SectionA.Sections488.040,494.455,and494.460,RSMo,arerepealedandtwonew

494.455.1.Eachcountyorcitynotwithinacountymayelecttocompensateits
2jurorspursuanttosubsection2ofthissectionexceptasotherwiseprovidedinsubsection3of
3thissection.
4 2.Eachgrandandpetitjurorshallreceive[six]twenty-fivedollarsperday,forevery
5dayheorshemayactuallyserveassuch,andsevencentsforeverymileheorshemay
6necessarilytravelgoingfromhisorherplaceofresidencetothecourthouseandreturning,to
7bepaidfromfundsofthecountyoracitynotwithinacounty.Thegoverningbodyofeach
8countyoracitynotwithinacountymayauthorizeadditionaldailycompensationandmileage
9allowanceforjurors,whichadditionalcompensationshallbepaidfromthefundsofthe
10countyoracitynotwithinacounty.Thegoverningbodyofeachcountyoracitynotwithina
11countymayauthorizeadditionaldailycompensationandmileageallowanceforjurors
12attendingacoroner'sinquest.Jurorsmayreceivetheadditionalcompensationandmileage
13allowanceauthorizedbythissubsectiononlyifthegoverningbodyofthecountyorthecity
14notwithinacountyauthorizestheadditionalcompensation.Theprovisionsofthissubsection
15authorizingadditionalcompensationshallterminateupontheissuanceofamandatebythe
16MissourisupremecourtwhichresultsinthestateofMissouribeingobligatedorrequiredto
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17payanysuchadditionalcompensationevenifsuchadditionalcompensationisformally
18approvedorauthorizedbythegoverningbodyofacountyoracitynotwithinacounty.
19Providedthatacountyoracitynotwithinacountyauthorizesdailycompensationpayable
20fromcountyorcityfundsforjurorswhoserveinthatcountypursuanttothissubsectioninthe
21amountofatleastsixdollarsperdayinadditiontotheamountrequiredbythissubsection,a
22personshallreceiveanadditionalsixdollarsperdaytobereimbursedbythestateofMissouri
23sothatthetotalcompensationpayableshallbeatleast[eighteen] thirty-sevendollars,plus
24mileageforeachdaythatthepersonactuallyservesasapetitjurorinaparticularcase;orfor
25eachdaythatapersonactuallyservesasagrandjurorduringatermofagrandjury.Thestate
26shallreimbursethecountyforsixdollarsoftheadditionaljurorcompensationprovidedby
27thissubsection.
28 3.Inanycountyofthefirstclassificationwithoutacharterformofgovernmentand
29withapopulationofatleasttwohundredthousandinhabitants,nograndorpetitjurorshall
30receivecompensationforthefirsttwodaysofservice,butshallreceivefiftydollarsperday
31forthethirddayandeachsubsequentdayheorshemayactuallyserveassuch,andseven
32centsforeverymileheorshemaynecessarilytravelgoingfromhisorherplaceofresidence
33tothecourthouseandreturning,tobepaidfromfundsofthecounty.
34 4.Ifapersonisemployed,inadditiontothecompensationowedtosuchperson
35undersubsection2or3ofthissection,anemployermaycompensatesuchpersonhisor
36herdailyaverageminimumpayforeachdaysuchpersonactuallyservesonajury.
37 5.Wheneachpanelofjurorssummonedandattendingcourthascompletedits
38service,theboardofjurycommissionersshallcausetobesubmittedtothegoverningbodyof
39thecountyoracitynotwithinacountyastatementoffeesearnedbyeachjuror.Withinthirty
40daysofthesubmissionofthestatementoffees,thegoverningbodyshallcausepaymenttobe
41madetothosejurorssummonedthefeesearnedduringtheirserviceasjurors.
494.460.1.Anemployershallnotterminate,discipline,threatenortakeadverse
2actionsagainstanemployeeonaccountofthatemployee'sreceiptoforresponsetoajury
3summons.
4 2.Anemployeedischargedinviolationofthissectionmaybringcivilactionagainst
5hisorheremployerwithinninetydaysofdischargeforrecoveryoflostwagesandother
6damagescausedbytheviolationandforanorderdirectingreinstatementoftheemployee.If
7theemployeeprevails,theemployeeshallbeentitledtoreceiveareasonableattorney'sfee.
8 3.Anemployee[may] shallnotberequiredorrequestedtouseannual,vacation,
9personal,orsickleavefortimespentrespondingtoasummonsforjuryduty[,] ortimespent
10participatinginthejuryselectionprocess[, ortimespentactuallyservingonajury]. Except
11ifanemployeeactuallyservesonajury,nothinginthisprovisionshallbeconstruedto
12requireanemployertoprovideannual,vacation,personal,orsickleavetoemployeesunder
HB1521	2 13theprovisionsofthisstatutewhootherwisearenotentitledtosuchbenefitsundercompany
14policies.Anyemployeerequiredtoactuallyserveonajurymaybecompensatedbyan
15employerasprovidedundersubsection4ofsection494.455.
16 4.Acourtshallautomaticallypostponeandrescheduletheserviceofasummoned
17jurorofanemployerwithfiveorfewerfull-timeemployees,ortheirequivalent,ifanother
18employeeofthatemployerhasbeenpreviouslysummonedtoappearduringthesameperiod.
19Suchpostponementwillnoteffectanindividual'srighttooneautomaticpostponement
20pursuanttosection494.432.
[488.040.1.Eachgrandandpetitjurorshall,pursuanttothe
2 provisionsofsection494.455,receivesixdollarsperdayforeverydayheor
3 shemayactuallyserveassuchandsevencentsforeverymileheorshemay
4 necessarilytravelgoingfromhisorherplaceofresidencetothecourthouse
5 andreturning,tobepaidfromfundsofthecountyoracitynotwithinacounty.
6 2.Providedthatacountyoracitynotwithinacountyauthorizesdaily
7 compensationpayablefromcountyorcityfundsforjurorswhoserveinthat
8 countypursuanttosubsection3ofthissectionintheamountofatleastsix
9 dollarsperdayinadditiontotheamountrequiredbysubsection1ofthis
10 section,apersonshallreceiveanadditionalsixdollarsperday,pursuanttothe
11 provisionsofsection494.455,tobereimbursedbythestateofMissourisothat
12 thetotalcompensationpayableshallbeatleasteighteendollars,plusmileage
13 asindicatedinsubsection1ofthissection,foreachdaythattheperson
14 actuallyservesasapetitjurorinaparticularcase;orforeachdaythataperson
15 actuallyservesasagrandjurorduringatermofagrandjury.Thestateshall
16 reimbursethecountyforsixdollarsoftheadditionaljurorcompensation
17 providedbythissubsection.
18 3.Thegoverningbodyofeachcountyoracitynotwithinacounty
19 mayauthorizeadditionaldailycompensationandmileageallowancefor
20 jurors,whichadditionalcompensationshallbepaidfromthefundsofthe
21 countyoracitynotwithinacounty.Thegoverningbodyofeachcountyora
22 citynotwithinacountymayauthorizeadditionaldailycompensationand
23 mileageallowanceforjurorsattendingacoroner'sinquest.Jurorsmayreceive
24 theadditionalcompensationandmileageallowanceauthorizedbythis
25 subsectiononlyifthegoverningbodyofthecountyorthecitynotwithina
26 countyauthorizestheadditionalcompensation.Theprovisionsofthis
27 subsectionauthorizingadditionalcompensationshallterminateuponthe
28 issuanceofamandatebytheMissourisupremecourtwhichresultsinthestate
29 ofMissouribeingobligatedorrequiredtopayanysuchadditional
30 compensationevenifsuchadditionalcompensationisformallyapprovedor
31 authorizedbythegoverningbodyofacountyoracitynotwithinacounty.
32 4.Wheneachpanelofjurorssummonedandattendingcourthas
33 completeditsservice,theboardofjurycommissionersshallcausetobe
34 submittedtothegoverningbodyofthecountyoracitynotwithinacountya
35 statementoffeesearnedbyeachjuror.Withinthirtydaysofthesubmissionof
HB1521	3 36 thestatementoffees,thegoverningbodyshallcausepaymenttobemadeto
37 thosejurorssummonedthefeesearnedduringtheirserviceasjurors.]
