305.637.1.Nostateagencyorcountyormunicipallawenforcementagencyin

3informationpertainingtocriminalconductorconductinviolationofastatuteor
4regulation,excepttotheextentauthorizedinawarrant.
5 2.Alawenforcementagency,withoutobtainingawarrant,mayoperateadrone
6orunmannedaircraftinstate,national,orlocalemergencysituationsifthereisan
7imminentthreattolifeorofgreatbodilyharmincluding,butnotlimitedto,fires,
8hostagecrises,hotpursuitsituationsifreasonablynecessarytopreventharmtolaw
9enforcementofficersorothers,andsearchandrescueoperationsonlandorwater.A
10lawenforcementagency,withoutobtainingawarrant,mayoperateadroneor
11unmannedaircrafttoassessthenecessityoffirstrespondersinsituationsrelatingto
12trafficaccidentsorfiresortoinspectstateparksandconservationareasforillegal
13vegetation.Nothinginsections305.635to305.641shallbeconstruedtoprohibitanylaw
14enforcementofficerfromgatheringevidenceundertheplainviewdoctrine.

16unmannedaircraftonlywithintheoperatinglimitationsprovidedin14CFR107.51.
17 (2)Noperson,entity,orstateagencyshalllaunchoroperateadroneorother
18unmannedaircraftwithinthepropertylineofprivatepropertywithouttheconsentof
19thepropertyowneroroccupant.
20 4.Noperson,entity,orstateagencyshalloperateadroneorotherunmanned
21aircrafttoconductsurveillanceorobservationofanyindividual,propertyownedbyan
22individual,farm,facilityengagedinthecreationoffuelfromagriculturalproducts,or

8subdivisionisvalidonlywhenthecameraisfacingalocationthatisopentopublicaccessor
9useandthecameraislocatedwithinonehundredfeetoftheintendedsurveillancelocation].
577.800.1.Apersoncommitstheoffenseofunlawfuluseofunmannedaircraftover
2anopen-airfacilityifheorshepurposely:
3 (1)Operatesanunmannedaircraftwithinaverticaldistanceoffourhundredfeetfrom
4thegroundandwithinthepropertylineofanopen-airfacility;or
5 (2)Usesanunmannedaircraftwiththepurposeofdeliveringtoapersonwithinan
6open-airfacilityanyobjectdescribedinsubdivision(1)or(2)ofsubsection4ofthissection.
7 2.Forpurposesofthissection,"open-airfacility"shallmeananysports,theater,
8music,performingarts,orotherentertainmentfacilitywithacapacityoffivethousandpeople
9ormoreandnotcompletelyenclosedbyarooforotherstructure.
10 3.Theprovisionsofthissectionshallnotprohibittheoperationofanunmanned
11aircraftby:
12 (1)Anemployeeofanopen-airfacilityatthedirectionofthepresidentorchief
13executiveofficeroftheopen-airfacility;
14 (2)Apersonwhohaswrittenconsentfromthepresidentorchiefexecutiveofficerof
15theopen-airfacility;
16 (3)Anemployeeofalawenforcementagency,firedepartment,oremergency
17medicalserviceintheexerciseofofficialduties;
18 (4)Agovernmentofficialoremployeeintheexerciseofofficialduties;
19 (5)Apublicutilityoraruralelectriccooperativeif:
20 (a)Theunmannedaircraftisusedforthepurposeofinspecting,repairing,or
21maintainingutilitytransmissionordistributionlinesorotherutilityequipmentor
22infrastructure;

30punishableasaninfraction] isaclassAmisdemeanorunlessthepersonusesanunmanned
31aircraftfor:
32 (1)Deliveringagun,knife,weapon,orotherarticlethatmaybeusedinsuchmanner
33toendangerthelifeofanemployeeorguestatanopen-airfacility,inwhichcasetheoffense
34isaclassBfelony;or
35 (2)Deliveringacontrolledsubstance,asthattermisdefinedundersection195.010,
36inwhichcasetheoffenseisaclassDfelony.
