Torepealsection311.550,RSMo,andtoenactinlieuthereofonenewsectionrelatingtoa
modificationofcertainfeesimposedonspirituousliquors.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section311.550,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection311.550,toreadasfollows:
311.550.1.Inadditiontoallotherlicensesandcharges,thereshallbepaidtoand
2collectedbythedirectorofrevenuechargesasfollows:
3 (1)FortheprivilegeofsellinginthestateofMissourispirituousliquors,including
4brandy,rum,whiskey,andgin,andotherspirituousliquorsandalcoholforbeverage
5purposes,thereshallbepaid,andthedirectorofrevenueshallbeentitledtoreceive,thesum
6of[twodollars] sixty-eightcentspergallonorfractionthereof;
7 (2)Fortheprivilegeofsellingwines,thesumofthirtycentspergallontothecreditof
8theagricultureprotectionfundcreatedundersection261.200tobeusedsolelyforagricultural
9businessdevelopmentandmarketing-relatedfunctionsofthedepartmentofagriculture.
10 2.Thepersonwhoshallfirstsellsuchliquortoanypersoninthisstateshallbeliable
11forthepayment,exceptthatnorefundofanytaxcollectedandremittedtothedirectorof
12revenuebyaretailsellerupongrossreceiptsfromasaleofbeer,liquororwinesubjecttothe
13chargescontainedinsections311.520,311.550and311.554shallbeclaimedforrefundunder
14chapter144foranyamountillegallyorerroneouslyoverchargedorovercollectedasaresult
15ofimpositionofsalestaxbytheretailselleruponamountsrepresentingthechargesimposed
16underthischapter.
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17 3.Anypersonwhosellstoanypersonwithinthisstateanyintoxicatingliquors
18mentionedinsubdivision(1)ofsubsection1,unlessthechargeherebyimposedispaid,is
19guiltyofafelonyandshallbepunishedbyimprisonmentbythestatedepartmentof
20correctionsforatermofnotlessthantwoyearsnormorethanfiveyears,orbyimprisonment
21inthecountyjailforatermofnotlessthanonemonthnormorethanoneyear,orbyafineof
22notlessthanfiftydollarsnormorethanonethousanddollars,orbybothsuchfineand
23imprisonment.
24 4.Itshallbeunlawfulforanypersontoremovethecontentsofanycontainer
25containinganyoftheintoxicatingliquorsmentionedinsubdivision(1)ofsubsection1
26withoutdestroyingsuchcontainer,ortorefillanysuchcontainer,inwholeorinpart,withany
27oftheliquorsmentionedinsubdivision(1)ofsubsection1.Anypersonviolatingthe
28provisionsofthissubsectionshallbeguiltyofamisdemeanor.
29 5.Everymanufacturer,out-statesolicitorandwholesaledealerlicensedunderthis
30chaptershallmakeatrueduplicateinvoiceofthesame,showingthedate,amountandvalue
31ofeachclassofsuchliquorsshippedordelivered,andretainaduplicatethereof,subjecttothe
32useandinspectionofthesupervisorof[liquor] alcoholandtobaccocontrolandhis
33representativesfortwoyears.
34 6.Anypersonwhoshallsellinthisstateanyintoxicatingliquorwithoutfirsthaving
35procuredalicensefromthesupervisorof[liquor] alcoholandtobaccocontrolauthorizing
36himtosellsuchintoxicatingliquorisguiltyofafelonyanduponconvictionshallbepunished
37byimprisonmentbythestatedepartmentofcorrectionsforatermofnotlessthantwoyears
38normorethanfiveyears,orbyimprisonmentinthecountyjailforatermofnotlessthan
39threemonthsnormorethanoneyear,orbyafineofnotlessthanonehundreddollarsnor
40morethanonethousanddollars,orbybothsuchfineandimprisonment.
