VIOLENTCRIMECLEARANCERATES(Section43.505,RSMo)
Currently,theDepartmentofPublicSafetyisthecentral
repositoryforthecollection,maintenance,analysis,andreporting
ofcrimeincidentactivitygeneratedbylawenforcementagenciesin
theState.ThisbillrequirestheDepartmenttopublishquarterly
clearanceratesontheirwebsitebeginningJanuary1,2026.
BeginningJanuary1,2026,everylawenforcementagencyinthe
Statewillcollectdatadocumentingcaseclearancesfornonfatal
shootings. Clearanceratedatawillbereportedonamonthly
basis.Clearanceratedatawillincludedemographicinformation
andbedisaggregatedbywhethertheoffensewasclearedbyarrest
orbyexceptionalmeans,asdefinedinthebill.BeginningJanuary
1,2027,theDepartmentwillmakeannualreportsofthisdatatoa
numberofofficeslistedinthebill.
Thisbilldefinesterms"Clearancerates","Offenseclearedbyan
arrest",and"Offenseclearedbyexceptionalmeans".Thebill
createstheMissouriViolentCrimeClearanceGrantProgramwithin
theDepartment,tobedevelopedinconsultationwiththePeace
OfficersStandardsandTrainingCommission,theOfficeforVictims
ofCrime,andtheCrimeLaboratoryReviewCommission. Thepurpose
oftheProgramwillbetoimprovelawenforcementstrategiesand
initiativesaimedatincreasingviolentcrimeclearancerates.The
billdescribeseligibleusesforfundingintheProgramtoachieve
thispurpose. Priorityforgrantsunderthisprogramwillbegiven
tolawenforcementagencies:
(1)Withconsistentpublicreportingoflowclearancerates;
(2)Thatdemonstrateacommitmenttoworkingwithcommunity-based
organizationsandgovernmentagenciestoreduceviolentcrime
rates;or
(3)Thatdetailaprocessforevaluatingtheeffectivenessofboth
investigatorsandinvestigativeunits,includingthedevelopmentof
specificgoalsandperformancemetrics.
Thebillrequireslawenforcementagenciesthatreceivefunding
underthisProgramtoreporttotheDepartmentannuallyon
activitiescarriedouttoreduceviolentcrimeandincrease
clearancerates,asdescribedinthebill.TheStateAuditorwill
periodicallyauditalllawenforcementagenciesreceivingstate
funds. RESTRAINTSONCHILDRENDURINGJUVENILECOURTPROCEEDINGS(Section
211.436)
Thisbillrequiresthatinstrumentsofrestraint,including
handcuffs,chains,irons,orstraitjackets, willnotbeusedona
childduringaproceedinginajuvenilecourtandwillberemoved
priortothechild'sappearancebeforethecourtunless,aftera
hearing,thecourtfindsboththat:
(1)Theuseofrestraintsisnecessarytopreventphysicalharmto
thechildoranotherperson,thereisevidencethatthechild
presentsasubstantialriskofflightfromthecourtroom,or
historyofdisruptivecourtroombehavior;and
(2)Therearenolessrestrictivealternativesincluding,butnot
limitedto,thepresenceofcourtpersonnel,lawenforcement
officers,orbailiffs.
Ifthejuvenileofficerbelievesthereisanimmediatesafetyor
flightrisk,theywilladvisetheattorneyforthechildandmakea
requestinwritingpriortothecommencementoftheproceedingfor
thechildtoremainrestrained. Thecourtwillorderahearing
andprovidethechild'sattorneyanopportunitytobeheardbefore
thecourtorderstheuseofrestraints. Ifrestraintsareordered,
thecourtwillmakefindingsoffactinsupportoftheorder.
Ifrestraintsareused,therestraintswillallowthechildsome
limitedmovementofthehandstoreadandhandledocuments
necessarytotheproceeding. Undernocircumstanceswillachild
berestrainedusingrestraintsfixedtoawall,floor,furniture,
orotherstationaryobject.
OFFENDERS'MEDICALRECORDREQUESTS(Section217.075)
ThisbillrequirestheDepartmentofCorrections(DOC)toprovide
toanoffenderortheirpersonalrepresentative electroniccopies
ofallmedicalrecordsrelatedtothatoffenderwhileinthe
custodyoftheDOCuponrequest. Theelectroniccopieswillbe
providedwithin30daysoftherequestandatnocosttothe
offender.
PERSONALREPRESENTATIVE DESIGNATIONFOROFFENDERS(Section217.312)
Thebillgivesoffendersdeliveredtothereceptionanddiagnostic
centeroftheDOCtheopportunitytodesignateapersonal
representative. TheDOCwilldevelopaformforoffenderstomake
apersonalrepresentative designation. Theformwillbemade
availableinpaperandelectronicformatandwillinclude informationaboutthepersonalrepresentative aslistedinthe
bill.TheDirectorwillhaverulemakingauthorityforthe
administration ofthissectionunderChapter536.
INVESTIGATIONOFDEATHSATDEPARTMENTOFCORRECTIONSFACILITIES
(Section217.446)
Thebillrequiresthatwhenanypersonunder50yearsofagedies
withinaDOCfacility,theStateHighwayPatrolwillconductan
independentdeathinvestigation. Inconductingtheinvestigation,
theStateHighwayPatrolwillbegrantedfullaccesstoanyrecords
andfindingsofanautopsy.
PHONEACCESSATJAILSANDCORRECTIONALCENTERS(Section217.451)
Thebillrequiresjailsandcorrectionalcenterstoprovide
offendersandinmateswithreasonableaccesstophoneservices,
exceptthatphoneaccesscanberestrictedasadisciplinary
measure. Thetotalcostofdomesticphonecallschargedtoan
inmateoroffenderwillnotexceed12centsperminute.
HOSPICECARETRAININGPROGRAMINSTATEPRISONS(Section217.1200)
ThisbillallowstheDOCtodevelopaHospiceCareTraining
Program. TheDOC,incooperationwiththeDepartmentofHealthand
SeniorServices(DHSS)andtheDepartmentofCommerceand
Insurance,canjointlypartnerintheProgramtodetermine
appropriatetrainingforthepurposeofobtaininglicensureor
certificationrequiredforinmatesselectedtoparticipateinthe
Program.
TheDepartmentswilljointlyapproveprogramcurriculum,including
requiredprogramcreditsforeachsubjectandpracticalskills
instruction. Trainingwillbeprovidedbyalicensedphysician,
registerednurse,orotherappropriatelylicensedortrainedhealth
careprofessional. TheDOCwillissuecertificatestoinmateswho
successfullycompletetheprogram.
TheDOC,incooperationwithDHSSandtheDivisionofProfessional
Registration,willdevelopaprocessforsubmissionofnoticeof
trainingcompletionandanapplicationforlicensureor
certificationtotheDivisionofProfessionalRegistration,as
prescribedbyDHSS.TheDHSS,inconsultationwithDOC,willhave
rulemakingauthorityfortheadministration ofthisProgramsubject
toChapter536.
USEOFRESTRAINTSONPREGNANTOFFENDERS(Section221.520) Thebilldefinestheterms"Extraordinary circumstance", "Labor",
"Postpartum",and"Restraints"
Thisbillbanstheuseofrestraintsbyacountyorcityjailona
pregnantoffenderinherthirdtrimester,exceptinextraordinary
circumstances. Thisbanwillincludetransportation toandfrom
visitstohealthcareprovidersandcourtproceedingsorduring
medicalappointmentsandexaminations,orduringlabor,delivery,
or48hourspostdelivery.
Intheeventasherifforjailerdeterminesthatextraordinary
circumstancesexistandrestraintsarenecessaryheorshewill
fullydocumentinwritingwithin48hoursoftheincident,the
reasonsheorshedeterminedsuchextraordinarycircumstances
existed,thetypeofrestraintsused,andthereasonsthose
restraintswereconsideredtheleastrestrictiveavailableandthe
mostreasonableunderthecircumstances. Thesewrittenfindings
willbekeptonfilebythecountyorcityjailforatleastfive
yearsfromthedatetherestraintswereused.
Anytimerestraintsareusedonapregnantoffenderinherthird
trimesteroronapostpartumoffenderwithinforty-eighthours
postdelivery,therestraintswillbetheleastrestrictive
availableandthemostreasonableunderthecircumstances. Inno
casewillleg,ankle,orwaistrestraints,oranymechanical
restraintsbeusedonanysuchoffender,andifwristrestraints
areused,suchrestraintswillbeplacedinthefrontofsuch
offender'sbodytoprotecttheoffenderandtheunbornchildinthe
caseofaforwardfall.
Ifahealthcareprovidertreatingthepregnantoffenderinher
thirdtrimesterorpostpartumrequeststhatrestraintsnotbeused,
thesherifforjaileraccompanyingtheoffenderwillimmediately
removeallrestraints. Pregnantoffenderswillbetransportedin
vehiclesequippedwithseatbelts.
Thebillrequirescountyandcityjailsto:
(1)Ensurethatemployeesofthejailareprovidedwithtraining
ontheprovisionsofthissectionofthebill,and
(2)Informfemaleoffenders,inwritingandorally,ofany
policiesandpracticesdevelopedinaccordancewiththissectionof
thebilluponadmissiontothejailandpostthepoliciesand
practicesinthejailwheretheywillbeseenbyfemaleoffenders.
DENTALSERVICESFOROFFENDERSINSTATECORRECTIONALCENTERS
(Section332.081) Currently,thereisanexemptionwhichallowsthepracticeof
dentistryatfacilitiesownedbyacity,county,orotherpolitical
subdivisionoftheState.Thisbillexpandsthatexceptionto
includeState-ownedcorrectionalcenters.
