Thisbillrequiresajuvenilecourttoorderahearingtodetermine
whethertocertifyajuvenileasanadultifapetitionalleges
thatachildbetweentheagesof12and18hascommittedthe
offenseoftamperingintheseconddegreeifthepropertyinvolves
amotorvehicleandthechildisinpossessionofafirearmduring
thecommissionoftheoffense.
Thebillalsomodifiestheoffenseoftamperinginthesecond
degreetospecifythattheoffenseisaclassEfelonywhena
defendanttamperswiththemotorvehicleofanotherforthepurpose
ofcausingsubstantialinconveniencetothatpersonandthe
defendantwasinpossessionofafirearmduringthecommissionof
theoffense. Adefendantsubjecttothepenaltiesunderthese
provisionswillnotbegrantedparoleorprobationuntilheorshe
hasservedatleastoneyearimprisonment.
