesarelocated,toenjoinsuchnuisance.
39 5.Anypersonoperatinganypremises,oranyemployee,agent,representative,
40partner,orassociateofsuchperson,whoshallknowinglyviolateanyoftheprovisionsofthis
41section,oranyofthelawsorregulationshereinmadeapplicabletotheconductofsuch
42premises,isguiltyofaclassAmisdemeanor.
43 6.Thesupervisorofalcoholandtobaccocontrolisherebyempoweredtopromulgate
44regulationsnecessaryorreasonablydesignedtoenforceorconstruetheprovisionsofthis
45section,andisempoweredtorevokeorsuspendanylicenseissuedhereunder,asprovidedin
46thischapter,forviolationofthissectionoranyofthelawsorregulationshereinmade
47applicabletotheconductofpremiseslicensedhereunder.
48 7.Nothinginthissectionshallbeconstruedtoprohibitthesaleordeliveryofany
49intoxicatingliquorduringanyofthehoursoronanyofthedaysspecifiedinthissectionbya
50wholesalerlicensedundertheprovisionsofsection311.180toapersonlicensedtosellthe
51intoxicatingliquoratretail.
52 8.Nointoxicatingliquormaybeservedorsoldonanypremisesusedasapolling
53placeonelectionday.
54 9.Thepossessionorconsumptionofintoxicatingliquorshallnotbepermittedin
55oruponthelicensedpremisesbyanypersonundertwenty-oneyearsofage,unlessthe
56personundertwenty-oneyearsofageiseighteenyearsofageorolderandsuchpersonis
57inthepresenceof,accompaniedby,andsupervisedbyhisorherparent,guardian,or
58spousewhoistwenty-oneyearsofageorolder.
311.710.1.Inadditiontothepenaltiesandproceedingsforsuspensionorrevocation
2oflicensesprovidedforinthischapter,andwithoutlimitingthem,proceedingsforthe
3suspensionorrevocationofanylicenseauthorizingthesaleofintoxicatingliquoratretail
4maybebroughtinthecircuitcourtofanycountyinthisstate,orintheCityofSt.Louis,in
5whichthelicensedpremisesarelocatedandsuchproceedingsmaybebroughtbythesheriff
6oranypeaceofficerofthatcountyorbyanyeightormorepersonswhoaretaxpayingcitizens
7ofthecountyorcityforanyofthefollowingoffenses:
8 (1)Selling,givingorotherwisesupplyingintoxicatingliquortoahabitualdrunkard
9ortoanypersonwhoisunderorapparentlyundertheinfluenceofintoxicatingliquor;
10 (2)Knowinglypermittinganyprostitute,degenerate,ordissolutepersontofrequent
11thelicensedpremises;
12 (3)Permittingonthelicensedpremisesanydisorderlyconduct,breachofthepeace,
13oranylewd,immoralorimproperentertainment,conductorpractices;
HB1443	6 14 (4)Selling,offeringforsale,possessingorknowinglypermittingtheconsumptionon
15thelicensedpremisesofanykindofintoxicatingliquors,thesale,possessionorconsumption
16ofwhichisnotauthorizedunderhisorherlicense;
17 (5)Selling,giving,orotherwisesupplyingintoxicatingliquortoanypersonunderthe
18ageoftwenty-oneyearsorapersonwhoiseighteenyearsofageorolderbutunder
19twenty-oneyearsofagewithoutthepresence,accompaniment,orsupervisionofsuch
20person'sparent,guardian,orspousewhoistwenty-oneyearsofageorolder;
21 (6)Selling,givingorotherwisesupplyingintoxicatingliquorsbetweenthehoursof
221:30a.m.and6:00a.m.anydayoftheweek.
23 2.Provided,thatsaidtaxpayingcitizenshallsubmitinwriting,underoath,by
24registeredUnitedStatesmailtothesupervisorofalcoholandtobaccocontrolajoint
25complaint,statingthenameofthelicensee,thenameunderwhichthelicensee'sbusinessis
26conductedandtheaddressofthelicensedpremises,settingoutingeneralthecharacterand
27natureoftheoffenseoroffensescharged,togetherwiththenamesandaddressesofthe
28witnessesbywhomproofthereofisexpectedtobemade;andprovided,thatafteraperiodof
29thirtydaysafterthemailingofsuchcomplainttothesupervisorofalcoholandtobacco
30controlthepersonthereincomplainedofshallnothavebeencitedbythesupervisortoappear
31andshowcausewhyhisorherlicenseshouldnotbesuspendedorrevokedthentheyshallfile
32withthecircuitclerkofthecountyorcityinwhichthepremisesarelocatedacopyofthe
33complaintonfilewiththesupervisorofalcoholandtobaccocontrol.
34 3.If,pursuanttothereceiptofsuchcomplaintbythesupervisorofalcoholand
35tobaccocontrol,thelicenseeappearsandshowscausewhyhisorherlicenseshouldnotbe
36suspendedorrevokedatahearingheldforthatpurposebythesupervisorandeitherthe
37complainantsorthelicenseeconsiderthemselvesaggrievedwiththeorderofthesupervisor
38then,afterarequestinwritingbyeitherthecomplainantsorthelicensee,thesupervisorshall
39certifytothecircuitclerkofthecountyorcityinwhichthelicensedpremisesarelocateda
40copyoftheoriginalcomplaintfiledwithhimorher,togetherwithacopyofthetranscriptof
41theevidenceadducedatthehearingheldbyhimorher.Suchcertificationbythesupervisor
42shallnotactasasupersedeasofanyordermadebyhimorher.
43 4.Uponreceiptofsuchcomplaint,whetherfromthecomplainantdirectlyorfromthe
44supervisorofalcoholandtobaccocontrol,thecourtshallsetadateforanearlyhearing
45thereonanditshallbethedutyofthecircuitclerktocausetobedeliveredbyregistered
46UnitedStatesmailtotheprosecutingattorneyofthecountyortothecircuitattorneyofthe
47CityofSt.Louisandtothelicenseecopiesofthecomplaintandheorsheshall,atthesame
48time,givenoticeofthetimeandplaceofthehearing.Suchnoticeshallbedeliveredtothe
49prosecutingattorneyortothecircuitattorneyandtothelicenseeatleastfifteendayspriorto
50thedateofthehearing.
HB1443	7 51 5.Thecomplaintshallbeheardbythecourtwithoutajuryandiftherehasbeena
52priorhearingthereonbythesupervisorofalcoholandtobaccocontrolthenthecaseshallbe
53hearddenovoandboththecomplainantsandthelicenseemayproducenewandadditional
54evidencematerialtotheissues.
55 6.Ifthecourtshallfinduponthehearingthattheoffenseoroffenseschargedinthe
56complainthavebeenestablishedbytheevidence,thecourtshallorderthesuspensionor
57revocationofthelicensebut,insodoing,shalltakeintoconsiderationwhateverorder,ifany,
58mayhavebeenmadeinthepremisesbythesupervisorofalcoholandtobaccocontrol.Ifthe
59courtfindsthattorevokethelicensewouldbeundulysevere,thenthecourtmaysuspendthe
60licenseforsuchperiodoftimeasthecourtdeemsproper.
61 7.Thejudgmentofthecourtinnoeventshallbesupersededorstayedduring
62pendencyofanyappealtherefrom.
63 8.Itshallbethedutyoftheprosecutingattorneyorcircuitattorneytoprosecute
64diligentlyandwithoutdelayanysuchcomplaintscomingtohimorherbyvirtueofthis
65section.
66 9.Thejurisdictionhereinconferreduponthecircuitcourtstohearanddetermine
67complaintsforthesuspensionorrevocationoflicensesinthemannerprovidedinthissection
68shallnotbeexclusiveandanyauthorityconferreduponthesupervisorofalcoholandtobacco
69controltorevokeorsuspendlicensesshallremaininfullforceandeffect,andthesuspension
70orrevocationofalicenseasprovidedinthissectionshallbeinadditiontoandnotinlieuof
71anyotherrevocationorsuspensionprovidedbythischapter.
72 10.Costsaccruingbecauseofsuchhearingsinthecircuitcourtshallbetaxedinthe
73samemannerascriminalcosts.
537.053.1.SincetherepealoftheMissouriDramShopActin1934(Lawsof1933-
234,extrasession,page77),ithasbeenandcontinuestobethepolicyofthisstatetofollow
3thecommonlawofEngland,asdeclaredinsection1.010,toprohibitdramshopliabilityand
4tofollowthecommonlawrulethatfurnishingalcoholicbeveragesisnottheproximatecause
5ofinjuriesinflictedbyintoxicatedpersons.
6 2.Notwithstandingsubsection1ofthissection,acauseofactionmaybebroughtby
7oronbehalfofanypersonwhohassufferedpersonalinjuryordeathagainstanyperson
8licensedtosellintoxicatingliquorbythedrinkforconsumptiononthepremiseswhenitis
9provenbyclearandconvincingevidencethattheseller:
10 (1)Kneworshouldhaveknownthatintoxicatingliquorwasservedtoapersonunder
11theageoftwenty-oneyears, unlessthepersonundertwenty-oneyearsofageiseighteen
12yearsofageorolderandsuchpersonwasinthepresenceof,accompaniedby,and
13supervisedbyhisorherparent,guardian,orspousewhoistwenty-oneyearsofageor
14older;or
HB1443	8 15 (2)Knowinglyservedintoxicatingliquortoavisiblyintoxicatedperson.
16 3.Forpurposesofthissection,apersonis"visiblyintoxicated"wheninebriatedto
17suchanextentthattheimpairmentisshownbysignificantlyuncoordinatedphysicalactionor
18significantphysicaldysfunction.Aperson'sbloodalcoholcontentdoesnotconstituteprima
19facieevidencetoestablishthatapersonisvisiblyintoxicatedwithinthemeaningofthis
20section,butmaybeadmissibleasrelevantevidenceoftheperson'sintoxication.
21 4.Nothinginthissectionshallbeinterpretedtoprovidearightofrecoverytoa
22personwhosuffersinjuryordeathproximatelycausedbytheperson'svoluntaryintoxication

28intoxicatingliquorbythedrinkforconsumptiononthepremisestoapersonundertheageof
29twenty-oneyears,proofthatthesellerortheseller'sagentoremployeedemandedandwas
30shownadriver'slicenseorofficialstateorfederalpersonalidentificationcard,appearingto
31begenuineandshowingthattheminorwasatleasttwenty-oneyearsofage,shallberelevant
32indeterminingtherelativefaultofthesellerorseller'sagentoremployeeintheaction.
33 6.Noemployermaydischargehisorheremployeeforrefusingservicetoavisibly
