BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section578.365,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection578.365,toreadasfollows:
578.365.1.Thissectionshallbeknownandmaybecitedas"Danny'sLaw".
2 2.Apersoncommitstheoffenseofhazingifheorsheknowingly, actively,andnot
3underduressparticipatesin,solicitsanotherpersontoparticipatein,orcausesorplansa
4willfulact,occurringonoroffthecampusofapublicorprivatecollegeoruniversity,directed
5againstastudentoraprospectivemember, currentmember,orformermemberofan
6organizationoperatingunderthesanctionofapublicorprivatecollegeoruniversity,that
7recklesslyendangersthementalorphysicalhealthorsafetyofastudentorprospective
8member, currentmember,orformermemberforthepurposeofinitiationoradmissioninto
9orcontinuedmembershipinanysuchorganizationtotheextentthatsuchpersonisknowingly
10placedatprobableriskofthelossoflifeorprobablebodilyorpsychologicalharm.Actsof
11hazinginclude:
12 (1)Anyactivitywhichrecklesslyendangersthephysicalhealthorsafetyofthe
13studentorprospectivemember, currentmember,orformermember, includingbutnot
14limitedtophysicalbrutality,whipping,beating,branding,exposuretotheelements,forced
15consumptionofanyfood,liquor,drugorothersubstance,orforcedsmokingorchewingof
16tobaccoproducts;

18prospectivemember, currentmember,orformermember, includingbutnotlimitedto
19sleepdeprivation,physicalconfinement,orotherextremestress-inducingactivity;or
20 (3)Anyactivitythatrequiresthestudentorprospectivemember, currentmember,
21orformermembertoperformadutyortaskwhichinvolvesaviolationofthecriminallaws
22ofthisstateoranypoliticalsubdivisioninthisstate.
23 [2.]3.Publicorprivatecollegesoruniversitiesinthisstateshalladoptawritten
24policyprohibitinghazingbyanyorganizationoperatingunderthesanctionoftheinstitution.
25 [3.]4.Nothinginthissectionshallbeinterpretedascreatinganewprivatecauseof
26actionagainstanyeducationalinstitution.
27 [4.]5.Consentisnotadefensetohazing.Section565.010doesnotapplytohazing
28casesortohomicidecasesarisingoutofhazingactivity.
29 [5.]6.TheoffenseofhazingisaclassAmisdemeanor,unlesstheactcreatesa
30substantialrisktothelifeofthestudent[or],prospectivemember, currentmember,or
31formermember, inwhichcaseitisaclassDfelony.
32 7.Apersonshallnotbeguiltyoftheoffenseofhazingifthepersonestablishesall
33ofthefollowing:
34 (1)Thathewaspresentataneventwhere,asaresultofhazing,aperson
35appearedtobeinneedofimmediatemedicalassistance;
36 (2)Thathewasthefirstpersontocall911orcampussecuritytoreporttheneed
37forimmediatemedicalassistance;
38 (3)Thatheprovidedhisownname,theaddresswhereimmediatemedical
39assistancewasneeded,andadescriptionofthemedicalissuetothe911operatoror
40campussecurityatthetimeofthecall;and
41 (4)Thatheremainedatthescenewiththepersoninneedofimmediatemedical
42assistanceuntilmedicalassistance,lawenforcement,orcampussecurityarrivedand
43thathecooperatedwithsuchpersonnelonthescene.
44 8.Notwithstandingsubsection7ofthissectiontothecontrary,apersonshallbe
45immunefromprosecutionunderthissectionifthepersonestablishesthattheperson
46renderedaidtothehazingvictimbeforemedicalassistance,lawenforcement,orcampus
47securityarrivedonthesceneofthehazingevent.Forpurposesofthissubsection,the
48term"aid"includes,butisnotlimitedto,renderingcardiopulmonaryresuscitationto
49thevictim,clearinganairwayforthevictimtobreathe,usingadefibrillatortoassistthe
50victim,orrenderinganyotherassistancetothevictimthatthepersonintendedingood
51faithtostabilizeorimprovethevictim'sconditionwhilewaitingformedicalassistance,
52lawenforcement,orcampussecuritytoarrive.

54isnolongeraffiliatedwiththechapteroftheorganizationoperatingunderthesanction
55ofthepublicorprivatecollegeoruniversity,butwhomaybeaffiliatedwiththenational
56chapteroftheorganization.
