571.201.1.Asusedinthissection,thefollowingtermsmean:
2 (1)"Centralrepository",thesamemeaninggiventotheterminsection43.500;
3 (2)"Lawenforcementofficer",anyindividualemployedbytheUnitedStatesor
4byastate,county,city,municipality,village,township,orotherpoliticalsubdivisionasa
5policeofficerorpeaceofficerorinasimilarpositionthatinvolvestheenforcementof
6thelawandprotectionofthepublicinterest;
7 (3)"Licenseddealer",apersonwhohasavalidfederalfirearmsdealerlicense
8andalladditionallicensesrequiredbystateorlocallawtoengageinthebusinessof
9sellingortransferringfirearms;
10 (4)"Person",anyindividual,corporation,company,association,firm,
11partnership,club,organization,society,jointstockcompany,orotherentity;
12 (5)"Transferee",apersonwhodesirestoreceiveoracquireafirearmfroma
13transferor.Ifatransfereeisnotanaturalperson,eachnaturalpersonwhois
14authorizedbythetransfereetopossessthefirearmafterthetransfershallbedeemed
15thetransfereeandsubjecttotherequirementsofthissection.
16 2.Anypersonwhoisnotalicenseddealer,beforetransferringorattemptingto
17transferpossessionofafirearm,shallrequirethatabackgroundcheckbeconductedon

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18theprospectivetransfereeandshallobtainapprovalofthetransferfromthecentral
19repositoryafterabackgroundcheck.Apersonwhoisnotalicenseddealershall
20arrangeforeitheralicenseddealerorlawenforcementagencytoobtainthebackground
21check.
22 3.(1)Alicenseddealerwhoobtainsabackgroundcheckonaprospective
23transfereeshallrecordthetransferandretaintherecordsinthesamemannerandfor
24thesamedurationasrequiredunder18U.S.C.Section923(g).
25 (2)Alicenseddealerorlawenforcementagencythatobtainsabackground
26checkforaprospectivefirearmtransferorshallprovidethefirearmtransferorand
27transfereeacopyoftheresultsofthebackgroundcheck,includingthecentral
28repositoryapprovalordisapprovalofthetransfer.
29 (3)Alicenseddealerorlawenforcementagencymaychargeafeeforconducting
30abackgroundcheck,whichshallnotexceedtwenty-fivedollarsorthecostofconducting
31thebackgroundcheck,whicheverisgreater.
32 4.(1)Aprospectivefirearmtransfereeshallnotacceptpossessionofafirearm
33unlesstheprospectivefirearmtransferorhasobtainedapprovalofthetransferfromthe
34centralrepositoryafterabackgroundcheck.
35 (2)Aprospectivefirearmtransfereeshallnotknowinglyprovidefalse
36informationtoaprospectivefirearmtransferorortoalicenseddealerforthe
37purposeofacquiringafirearm.
38 5.Ifthecentralrepositoryapprovesatransferofafirearminaccordancewith
39thissection,theapprovalshallbevalidforthirtycalendardays,duringwhichtimethe
40transferorandtransfereemaycompletethetransfer.
41 6.Theprovisionsofthissectionshallnotapplyto:
42 (1)Atransferofanantiquefirearm,asdefinedin18U.S.C.Section921,as
43amended,oracurioorrelic,asdefinedin27CFR478,asamended;
44 (2)Atransferthatisabonafidegiftorloanbetweenimmediatefamily
45members,whichshallbelimitedtospouses,parents,children,siblings,grandparents,
46grandchildren,nieces,nephews,firstcousins,aunts,anduncles;
47 (3)Atransferthatoccursbyoperationoflaworbecauseofthedeathofaperson
48forwhomtheprospectivetransferorisanexecutororadministratorofanestateora
49trusteeofatrustcreatedinawill;
50 (4)Atransferthatistemporaryandoccurswhileinthehomeoftheunlicensed
51transfereeif:
52 (a)Theunlicensedtransfereeisnotprohibitedfrompossessingfirearms;and
HB1545	2 53 (b)Theunlicensedtransfereereasonablybelievesthatpossessionofthefirearm
54isnecessarytopreventimminentdeathorseriousbodilyinjurytotheunlicensed
55transferee;
56 (5)Atemporarytransferofpossessionwithouttransferofownershiporatitleto
57ownership,whichtransfertakesplace:
58 (a)Atashootingrangelocatedinoronpremisesownedoroccupiedbyaduly
59incorporatedorganizationorganizedforconservationpurposesortofosterproficiency
60infirearms;
61 (b)Atatargetfirearmshootingcompetitionundertheauspicesof,orapproved
62by,astateagencyoranonprofitorganization;or
63 (c)Whilehunting,fishing,targetshooting,ortrappingif:
64 a.Thehunting,fishing,targetshooting,ortrappingislegalinallplaceswhere
65theunlicensedtransfereepossessesthefirearm;and
66 b.Theunlicensedtransfereeholdsanylicenseorpermitthatisrequiredforsuch
67hunting,fishing,targetshooting,ortrapping;
68 (6)Anytemporarytransferthatoccurswhileinthecontinuouspresenceofthe
69ownerofthefirearm;
70 (7)Anylawenforcementorcorrectionsagencyorlawenforcementor
71correctionsofficeractingwithinthecourseandscopeofhisorheremploymentor
72officialduties;
73 (8)AUnitedStatesmarshal,amemberoftheUnitedStatesArmedForcesorthe
74NationalGuard,orafederalofficialtransferringorreceivingafirearmasrequiredin
75theoperationofhisorherofficialduties;
76 (9)Agunsmithwhoreceivesafirearmsolelyforthepurposesofserviceor
77repairorthereturnofthefirearmtoitsownerbythegunsmith;
78 (10)Acommoncarrier,warehouseman,orotherpersonengagedinthebusiness
79oftransportationorstorage,totheextentthatthereceiptofanyfirearmisinthe
80ordinarycourseofbusinessandnotforthepersonaluseofanysuchperson;or
81 (11)Apersonwhotransfersafirearmtoarelativewhoisrelatedwithinthefirst
82degreebyconsanguinityoraffinity.
83 7.AviolationofaprovisionofthissectionisaclassBmisdemeanor.Eachdaya
84violationofthissectioniscommittedorcontinuedshallbeconsideredaseparate
85violationandpunishedaccordingly.
86 8.Inadditiontoanyotherpenaltyorremedy,theinvestigatinglawenforcement
87agencyshallreportanyviolationofthissectioncommittedbyalicenseddealertothe
HB1545	3 88attorneygeneral,whoshallreporttheviolationtotheBureauofAlcohol,Tobacco,
89FirearmsandExplosiveswithintheUnitedStatesDepartmentofJustice.
