72 (15)"Renewalstudent",aneligiblestudentwhoremainsincompliancewiththe 73provisionsofthissection,hasreceivedagrantasaninitialrecipient,maintainsacumulative 74gradepointaverageofatleasttwoandone-halfonafour-pointscaleortheequivalent,makes 75satisfactoryacademicdegreeprogressasdefinedbytheinstitution,withtheexceptionof 76gradepointaverage,andhasnotreceivedabachelor'sdegree. 77 3.Standardsofeligibilityforrenewedassistanceshallbethesameasforaninitial 78awardoffinancialassistance;exceptthat,forarenewalstudent,anapplicantshall 79demonstrateagradepointaverageoftwoandone-halfonafour-pointscale,ortheequivalent 80onanotherscale. 81 4.Eligibilityforagrantexpiresupontheearliestof: 82 (1)Receiptofthegrantforfoursemestersortheequivalent; 83 (2)Receiptofabachelor'sdegree;or 84 (3)Foraneligiblestudent,reachingtwohundredpercentofthetimetypically 85requiredtocompletetheprogramofstudy. 86 5.Thecoordinatingboardshallinitiallydesignateeligibleprogramsofstudyby 87January1,2020,inconnectionwithlocaleducationinstitutions,regionalbusiness 88organizations,andotherstakeholders.Thecoordinatingboardshallannuallyreviewthe 89listofeligibleprogramsofstudyandoccupationsrelatingtoeligibleapprenticeshipsand 90makechangestotheprogramlistasitdeterminesappropriate. HB1527 3 91 6.Thecoordinatingboardshallbetheadministrativeagencyfortheimplementation 92oftheprogramestablishedbythissection[andsection173.2554]. Thecoordinatingboard 93shallpromulgatereasonablerulesandregulationsfortheexerciseofitsfunctionsandthe 94effectuationofthepurposesofthissection[andsection173.2554]. Thecoordinatingboard 95shallprescribetheformandthetimeandmethodoffilingapplicationsandsupervisethe 96processingthereof.Thecoordinatingboardshalldeterminethecriteriaforeligibilityof 97applicantsandshallevaluateeachapplicant'seligibility.Thecoordinatingboardshallselect 98qualifiedrecipientstoreceivegrants,makesuchawardsoffinancialassistancetoqualified 99recipients,anddeterminethemannerandmethodofpaymenttotherecipients. 100 7.Thecoordinatingboardshalldetermineeligibilityforrenewedassistanceonthe 101basisofannualapplications.Asaconditiontoconsiderationforinitialorrenewedassistance, 102thecoordinatingboardmayrequiretheapplicantandtheapplicant'sspousetoexecuteforms 103ofconsentauthorizingthedirectorofrevenuetocomparefinancialinformationsubmittedby 104theapplicantwiththeMissouriindividualincometaxreturnsoftheapplicant,andthe 105applicant'sspouse,forthetaxableyearimmediatelyprecedingtheyearforwhichapplication 106ismade,andtoreportanydiscrepanciestothecoordinatingboard. 107 8.Grantsshallbeawardedinanamountequaltotheactualtuitionandgeneralfees 108chargedofaneligiblestudent,afterallfederalnonloanaid,statestudentaid,andanyother 109governmentalstudentfinancialaidareapplied.Ifagrantamountisreducedtozeroduetothe 110receiptofotheraid,theeligiblestudentshallreceiveanawardofuptofivehundreddollarsor 111theremainingcostofattendanceascalculatedbytheinstitutionafterallnonloanstudentaid 112hasbeenapplied,whicheverisless,peracademicterm.Grantsshallalsobeawardedinan 113amountequaltotherelatededucationalcostsforaneligibleapprenticeafterallother 114governmentalassistanceprovidedfortheapprenticeshiphasbeenapplied. 115 9.Ifappropriatedfundsareinsufficienttofundtheprogramasdescribed,students 116andapprenticesapplyingforrenewedassistanceshallbegivenpriorityuntilallfundsare 117expended. 118 10.Aneligiblestudent[that]whoistherecipientoffinancialassistancemaytransfer 119fromoneapprovedpublic,private,orvirtualinstitution,oreligibletrainingproviderto 120anotherwithoutlosingeligibilityforassistanceunderthissection,butthecoordinatingboard 121shallmakeanynecessaryadjustmentsintheamountoftheaward.Ifarecipientoffinancial 122assistanceatanytimeisentitledtoarefundofanytuitionorfeesundertherulesand 123regulationsoftheinstitutioninwhichheorsheisenrolled,theinstitutionshallpaythe 124portionoftherefundthatmaybeattributedtothegranttothecoordinatingboard.The 125coordinatingboardshallusetheserefundstomakeadditionalawardsundertheprovisionsof 126thissection. HB1527 4 127 11.Personswhoreceivefasttrackgrantsunderthissectionshallberequiredto 128submitproofofresidencyandqualifyingemploymenttothecoordinatingboardforhigher 129educationwithinthirtydaysofcompletingeachtwelvemonthsofqualifyingemployment 130untilthethree-yearemploymentobligationisfulfilled. 131 12.Undersection23.253oftheMissourisunsetact: 132 (1)Theprovisionsofthenewprogramauthorizedunderthissectionshallsunset 133automaticallyonAugust28,2029,unlessreauthorizedbyanactofthegeneralassembly;and 134 (2)Ifsuchprogramisreauthorized,theprogramauthorizedunderthissectionshall 135sunsetautomaticallysixyearsaftertheeffectivedateofthereauthorization;and 136 (3)ThissectionshallterminateonDecemberthirty-firstofthecalendaryear 137immediatelyfollowingthecalendaryearinwhichtheprogramauthorizedunderthissection 138issunset. 139 13.(1)Thereisherebycreatedinthestatetreasurythe"FastTrackWorkforce 140IncentiveGrantFund".Thestatetreasurershallbecustodianofthefund.Inaccordancewith 141sections30.170and30.180,thestatetreasurermayapprovedisbursements.Thefundshallbe 142adedicatedfundand,uponappropriation,moneysinthefundshallbeusedsolelybythe 143coordinatingboardforthepurposesofthissection. 144 (2)Notwithstandingtheprovisionsofsection33.080tothecontrary,anymoneys 145remaininginthefundattheendofthebienniumshallnotreverttothecreditofthegeneral 146revenuefund. 147 (3)Thestatetreasurershallinvestmoneysinthefundinthesamemannerasother 148fundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbecreditedto 149thefund. 150 14.(1)Asusedinthissubsection,"publicsafetypersonnel"includes,butisnot 151limitedto,anypoliceofficer,firefighter,paramedic,emergencymedicaldispatcher, 152emergencymedicaltechnician,oradvancedemergencymedicaltechnicianwhois 153trainedandauthorizedbylaworruletorenderemergencymedicalassistanceor 154treatment. 155 (2)Inadditiontoaneligibleapprenticeandaneligiblestudentasdefinedinthis 156section,thefollowingshallbeeligibletoreceivefasttrackgrantsunderthissection: 157 (a)Anindividualwhoqualifiesaspublicsafetypersonnel;and 158 (b)Adependentofanindividualwhoqualifiesaspublicsafetypersonnel. 159 (3)Theadjustedgrossincomerequirementsunderparagraph(d)ofsubdivision 160(3)ofsubsection2ofthissectionandparagraph(e)ofsubdivision(6)ofsubsection2of 161thissectionshallnotapplytoanindividualdescribedundersubdivision(2)ofthis 162subsection. HB1527 5 163 15.Thecoordinatingboardshallhavetheauthoritytopromulgaterulestoimplement 164theprovisionsofthissection.Anyruleorportionofarule,asthattermisdefinedinsection 165536.010,thatiscreatedundertheauthoritydelegatedinthissectionshallbecomeeffective 166onlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter536and,ifapplicable, 167section536.028.Thissectionandchapter536arenonseverableandifanyofthepowers 168vestedwiththegeneralassemblypursuanttochapter536toreview,todelaytheeffective 169date,ortodisapproveandannularulearesubsequentlyheldunconstitutional,thenthegrant 170ofrulemakingauthorityandanyruleproposedoradoptedafterAugust28,2019,shallbe 171invalidandvoid. ✔ HB1527 6
