ThisbillrequiresasalvagelicensefromtheDepartmentofRevenue
toengageinthebuyingorsellingofcatalyticconverters.
Thebillrequiresscrapmetaldealersandothersregulatedunder
Section407.300,RSMotorequireproofthatthesellerofa
detachedcatalyticconverterisabonafideautomobilerepairshop
oranaffidavitthattheconverterwaslawfullyacquired. The
make,model,year,andvehicleidentification numberofthevehicle
fromwhichtheconverteroriginatedwillberequiredandmaintained
forfouryears.Recordswillbesubmittedatleastmonthlytothe
DepartmentofRevenueonaformprovidedbytheDepartmentin
eitherapaperorelectronicformatasspecifiedinthebill.
Transactionsinvolvingcatalyticconvertersmustoccuratthefixed
placeofbusinessofthescrapmetaldealerorpersonregulated
underSection407.300. Suchindividualsmustpossessthecatalytic
converterforfivedaysbeforemodifyingitinanyway.Currently,
anyonewhoknowinglypurchasesastolencatalyticconverterin
violationofthissectionwillbesubjecttopenaltiesasspecified
inthesection. Thisbillrepealstherequirementthatthe
purchaserknowsthecatalyticconverterisstolenandprovidesthat
anyoneconvictedofviolatingthissectionisguiltyofaclassE
felonyinadditiontobeingsubjecttohavinganybusinesslicense
revoked.
Thebillclarifiesthatminorpartsofheatingandcooling
equipmentandequipmentusedinthegenerationandtransmissionof
electricalpowerortelecommunications, includinganycatalytic
converterofsuchequipment,remainssubjecttotheprovisionsof
thebill.
Thebilladdsthatapersoncommitstheoffenseofstealingif,for
thepurposeofdeprivingtheownerofalawfulinteresttherein,he
orshereceives,retains,ordisposesofacatalyticconverterand
knowsithasbeenstolen,believesithasbeenstolen,or
reasonablyshouldhavesuspectedthatsuchpropertywasstolen.
Thebillestablishestheoffenseofunlawfulpossessionofa
detachedcatalyticconverter. ThisoffenseisaclassEfelony.A
personcommitstheoffenseofunlawfulpossessionofadetached
catalyticconverterifthepersonpossessesacatalyticconverter
withtheintenttosellunless:
(1)Thecatalyticconverterispossessedinthecourseofa
legitimatebusinesspurpose; (2)Thecatalyticconverterisacomponentorconstituentpartof
anitemorequipmentownedbytheindividual;or
(3)Thepossessionofthecatalyticconverterisforsomeother
lawfulpurpose.
