HIGHWAYPATROLSALARYINCREASES(Section43.080,RSMo)
Currently,thesalaryschedulereportpreparedbythe
Superintendent oftheStateHighwayPatrolmustincludea
comparisonofthethreelargestpolicedepartmentsintheState.
Thisbillrequiresthereporttoalsoincludeacomparisonofthe
salariesandbenefitsofpoliceofficersemployedbythelaw
enforcementagencieslocatedinsurroundingstatesasspecifiedin
thebill.
VIOLENTCRIMECLEARANCERATES(Sections43.505and650.040)
Currently,theDepartmentofPublicSafetyisthecentral
repositoryforthecollection,maintenance,analysis,andreporting
ofcrimeincidentactivitygeneratedbylawenforcementagenciesin
theState.ThisbillrequirestheDepartmenttopublishquarterly
clearanceratesontheirwebsitebeginningJanuary1,2026.
BeginningJanuary1,2026,everylawenforcementagencyinthe
Statewillcollectdatadocumentingcaseclearancesfornonfatal
shootings. Clearanceratedatawillbereportedonamonthly
basis.Clearanceratedatawillincludedemographicinformation
andbedisaggregatedbywhethertheoffensewasclearedbyarrest
orbyexceptionalmeans,asdefinedinthebill.BeginningJanuary
1,2027,theDepartmentwillmakeannualreportsofthisdatatoa
numberofofficeslistedinthebill.
Thisbilldefinesterms"clearancerates","offenseclearedbyan
arrest",and"offenseclearedbyexceptionalmeans".Thebill
createstheMissouriViolentCrimeClearanceGrantProgramwithin
theDepartment,tobedevelopedinconsultationwiththePeace
OfficersStandardsandTrainingCommission,theOfficeforVictims
ofCrime,andtheCrimeLaboratoryReviewCommission. Thepurpose
oftheProgramwillbetoimprovelawenforcementstrategiesand
initiativesaimedatincreasingviolentcrimeclearancerates.The
billdescribeseligibleusesforfundingintheProgramtoachieve
thispurpose. Priorityforgrantsunderthisprogramwillbegiven
tolawenforcementagencies: (1)Withconsistentpublicreportingoflowclearancerates;
(2)Thatdemonstrateacommitmenttoworkingwithcommunity-based
organizationsandgovernmentagenciestoreduceviolentcrime
rates;or
(3)Thatdetailaprocessforevaluatingtheeffectivenessofboth
investigatorsandinvestigativeunits,includingthedevelopmentof
specificgoalsandperformancemetrics.
Thebillrequireslawenforcementagenciesthatreceivefunding
underthisProgramtoreporttotheDepartmentannuallyon
activitiescarriedouttoreduceviolentcrimeandincrease
clearancerates,asdescribedinthebill.TheStateAuditorwill
periodicallyauditalllawenforcementagenciesreceivingstate
funds.Thestatefundsthatareexpendedaresubjectto
appropriation.
RESTRAINTSONCHILDRENDURINGJUVENILECOURTPROCEEDINGS(Section
211.436)
Thisbillrequiresthatinstrumentsofrestraint,including
handcuffs,chains,irons,orstraitjackets, willnotbeusedona
childduringaproceedinginajuvenilecourtandwillberemoved
priortothechild'sappearancebeforethecourtunless,aftera
hearing,thecourtfindsboththat:
(1)Theuseofrestraintsisnecessarytopreventphysicalharmto
thechildoranotherperson,thereisevidencethatthechild
presentsasubstantialriskofflightfromthecourtroom,or
historyofdisruptivecourtroombehavior;and
(2)Therearenolessrestrictivealternativesincluding,butnot
limitedto,thepresenceofcourtpersonnel,lawenforcement
officers,orbailiffs.
Ifthejuvenileofficerbelievesthereisanimmediatesafetyor
flightrisk,theywilladvisetheattorneyforthechildandmakea
requestinwritingpriortothecommencementoftheproceedingfor
thechildtoremainrestrained. Thecourtwillorderahearing
andprovidethechild'sattorneyanopportunitytobeheardbefore
thecourtorderstheuseofrestraints. Ifrestraintsareordered,
thecourtwillmakefindingsoffactinsupportoftheorder.
Ifrestraintsareused,therestraintswillallowthechildsome
limitedmovementofthehandstoreadandhandledocuments
necessarytotheproceeding. Undernocircumstanceswillachild
berestrainedusingrestraintsfixedtoawall,floor,furniture,
orotherstationaryobject. OFFENDERS'MEDICALRECORDREQUESTS(Section217.075)
ThisbillrequirestheDepartmentofCorrections(DOC)toprovide
toanoffenderortheirpersonalrepresentative electroniccopies
ofallmedicalrecordsrelatedtothatoffenderwhileinthe
custodyoftheDOCuponrequest. Theelectroniccopieswillbe
providedwithin30daysoftherequestandatnocosttothe
offender.
PERSONALREPRESENTATIVE DESIGNATIONFOROFFENDERS(Section217.312)
Thebillgivesoffendersdeliveredtothereceptionanddiagnostic
centeroftheDOCtheopportunitytodesignateapersonal
representative. TheDOCwilldevelopaformforoffenderstomake
apersonalrepresentative designation. Theformwillbemade
availableinpaperandelectronicformatandwillinclude
informationaboutthepersonalrepresentative aslistedinthe
bill.TheDirectorwillhaverulemakingauthorityforthe
administration ofthissectionunderChapter536.
PHONEACCESSATJAILSANDCORRECTIONALCENTERS(Sections217.451
and221.108)
Thebillrequiresjailsandcorrectionalcenterstoprovide
offendersandinmateswithreasonableaccesstophoneservices,
exceptthatphoneaccesscanberestrictedasadisciplinary
measure. Thetotalcostofdomesticphonecallschargedtoan
inmateoroffenderwillnotexceed12centsperminute.
HOSPICECARETRAININGPROGRAMINSTATEPRISONS(Section217.1200)
ThisbillallowstheDOCtodevelopaHospiceCareTraining
Program. TheDOC,incooperationwiththeDepartmentofHealthand
SeniorServices(DHSS)andtheDepartmentofCommerceand
Insurance,mayjointlypartnerintheProgramtodetermine
appropriatetrainingforthepurposeofobtaininglicensureor
certificationrequiredforinmatesselectedtoparticipateinthe
Program.
TheDepartmentswilljointlyapproveprogramcurriculum,including
requiredprogramcreditsforeachsubjectandpracticalskills
instruction. Trainingwillbeprovidedbyalicensedphysician,
registerednurse,orotherappropriatelylicensedortrainedhealth
careprofessional. TheDOCwillissuecertificatestoinmateswho
successfullycompletetheprogram.
TheDOC,incooperationwithDHSSandtheDivisionofProfessional
Registration,willdevelopaprocessforsubmissionofnoticeof trainingcompletionandanapplicationforlicensureor
certificationtotheDivisionofProfessionalRegistration,as
prescribedbyDHSS.TheDHSS,inconsultationwithDOC,willhave
rulemakingauthorityfortheadministration ofthisProgramsubject
toChapter536.
USEOFRESTRAINTSONPREGNANTOFFENDERS(Section221.520)
Thebilldefinestheterms"Extraordinary circumstance", "Labor",
"Postpartum",and"Restraints"
Thisbillbanstheuseofrestraintsbyacountyorcityjailona
pregnantoffenderinherthirdtrimester,exceptinextraordinary
circumstances. Thisbanincludestransportation toandfromvisits
tohealthcareprovidersandcourtproceedingsorduringmedical
appointmentsandexaminations,orduringlabor,delivery,or48
hourspostdelivery.
Intheeventasherifforjailerdeterminesthatextraordinary
circumstancesexistandrestraintsarenecessaryheorshewill
fullydocumentinwritingwithin48hoursoftheincident,the
reasonsheorshedeterminedsuchextraordinarycircumstances
existed,thetypeofrestraintsused,andthereasonsthose
restraintswereconsideredreasonableunderthecircumstances.
Thesewrittenfindingswillbekeptonfilebythecountyorcity
jailforatleastfiveyearsfromthedatetherestraintswere
used.
Anytimerestraintsareusedonapregnantoffenderinherthird
trimesteroronapostpartumoffenderwithin48hourspostdelivery,
therestraintswillbereasonableunderthecircumstances. Except
inextraordinarycircumstances, leg,ankle,orwaistrestraints,or
anymechanicalrestraintsmustnotbeusedonanysuchoffender,
andifwristrestraintsareused,therestraintswillbeplacedin
thefrontoftheoffender'sbodytoprotecttheoffenderandthe
unbornchildinthecaseofaforwardfall.
Pregnantoffenderswillbetransportedinvehiclesequippedwith
seatbelts.
Thebillrequirescountyandcityjailsto:
(1)Ensurethatemployeesofthejailareprovidedwithtraining
ontheprovisionsofthissectionofthebill,and
(2)Informfemaleoffenders,inwritingandorally,ofany
policiesandpracticesdevelopedinaccordancewiththissectionof
thebilluponadmissiontothejailandpostthepoliciesand
practicesinthejailwheretheywillbeseenbyfemaleoffenders. DENTALSERVICESFOROFFENDERSINSTATECORRECTIONALCENTERS
(Section332.081)
Currently,thereisanexemptionwhichallowsthepracticeof
dentistryatfacilitiesownedbyacity,county,orotherpolitical
subdivisionoftheState.Thisbillexpandsthatexceptionto
includeState-ownedcorrectionalcenters.
GOODTIMEANDEARNEDTIMECREDIT(Section558.041)
Currently,anoffenderinaDepartmentofCorrectionsinstitution
mayearngoodtimecredit.Thisbillexpandsthecredit-earning
systemtoincludeboth"goodtimecredit"fordisplayingexemplary
compliancewithinstitutionaldisciplinaryregulationsand"earned
timecredit"forsuccessfullyparticipatinginrehabilitative
programmingorproductiveactivities. Majorconductviolationsor
atotalofsixminorconductviolationswillresultinthelossof
allgoodtimeandearnedtimecredit.Goodtimecreditwillbe
earnedatarateof54daysperyearoftheoffender'ssentence
imposedbythecourtsandearnedtimecreditwillbeearnedata
rateof10daysfor30daysofsuccessfulparticipationin
rehabilitative programmingorproductiveactivities.
IftheDepartmentofCorrectionsdeterminestheoffenderhasnot
satisfactorily compliedwithinstitutionalregulations,theywill
notreceivegoodtimecredit.
Earnedtimecreditwillnotbeawardedforprogramscompletedprior
toanoffender'ssentence. TheDepartmentwillspecifythetypes
ofprogramsoractivitiesforwhichearnedtimecreditwillbe
awarded,includingbutnotlimitedtothefollowing: receivinga
highschooldiplomaorequivalent,collegediplomaorprofessional
certificate,orvocationaltrainingcertificate,andparticipating
insuccessfulemployment,parenting,andfinancialliteracy
courses,alcoholanddrugabusetreatmentprograms,andrestorative
justiceandfaith-basedprograms.
FromJanuary1,2026,toDecember31,2026,eligibleoffendersmay
petitionforearnedtimecreditforprogramscompletedbetween
January1,2010andAugust28,2025.Theincarceratedpopulation
willbenotifiedofthepetitionprocess. Offenderssentencedto
deathorlifesentenceswithoutprobationwillnotbeeligiblefor
goodtimecreditsorearnedtimecredits,buttheDepartmentwill
recordtheirparticipationinthesamemannerastheeligible
population. TheDepartmentwillsubmitanannualreporttotheGeneralAssembly
ongoodtimecreditandearnedtimecreditincludingthenumberof
offendersreceivingcreditunderbothprograms.
ThisbillissimilartoHB1360andHB916(2025).

thesestrategiestosolvecrimes.Clearanceratesaregoodfor
crimereportingpurposes. Thereisalargepercentageofcrimesin
Missourithatgounresolvedandcollectionofdataisessentialto
solvethecrimesandbuildpublictrustandconfidence. The
hospicetrainingprogramallowsforacertificateorlicensetobe
givenuponsuccessfulcompletionwhichprovidesameanstogeta
goodjob.Alsostrengtheningfamilytiesisimportanttoreduce
recidivismrates.
