Thebillincludesadefinitionforwhoisregardedasa"family
member"forpurposesofdeterminingwhoisentitledtoreceive
benefitsthathaveaccruedandarepayableatthetimeofthe
employee'sdeath.
Undercurrentlaw,theunpaidandaccruedcompensationbenefitthat
isduetothedeceasedemployeeispaidtothedependentswithout
administration, andiftherearenodependents,thentothe
personalrepresentative orotherpersonsentitledtoreceivethe
benefit. Underthisbill,iftheemployeehasnodependents,the
benefitwouldbepaidtothepersonalrepresentative, afamily
member,orotherpersonsentitledtothebenefit,asprovidedin
thebill.
