HCSHB1505 3 56 4.AnylawenforcementagencythatviolatesthissectionafterDecember31,2021, 57maybeineligibletoreceivestateorfederalfundswhichwouldotherwisebepaidtosuch 58agencyforlawenforcement,safetyorcriminaljusticepurposes. 211.436.1.Instrumentsofrestraint,includinghandcuffs,chains,irons,or 2straitjackets,shallnotbeusedonachildduringaproceedinginajuvenilecourtand 3shallberemovedpriortothechild'sappearancebeforethecourtunless,afterahearing, 4thecourtfindsboththat: 5 (1)Theuseofrestraintsisnecessaryduetooneofthefollowingfactors: 6 (a)Instrumentsofrestraintarenecessarytopreventphysicalharmtothechild 7oranotherperson; 8 (b)Thechildhasahistoryofdisruptivecourtroombehaviorthathasplaced 9othersinpotentiallyharmfulsituationsorpresentsasubstantialriskofinflicting 10physicalharmonhimselforherselforothersasevidencedbyrecentbehavior;or 11 (c)Thereisevidencethatthechildpresentsasubstantialriskofflightfromthe 12courtroom;and 13 (2)Therearenolessrestrictivealternativestorestraintsthatwillpreventflight 14orphysicalharmtothechildoranotherpersonincluding,butnotlimitedto,the 15presenceofcourtpersonnel,lawenforcementofficers,orbailiffs. 16 2.Ifthejuvenileofficerbelievesthatthereisanimmediatesafetyorflightrisk, 17asprovidedundersubsection1ofthissection,thejuvenileofficershalladvisethe 18attorneyforthechildandmakearequestinwritingpriortothecommencementofthe 19proceedingforthechildtoremainrestrainedduringthecourtproceedingwhileinthe 20presenceofthepartiestotheproceeding. 21 3.Ifarequestforrestraintsismadebythejuvenileofficer,thecourtshallorder 22ahearingandprovidethechild'sattorneyanopportunitytobeheardbeforethecourt 23orderstheuseofrestraints.Ifrestraintsareordered,thecourtshallmakefindingsof 24factinsupportoftheorder. 25 4.Ifrestraintsareused,therestraintsshallallowthechildlimitedmovementof 26thehandstoreadandhandledocumentsandwritingsnecessarytotheproceeding. 27Undernocircumstancesshallachildberestrainedusingrestraintsfixedtoawall,floor, 28furniture,orotherstationaryobject. 217.075.1.Alloffenderrecordscompiled,obtained,preparedormaintainedbythe 2departmentoritsdivisionsshallbedesignatedpublicrecordswithinthemeaningofchapter 3610except: 4 (1)Anyinformation,report,recordorotherdocumentpertainingtoanoffender's 5personalmedicalhistory,whichshallbeaclosedrecord; HCSHB1505 4 6 (2)Anyinformation,report,recordorotherdocumentinthecontrolofthe 7departmentoritsdivisionsauthorizedbyfederalorstatelawtobeaclosedrecord; 8 (3)Anyinternaladministrativereportordocumentrelatingtoinstitutionalsecurity. 9 2.Thecourtofjurisdiction,orthedepartment,mayattheirdiscretionpermitthe 10inspectionofthedepartmentreportsorpartsofsuchreportsbytheoffender,wheneverthe 11courtordepartmentdeterminesthatsuchinspectionisinthebestinterestorwelfareofthe 12offender. 13 3.Departmentrecordsmaybeautomatedandmadeavailableto: 14 (1)Treatmentagenciesworkingwiththedepartmentinthetreatmentoftheoffender; 15 (2)Lawenforcementagencies;or 16 (3)Qualifiedpersonsandorganizationsforresearch,evaluative,andstatistical 17purposesunderwrittenagreementsreasonablydesignedtoensurethesecurityand 18confidentialityoftheinformationandtheprotectionoftheprivacyinterestsofthe 19individualswhoaresubjectsoftherecords. 20 4.Nodepartmentemployeeshallhaveaccesstoanymaterialclosedbythissection 21unlesssuchaccessisnecessaryfortheemployeetocarryouthisduties.Thedepartmentby 22ruleshalldeterminewhatdepartmentemployeesorotherpersonsshallhaveaccesstoclosed 23recordsandtheproceduresneededtomaintaintheconfidentialityofsuchclosedrecords. 24 5.Noperson,association,firm,corporationorotheragencyshallknowinglysolicit, 25disclose,receive,publish,makeuseof,authorize,permit,participateinoracquiesceinthe 26useofanynameorlistsofnamesforcommercialorpoliticalpurposesofanynaturein 27violationofthissection. 28 6.Allhealthcareprovidersandhospitalswhohavecaredforoffendersduringthe 29periodoftheoffender'sincarcerationshallprovideacopyofallmedicalrecordsintheir 30possessionrelatedtosuchoffenderupondemandfromthedepartment'shealthcare 31administrator.Thedepartmentshallprovidereasonablecompensationforthecostofsuch 32copiesandnohealthcareprovidershallbeliableforbreachofconfidentialitywhenacting 33pursuanttothissubsection. 34 7.Notwithstandinganyprovisionoflawtothecontrary,thedepartmentshall 35providetoanoffender,ortoanoffender'spersonalrepresentative,electroniccopiesof 36allmedicalrecordsrelatedtosuchoffenderwhileinthecustodyofthedepartmentupon 37requestfromtheoffenderortheoffender'spersonalrepresentative.Suchelectronic 38copiesshallbeprovidedwithinthirtydaysofanoffender'srequestandatnocosttothe 39offender. 40 [7.]8.Copiesofallpapers,documents,orrecordscompiled,obtained,preparedor 41maintainedbythedepartmentoritsdivisions,properlycertifiedbytheappropriatedivision, 42shallbeadmissibleasevidenceinallcourtsandinalladministrativetribunalsinthesame HCSHB1505 5 [8.]9.Anypersonfoundguiltyofviolatingtheprovisionsofthissectionshallbe 48guiltyofaclassAmisdemeanor. 217.312.1.Ondeliveryoftheoffendertothereceptionanddiagnosticcenter,he 2orsheshallbegiventheopportunitytodesignateapersonalrepresentative. 3 2.Thedepartmentshalldevelopaformforoffenderstomakeapersonal 4representativedesignation.Suchform,whichshallbemadeavailabletotheoffenderin 5apaperandanelectronicformat,shallincludethepersonalrepresentative'snameand 6relationshiptotheoffender,mailingaddress,emailaddress,phonenumber,andbirth 7date. 8 3.Thedirectormaypromulgateallnecessaryrulesandregulationsforthe 9administrationofthissection.Anyruleorportionofarule,asthattermisdefinedin 10section536.010,thatiscreatedundertheauthoritydelegatedinthissectionshall 11becomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter 12536and,ifapplicable,section536.028.Thissectionandchapter536arenonseverable 13andifanyofthepowersvestedwiththegeneralassemblypursuanttochapter536to 14review,todelaytheeffectivedate,ortodisapproveandannularulearesubsequently 2tophoneservicesduringanoffender'stermofconfinement;providedthat,phoneaccess 3mayberestrictedasadisciplinarymeasure. 4 2.Nocorrectionalcenterorotherpartyshallchargeanoffenderina 5correctionalcenteratotalamountforadomesticphonecall,includingfeesandanyper- 6minuterate,thatexceedstheequivalentoftwelvecentsperminute. 217.1200.1.Thedepartmentofcorrectionsmaydevelopahospicecaretraining 2programwithinthestateprisonsystem.Thedepartmentofcorrections,incooperation 3withthedepartmentofhealthandseniorservicesandthedepartmentofcommerceand 4insurance,mayjointlypartnerintheprogramtodeterminetheappropriatetrainingfor 5thepurposeofobtaininglicensureorcertificationrequiredforinmatesselectedto 6participateintheprogram. 7 2.Thedepartmentofcorrections,thedepartmentofhealthandseniorservices, 8andthedivisionofprofessionalregistrationwithinthedepartmentofcommerceand 9insuranceshalljointlyapproveprogramcurriculumforthetrainingofeligibleinmates HCSHB1505 6 10currentlyinthecustodyofthedepartmentofcorrections.Thecurriculumshallinclude 11requiredprogramcreditsforeachsubjectandpracticalskillsinstruction.Training 12shallbeprovidedbyalicensedphysician,registerednurse,orotherappropriately 13licensedortrainedhealthcareprofessional,asdeterminedbythedepartmentofhealth 14andseniorservicesandthedivisionofprofessionalregistration. 15 3.Uponsuccessfulcompletionofthetrainingprogramprovidedforunder 16subsection2ofthissection,thedepartmentofcorrectionsshallissueaprogram 17completioncertificatetotheinmate.Thedepartmentofcorrectionsincooperationwith 18thedepartmentofhealthandseniorservicesandthedivisionofprofessionalregistration 19shalldevelopaprocessforsubmissionofnoticeoftrainingcompletionandapplication 20forlicensureorcertificationtothedivisionofprofessionalregistration,asprescribedby 21thedepartmentofhealthandseniorservices. 22 4.Thedepartmentofhealthandseniorservices,inconsultationwiththe 23departmentofcorrectionsandthedepartmentofcommerceandinsurance,shallhave 24theauthoritytopromulgaterulesfortheadministrationofthissection,including 25implementationofthecurriculum,asprovidedforundersubsection2ofthissection, 26andforcontinuingeducationortrainingrequirementsnecessaryformaintainingstate 27certificationingoodstanding.Anyruleorportionofarule,asthattermisdefinedin 28section536.010,thatiscreatedundertheauthoritydelegatedinthissectionshall 29becomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter 30536and,ifapplicable,section536.028.Thissectionandchapter536arenonseverable 31andifanyofthepowersvestedwiththegeneralassemblypursuanttochapter536to 32review,todelaytheeffectivedate,ortodisapproveandannularulearesubsequently 33heldunconstitutional,thenthegrantofrulemakingauthorityandanyruleproposedor 221.108.1.Jailsshallprovideinmateswithreasonableaccesstophoneservices 2duringaninmate'stermofconfinement;providedthat,phoneaccessmayberestricted 3asadisciplinarymeasure. 4 2.Nojailorotherpartyshallchargeaninmateinajailatotalamountfora 5domesticphonecall,includingfeesandanyper-minuterate,thatexceedstheequivalent 6oftwelvecentsperminute. 221.520.1.Asusedinthissection,thefollowingtermsshallmean: 2 (1)"Extraordinarycircumstance",asubstantialflightriskorsomeother 3extraordinarymedicalorsecuritycircumstancethatdictatesrestraintsbeusedto 4ensurethesafetyandsecurityofapregnantoffenderinherthirdtrimesterora HCSHB1505 7 5postpartumoffenderwithinforty-eighthourspostdelivery,thestaffofthecountyorcity 6jailormedicalfacility,otheroffenders,orthepublic; 7 (2)"Labor",theperiodoftimebeforeabirthduringwhichcontractionsare 8present; 9 (3)"Postpartum",theperiodofrecoveryimmediatelyfollowingchildbirth, 10whichissixweeksforavaginalbirthoreightweeksforacesareanbirth,orlongerifso 11determinedbyaphysicianornurse; 12 (4)"Restraints",anydeviceusedtocontrolthemovementofaperson'sbodyor 13limbs. 14 2.Exceptinextraordinarycircumstances,acountyorcityjailshallnotuse 15restraintsonapregnantoffenderinherthirdtrimester,whetherduringtransportation 16toandfromvisitstohealthcareprovidersandcourtproceedingsorduringmedical 17appointmentsandexaminations,orduringlabor,delivery,orforty-eighthours 18postdelivery. 19 3.Intheeventasherifforjailerdeterminesthatextraordinarycircumstances 20existandrestraintsarenecessary,thesherifforjailershallfullydocumentinwriting 21withinforty-eighthoursoftheincidentthereasonsheorshedeterminedsuch 22extraordinarycircumstancesexisted,thetypeofrestraintsused,andthereasonsthose 23restraintswereconsideredreasonableunderthecircumstances.Suchdocumentsshall 24bekeptonfilebythecountyorcityjailforatleastfiveyearsfromthedatetherestraints 25wereused. 26 4.Anytimerestraintsareusedonapregnantoffenderinherthirdtrimesteror 27onapostpartumoffenderwithinforty-eighthourspostdelivery,therestraintsshallbe 28reasonableunderthecircumstances.Exceptinextraordinarycircumstances,noleg, 29ankle,orwaistrestraints,oranymechanicalrestraints,shallbeusedonanysuch 30offender,andifwristrestraintsareused,suchrestraintsshallbeplacedinthefrontof 31suchoffender'sbodytoprotecttheoffenderandtheunbornchildinthecaseofa 32forwardfall. 33 5.Pregnantoffendersshallbetransportedinvehiclesequippedwithseatbelts. 34 6.Thecountyorcityjailshall: 35 (1)Ensurethatemployeesofthejailareprovidedwithtraining,whichmay 36includeonlinetraining,ontheprovisionsofthissection;and 37 (2)Informfemaleoffenders,inwritingandorally,ofanypoliciesandpractices 38developedinaccordancewiththissectionuponadmissiontothejail,andpostthe 39policiesandpracticesinlocationsinthejailwheresuchnoticesarecommonlyposted 40andwillbeseenbyfemaleoffenders. HCSHB1505 8 332.081.1.Notwithstandinganyotherprovisionoflawtothecontrary,hospitals 2licensedunderchapter197shallbeauthorizedtoemployanyorallofthefollowingoral 3healthproviders: 4 (1)Adentistlicensedunderthischapterforthepurposeoftreatingonhospital 5premisesthosepatientswhopresentwithadentalconditionandsuchtreatmentisnecessaryto 6amelioratetheconditionforwhichtheypresentedsuchasseverepainortoothabscesses; 7 (2)Anoralandmaxillofacialsurgeonlicensedunderthischapterforthepurposeof 8treatingoralconditionsthatneedtobeamelioratedaspartoftreatingtheunderlyingcauseof 9thepatient'smedicalneedsincluding,butnotlimitedto,headandneckcancer,HIVorAIDS, 10severetraumaresultinginadmissiontothehospital,organtransplant,diabetes,orseizure 11disorders.Itshallbeaconditionoftreatmentthatsuchpatientsareadmittedtothehospitalon 12eitheranin-orout-patientbasis;and 13 (3)Amaxillofacialprosthodontistlicensedunderthischapterforthepurposeof 14treatingandsupportingpatientsofaheadandneckcancerteamorothercomplexcareor 15surgicalteamforthefabricationofappliancesfollowingablativesurgery,surgerytocorrect 16birthanomalies,extensiveradiationtreatmentoftheheadorneck,ortrauma-relatedsurgery. 17 2.NopersonorotherentityshallpracticedentistryinMissouriorprovidedental 18servicesas[defined] describedinsection332.071unlessanduntiltheboardhasissuedtothe 19personacertificatecertifyingthatthepersonhasbeendulyregisteredasadentistinMissouri 20ortheboardhasissuedsuchcertificatetoanentitythathasbeendulyregisteredtoprovide 21dentalservicesbylicenseddentistsanddentalhygienistsandunlessanduntiltheboardhas 22issuedtothepersonalicense,toberenewedeachperiod,asprovidedinthischapter,to 23practicedentistryorasadentalhygienist,orhasissuedtothepersonorentityapermit,tobe 24renewedeachperiod,toprovidedentalservicesinMissouri.Nothinginthischaptershallbe 25soconstruedastomakeitunlawfulfor: 26 (1)Alegallyqualifiedphysicianorsurgeon,whodoesnotpracticedentistryasa 27specialty,fromextractingteeth; 28 (2)AdentistlicensedinastateotherthanMissourifrommakingaclinical 29demonstrationbeforeameetingofdentistsinMissouri; 30 (3)Dentalstudentsinanyaccrediteddentalschooltopracticedentistryunderthe 31personaldirectionofinstructors; 80 (5)Anyentitythathasreceivedapermitfromthedentalboardanddoesnotreceive 81compensationfromthepatientorfromanythirdpartyonthepatient'sbehalfatwhicha 82personregulatedunderthischapterprovidesdentalcarewithinthescopeofhisorherlicense 83orregistration;or 84 (6)AnyhospitalnonprofitcorporationexemptfromtaxationunderSection501(c)(3) 85oftheInternalRevenueCode,asamended,thatengagesinitsoperationsandprovidesdental 86servicesatfacilitiesownedbyacity,county,orotherpoliticalsubdivisionofthestate,orany 87entitycontractedwiththestatetoprovidecareinacorrectionalcenter,assuchtermis 88definedinsection217.010,atwhichapersonregulatedunderthischapterprovidesdental 89carewithinthescopeofhisorherlicenseorregistration. 90 91Ifanyoftheentitiesexemptedfromtherequirementsofthissubsectionareunabletoprovide 92servicestoapatientduetothelackofaqualifiedproviderandareferraltoanotherentityis 93made,theexemptionshallextendtothepersonorentitythatsubsequentlyprovidesservices 94tothepatient. 95 4.Nounincorporatedorganizationshallpracticedentistryasdefinedinsection 96332.071unlesssuchorganizationisexemptfromfederaltaxationunderSection501(c)(3)of 97theInternalRevenueCodeof1986,asamended,andprovidesdentaltreatmentwithout 98compensationfromthepatientoranythirdpartyontheirbehalfasapartofabroader 99programofsocialservicesincludingfooddistribution.Nothinginthischaptershallprohibit 100organizationsunderthissubsectionfromemployinganypersonregulatedbythischapter. 101 5.Adentistshallnotenterintoacontractthatallowsapersonwhoisnotadentistto 102influenceorinterferewiththeexerciseofthedentist'sindependentprofessionaljudgment. 103 6.Anot-for-profitcorporationorganizedundertheprovisionsofchapter355and 104qualifyingasanorganizationunder26U.S.C.Section501(c)(3),anunincorporated 105organizationoperatingpursuanttosubsection4ofthissection,oranyotherpersonshouldnot 106directorinterfereorattempttodirectorinterferewithalicenseddentist'sprofessional 107judgmentandcompetentpracticeofdentistry.Nothinginthissubsectionshallbeso 108construedastomakeitunlawfulfornot-for-profitorganizationstoenforceemployment 109contracts,corporatepolicyandproceduremanuals,orqualityimprovementorassurance 110requirements. HCSHB1505 11 111 7.Allentitiesdefinedinsubsection3ofthissectionandthoseexemptedunder 112subsection4ofthissectionshallapplyforapermittoemploydentistsanddentalhygienists 113licensedinthisstatetorenderdentalservices,andtheentityshallapplyforthepermitin 114writingonformsprovidedbytheMissouridentalboard.Theboardshallnotchargeafeeof 115anykindfortheissuanceorrenewalofsuchpermit.Theprovisionsofthissubsectionshall 116notapplytoafederallyqualifiedhealthcenterasdefinedinSection1905(l)oftheSocial 117SecurityAct(42U.S.C.Section1396d(l)). 118 8.Anyentitythatobtainsapermittorenderdentalservicesinthisstateissubjectto 119disciplinepursuanttosection332.321.Iftheboardconcludesthatthepersonorentityhas 120committedanactorisengaginginacourseofconductthatwouldbegroundsfordisciplinary 121action,theboardmayfileacomplaintbeforetheadministrativehearingcommission.The 122boardmayrefusetoissueorrenewthepermitofanyentityforoneoranycombinationof 123causesstatedinsubsection2ofsection332.321.Theboardshallnotifytheapplicantin 124writingofthereasonsfortherefusalandshalladvisetheapplicantofhisorherrighttofilea 125complaintwiththeadministrativehearingcommissionasprovidedbychapter621. 126 9.AfederallyqualifiedhealthcenterasdefinedinSection1905(l)oftheSocial 127SecurityAct(42U.S.C.Section1396d(l))shallregisterwiththeboard.Theinformation 128providedtotheboardaspartoftheregistrationshallincludethenameofthehealthcenter,the 129nonprofitstatusofthehealthcenter,siteswheredentalserviceswillbeprovided,andthe 130namesofallpersonsemployedby,orcontractingwith,thehealthcenterwhoarerequiredto 131holdalicensepursuanttothischapter.Theregistrationshallberenewedeverytwenty-four 132months.Theboardshallnotchargeafeeofanykindfortheissuanceorrenewalofthe 133registration.Theregistrationofthehealthcentershallnotbesubjecttodisciplinepursuantto 134section332.321.Nothinginthissubsectionshallprohibitdisciplinaryactionagainsta 135licenseeofthischapterwhoisemployedby,orcontractswith,suchhealthcenterforthe 136actionsofthelicenseeinconnectionwithsuchemploymentorcontract. 137 10.Theboardmaypromulgaterulesandregulationstoensurenot-for-profit 138corporationsarerenderingcaretothepatientpopulationsassetforthherein,including 139requirementsforcoverednot-for-profitcorporationstoreportpatientcensusdatatotheboard. 140Theprovisionsofthissubsectionshallnotapplytoafederallyqualifiedhealthcenteras 141definedinSection1905(l)oftheSocialSecurityAct(42U.S.C.Section1396d(l)). 142 11.Allnot-for-profitcorporationsorganizedoroperatedpursuanttotheprovisionsof 143chapter355andqualifyingasanorganizationunder26U.S.C.Section501(c)(3),orthe 144requirementsrelatingtomigrant,community,orhealthcareforthehomelesshealthcenters 145providedinSection330ofthePublicHealthServiceAct(42U.S.C.Section254b)and 146federallyqualifiedhealthcentersasdefinedinSection1905(l)(42U.S.C.Section1396d(l)) 147oftheSocialSecurityAct,thatemploypersonswhopracticedentistryordentalhygienein HCSHB1505 12 148thisstateshalldosoinaccordancewiththerelevantlawsofthisstateexcepttotheextentthat 149suchlawsarecontraryto,orinconsistentwith,federalstatuteorregulation. 558.041.1.Anyoffendercommittedtothedepartmentofcorrections,exceptthose 2personscommittedpursuanttosubsection7ofsection558.016,orsubsection3ofsection 3566.125,[may] shallreceiveadditionalcreditintermsofdaysspentinconfinementupon 4[recommendationforsuchcreditbytheoffender'sinstitutionalsuperintendent] calculationof 5suchcreditwhentheoffendermeetstherequirementsforsuchcreditasprovidedin 6[subsections3and4of]thissection.Goodtimecreditorearnedtimecreditmaybe 7rescindedbythedirectororhisorherdesigneepursuanttothedivisionalpolicyissued 8pursuanttosubdivision(2)ofsubsection[3]2ofthissection. 9 2.(1)Anycreditextendedtoanoffendershallonlyapplytothesentencewhichthe 10offenderiscurrentlyserving. 11 [3.](2)Thedirectorofthedepartmentofcorrectionsshallissueapolicyfor 12awardinggoodtimecreditand,separately,earnedtimecredit. 13 (3)Thepolicy[may] shallrewardan[inmate] offenderwhohasservedhisorher 14sentenceinanorderlyandpeaceablemanner[andhas]throughgoodtimecreditas 15providedinsubsection3ofthissectionandawardanoffenderwhohassuccessfully 16takenadvantageoftherehabilitationprogramsandproductiveactivitiesavailabletohimor 17herthroughearnedtimecreditasprovidedinsubsection4ofthissection. 18 (4)Anymajorconductviolationofinstitutionalrules[or],violationofthelawsof 19thisstate[may], parolerevocation,ortheaccumulationofminorconductviolations 20exceedingsixwithinacalendaryearshallresultinthelossofall[oraportionofany]prior 21creditearnedbythe[inmate] offenderpursuanttothissection. 22 [4.Thedepartmentshallcausethepolicytobepublishedinthecodeofstate 23regulations. 24 5.Noruleorportionofarulepromulgatedundertheauthorityofthischaptershall 25becomeeffectiveunlessithasbeenpromulgatedpursuanttotheprovisionsofsection 26536.024.] 27 3.(1)Subjecttosubsections1and2ofthissection,anoffenderwhoisservinga 28termofimprisonmentofmorethanoneyear,otherthanatermofimprisonmentforthe 29durationoftheoffender'slife,mayreceivegoodtimecredittowardtheserviceofthe 30offender'ssentenceofuptofifty-fourdaysforeachyearoftheoffender'ssentence 31imposedbythecourt,subjecttoyearlydeterminationbythedepartmentofcorrections 32thatduringthatyeartheoffenderhasdisplayedexemplarycompliancewith 33institutionaldisciplinaryregulations. 34 (2)Ifthedepartmentofcorrectionsdeterminesthatduringtheyeartheoffender 35hasnotsatisfactorilycompliedwithsuchinstitutionalregulations,theoffendershall HCSHB1505 13 36receivenogoodtimecredittowardserviceofsentenceorshallreceivesuchlessercredit 37asthedepartmentdeterminestobeappropriate.Creditthathasnotbeenearnedshall 38notlaterbegranted.Creditforthelastyearofatermofimprisonmentshallbecredited 39onthefirstdayofthelastyearofthetermofimprisonment. 40 4.(1)Subjecttosubsections1and2ofthissection,anoffenderwhoisservinga 41termofimprisonmentofmorethanoneyear,otherthanatermofimprisonmentforthe 42durationoftheoffender'slife,andwhosuccessfullyparticipatesinrehabilitative 43programmingorproductiveactivitiesshallearntendaysofearnedtimecreditforevery 44thirtydaysofsuccessfulparticipationinrehabilitativeprogrammingorproductive 45activities. 46 (2)Anoffendershallnotreceiveearnedtimecreditsunderthissubsectionfor 47programscompletedpriortothedatethattheoffender'ssentencecommenced. 48 (3)Thedepartmentofcorrectionsshallspecifyinitspoliciesundersubsection2 49ofthissectionthetypesofprogramsoractivitiesforwhichcreditmaybeearnedunder 50thissection;thecriteriafordeterminingproductiveparticipationin,orcompletionof, 51theprogramsoractivities;andthecriteriaforannuallyawardingcredit.Such 52programsandactivitiesshallinclude,butarenotlimitedto,receivingahighschool 53diplomaorequivalent,collegediplomaorprofessionalcertificate,orvocationaltraining 54certificates,andparticipatinginsuccessfulemployment,parenting,andfinancial 55literacycourses,alcoholanddrugabusetreatmentprograms,andrestorativejustice 56andfaith-basedprograms.Thedepartmentofcorrectionsshallincludeprovisionsfor 57educationalprogrammingthroughcorrespondencecourses. 58 (4)BeginningonJanuary1,2026,butnotlaterthanDecember31,2026,eligible 59offendersmaypetitionthedepartmenttoreceiveearnedtimecreditforanyqualifying 60programsoractivitiescompletedafterJanuary1,2010,butbeforeAugust28,2025. 61 (5)BeginningonAugust28,2025,earnedtimecreditforprogramscompletedon 62oraftersuchdateshallbeawardedonanannualbasis. 63 (6)Thedepartmentofcorrectionsshallnotifytheincarceratedpopulationofthe 64petitionprocessthroughpostedsignage,electronicnotification,andthroughstaffinall 65facilitiesandshallprovideapetitionformtooffenders. 66 5.(1)Offenderssentencedundersubsections2and3ofsection558.019shallbe 67eligibleforgoodtimecreditandearnedtimecreditandanycreditearnedshallbe 68subtractedfromtheoffender'sentiresentenceofimprisonment. 69 (2)Offenderscommittedtothedepartmentwhoaresentencedtodeathor 70sentencedtolifewithoutprobationorparoleshallnotbeeligibleforgoodtimecreditor 71earnedtimecreditunderthissection;however,thedepartmentshallrecordtheir 72programparticipationinthesamemannerastheeligiblepopulation. HCSHB1505 14 73 (3)Theincentivesdescribedinthissectionshallbeinadditiontoanyother 74rewardsorcreditsforwhichanoffendermaybeeligible. 75 (4)Nothinginthissectionshallbeconstruedtoremovetheparoleboard's 76discretioninawardinggoodtimecreditorearnedtimecredit. 77 6.Thedepartmentofcorrectionsshallprepareandsubmitanannualreportto 78thegeneralassemblyongoodtimecreditandearnedtimecredit,whichshallinclude 79informationonthenumberofoffendersreceivingcreditunderbothprograms. 650.040.1.Asusedinthissection,thefollowingtermsshallmean: 2 (1)"Clearancerates",therateatwhichlawenforcementagenciesclearan 3offensebyarrestorbyexceptionalmeans; 4 (2)"Offenseclearedbyanarrest",whenatleastonepersonhasbeenarrested, 5chargedwiththecommissionoftheoffense,andturnedovertothecourtfor 6prosecution; 7 (3)"Offenseclearedbyexceptionalmeans",whenthelawenforcementagency 8has: 9 (a)Identifiedtheoffender; 10 (b)Gatheredenoughevidencetosupportanarrest,makeacharge,andturn 11overtheoffendertothecourtforprosecution; 12 (c)Identifiedtheoffender'sexactlocationsothatthesuspectcouldbetakeninto 13custodyimmediately;and 14 (d)Encounteredacircumstanceoutsidethecontrolofsuchagencythat 15prohibitedtheagencyfromarresting,charging,andprosecutingtheoffender. 16 2.Thereisherebycreatedthe"MissouriViolentCrimeClearanceGrant 17Program"withinthedepartmentofpublicsafety.Thisprogramshallbedevelopedin 18consultationwiththeMissouripeaceofficersstandardsandtrainingcommission 19createdpursuanttosection590.120,theofficeforvictimsofcrimecreatedpursuantto 20section650.310,andthecrimelaboratoryreviewcommissioncreatedpursuantto 21section650.059. 22 3.Thepurposeofthisprogramistoimprovelawenforcementstrategiesand 23initiativesaimedatincreasingviolentcrimeclearancerates. 24 4.Totheextentthatsuchusescanbedemonstratedtoadvancethepurposes 25describedinsubsection3ofthissection,eligibleusesforthefundinginclude: 26 (1)Improvedinvestigatoryresources,includingthehiringofpersonnelassigned 27toinvestigateviolentcrimesorcollect,process,andtestforensicevidence; 28 (2)Developmentofevidence-basedpolicies,procedures,andtraining; 29 (3)Technicalassistance; HCSHB1505 15 30 (4)Lawenforcementequipmentortechnology,includinginvestigative,evidence- 31processing,orforensic-testingequipmentortechnology; 32 (5)Contractualsupport; 33 (6)Informationsystems,withprioritizationforprojectsthatwouldimprove 34dataintegrationandtheabilitytoshareinformationacrossandbetweenlaw 35enforcementagencies,prosecutingattorneys'offices,andcrimelabs; 36 (7)Officerhealthandwellnessservices; 37 (8)Hiringandretentionofvictim-witnesscoordinators; 38 (9)Partnershipwithhospital-basedviolenceinterventionprograms; 39 (10)Partnershipwithaccreditedbehavioralhealthprograms;and 40 (11)Partnershipwithlocalcommunityserviceproviderstoimprovesupportfor 41victimsofviolentcrime. 42 5.Inawardingagrantundersubsection2ofthissectionforanallowableuse 43undersubsection4ofthissection,thedepartmentofpublicsafetyshallgivepriorityto 44lawenforcementagencies: 45 (1)Withconsistentpublicreportingoflowclearancerates; 46 (2)Thatdemonstrateacommitmenttoworkingwithcommunity-based 47organizationsandgovernmentagenciestoreduceviolentcrimerates;or 48 (3)Thatdetailaprocessforevaluatingtheeffectivenessofbothinvestigators 49andinvestigativeunits,includingthedevelopmentofspecificgoalsandperformance 50metrics. 51 6.Alllawenforcementagenciesthatreceivefundingunderthissectionshall 52reporttothedepartmentofpublicsafetyannuallyonactivitiescarriedouttoreduce 53violentcrimeandimproveclearanceratesduringtheprecedingfiscalyearincluding, 54butnotlimitedto: 55 (1)Thenumberofpersonnelhiredorassignedtoinvestigateviolentcrimes, 56disaggregatedbetweenswornlawenforcementofficersandcivilianorunsworn 57professionalstaff; 58 (2)Thenumberofpersonnelhiredorassignedtocollect,process,andtest 59forensicevidence; 60 (3)Thenumberofpersonnelhiredorassignedtoprovidevictimservices; 61 (4)Thedescriptionofanytrainingdevelopedorimplemented; 62 (5)Thedescriptionofanynewtechnologypurchasedoracquired; 63 (6)Howgrant-fundedactivitieshaveimpactedclearancerates; 64 (7)Therecordmanagementsystem,orequivalent,usedtocollectcase 65informationanditsabilitytointegratewithotheragencies',prosecutingattorney 66offices',andcrimelabs'recordmanagementsystems;and HCSHB1505 16 67 (8)Howthegranteeworkedwithcommunity-basedorganizationstoimprove 68violentcrimeratesandclearanceratesforviolentcrimes. 69 7.Distributionofstatefundsortechnicalassistanceshallbebycontractual 70arrangementbetweenthedepartmentandeachrecipientlawenforcementagency. 71Termsofthecontractshallbenegotiableeachyear.Thestateauditorshallperiodically 72auditalllawenforcementagenciesreceivingstatefunds. 73 8.Nothinginthissectionshallprohibitanylawenforcementagencyfrom 74receivingfederalorlocalfundsshouldsuchfundsbecomeavailable. 75 9.Nostatefundsshallbeexpendedunlessappropriatedbythegeneralassembly 76forthispurpose. ✔ HCSHB1505 17
