393.2500.1.Asusedinthissection,thefollowingtermsshallmean:

5 (4)"Energystoragesystem",commerciallyavailabletechnologythatiscapable

8maybeinterconnectedbehindthecustomer'smeterorinterconnectedbehinditsown

16 2.WithinninetydaysafterAugust28,2025,anelectricalcorporationshallfile
17anapplicationwiththecommissionrequestingapprovalofthecorporation'stariffto
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18providearebatetoanycustomer-generatorinstallinganyenergystoragesystemand,if
19applicable,anewsolarelectricsystematthecustomer-generator'spremisesforthe
20customer-generator'sownuse.Therebateshallbeasfollows:

23 (2)Onedollarandfiftycentsperwattforsystemsbecomingoperationalbetween
24July1,2026,andJune30,2027;
25 (3)OnedollarperwattforsystemsbecomingoperationalbetweenJuly1,2027,
26andJune30,2028;
27 (4)FiftycentsperwattforsystemsbecomingoperationalbetweenJuly1,2028,

34Therebateamountsunderthissubsectionshallbeissueduntilsuchfundsexpireor
35exceedtheallottedamounts.Anelectricalcorporationmay,throughitstariffs,require
36applicationsforrebatestobesubmittedbycustomer-generatorsuptoonehundredand
37eightydayspriortoJune30,2026.
38 3.Thecommissionshallreviewtheapplicationundersubsection2ofthissection
39andmakemodifications,ifnecessary,thatareconsistentwiththecommission's
40authorityunderchapter386.Nolaterthanonehundredandeightydaysafterthe
41electricalcorporationfilestheapplicationundersubsection2ofthissection,the
42commissionshallholdahearingandissueanorderapproving,orapprovingwith
43modifications,thetariff.
44 4.Tobeeligibleforarebateunderthissection,acustomer-generatorshall:
45 (1)Haveasmartinverterinstalledatthecustomer'spremisesthatis
46interconnectedtodistributionfacilitiesownedoroperatedbyanelectricalcorporation;
47 (2)Installanenergystoragesystem;
48 (3)Connectanenergystoragesystemtoaneworexistingsolarelectricsystem
49sitedonthecustomer-generator'spremisesthatisconfirmedbytheelectrical
50corporationtohavebecomeoperationalandincompliancewiththeprovisionsof
51section386.890;and
52 (4)Transfertotheelectricalcorporationallrights,titles,andinterestinandto
53therenewableenergycreditsassociatedwiththesolarelectricsystemandenergy
54storagesystemthatqualifiedthecustomer-generatorfortherebateforaperiodoften
HB1487	2 55yearsfromthedatetheelectricalcorporationconfirmedthattheenergystoragesystem
56wasinstalledandoperational.
57 5.Anelectricalcorporation'sobligationtomakerebatepaymentsunderthis
58sectionshallnotexceedthefollowinglimitations:
59 (1)AsofAugust28,2025,anelectricalcorporationwithonemillionormore
60customersinthestateshallnotbeobligatedtopayrebatesinanycalendaryearfrom
612025through2031inanamountexceedingfivemillionsixhundredthousanddollarsor
62inanaggregateamountexceedingtwenty-eightmilliondollars;
63 (2)AsofAugust28,2025,anelectricalcorporationwithlessthanonemillionbut
64morethantwohundredthousandcustomersinthestateshallnotbeobligatedtopay
65rebatesinanycalendaryearfrom2025through2031inanamountexceedingone
66millionsixhundredthousanddollarsorinanaggregateamountexceedingeightmillion
67dollars;and
68 (3)AsofAugust28,2025,anelectricalcorporationwithtwohundredthousand
69orlesscustomersinthestateshallnotbeobligatedtopayrebatesinanycalendaryear
70from2025through2031inanamountexceedingonemillionfourhundredthousand
71dollarsorinanaggregateamountexceedingsevenmilliondollars.
72 6.Aftertheissuanceoftherebateunderthissection,anelectricalcorporation
73shallbepermittedtorecoverthecostofallrebatepaymentsithasmadethrougheither
74baseratesorarateadjustmentmechanismundersection393.1030andshallalsobe
75permittedtodeferandamortizetherecoveryofsuchcosts,includinginterestatthe
76electricalcorporation'sshort-termborrowingrate,througheitherbaseratesora
77surchargeoveraperiodoftheelectricalcorporation'schoicenottoexceedfiveyears,
78providedthatifrecoveryofsuchcostsinsuchmannerandoversuchatimeperiod
79wouldcausetheelectricalcorporationtoexceedtheonepercentmaximumaverage
80retailrateincreaselimitationrequiredbysubdivision(1)ofsubsection2ofsection
81393.1030.Therecoveryofsuchcoststhatwouldexceedtheonepercentmaximum
82averageretailrateincreaselimitationshallbedeferredbytheelectricalcorporationtoa
83regulatoryassettowhichcarryingcostsattheelectricalcorporation'sweightedaverage
84costofcapitalshallbeaddedandrecoveredthroughbaseratesorthrougharate
85adjustmentmechanismundersection393.1030,assoonaspracticable.
86 7.Thecommissionshallpromulgaterulestoimplementtheprovisionsofthis
87section.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis
88createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifit
89complieswithandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,
90section536.028.Thissectionandchapter536arenonseverableandifanyofthepowers
91vestedwiththegeneralassemblypursuanttochapter536toreview,todelaythe
HB1487	3 92effectivedate,ortodisapproveandannularulearesubsequentlyheldunconstitutional,
93thenthegrantofrulemakingauthorityandanyruleproposedoradoptedafterAugust
9428,2025,shallbeinvalidandvoid.
