8materialandsexualoffensesinvolvingchildren,consumerfraudandharassment;
9 (3)Itisnecessaryfortheprotectionofthecitizensofthisstatethatprovisionsbe
10madefortheestablishmentoftheMissouriregionalcomputerforensicslabtopreventand
11reducecomputer,internetandotherelectronicallybasedcrimes.
67.2540.Asusedinsections67.2540to67.2556,thefollowingtermsmean:
2 (1)"Adultcabaret",anightclub,bar,restaurant,orsimilarestablishmentinwhich
3personsregularlyappearinastateofnudity,asdefinedinsection573.500,orseminudityin
4theperformanceoftheirduties;
5 (2)"Employee",apersonwhoisatleasttwenty-oneyearsofageandwhoperforms
6anyserviceonthepremisesofasexuallyorientedbusinessonafull-time,part-time,or
7contractbasis,whetherornotthepersonisdenominatedanemployee,independent
8contractor,agent,orotherwise,andwhetherornotsaidpersonispaidasalary,wage,orother
9compensationbytheoperatorofsaidbusiness.Thetermemployeedoesnotincludeaperson
10exclusivelyonthepremisesforrepairormaintenanceofthepremisesorequipmentonthe
11premises,orforthedeliveryofgoodstothepremises;
12 (3)"Nudity"ora"stateofnudity",theshowingofthehumanmaleorfemalegenitals,
13pubicarea,vulva,anus,analcleftoranalcleavagewithlessthanafullyopaquecovering,the
14showingofthefemalebreastwithlessthanafullyopaquecoveringofanypartofthenipple,
15ortheshowingofthecoveredmalegenitalsinadiscerniblyturgidstate;
16 (4)"Nuisance",anyplaceinoruponwhichlewdness,assignation,orprostitutionis
17conducted,permitted,continued,orexists,oranyplace,inoruponwhichlewd,indecent,
18lascivious,orobscenefilms,orfilmsdesignedtobeprojectedforexhibition,are
19photographed,manufactured,developed,screened,exhibited,orotherwisepreparedor
20shown,andthepersonalpropertyandcontentsusedinconductingandmaintaininganysuch
21placeforanysuchpurpose.Theprovisionsofthissectionshallnotaffectanynewspaper,
22magazine,orotherpublicationenteredassecondclassmatterbythepostofficedepartment;
23 (5)"Person",anindividual,proprietorship,partnership,corporation,association,or
24otherlegalentity;
25 (6)"Seminude"orina"seminudecondition",astateofdressinwhichopaque
26clothingfailstocoverthegenitals,anus,analcleftorcleavage,pubicarea,vulva,nippleand
27areolaofthefemalebreastbelowahorizontallineacrossthetopoftheareolaatitshighest
28point.Seminudityshallincludetheentirelowerportionofthefemalebreast,butshallnot

168.071.1.Thestateboardofeducationmayrefusetoissueorrenewacertificate,or
2may,uponhearing,disciplinetheholderofacertificateoflicensetoteachforthefollowing
3causes:
4 (1)Acertificateholderorapplicantforacertificatehaspleadedtoorbeenfound
5guiltyofafelonyorcrimeinvolvingmoralturpitudeunderthelawsofthisstate,anyother
6state,oftheUnitedStates,oranyothercountry,whetherornotsentenceisimposed;
7 (2)Thecertificationwasobtainedthroughuseoffraud,deception,misrepresentation
8orbribery;
9 (3)Thereisevidenceofincompetence,immorality,orneglectofdutybythe
10certificateholder;
11 (4)Acertificateholderhasbeensubjecttodisciplinaryactionrelatingtocertification
12issuedbyanotherstate,territory,federalagency,orcountryupongroundsforwhichdiscipline
13isauthorizedinthissection;or
14 (5)Ifchargesarefiledbythelocalboardofeducation,basedupontheannullingofa
15writtencontractwiththelocalboardofeducation,forreasonsotherthanelectiontothe
16generalassembly,withouttheconsentofthemajorityofthemembersoftheboardthatisa
17partytothecontract.
18 2.Apublicschooldistrictmayfilechargesseekingthedisciplineofaholderofa
19certificateoflicensetoteachbaseduponanycauseorcombinationofcausesoutlinedin
20subsection1ofthissection,includingannulmentofawrittencontract.Chargesshallbein
21writing,specifythebasisforthecharges,andbesignedbythechiefadministrativeofficerof
22thedistrict,orbythepresidentoftheboardofeducationasauthorizedbyamajorityofthe
23boardofeducation.Theboardofeducationmayalsopetitiontheofficeoftheattorney
24generaltofilechargesonbehalfoftheschooldistrictforanycauseotherthanannulmentof
25contract,withacceptanceofthepetitionatthediscretionoftheattorneygeneral.
26 3.Thedepartmentofelementaryandsecondaryeducationmayfilechargesseeking
27thedisciplineofaholderofacertificateoflicensetoteachbaseduponanycauseor
28combinationofcausesoutlinedinsubsection1ofthissection,otherthanannulmentof
29contract.Chargesshallbeinwriting,specifythebasisforthecharges,andbesignedbylegal
30counselrepresentingthedepartmentofelementaryandsecondaryeducation.
31 4.Iftheunderlyingconductoractionswhicharethebasisforchargesfiledpursuant
32tothissectionarealsothesubjectofapendingcriminalchargeagainstthepersonholding
33suchcertificate,thecertificateholdermayrequest,inwriting,adelayedhearingonadviceof
HB1464	4 34counselunderthefifthamendmentoftheConstitutionoftheUnitedStates.Baseduponsuch
35arequest,nohearingshallbehelduntilafteratrialhasbeencompletedonthiscriminal
36charge.
37 5.Thecertificateholdershallbegivennotlessthanthirtydays'noticeofanyhearing
38heldpursuanttothissection.
39 6.Otherprovisionsofthissectionnotwithstanding,thecertificateoflicensetoteach

85 7.Whenacertificateholderisfoundguiltyofanyoffensethatwouldauthorizethe

88immediatelyprovidewrittennoticetothestateboardofeducationandtheattorneygeneral
89regardingthefindingofguilt.
90 8.Thecertificateholderwhosecertificatewasrevokedpursuanttosubsection6of
91thissectionmayappealsuchrevocationtothestateboardofeducation.Noticeofthisappeal
92mustbereceivedbythecommissionerofeducationwithinninetydaysofnoticeofrevocation
93pursuanttothissubsection.Failureofthecertificateholdertonotifythecommissionerofthe
94intenttoappealwaivesallrightstoappealtherevocation.Uponnoticeofthecertificate
95holder'sintenttoappeal,anappealhearingshallbeheldbyahearingofficerdesignatedbythe
96commissionerofeducation,withthefinaldecisionmadebythestateboardofeducation,
97basedupontherecordofthathearing.Thecertificateholdershallbegivennotlessthanthirty
98days'noticeofthehearing,andanopportunitytobeheardbythehearingofficer,together
99withwitnesses.
100 9.Inthecaseofanycertificateholderwhohassurrenderedorfailedtorenewhisor
101hercertificateoflicensetoteach,thestateboardofeducationmayrefusetoissueorrenew,or
102maysuspendorrevoke,suchcertificateforanyofthereasonscontainedinthissection.
103 10.Inthosecaseswherethechargesfiledpursuanttothissectionarebaseduponan
104allegationofmisconductinvolvingaminorchild,thehearingofficermayacceptintothe
105recordthesworntestimonyoftheminorchildrelatingtothemisconductreceivedinanycourt

2 (1)"Childcareprovider",apersonlicensed,regulated,orregisteredtoprovidechild
3carewithinthestateofMissouri,includingthememberormembers,managerormanagers,
4shareholderorshareholders,directorordirectors,andofficerorofficersofanyentity
5licensed,regulated,orregisteredtoprovidechildcarewithinthestateofMissouri;
6 (2)"Childcarestaffmember",achildcareprovider;personsemployedbythechild
7careproviderforcompensation,includingcontractemployeesorself-employedindividuals;
8individualsorvolunteerswhoseactivitiesinvolvethecareorsupervisionofchildrenfora
9childcareproviderorunsupervisedaccesstochildrenwhoarecaredfororsupervisedbya
10childcareprovider;individualsresidinginahomewherechildcareisprovidedwhoare
11eighteenyearsofageorolder;orindividualsresidinginahomewherechildcareisprovided
12whoareundereighteenyearsofageandhavebeencertifiedasanadultforthecommissionof

14 (3)"Criminalbackgroundcheck":

29 2.(1)Priortotheemploymentorpresenceofachildcarestaffmemberinalicensed,
30license-exempt,orunlicensedregisteredchildcarefacility,thechildcareprovidershall
31requesttheresultsofacriminalbackgroundcheckforsuchchildcarestaffmemberfromthe
32department.
33 (2)Aprospectivechildcarestaffmembermaybeginworkforachildcareprovider
34afterreceivingthequalifyingresultofeitheraFederalBureauofInvestigationfingerprint
35checkorasearchoftheMissouricriminalregistryorrepositorywiththeuseoffingerprints;
36however,pendingcompletionofthecriminalbackgroundcheck,theprospectivechildcare
37staffmembershallbesupervisedatalltimesbyanotherchildcarestaffmemberwhoreceived
38aqualifyingresultonthecriminalbackgroundcheckwithinthepastfiveyears.
39 (3)Anyindividualwhomeetsthedefinitionofchildcareproviderbutisnot
40responsiblefortheoversightordirectionofthechildcarefacilityanddoesnothave
41independentaccesstothechildcarefacilityshallnotberequiredtorequesttheresultsofa
42criminalbackgroundcheckunderthissection;however,suchindividualshallbeaccompanied
43byanindividualwithaqualifyingcriminalbackgroundcheckinordertobepresentatthe
44childcarefacilityduringchildcarehours.
45 3.Thecostsofthecriminalbackgroundcheckshallbetheresponsibilityofthechild
46carestaffmember,butmaybepaidorreimbursedbythechildcareproviderattheprovider's
47discretion.Thefeeschargedforthecriminalbackgroundcheckshallnotexceedtheactual
48costofprocessingandadministration.
49 4.Uponcompletionofthecriminalbackgroundcheck,anychildcarestaffmemberor
50prospectivechildcarestaffmembershallbeineligibleforemploymentorpresenceata
51licensedorlicense-exemptchildcarefacilityoranunlicensedchildcarefacilityregistered
52withthedepartmentandshallbedisqualifiedfromreceiptofstateorfederalfundsfor
53providingchildcareserviceseitherbydirectpaymentorthroughreimbursementtoan
54individualwhoreceiveschildcarebenefitsifsuchperson:
55 (1)Refusestoconsenttothecriminalbackgroundcheckasrequiredbythissection;

329.050.1.Applicantsforexaminationorlicensurepursuanttothischaptershall

3 (1)Theyshallprovidedocumentationofsuccessfulcompletionofcoursesapproved
4bytheboard,haveaneducationequivalenttothesuccessfulcompletionofthetenthgrade,
5andbeatleastseventeenyearsofage;
6 (2)Iftheapplicantsareapprentices,theyshallhaveservedandcompleted,asan
7apprenticeunderthesupervisionofalicensedcosmetologist,thetimeandstudiesrequiredby

13 (3)Iftheapplicantsarestudents,theyshallhavehadtherequiredtimeinalicensed
14schoolofnolessthanonethousandfivehundredhourstrainingorthecredithoursdetermined
15bytheformulainSubpartAofPart668ofSection668.8ofTitle34oftheCodeofFederal

42 3.Eachapplicationshallcontainastatementthat,subjecttothepenaltiesofmakinga

660.520.1.Thereisherebyestablishedinthedepartmentofsocialservicesaspecial
2team,tobeknownasthe"statetechnicalassistanceteam",toassistincasesofchildabuse,
3childneglect,childsexualabuse,childexploitation,child[pornography] sexualabuse
4material, orchildfatality.Itshallbethepriorityoftheteamtofocusonthosecasesinwhich
5morethanonereporthasbeenreceived.Theteamshall:
6 (1)Provideassistance,expertise,andtrainingtochildprotectionagenciesand
7multidisciplinaryteamsfortheinvestigationandprosecutionofchildabuse,childneglect,
8childsexualabuse,childexploitation,child[pornography] sexualabusematerial, orchild
9fatalitycases;
10 (2)Assistintheinvestigationofchildabuse,childneglect,childsexualabuse,child
11exploitation,child[pornography] sexualabusematerial, orchildfatalitycases,uponthe
12requestofalocal,county,state,orfederallawenforcementagency,county,state,orfederal
13prosecutor,arepresentativeofthefamilycourts,medicalexaminer,coroner,juvenileofficer,
14ordepartmentofsocialservicesstaff.Uponbeingrequestedtoassistinaninvestigation,the
15statetechnicalassistanceteamshallnotifyappropriatepartiesspecifiedinthissubdivisionof
16theteam'sinvolvement.Statetechnicalassistanceteaminvestigatorslicensedaspeace
17officersbythedirectorofthedepartmentofpublicsafetypursuanttochapter590shallbe
18deemedtobepeaceofficerswithinthestateofMissouriwhileactinginaninvestigationoron
19behalfofachild.Thepowerofarrestofastatetechnicalassistanceteaminvestigatoracting
20asapeaceofficershallbelimitedtooffensesinvolvingchildabuse,childneglect,child
21sexualabuse,childexploitation,child[pornography] sexualabusematerial, childfatality,or
22insituationsofimminentdangertotheinvestigatororanotherperson;
23 (3)Assistcountymultidisciplinaryteamstodevelopandimplementprotocolsforthe
24investigationandprosecutionofchildabuse,childneglect,childsexualabuse,child
25exploitation,child[pornography] sexualabusematerial, orchildfatalitycases.
26 2.Theteammaycallupontheexpertiseoftheofficeoftheattorneygeneral,the
27Missouriofficeofprosecutionservices,thestatehighwaypatrol,thedepartmentofhealthand
28seniorservices,thedepartmentofmentalhealthoranyotheragencyorinstitution.
29 3.Eachcountymaydevelopamultidisciplinaryteamforthepurposeofdetermining
30theappropriateinvestigativeandtherapeuticactiontobeinitiatedoncomplaintsreferencedin
31subsection1ofthissectionreportedtothechildren'sdivision.Themultidisciplinaryteam
32mayinclude,butisnotlimitedto,aprosecutor,orhisorherrepresentative,aninvestigator

34agencyandarepresentativeofthepoliceagencyofprimaryjurisdiction.
35 4.Allreportsandrecordsmadeandmaintainedbythestatetechnicalassistanceteam
36orlocallawenforcementrelatingtocriminalinvestigationsconductedpursuanttothis
37section,includingarrests,shallbeavailableinthesamemanneraslawenforcementrecords,
38assetforthinsections610.100to610.200,andtotheindividualsidentifiedinsubdivision
