204.300.1.Inallcountiesexceptcountiesofthefirstclassificationwhichhavea
2charterformofgovernmentandwhichcontainalloranyportionofacitywithapopulationof
3threehundredfiftythousandormoreinhabitants,thegoverningbodyofthecounty,by
4resolution,order,orordinance,shallappointfivetrustees,themajorityofwhomshallreside
5withintheboundariesofthedistrict.Intheeventthedistrictextendsintoanycounty
6borderingthecountyinwhichthegreaterportionofthedistrictlies,thepresiding
7commissionerorotherchiefexecutiveofficeroftheadjoiningcountyshallbeanadditional
8memberoftheappointedboardoftrustees.Subjecttotheprovisionsofsection105.454,the
9trusteesmaybepaidreasonablecompensationbythedistrictfortheirservices[; exceptthat,
10anycompensationscheduleshallbeapprovedbyresolutionoftheboardoftrustees] outside
11theirdutiesastrustees.Eachtrusteeoftheboardmayreceiveanattendancefeenotto
12exceedonehundreddollarsforattendingeachregularlycalledboardmeeting,orspecial
13meeting,butshallnotbepaidforattendingmorethantwomeetingsinanycalendar
14month,exceptthatinacountyofthefirstclassification,atrusteeshallnotbepaidfor
15attendingmorethanfourmeetingsinanycalendarmonth.However,notrusteeshallbe
16paidmorethanoneattendancefeeifsuchtrusteeattendsmorethanoneboardmeeting
17inacalendarweek.Eachtrusteeoftheboardshallbereimbursedforhisorheractual

19oftrusteesshallberesponsibleforthecontrolandoperationofthesewerdistrict.Thetermof
20eachboardmembershallbefiveyears;exceptthat,membersofthegoverningbodyofthe
21countysittingupontheboardshallnotservebeyondtheexpirationoftheirtermasmembers
22ofsuchgoverningbodyofthecounty.Thefirstboardoftrusteesshallbeappointedforterms
23rangingfromonetofiveyearssoastoestablishonevacancyperyearthereafter.Ifthe
24governingbodyofthecountywiththerightofappointmentunderthissectionfailstoappoint
25atrusteetofillavacancyontheboardwithinsixtydaysafterreceivingwrittennoticefrom
26thecommonsewerdistrictoftheexistenceofsuchvacancy,thenthevacancymaybefilledby
27amajorityoftheremainingmemberstheninofficeoftheboardoftrusteesofsuchcommon
28sewerdistrict.Subjecttotheprovisionsofsection105.454,thetrusteesmaybepaid
29reasonablecompensationbythedistrictfortheirservices[; exceptthat,anycompensation
30scheduleshallbeapprovedbyresolution,order,orordinanceofthegoverningbodyofthe
31county.Anyandallexpensesincurredintheperformanceoftheirdutiesshallbereimbursed
32bythedistrict] outsidetheirdutiesastrustees.Eachtrusteeoftheboardmayreceivean
33attendancefeenottoexceedonehundreddollarsforattendingeachregularlycalled
34boardmeeting,orspecialmeeting,butshallnotbepaidforattendingmorethantwo
35meetingsinanycalendarmonth,exceptthatinacountyofthefirstclassification,a
36trusteeshallnotbepaidforattendingmorethanfourmeetingsinanycalendarmonth.
37However,notrusteeshallbepaidmorethanoneattendancefeeifsuchtrusteeattends
38morethanoneboardmeetinginacalendarweek.Eachtrusteeoftheboardshallbe
39reimbursedforhisorheractualexpendituresintheperformanceofhisorherdutieson
40behalfofthedistrict. Theboardoftrusteesshallhavethepowertoemployandfixthe
41compensationofsuchstaffasmaybenecessarytodischargethebusinessandpurposesofthe
42district,includingclerks,attorneys,administrativeassistants,andanyothernecessary
43personnel.Theboardoftrusteesshallselectatreasurer,whomaybeeitheramemberofthe
44boardoftrusteesoranotherqualifiedindividual.Thetreasurerselectedbytheboardshall
45givesuchbondasmayberequiredbytheboardoftrustees.Theboardoftrusteesshall
46appointthesewerengineerforthecountyinwhichthegreaterpartofthedistrictliesaschief
47engineerforthedistrict,andthesewerengineershallhavethesamepowers,responsibilities
48anddutiesinregardtoplanning,constructionandmaintenanceofthesewers,andtreatment
49facilitiesofthedistrictashenowhasbyvirtueoflawinregardtothesewerfacilitieswithin
50thecountyforwhichheiselected.Ifthereisnosewerengineerinthecountyinwhichthe
51greaterpartofthedistrictlies,theboardoftrusteesmayemployaregisteredprofessional
52engineeraschiefengineerforthedistrictundersuchtermsandconditionsasmaybe
53necessarytodischargethebusinessandpurposesofthedistrict.Theprovisionsofthis
54subsectionshallnotapplytoanycountyofthefirstclassificationwhichhasacharterformof

56fiftythousandormoreinhabitants.
57 2.Inanycountyofthefirstclassificationwhichhasacharterformofgovernmentand
58whichcontainsalloranyportionofacitywithapopulationofthreehundredfiftythousandor
59moreinhabitants,[andinanycountyofthefirstclassificationwithoutacharterformof
60governmentandwhichhasapopulationofmorethansixty-threethousandsevenhundredbut
61lessthanseventy-fivethousand,] thereshallbeaten-memberboardoftrusteestoconsistof
62thecountyexecutive,themayorsofthefivecitiesconstitutingthelargestusersbyflow
63duringthepreviousfiscalyear,themayorsofthreecitieswhicharenotamongthefivelargest
64usersandwhoaremembersoftheadvisoryboardofthedistrictestablishedpursuantto
65section204.310,andonememberofthecountylegislaturetobeappointedbythecounty
66executive,withtheconcurrenceofthecountylegislature.Ifthecountyexecutivedoesnot
67appointsuchmembersofthecountylegislaturetotheboardoftrusteeswithinsixtydays,the
68countylegislatureshallmaketheappointments.Theadvisoryboardmembersshallbe
69appointedannuallybytheadvisoryboard.Intheeventthedistrictextendsintoanycounty
70borderingthecountyinwhichthegreaterportionofthedistrictlies,thenumberofmembers
71ontheboardoftrusteesshallbeincreasedtoatotalofelevenandthepresidingcommissioner
72orcountyexecutiveoftheadjoiningcountyshallbeanadditionalmemberoftheboardof
73trustees.Thetrusteesofadistrictwithaneleven-memberboardandlocatedintwo
74countiesshallreceivenocompensationfortheirservices[,] butmaybecompensatedfortheir
75reasonableexpensesnormallyincurredintheperformanceoftheirduties.Eachtrusteeofa
76ten-memberboardmayreceiveanattendancefeenottoexceedonehundreddollarsfor
77attendingeachregularlycalledboardmeeting,orspecialmeeting,butshallnotbepaid
78forattendingmorethantwomeetingsinanycalendarmonth.However,notrusteeofa
79ten-memberboardshallbepaidmorethanoneattendancefeeifsuchtrusteeattends
80morethanoneboardmeetinginacalendarweek.Eachtrusteeofaten-memberboard
81shallbereimbursedforhisorheractualexpendituresintheperformanceofhisorher
82dutiesonbehalfofthedistrict.Subjecttotheprovisionsofsection105.454,thetrustees
83ofaten-memberboardmaybepaidreasonablecompensationbythedistrictfortheir
84servicesoutsidetheirdutiesastrustees.Theboardoftrusteesmayemployandfixthe
85compensationofsuchstaffasmaybenecessarytodischargethebusinessandpurposesofthe
86district,includingclerks,attorneys,administrativeassistants,andanyothernecessary
87personnel.Theboardoftrusteesmayemployandfixthedutiesandcompensationofan
88administratorforthedistrict.Theadministratorshallbethechiefexecutiveofficerofthe
89districtsubjecttothesupervisionanddirectionoftheboardoftrusteesandshallexercisethe
90powers,responsibilitiesanddutiesheretoforeexercisedbythechiefengineerpriorto
91September28,1983.Theadministratorofthedistrictmay,withtheapprovaloftheboardof
HB148	3 92trustees,retainconsultingengineersforthedistrictundersuchtermsandconditionsasmaybe
93necessarytodischargethebusinessandpurposesofthedistrict.Theprovisionsofthis
94subsectionshallonlyapplytocountiesofthefirstclassificationwhichhaveacharterformof
95governmentandwhichcontainalloranyportionofacitywithapopulationofthreehundred
96fiftythousandormoreinhabitants.
204.610.1.Thereshallbefivetrustees,appointedorelectedasprovidedforinthe
2circuitcourtdecreeoramendeddecreeofincorporationforareorganizedcommonsewer
3district,whoshallresidewithintheboundariesofthedistrict.Eachtrusteeshallbeavoterof
4thedistrictandshallhaveresidedinsaiddistrictfortwelvemonthsimmediatelypriortothe
5trustee'selectionorappointment.Atrusteeshallbeatleasttwenty-fiveyearsofageandshall
6notbedelinquentinthepaymentoftaxesatthetimeofthetrustee'selectionorappointment.
7Regardlessofwhetherornotthetrusteesareelectedorappointed,intheeventthedistrict
8extendsintoanycountyborderingthecountyinwhichthegreaterportionofthedistrictlies,
9thepresidingcommissionerorotherchiefexecutiveofficeroftheadjoiningcountyshallbe
10anadditionalmemberoftheboardoftrustees,orthegoverningbodyofsuchbordering
11countymayappointacitizenfromsuchcountytoserveasanadditionalmemberoftheboard
12oftrustees.Saidadditionaltrusteeshallmeetthequalificationssetforthinthissectionfora
13trustee.
14 2.[Thetrusteesshallreceivenocompensationfortheirservicesbutmaybe
15compensatedforreasonableexpensesnormallyincurredintheperformanceoftheirduties.]
16Eachtrusteeoftheboardmayreceiveanattendancefeenottoexceedonehundred
17dollarsforattendingeachregularlycalledboardmeeting,orspecialmeeting,butshall
18notbepaidforattendingmorethantwomeetingsinanycalendarmonth.However,no
19trusteeshallbepaidmorethanoneattendancefeeifsuchtrusteeattendsmorethanone
20boardmeetinginacalendarweek.Eachtrusteeoftheboardshallbereimbursedforhis
21orheractualexpendituresintheperformanceofhisorherdutiesonbehalfofthe
22district.Subjecttotheprovisionsofsection105.454,thetrusteesmaybepaid
23reasonablecompensationbythedistrictfortheirservicesoutsidetheirdutiesas
24trustees.Theboardoftrusteesmayemployandfixthecompensationofsuchstaffasmaybe
25necessarytodischargethebusinessandpurposesofthedistrict,includingclerks,attorneys,
26administrativeassistants,andanyothernecessarypersonnel.Theboardoftrusteesmay
27employandfixthedutiesandcompensationofanadministratorforthedistrict.The
28administratorshallbethechiefexecutiveofficerofthedistrictsubjecttothesupervisionand
29directionoftheboardoftrustees.Theadministratorofthedistrictmay,withtheapprovalof
30theboardoftrustees,retainconsultingengineersforthedistrictundersuchtermsand
31conditionsasmaybenecessarytodischargethebusinessandpurposesofthedistrict.
HB148	4 32 3.Exceptasprovidedinsubsection1ofthissection,thetermofofficeofatrustee
33shallbefiveyears.Theremainingtrusteesshallappointapersonqualifiedunderthissection
34tofillanyvacancyontheboard.Theinitialtrusteesappointedbythecircuitcourtshallserve
35untilthefirstTuesdayafterthefirstMondayinJuneoruntilthefirstTuesdayafterthefirst
36MondayinApril,dependingupontheresolutionofthetrustees.Intheeventthatthetrustees
37areelected,saidelectionsshallbeconductedbytheappropriateelectionauthorityunder
38chapter115.Otherwise,trusteesshallbeappointedbythecountycommissioninaccordance
39withthequalificationssetforthinsubsection1ofthissection.
40 4.Notwithstandinganyotherprovisionoflaw,ifthereisonlyonecandidateforthe
41postoftrustee,thennoelectionshallbeheld,andthecandidateshallassumethe
42responsibilitiesofofficeatthesametimeandinthesamemannerasifelected.Ifthereisno
43candidateforthepostoftrustee,thennoelectionshallbeheldforthatpostanditshallbe
44consideredvacant,tobefilledundertheprovisionsofsubsection3ofthissection.
