SectionA.Sections211.071and569.090,RSMo,arerepealedandtwonewsections
2enactedinlieuthereof,tobeknownassections211.071and569.090,toreadasfollows:
211.071.1.Ifapetitionallegesthatachildbetweentheagesoffourteenandeighteen
2hascommittedanoffense[which] thatwouldbeconsideredafelonyifcommittedbyan
3adult,thecourtmay,uponitsownmotionoruponmotionbythejuvenileofficer,thechildor
4thechild'scustodian,orderahearingandmay,initsdiscretion,dismissthepetitionandsuch
5childmaybetransferredtothecourtofgeneraljurisdictionandprosecutedunderthegeneral
6law;exceptthatifapetitionallegesthatachildbetweentheagesoftwelveandeighteenhas:

30thecourtshallorderahearing,andmayinitsdiscretion,dismissthepetitionandtransferthe
31childtoacourtofgeneraljurisdictionforprosecutionunderthegenerallaw.
32 2.Uponapprehensionandarrest,jurisdictionoverthecriminaloffenseallegedly
33committedbyanypersonbetweeneighteenandtwenty-oneyearsofageoverwhomthe
34juvenilecourthasretainedcontinuingjurisdictionshallautomaticallyterminateandthat
35offenseshallbedealtwithinthecourtofgeneraljurisdictionasprovidedinsection211.041.
36 3.Knowingandwillfulagemisrepresentationbyajuvenilesubjectshallnotaffect
37anyactionorproceedingwhichoccursbaseduponthemisrepresentation.Anyevidence
38obtainedduringtheperiodoftimeinwhichachildmisrepresentshisorheragemaybeused
39againstthechildandwillbesubjectonlytorulesofevidenceapplicableinadultproceedings.
40 4.Writtennotificationofatransferhearingshallbegiventothejuvenileandhisor
41hercustodianinthesamemannerasprovidedinsections211.101and211.111.Noticeofthe
42hearingmaybewaivedbythecustodian.Noticeshallcontainastatementthatthepurposeof
43thehearingistodeterminewhetherthechildisapropersubjecttobedealtwithunderthe
44provisionsofthischapter,andthatifthecourtfindsthatthechildisnotapropersubjecttobe
45dealtwithundertheprovisionsofthischapter,thepetitionwillbedismissedtoallowfor
46prosecutionofthechildunderthegenerallaw.
47 5.Thejuvenileofficermayconsultwiththeofficeofprosecutingattorneyconcerning
48anyoffenseforwhichthechildcouldbecertifiedasanadultunderthissection.The
49prosecutingorcircuitattorneyshallhaveaccesstopolicereports,reportsofthejuvenileor
50deputyjuvenileofficer,statementsofwitnessesandallotherrecordsorreportsrelatingtothe
51offenseallegedtohavebeencommittedbythechild.Theprosecutingorcircuitattorneyshall
52haveaccesstothedispositionrecordsofthechildwhenthechildhasbeenadjudicated
53pursuanttosubdivision(3)ofsubsection1ofsection211.031.Theprosecutingattorneyshall
54notdivulgeanyinformationregardingthechildandtheoffenseuntilthejuvenilecourtata
HB159	2 55judicialhearinghasdeterminedthatthechildisnotapropersubjecttobedealtwithunderthe
56provisionsofthischapter.
57 6.Awrittenreportshallbepreparedinaccordancewiththischapterdevelopingfully
58allavailableinformationrelevanttothecriteriawhichshallbeconsideredbythecourtin
59determiningwhetherthechildisapropersubjecttobedealtwithundertheprovisionsofthis
60chapterandwhethertherearereasonableprospectsofrehabilitationwithinthejuvenilejustice
61system.Thesecriteriashallincludebutnotbelimitedto:
62 (1)Theseriousnessoftheoffenseallegedandwhethertheprotectionofthe
63communityrequirestransfertothecourtofgeneraljurisdiction;
64 (2)Whethertheoffenseallegedinvolvedviciousness,forceandviolence;
65 (3)Whethertheoffenseallegedwasagainstpersonsorpropertywithgreaterweight
66beinggiventotheoffenseagainstpersons,especiallyifpersonalinjuryresulted;
67 (4)Whethertheoffenseallegedisapartofarepetitivepatternofoffenseswhich
68indicatesthatthechildmaybebeyondrehabilitationunderthejuvenilecode;
69 (5)Therecordandhistoryofthechild,includingexperiencewiththejuvenilejustice
70system,othercourts,supervision,commitmentstojuvenileinstitutionsandotherplacements;
71 (6)Thesophisticationandmaturityofthechildasdeterminedbyconsiderationofhis
72orherhomeandenvironmentalsituation,emotionalconditionandpatternofliving;
73 (7)Theageofthechild;
74 (8)Theprogramandfacilitiesavailabletothejuvenilecourtinconsidering
75disposition;
76 (9)Whetherornotthechildcanbenefitfromthetreatmentorrehabilitativeprograms
77availabletothejuvenilecourt;and
78 (10)Racialdisparityincertification.
79 7.Ifthecourtdismissesthepetitiontopermitthechildtobeprosecutedunderthe
80generallaw,thecourtshallenteradismissalordercontaining:
81 (1)Findingsshowingthatthecourthadjurisdictionofthecauseandoftheparties;
82 (2)Findingsshowingthatthechildwasrepresentedbycounsel;
83 (3)Findingsshowingthatthehearingwasheldinthepresenceofthechildandhisor
84hercounsel;and
85 (4)Findingsshowingthereasonsunderlyingthecourt'sdecisiontotransfer
86jurisdiction.
87 8.Acopyofthepetitionandorderofthedismissalshallbesenttotheprosecuting
88attorney.
89 9.Whenapetitionhasbeendismissedtherebypermittingachildtobeprosecuted
90underthegenerallawandtheprosecutionofthechildresultsinaconviction,thejurisdiction

93 10.Ifapetitionhasbeendismissedtherebypermittingachildtobeprosecutedunder
94thegenerallawandthechildisfoundnotguiltybyacourtofgeneraljurisdiction,thejuvenile
95courtshallhavejurisdictionoveranylateroffensecommittedbythatchildwhichwouldbe
96consideredamisdemeanororfelonyifcommittedbyanadult,subjecttothecertification
97provisionsofthissection.
98 11.Ifthecourtdoesnotdismissthepetitiontopermitthechildtobeprosecutedunder
99thegenerallaw,itshallsetadateforthehearinguponthepetitionasprovidedinsection

569.090.1.Apersoncommitstheoffenseoftamperingintheseconddegreeifheor

3 (1)Tamperswithpropertyofanotherforthepurposeofcausingsubstantial
4inconveniencetothatpersonortoanother;or
5 (2)Unlawfullyridesinoruponanother'sautomobile,airplane,motorcycle,motorboat
6orothermotor-propelledvehicle;or
7 (3)Tampersormakesconnectionwithpropertyofautility;or
8 (4)Tamperswith,orcausestobetamperedwith,anymeterorotherpropertyofan
9electric,gas,steamorwaterutility,theeffectofwhichtamperingiseither:
10 (a)Topreventthepropermeasuringofelectric,gas,steamorwaterservice;or
11 (b)Topermitthediversionofanyelectric,gas,steamorwaterservice.
12 2.Inanyprosecutionundersubdivision(4)ofsubsection1,proofthatameterorany
13otherpropertyofautilityhasbeentamperedwith,andthepersonorpersonsaccusedreceived
14theuseordirectbenefitoftheelectric,gas,steamorwaterservice,withoneormoreofthe
15effectsdescribedinsubdivision(4)ofsubsection1,shallbesufficienttosupportaninference
16whichthetrialcourtmaysubmittothetrieroffact,fromwhichthetrieroffactmayconclude
17thattherehasbeenaviolationofsuchsubdivisionbythepersonorpersonswhouseor
18receivethedirectbenefitoftheelectric,gas,steamorwaterservice.
19 3.TamperingintheseconddegreeisaclassAmisdemeanorunless:
20 (1)Committedasasecondorsubsequentviolationofsubdivision(4)ofsubsection1,
21inwhichcaseitisaclassEfelony;[or]
22 (2)Thedefendanthasapriorconvictionorhaspreviouslybeenfoundguiltypursuant
23toparagraph(a)ofsubdivision(3)ofsubsection5ofsection570.030,orsubdivision(2)of
24subsection1ofthissection,inwhichcaseitisaclassDfelony; or
25 (3)Thedefendantisguiltyundersubdivision(1)ofsubsection1ofthissection,
26thepropertyundersubdivision(1)ofsubsection1ofthissectioninvolvesamotor
27vehicle,andthedefendantisinpossessionofafirearmduringthecommissionofthe
HB159	4 28offense,inwhichcaseitisaclassEfelony.Apersonsubjecttothepenaltiesunderthis
29subdivisionshallnotbegrantedparoleorprobationuntilheorshehasserveda
30minimumofoneyearimprisonment.Ifthepersonisinviolationofthissubdivisionand
