147 (8)Thestatehighwaysandtransportationcommissiononbehalfofthestateof 148Missouri,mayseekagreementwiththeSecretaryofTransportationoftheUnitedStatesunder 149Section131ofTitle23,UnitedStatesCode,asamended,thatsections226.500to226.600are 150inconformancewiththatSection131andprovideseffectivecontrolofoutdooradvertising 151signsassetforththerein.Ifsuchagreementcannotbereachedandthepenaltiesunder 152subsection(b)ofSection131areinvoked,theattorneygeneralofthisstateshallinstitute 153proceedingsdescribedinsubsection(1)ofthatSection131. 226.550.1.Nooutdooradvertisingwhichisregulatedbysubdivision(1),(3)or(4) 2ofsection226.520orsubsection1ofsection226.527shallbeerectedormaintainedonor 3afterAugust28,1992,withoutaone-timepermanentpermitissuedbythestatehighwaysand 4transportationcommission.Applicationforpermitsshallbemadetothestatehighwaysand 5transportationcommissiononformsfurnishedbythecommissionandshallbeaccompanied 6byapermitfeeoftwohundreddollarsforallsigns;exceptthat,tax-exemptreligious 7organizationsasdefinedinsubdivision(11)ofsection313.005,serviceorganizationsas 8definedinsubdivision(12)ofsection313.005,veterans'organizationsasdefinedin 9subdivision(14)ofsection313.005,andfraternalorganizationsasdefinedinsubdivision(8) 10ofsection313.005shallbegrantedapermitforsignslessthanseventy-sixsquarefeetwithout 11paymentofthefee.Thepermitfeeoftwohundreddollarsshallbewaivedfor 12landowners,providedthatthelandowneristhepermitholderandownsboththeland HB272 5 13uponwhichtheoutdooradvertisingisplacedandthebusinessbeingadvertisedonthe 14sign,solongasthebusinessbeingadvertisedislocatedwithinsevenhundredfiftyfeetof 15thesignlocation.Intheeventapermitholderfailstoerectasignstructurewithintwenty- 16fourmonthsofissuance,saidpermitshallexpireandanewpermitmustbeobtainedpriorto 17anyconstruction. 18 2.Nooutdooradvertisingwhichisregulatedbysubdivision(1),(3)or(4)ofsection 19226.520orsubsection1ofsection226.527whichwaserectedpriortoAugust28,1992,shall 20bemaintainedwithoutaone-timepermanentpermitforoutdooradvertisingissuedbythe 21statehighwaysandtransportationcommission.Ifaone-timepermanentpermitwasissuedby 22thestatehighwaysandtransportationcommissionafterMarch30,1972,andbeforeAugust 2328,1992,itisnotnecessaryforanewpermittobeissued.Ifaone-timepermanentpermit 24wasnotissuedforalawfullyerectedandlawfullyexistingsignbythestatehighwaysand 25transportationcommissionafterMarch30,1972,andbeforeAugust28,1992,aone-time 26permanentpermitshallbeissuedbythecommissionforeachsignwhichislawfullyin 27existenceonthedaypriortoAugust28,1992,uponapplicationandpaymentofapermitfee 28oftwohundreddollars.Allapplicationsandfeesduepursuanttothissubsectionshallbe 29submittedbeforeDecember31,1992.Thepermitfeeoftwohundreddollarsshallbe 30waivedforlandowners,providedthatthelandowneristhepermitholderandownsboth 31thelanduponwhichtheoutdooradvertisingisplacedandthebusinessbeingadvertised 32onthesign,solongasthebusinessbeingadvertisedislocatedwithinsevenhundredfifty 33feetofthesignlocation. 34 3.Forpurposesofsections226.500to226.600,theterminology"structurelawfullyin 35existence"or"lawfullyexisting"signoroutdooradvertisingshall,nevertheless,includethe 36followingsignsunlessthesignsviolatetheprovisionsofsubdivisions(3)to(7)ofsubsection 371ofsection226.580: 38 (1)AllsignserectedpriortoJanuary1,1968; HB272 6 49 4.OnorafterAugust28,1992,thestatehighwaysandtransportationcommission 50may,inadditiontothefeesauthorizedbysubsections1and2ofthissection,collecta 51biennialinspectionfeeeverytwoyearsafterastatepermithasbeenissued.Biennial 52inspectionfeesdueafterAugust28,2002,andpriortoAugust28,2003,shallbefiftydollars. 53BiennialinspectionfeesdueonorafterAugust28,2003,shallbeseventy-fivedollars. 54BiennialinspectionfeesdueonorafterAugust28,2004,shallbeonehundreddollars;except 55that,tax-exemptreligiousorganizationsasdefinedinsubdivision(11)ofsection313.005, 56serviceorganizationsasdefinedinsubdivision(12)ofsection313.005,veterans' 57organizationsasdefinedinsubdivision(14)ofsection313.005,andfraternalorganizations 58asdefinedinsubdivision(8)ofsection313.005shallnotberequiredtopaysuchfee.The 59biennialinspectionfeeshallbewaivedforlandowners,providedthatthelandowneris 60thepermitholderandownsboththelanduponwhichtheoutdooradvertisingisplaced 61andthebusinessbeingadvertisedonthesign,solongasthebusinessbeingadvertisedis 62locatedwithinsevenhundredfiftyfeetofthesignlocation. 63 5.Inordertoeffectthemoreefficientcollectionofbiennialinspectionfees,thestate 64highwaysandtransportationcommissionisencouragedtoadoptarenewalsysteminwhich 65allpermitsinaparticularcountyarerenewedinthesamemonth.Inconjunctionwiththe 66conversiontothisrenewalsystem,thestatehighwaysandtransportationcommissionis 67specificallyauthorizedtoproraterenewalfeesbasedonchangesinrenewaldates. 68 6.Signownersorownersofthelandonwhichsignsarelocatedmustapplytothe 69statehighwaysandtransportationcommissionforbiennialinspectionandsubmitanyfeesas 70requiredbythissectiononorbeforeDecember31,1992.Forapermittedsignwhichdoesnot 71haveapermit,apermitshallbeissuedatthetimeofthenextbiennialinspection. 72 7.Thestatehighwaysandtransportationcommissionshalldepositallfeesreceived 73foroutdooradvertisingpermitsandinspectionfeesinthestateroadfund,keepingaseparate 74recordofsuchfees,andthesamemaybeexpendedbythecommissionintheadministration 75ofsections226.500to226.600. ✔ HB272 7
