302.178.1.Anypersonbetweentheagesofsixteenandeighteenyearswhois
2qualifiedtoobtainalicensepursuanttosections302.010to302.340mayapplyfor,andthe
3directorshallissue,anintermediatedriver'slicenseentitlingtheapplicant,whilehavingsuch
4licenseinhisorherpossession,tooperateamotorvehicleoftheappropriateclassuponthe
5highwaysofthisstateinconjunctionwiththerequirementsofthissection.Anintermediate
6driver'slicenseshallbereadilydistinguishablefromalicenseissuedtothoseovertheageof
7eighteen.Allapplicantsforanintermediatedriver'slicenseshall:
8 (1)Successfullycompletetheexaminationrequiredbysection302.173;
9 (2)Paythefeerequiredbysubsection4ofthissection;
10 (3)Havehadatemporaryinstructionpermitissuedpursuanttosubsection1of
11section302.130foratleastasix-monthperiodoravalidlicensefromanotherstate;and
12 (4)Haveaparent,grandparent,legalguardian,or,iftheapplicantisaparticipantina
13federalresidentialjobtrainingprogram,adrivinginstructoremployedbyafederalresidential
14jobtrainingprogram,signtheapplicationstatingthattheapplicanthascompletedatleast
15fortyhoursofsuperviseddrivingexperienceunderatemporaryinstructionpermitissued
16pursuanttosubsection1ofsection302.130,or,iftheapplicantisanemancipatedminor,the

18section,theterm"emancipatedminor"meansapersonwhoisatleastsixteenyearsofage,
19exceptasprovidedundersection451.090, butlessthaneighteenyearsofage,who:
20 (a)Marrieswiththeconsentofthelegalcustodialparentorlegalguardianpursuantto
21section451.080;
22 (b)Hasbeendeclaredemancipatedbyacourtofcompetentjurisdiction;
23 (c)EntersactivedutyintheArmedForces;
24 (d)Haswrittenconsenttotheemancipationfromthecustodialparentorlegal
25guardian;or
26 (e)Throughemploymentorothermeansprovidesforsuchperson'sownfood,shelter
27andothercost-of-livingexpenses;
28 (5)Havehadnoalcohol-relatedenforcementcontactsasdefinedinsection302.525
29duringtheprecedingtwelvemonths;and
30 (6)Havenononalcoholictrafficconvictionsforwhichpointsareassessedpursuantto
31section302.302,withintheprecedingsixmonths.
32 2.Anintermediatedriver'slicensegrantsthelicenseethesameprivilegestooperate
33thatclassificationofmotorvehicleasalicenseissuedpursuanttosection302.177,exceptthat
34nopersonshalloperateamotorvehicleonthehighwaysofthisstateundersuchan
35intermediatedriver'slicensebetweenthehoursof1:00a.m.and5:00a.m.unless
36accompaniedbyapersondescribedinsubsection1ofsection302.130;exceptthelicensee
37mayoperateamotorvehiclewithoutbeingaccompaniedifthetravelistoorfromaschoolor
38educationalprogramoractivity,aregularplaceofemploymentorinemergencysituationsas
39definedbythedirectorbyregulation.
40 3.Eachintermediatedriver'slicenseshallberestrictedbyrequiringthatthedriver
41andallpassengersinthelicensee'svehiclewearsafetybeltsatalltimes.Thissafetybelt
42restrictionshallnotapplytoapersonoperatingamotorcycle.Forthefirstsixmonthsafter
43issuanceoftheintermediatedriver'slicense,theholderofthelicenseshallnotoperateamotor
44vehiclewithmorethanonepassengerwhoisundertheageofnineteenwhoisnotamember
45oftheholder'simmediatefamily.Asusedinthissubsection,anintermediatedriver'slicense
46holder'simmediatefamilyshallincludebrothers,sisters,stepbrothersorstepsistersofthe
47driver,includingadoptedorfosterchildrenresidinginthesamehouseholdoftheintermediate
48driver'slicenseholder.Aftertheexpirationofthefirstsixmonths,theholderofan
49intermediatedriver'slicenseshallnotoperateamotorvehiclewithmorethanthreepassengers
50whoareundernineteenyearsofageandwhoarenotmembersoftheholder'simmediate
51family.Thepassengerrestrictionsofthissubsectionshallnotbeapplicabletoany
52intermediatedriver'slicenseholderwhoisoperatingamotorvehiclebeingusedin
53agriculturalwork-relatedactivities.
HB1496	2 54 4.Notwithstandingtheprovisionsofsection302.177tothecontrary,thefeeforan
55intermediatedriver'slicenseshallbefivedollarsandsuchlicenseshallbevalidforaperiodof
56twoyears.
57 5.Anyintermediatedriver'slicenseeaccumulatingsixormorepointsinatwelve-
58monthperiodmayberequiredtoparticipateinandsuccessfullycompleteadriver-
59improvementprogramapprovedbythestatehighwaysandtransportationcommission.The
60driver-improvementprogramorderedbythedirectorofrevenueshallnotbeusedinlieuof
61pointassessment.
62 6.(1)Anintermediatedriver'slicenseewhohas,fortheprecedingtwelve-month
63period,hadnoalcohol-relatedenforcementcontacts,asdefinedinsection302.525andno
64trafficconvictionsforwhichpointsareassessed,uponreachingtheageofeighteenyearsor
65withinthethirtydaysimmediatelyprecedingtheireighteenthbirthdaymayapplyforand
66receivewithoutfurtherexamination,otherthanavisiontestasprescribedbysection302.173,
67alicenseissuedpursuanttothischaptergrantingfulldrivingprivileges.Suchpersonshall
68paytherequiredfeeforsuchlicenseasprescribedinsection302.177.
69 (2)Ifanintermediatedriver'slicenseexpiresonaSaturday,Sunday,orlegalholiday,
70suchlicenseshallremainvalidforthefivebusinessdaysimmediatelyfollowingthe
71expirationdate.Innocaseshallalicenseewhoseintermediatedriver'slicenseexpiresona
72Saturday,Sunday,orlegalholidaybeguiltyofanoffenseofdrivingwithanexpiredorinvalid
73driver'slicenseifsuchoffenseoccurredwithinfivebusinessdaysimmediatelyfollowingan
74expirationdatethatoccursonaSaturday,Sunday,orlegalholiday.
75 (3)Thedirectorofrevenueshalldenyanapplicationforafulldriver'slicenseuntil
76thepersonhashadnotrafficconvictionsforwhichpointsareassessedforaperiodoftwelve
77monthspriortothedateofapplicationforlicenseoruntilthepersoniseligibletoapplyfora
78six-yeardriver'slicenseasprovidedforinsection302.177,providedtheapplicantis
79otherwiseeligibleforfulldrivingprivileges.Anintermediatedriver'slicenseshallexpire
80whenthelicenseeiseligibleandreceivesafulldriver'slicenseasprescribedinsubdivision
81(1)ofthissection.
82 7.Nopersonuponreachingtheageofeighteenyearswhoseintermediatedriver's
83licenseanddrivingprivilegeisdenied,suspended,cancelledorrevokedinthisstateorany
84otherstateforanyreasonmayapplyforafulldriver'slicenseuntilsuchlicenseordriving
85privilegeisfullyreinstated.Anysuchpersonwhoseintermediatedriver'slicensehasbeen
86revokedpursuanttotheprovisionsofsections302.010to302.540shall,uponreceiptof
87reinstatementoftherevocationfromthedirector,passthecompletedriverexamination,apply
88foranewlicense,andpaytheproperfeebeforeagainoperatingamotorvehicleuponthe
89highwaysofthisstate.
HB1496	3 90 8.Apersonshallbeexemptfromtheintermediatelicensingrequirementsifthe
91personhasreachedtheageofeighteenyearsandmeetsallotherlicensingrequirements.
92 9.Anypersonwhoviolatesanyoftheprovisionsofthissectionrelatingto
93intermediatedrivers'licensesortheprovisionsofsection302.130relatingtotemporary
94instructionpermitsisguiltyofaninfraction,andnopointsshallbeassessedtohisorher
95drivingrecordforanysuchviolation.
96 10.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis
97createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies
98withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.
99Thissectionandchapter536arenonseverableandifanyofthepowersvestedwiththe
100generalassemblypursuanttochapter536toreview,todelaytheeffectivedateorto
101disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof
102rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2000,shallbeinvalid
103andvoid.
451.015.Aminorwhoislegallymarriedundertheprovisionsofthischapter
2shallbeconsideredanemancipatedminorandshallbequalifiedandcompetentto
3contractforhousing,employment,purchaseofanautomobile,receiptofastudentloan,
4oradmissiontohighschoolorpostsecondaryschool;toobtainmedicalandmental
5healthcare;toestablishabankaccount;tobeadmittedtoashelterforvictimsof
6domesticviolenceasthatphraseisusedinsections455.200to455.220,arapecrisis
7centerasdefinedinsection455.003,orahomelessshelter;andtoreceiveservicesasa
8victimofdomesticviolenceorsexualassaultassuchtermsaredefinedinsection455.010
9including,butnotlimitedto,counseling,courtadvocacy,financialassistance,andother
10advocacyservices.Anemancipatedminormayalsocommence,prosecute,ordefend
11anyactioninhisorherownnameastherealpartyininterest.
451.090.1.Norecordershallissuealicenseauthorizingthemarriageofanymaleor
2femaleunder[sixteen] seventeenyearsofagenorshallalicensebeissuedauthorizingthe
3marriageofanymaleorfemaletwenty-oneyearsofageoroldertoamaleorfemaleunder
4eighteenyearsofage.
5 2.Norecordershallissuealicenseauthorizingthemarriageofanymaleorfemale
6undertheageofeighteenyears,exceptwiththeconsentofhisorhercustodialparentor
7guardian,whichconsentshallbegivenatthetime,inwriting,statingtheresidenceofthe
8persongivingsuchconsent,signedandsworntobeforeanofficerauthorizedtoadminister
9oaths.
10 3.Therecordershallstateineverylicensewhetherthepartiesapplyingforsame,one
11oreitherorbothofthem,areofage,orwhetherthemaleisundertheageofeighteenyearsor
12thefemaleundertheageofeighteenyears,andifthemaleisundertheageofeighteenyears
HB1496	4 13orthefemaleisundertheageofeighteenyears,thenameofthecustodialparentorguardian
14consentingtosuchmarriage.Applicantsshallprovideproofofagetotherecorderintheform
15ofacertifiedcopyoftheapplicant'sbirthcertificate,passport,orothergovernment-issued
16identification,whichshallthenbedocumentedbytherecorder.
