151.150.1.Forthepurposeoflevyingschooltaxes,includingtaxesforschool

4countiesofthisstate,onthedistributablepropertyoftherailroadcompany,theseveralcounty

6oftaxationleviedforschoolpurposesforcapitalprojectspurposes,andforotherpurposes,
7eachseparatelybytheseverallocalschoolboardsorauthoritiesoftheseveralschooldistricts
8throughoutthecounty.
9 2.Theaveragerateforschoolpurposesshallbeascertainedbyaddingtogetherthe
10localratesoftheseveralschooldistrictsinthecountyandbydividingthesumthusobtained
11bythewholenumberofdistrictslevyingataxforschoolpurposes.Thecountyclerkshall
12causetobechargedtotherailroadcompaniestaxesforschoolpurposesattheaveragerateon
13theproportionatevalueoftherailroadpropertysocertifiedtothecountycommissionbythe
14statetaxcommission,undertheprovisionsofthischapter,andshallapportionthetaxesfor
15schoolpurposes,soleviedandcollected,amongalltheschooldistrictsinhiscounty,thesame
16proportionthattheSeptembermembershipofadistrict,determinedasprovidedin[(1)of
17subdivision(8)]paragraph(a)ofsubdivision(12)ofsection163.011,bearstothesumof
18theSeptembermembershipofalldistrictsinthecounty.
19 3.Theaveragerateleviedforcapitalprojectspurposes,andforotherpurposes,each
20separately,shallbeascertainedbyaddingtogetherthelocalratesoftheseveraldistrictsinthe
21countylevyingataxforcapitalprojectspurposes,orforotherpurposesandbydividingthe
22sumthusobtainedineachcasebythewholenumberofdistrictsinthecounty.Thecounty
23clerkshallcausetobechargedtotherailroadcompaniestaxesforcapitalprojectspurposes,
24orforotherpurposes,attheaveragerateontheproportionatevalueoftherailroad
25distributablepropertysocertifiedtothecountycommissionbythestatetaxcommission,
26undertheprovisionsofthischapter,andthecountycommissionshallapportionthetaxesfor
27capitalprojectspurposes,orforotherpurposessoleviedandcollected,amongtheseveral
28schooldistrictslevyingthetaxes,inproportiontotheamountofsuchtaxessoleviedineach
29ofthedistricts.
30 4.Alllocalpropertyownedorcontrolledbyarailroadcompanylyinginanyschool
31districtshallbetaxedatthesamerateasotherpropertyinthedistrict,andtheschooltaxes,
32includingtaxesforcapitalprojectspurposes,andforotherpurposesthereon,shallgotothe
33districtinwhichsuchpropertyissituated.
163.011.Asusedinthischapterunlessthecontextrequiresotherwise:
2 (1)"Adjustedoperatinglevy",thesumoftaxratesforthecurrentyearforteachers'
3andincidentalfundsforaschooldistrictasreportedtotheproperofficerofeachcounty
4pursuanttosection164.011;
5 (2)"Averagedailyattendance",thequotientorthesumofthequotientsobtainedby
6dividingthetotalnumberofhoursattendedinatermbyresidentpupilsbetweentheagesof
7fiveandtwenty-onebytheactualnumberofhoursschoolwasinsessioninthatterm.Tothe
8averagedailyattendanceofthefollowingschooltermshallbeaddedthefull-timeequivalent

12studentsingradesnine,ten,eleven,andtwelve,attendedbyallsummerschoolpupilsbythe
13numberofhoursrequiredinsection160.011intheschoolterm.Forpurposesofdetermining
14averagedailyattendanceunderthissubdivision,theterm"residentpupil"shallincludeall
15childrenbetweentheagesoffiveandtwenty-onewhoareresidentsoftheschooldistrictand
16whoareattendingkindergartenthroughgradetwelveinsuchdistrict.Ifachildisattending
17schoolinadistrictotherthanthedistrictofresidenceandthechild'sparentisteachinginthe
18schooldistrictorisaregularemployeeoftheschooldistrictwhichthechildisattending,then
19suchchildshallbeconsideredaresidentpupiloftheschooldistrictwhichthechildis
20attendingforsuchperiodoftimewhenthedistrictofresidenceisnototherwiseliablefor
21tuition.Averagedailyattendanceforstudentsbelowtheageoffiveyearsforwhichaschool
22districtmayreceivestateaidbasedonsuchattendanceshallbecomputedasregularschool
