Thisbillestablishesthe"PreservingFreedomfromUnwarranted
SurveillanceAct".
Thebillspecifiesthatnostateagency,county,ormunicipallaw
enforcementagencyispermittedtouseadroneorotherunmanned
aircraft,asdefinedinthebill,togatherevidenceorother
informationpertainingtocriminalconduct,excepttotheextent
authorizedinawarrant. Alawenforcementagencymayuseadrone
orunmannedaircraftinresponsetostate,national,orlocal
emergencysituations,asspecifiedinthebill.
Noperson,entity,orstateagencymayuseadroneorother
unmannedaircrafttoconductsurveillanceorobservationofany
individualorproperty,asspecifiedinthebill,withoutthe
consentofthatindividualorpropertyowner.Aperson,entity,or
stateagencycanonlylaunchoroperateadroneorotherunmanned
aircraftwithintheoperatinglimitationsprovidedin14CFR
107.51.Noperson,entity,orstateagencywilllaunchoroperate
adroneorotherunmannedaircraftwithinthepropertylineof
privatepropertywithouttheconsentofthepropertyowneror
occupant.
Thisbilldoesnotprohibittheuseofamannedaircraft,drone,or
unmannedaircraftforpurposeslistedinthebill,including:a
personperformingdutiesonbehalfofafiredepartment;higher
educationinstitutionintheStateconductingeducational,
research,ortrainingprograms;certainactivitiesofmanufacturers
orsellersofaircraftanddrones;certainactivitiesofpublic
utilities;forusebyanybranchoftheUnitedStatesArmedForces
orNationalGuard;oraprofessionalengagedinsurveyingor
mapping. Thisbilldoesnotprohibittheuseofamodelaircraft.
Anyaggrievedpartymayinacivilactionobtainallappropriate
relieftopreventorremedyaviolationoftheprovisionsofthis
bill.
Noinformationobtainedinviolationoftheprovisionsofthisbill
willbeadmissibleasevidenceinacriminalproceeding.
SovereignimmunityfortheStateiswaivedforanycivilaction
resultingfromaviolationoftheprovisionsofthisbill.
Thisbillchangestheoffenseofunlawfuluseofanunmanned
aircraftoveranopen-airfacilityfromaninfractiontoaclassA
misdemeanor. Currently,employeesofastateagencyorapoliticalsubdivision
areprohibitedfromplacingasurveillancecameraorgamecameraon
privatepropertywithouttheconsentofthelandowneror
landowner'sdesignee,asearchwarrant,orpermissionfromthe
highestrankinglawenforcementchieforofficeroftheagency
undercertainconditions. Thisbillrepealstheabilityforthe
highestrankinglawenforcementchieforofficertoapprovethe
placementofacameraonprivateproperty.
