Torepealsection287.230,RSMo,andtoenactinlieuthereofonenewsectionrelatingtothe
paymentofworkers'compensationuponthedeathofanemployee.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section287.230,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection287.230,toreadasfollows:
287.230.1.(1)Thedeathoftheinjuredemployeeshallnotaffecttheliabilityofthe
2employertofurnishcompensationasinthischapterprovided,sofarastheliabilityhas
3accruedandbecomepayableatthetimeofthedeath,andanyaccruedandunpaid
4compensationduetheemployeeshallbepaidtohisorherdependentswithout
5administration,oriftherearenodependents,tohisorherpersonalrepresentative, a
6familymemberasdefinedunderthissubsection,orotherpersonsentitledthereto,butthe
7deathshallbedeemedtobetheterminationofthedisability.
8 (2)Forthepurposesofthissubsection,theterm"familymember"shallinclude
9theadultchildorchildren,natural,illegitimate,adopted,orposthumous,whodidnot
10qualifyasadependentundersection287.240duetoageordependency;aparentofthe
11deceased,naturaloradoptive;agrandparentofthedeceased,naturaloradoptive;a
12siblingofthedeceased;anadultnextofkin;ortheconservatorofadependentchildif
13suchchildhasnorepresentativetobringaclaimonhisorherownbehalf.
14 2.Whereanemployeeisentitledtocompensationunderthischapter,exclusiveof
15compensationasprovidedforinsection287.200,foraninjuryreceivedanddeathensuesfor
16anycausenotresultingfromtheinjuryforwhichtheemployeewasentitledtocompensation,
