192.258.1.Forpurposesofthissection,thefollowingtermsmean:
2 (1)"Localpublichealthagency",acountyhealthcenterboardestablished
3underchapter205,acountyhealthdepartment,acityhealthdepartmentoragency,a
4combinedcityandcountyhealthdepartmentoragency,amulticountyhealth
5departmentoragency,oranyothercountyorcityhealthauthority;
6 (2)"Terminfants",infantswhoareatthirty-sixweeksormoreofgestation.
7 2.(1)Eachcountyshallannuallyreportinfantdeathstothelocalpublichealth
8agencyoragencieswithjurisdictionoverthecountyoranypartofthecounty.
9 (2)Thedatashallbeaggregatedtoensuredatareflectshowregionalizedcare
10systemsare,orshouldbe,collaboratingtoimprovefetalandinfanthealthoutcomes
11basedonstandardstatisticalmethodsforaccuratedisseminationofpublichealthdata
12withoutriskingaconfidentialityorotherdisclosurebreach.
13 (3)Thedatashallbedisaggregatedbyracialandethnicidentity.
14 3.Subjecttoappropriation,alocalpublichealthagencyshallestablishafetal
15andinfantmortalityreviewcommitteetoinvestigateinfantdeathstopreventfetaland
16infantdeathifbothofthefollowingapplywithrespecttothelocalpublichealth
17agency'sjurisdiction:
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 (1)Thejurisdictionhasfiveormoreinfantdeathsinasingleyear;and
19 (2)Thejurisdictionhasaninfantdeathratethatishigherthanthestate'sinfant
20deathratefortwoconsecutiveyears.
21 4.Thedepartmentofhealthandseniorservicesshallestablishafetalandinfant
22mortalityreviewprocessinwhichalllocalpublichealthagenciesmayvoluntarily
23participate.Alocalpublichealthagencythatparticipatesinthefetalandinfant
24mortalityreviewprocessestablishedbythedepartmentofhealthandseniorservices
25shalldoallofthefollowing:
26 (1)Annuallyinvestigate,track,andreviewaminimumamountoftwenty
27percentofthejurisdiction'scasesofterminfantswhowerebornfollowinglaborwith
28theoutcomeofintrapartumstillbirth,earlyneonataldeath,orpostneonataldeath,
29focusingondemographicgroupsthataredisproportionatelyimpactedbyinfantdeath.
30Ajurisdictionthathasfewerthanfiveinfantdeathsinayearshallinvestigateatleast
31oneinfantdeath;
32 (2)Establishacommitteeforfetalandinfantmortalityreviewsledbylocal
33publichealthagencies.Thecommitteeshallincludemembersofthecommunitybut
34shallnotincludeanyoneemployedbyalawenforcementagency.Injurisdictionsin
35whichthecoroner,medicalexaminer,orothermedicalprofessionalisemployedbylaw
36enforcement,theseindividualscanshareinformationwiththecommitteeintheir
37medicalprofessionalcapacityonly.Thecommitteeshallbesubjecttothefollowing
38provisions:
39 (a)Alldataandrecordsobtained,prepared,created,andmaintainedin
40anticipationofareviewmeetingshallbeconfidential.Dataandrecordsprepared,
41created,andmaintainedinanticipationofareviewmeetingshallnotbesubjectto
42publicrecordsrequests,subpoena,orcivilprocessesandshallnotbeadmissiblein
43evidenceinconnectionwithanyadministrative,judicial,executive,legislative,orother
44proceeding;
45 (b)Allparticipantsengagedinandassociatedwiththereviewprocessshallsign
46aconfidentialityagreementthatstatessuchparticipantswillnotdiscussorshare
47informationaboutindividualcasesandtheproceedingsofthereviewmeetingoutside
48themeeting.Thisshallnotprecludethecommitteefrompublishing,orfromotherwise
49makingavailableforpublicinspection,statisticalcompilationsorreportsthatarebased
50onconfidentialinformation,providedthatthosecompilationsorreportsshallnot
51containpersonallyidentifyinginformationorotherinformationthatcouldbeusedto
52ultimatelyidentifytheindividualsconcernedandshallutilizestandardpublichealth
53reportingpracticesforaccuratedisseminationofthesedataelements,especiallywith

56 (c)Totheextentprescribedbysection537.035,membersofthecommittee,

58committeeshallnotbequestionedinanyadministrative,civil,orcriminalproceeding
59regardinginformationpresentedin,oropinionsformedasaresultof,ameeting.This
60paragraphshallnotprohibitapersonfromtestifyingtoinformationobtained
61independentlyofthecommitteeorthatispublicinformation.Ahealthcareprovider,
62healthcarefacility,orpharmacyprovidingaccesstomedicalrecordsunderthissection
63shallnotbeheldliableforcivildamagesorbesubjecttoanycriminalordisciplinary
64actionforgoodfaitheffortsinprovidingtherecords;
65 (3)Conductvoluntaryinterviewswithindividualswhohaveexperiencedchild
66lossorsurvivingfamilymembersofmaternalorinfantdeathwhohaveknowledgeof
67theevent.Theinterviewshallincludequestionstodetermineifthepregnantpersonhad
68concernsaboutperinatalcareduringanypointintheperson'spregnancyor
69postpartumcare,whetherthereweredisagreementsaboutcareofferedandreceived,
70andwhetherthepregnantpersonhadaskedforcertaincarethatwasdeniedornot
71received;
72 (4)Conductareportorinvestigation,tothedegreepracticable,withallmedical
73staffinvolvedwithamaternalorinfantdeath;and
74 (5)Offergriefcounselingtosurvivingfamilymembers.
75 5.Counties,hospitals,birthingcenters,andstateentitiesshallprovidetolocal
76publichealthagenciesdeathrecords,medicalrecords,autopsyreports,toxicology
77reports,hospitaldischargerecords,birthrecords,andanyotherinformationthatwill
78helpthelocalpublichealthagencyconductthefetalandinfantmortalityreviewwithin
79thirtydaysofarequestmadeinwritingbyalocalpublichealthagency.Thelocalpublic
80healthagencyshallnotrequest,andhealthcareprovidersshallnotprovide,reports,
81testimony,orotherinformationproducedasaresultofactivitiesundertakenbyapeer
82reviewcommittee,asdefinedinsection537.035,thathastheresponsibilitytoevaluateor
83improvethequalityofcarerenderedinahospital.
84 6.(1)Thereisherebycreatedinthestatetreasurythe"FetalandInfant
85MortalityReviewFund",whichshallconsistofmoneysappropriatedtoitbythegeneral
86assemblyandanygifts,contributions,grants,orbequestsreceivedfromfederal,private,
87orothersources.Thestatetreasurershallbecustodianofthefund.Inaccordancewith
88sections30.170and30.180,thestatetreasurermayapprovedisbursements.Thefund
89shallbeadedicatedfundand,uponappropriation,moneysinthisfundshallbeused
90solelyasprovidedinthissection.
HB256	3 91 (2)Notwithstandingtheprovisionsofsection33.080tothecontrary,anymoneys
92remaininginthefundattheendofthebienniumshallnotreverttothecreditofthe
93generalrevenuefund.
94 (3)Thestatetreasurershallinvestmoneysinthefundinthesamemanneras
95otherfundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbe
96creditedtothefund.
192.990.1.Thereisherebyestablishedwithinthedepartmentofhealthandsenior
2servicesthe"Pregnancy-AssociatedMortalityReviewBoard"toimprovedatacollectionand
3reportingwithrespecttomaternaldeaths.Thedepartmentmaycollaboratewithlocalitiesand
4withotherstatestomeetthegoalsoftheinitiative.
5 2.Forpurposesofthissection,thefollowingtermsshallmean:
6 (1)"Department",theMissouridepartmentofhealthandseniorservices;
7 (2)"Maternaldeath"or"maternalmortality", thedeathofawomanwhilepregnant
8orduringtheone-yearperiodfollowingthedateoftheendofpregnancy,regardlessofthe
9causeofdeathandregardlessofwhetheradelivery,miscarriage,ordeathoccursinsideor
10outsideofahospital;
11 (3)"Severematernalmorbidity",unexpectedoutcomesofpregnancy,labor,or
12deliverythatresultinsignificantshort-termorlong-termconsequencestothepregnant
13person'smentalorphysicalhealth.
14 3.Theboardshallbecomposedofnomorethaneighteenmembers,withachair
15electedfromamongitsmembership.Theboardshallmeetatleasttwiceperyearandshall
16approvethestrategicpriorities,fundingallocations,workprocesses,andproductsofthe
17board.Membersoftheboardshallbeappointedbythedirectorofthedepartment.Members
18shallservefour-yearterms,exceptthattheinitialtermsshallbestaggeredsothat
19approximatelyone-thirdservethree-,four-,andfive-yearterms.
20 4.Theboardshallhaveamultidisciplinaryanddiversemembershipthatrepresentsa
21varietyofmedicalandnursingspecialties,including,butnotlimitedto,obstetricsand
22maternal-fetalcare,aswellasstateorlocalpublichealthofficials,epidemiologists,
23statisticians,communityorganizations,geographicregions,andotherindividualsor
24organizationsthataremostaffectedbymaternaldeathsandlackofaccesstomaternal
25healthcareservices.
26 5.Thedutiesoftheboardshallinclude,butnotbelimitedto:
27 (1)Conductingongoingcomprehensive,multidisciplinaryreviewsofallmaternal
28deaths;
29 (2)Identifyingfactorsassociatedwithmaternaldeaths;
30 (3)Reviewingmedicalrecordsandotherrelevantdata,whichshallinclude,tothe
31extentavailable:
HB256	4 32 (a)Adescriptionofthematernaldeathsdeterminedbymatchingeachdeathrecordof
33amaternaldeathtoabirthcertificateofaninfantorfetaldeathrecord,asapplicable,andan
34indicationofwhetherthedelivery,miscarriage,ordeathoccurredinsideoroutsideofa
35hospital;
36 (b)Datacollectedfrommedicalexaminerandcoronerreports,asappropriate;and
37 (c)Usingotherappropriatemethodsorinformationtoidentifymaternaldeaths,
38includingdeathsfrompregnancyoutcomesnotidentifiedunderparagraph(a)ofthis
39subdivision;
40 (4)Consultingwithrelevantexperts,asneeded;
41 (5)Analyzingcasestoproducerecommendationsforreducingmaternalmortality;
42 (6)Analyzingcommonindicatorsofseverematernalmorbiditytoidentify
43preventionopportunitiesandreducenear-missexperiences;
44 (7)Disseminatingrecommendationstopolicymakers,healthcareprovidersand
45facilities,andthegeneralpubliconbestpracticestopreventmaternalmortalityand
46morbidityincluding,butnotlimitedto,addressingsocioeconomicandenvironmental
47impacts,includingglobalwarming,onpregnancyoutcomes;
48 [(7)] (8)Recommendingandpromotingpreventativestrategiesandmaking
49recommendationsforsystemschanges, includingchangesindatacollectionand
50investigatoryprocesses;
51 [(8)](9)Protectingtheconfidentialityofthehospitalsandindividualsinvolvedinany
52maternaldeaths;
53 [(9)](10)Examiningracialandsocialdisparitiesinmaternaldeathsandmaking
54recommendationsonthepreventionofracialandsocialdisparities;
55 [(10)] (11)Trackingandexaminingdisparitiesexperiencedbylesbian,bisexual,

66appropriateandpracticable,forresearchpurposes,inamannerthatprotectsindividually
67identifiableorpotentiallyidentifiableinformationandthatisconsistentwithstateandfederal

HB256	5 69 6.(1)Theboard'sreviewofcasesofmaternalmortalityandmorbidityshall
70include,tothedegreepracticable,forpopulationsexperiencingdisparity,voluntary
71interviewswiththefollowingindividuals:
72 (a)Pertinentsurvivingfamilymembersorsupportpeoplepresentwithdirect
73knowledgeof,orinvolvementin,theevent,includingthepatientincasesofsevere
74maternalmorbidity.Theboardshalltranscribeorsummarizeinwritinganyoral
75statementsreceivedinaccordancewiththisparagraph;and
76 (b)Membersofthemedicalteamwhowerepresentorinvolvedinthedeceased
77individual'sdirectcare.
78 (2)Indeterminingthepracticabilityoftheinterviewsundersubdivision(1)of
79thissubsection,theboardmayprioritizeinterviewswithpopulationsthathavea
80documentedhigherrateofmaternaldeath.
81 7.Theboardmaycontractwithotherentitiesconsistentwiththedutiesoftheboard.
82 [7.]8.(1)BeforeJune30,2020,andannuallythereafter,theboardshallsubmittothe
83DirectoroftheCentersforDiseaseControlandPrevention,thedirectorofthedepartment,the
84governor,andthegeneralassemblyareportonmaternalmortalityinthestatebasedondata
85collectedthroughongoingcomprehensive,multidisciplinaryreviewsofallmaternaldeaths,
86andanyotherprojectsoreffortsfundedbytheboard.Thedatashallbecollectedusingbest
87practicestoreliablydetermineandincludeallmaternaldeaths,regardlessoftheoutcomeof
88thepregnancyandshallincludedata,findings,andrecommendationsofthecommittee,and,
89asapplicable,informationontheimplementationduringsuchyearofanyrecommendations
90submittedbytheboardinapreviousyear.
91 (2)Thereportshallbemadeavailabletothepubliconthedepartment'swebsiteand
92thedirectorshalldisseminatethereporttoallhealthcareprovidersandfacilitiesthatprovide
93women'shealthservicesinthestate.
94 [8.]9.Thedirectorofthedepartment,orhisorherdesignee,shallprovidetheboard
95withthecopyofthedeathcertificateandanylinkedbirthorfetaldeathcertificateforany
96maternaldeathoccurringwithinthestate.
97 [9.]10.Uponrequestbythedepartment,healthcareproviders,healthcarefacilities,
98clinics,laboratories,medicalexaminers,coroners,lawenforcementagencies,driver'slicense
99bureaus,otherstateagencies,andfacilitieslicensedbythedepartmentshallprovidetothe
100departmentdatarelatedtomaternaldeathsfromsourcessuchasmedicalrecords,autopsy
101reports,medicalexaminer'sreports,coroner'sreports,lawenforcementreports,motorvehicle
102records,socialservicesrecords,andothersourcesasappropriate.Suchdatarequestsshallbe
103limitedtomaternaldeathswhichhaveoccurredwithintheprevioustwenty-fourmonths.No
104entityshallbeheldliableforcivildamagesorbesubjecttoanycriminalordisciplinaryaction

106provisionsofthissubsection.
107 [10.]11.(1)Theboardshallprotecttheprivacyandconfidentialityofallpatients,
108decedents,providers,hospitals,oranyotherparticipantsinvolvedinanymaternaldeathsor
109anycasesofseverematernalmorbidity. Innocaseshallanyindividuallyidentifiable
110healthinformationbeprovidedtothepublicorsubmittedtoaninformationclearinghouse.
111 (2)Nothinginthissubsectionshallprohibittheboardordepartmentfrompublishing
112statisticalcompilationsandresearchreportsthat:
113 (a)Arebasedonconfidentialinformationrelatingtomortalityreviewsunderthis
114section;and
115 (b)Donotcontainidentifyinginformationoranyotherinformationthatcouldbe
116usedtoultimatelyidentifytheindividualsconcerned.
117 (3)Information,records,reports,statements,notes,memoranda,orotherdata
118collectedunderthissectionshallnotbeadmissibleasevidenceinanyactionofanykindin
119anycourtorbeforeanyothertribunal,board,agency,orperson.Suchinformation,records,
120reports,notes,memoranda,dataobtainedbythedepartmentoranyotherperson,statements,
121notes,memoranda,orotherdatashallnotbeexhibitednortheircontentsdisclosedinany

7 (4)"Programsthattraincertifiednursemidwives",anurse-midwifery
8educationprogramthatisrecognizedbythestateboardofnursingasproviding
9educationnecessarytobecomeacertifiednursemidwife;
10 (5)"Programsthattrainprofessionalmidwives",amidwiferyeducation
11programthatprovidestheeducationnecessarytopracticeasamidwifeinthisstatein
12accordancewiththeprovisionsofsection376.1753.
13 2.Subjecttoappropriation,thedepartmentshallestablishaprogramto
14contractwithprogramsthattraincertifiednursemidwivesandprogramsthattrain
15professionalmidwivesinaccordancewiththeglobalstandardsformidwiferyeducation
16andtheinternationaldefinitionoftheterm"midwife"asestablishedbythe
17InternationalConfederationofMidwivesinordertoincreasethenumberofstudents
18receivingqualityeducationandtrainingasacertifiednursemidwifeorasaprofessional
19midwife.
20 3.Thedepartmentshallcontractonlywithprogramsthattraincertifiednurse
21midwivesandprogramsthattrainprofessionalmidwivesthat,atminimum,include,or
22thatintendtocreate,acomponentoftrainingdesignedformedicallyunderserved
23multiculturalcommunities,lowersocioeconomicneighborhoods,orruralcommunities,
24andthatareorganizedtoprepareprogramgraduatesforserviceinthose
25neighborhoodsandcommunities,orthatseektorecruitandretainraciallyand
26ethnicallydiversestudents,underrepresentedgroups,orpeoplefromunderservedor
27historicallymarginalizedcommunities.
28 4.(1)Thedepartmentmayadoptstandardsandregulationsnecessarytocarry
29outtheprovisionsofthissection.Inadoptingeligibilitystandardsforprogramsthat
30traincertifiednursemidwivesandprogramsthattrainprofessionalmidwivesin
31accordancewiththestandardssetforthinsubsections2and3ofthissection,the
HB256	8 32departmentmayacceptthoseeducationalstandardsandcompetenciesestablishedby
33thestateboardofnursingorbytheprovisionsofsection376.1753.Thedepartment
34shalltakecarenottoimplementeducationorcompetencystandardsbeyondwhatis
35requiredbythestateboardofnursingortheprovisionsofsection376.1753thatcould
36inadvertentlycreateanunnecessarybarrierfortrainingprogramstoobtainfundingfor
37thetrainingofmidwivesinthisstate.
38 (2)Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis
39createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifit
40complieswithandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,
41section536.028.Thissectionandchapter536arenonseverableandifanyofthepowers
42vestedwiththegeneralassemblypursuanttochapter536toreview,todelaythe
43effectivedate,ortodisapproveandannularulearesubsequentlyheldunconstitutional,
44thenthegrantofrulemakingauthorityandanyruleproposedoradoptedafterAugust
4528,2025,shallbeinvalidandvoid.
46 5.Thedepartmentshalldevelopalternativestrategiestoprovidelong-term
47stabilityfor,orexpansionof,thetrainingprovidedforunderthissection,suchas
48throughfundingprovidedbyprivatefoundationsandadministeredbythedepartment
49forthepurposesofcarryingoutthissection.
50 6.Nothinginthissectionpreventsthedepartmentfromdevelopingaprotocolto
51contractwithpotentialprogramsthattraincertifiednursemidwivesorpotential
52programsthattrainprofessionalmidwivesinordertosupporttheinitialstartupofnew
53trainingprogramsaslongastheeligibilityrequirementsofthissectionaremetorcanbe
54metthroughanawardoffunds.
55 7.Thedepartmentmaypaycontractedprogramsthattraincertifiednurse
56midwivesandprogramsthattrainprofessionalmidwivesinanamountcalculatedbased
57onasingleper-studentcapitationformula,orthroughanothermethod,inordertocover
58thecostsofinnovativespecialprojectsorprograms.
59 8.Fundsappropriatedtothedepartmentforpurposesofthissectionand
60awardedbythedepartmenttoeligibleprogramsthattraincertifiednursemidwivesor
61programsthattrainprofessionalmidwivesmaybeusedbythetrainingprogramto
62developnewinitiatives,projects,orcurricula,ortoexpandexistinginitiatives,projects,
63orcurricula.Awardedfundsmayalsobeusedforgeneralsupportandsustainabilityof
64theoveralltrainingprogram,ortosustainspecificcomponentsofthetrainingprogram
65including,butnotlimitedto,tuitionassistanceforstudents,supportforpreceptor
